New Delhi , the 16th August 1977
G.S.R. 575 ( E). In exercise of the powers conferred by sub- rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Government hereby exempts regulators for electric fans , falling under Item No. 33 of the First Schedule to the Central Excis - s and Salt Act , 1944 ( 1 of 1944) , and cleared for home consumption on or after the 1st day of April in any financial year by , or on be'nalf of , a manufacturer from one or more factories , from the whole of the duty of excise leviable thereon , if an officer not below the rank of an Assistant Collector of Cential Excise is satisfied that the sum total of the value of the capital investment made from time to time on plant and machinery installed in the industrial unit in which the goods , under clearance , ' are manufactured is not more than rupees ten lakhs .
Provided that the exemption contained in this notification shall apply only to the first clearances for home consumption by , or on behalf of , the manufacturer referred to in this notification , from one or more factories ,-
(1) upto an aggregate value not exceeding rupees two lakhs during a financial year subsequent to 1977-78 ; and

(u) upto an aggregate value not exceeding rupees one lakh and twenty - five thousand during the period commencing on the 16th day of August , 1977 and ending on the 31st day of March , 1978
Explanation . For the purposes of determining the value of any capital investment , only the face value of such investment at the time when such investment was made shall be taken into account .

सा० का ० नि ० 575 ( भ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उप- नियम ( 1 ) द्वारा प्रदत्त शक्तित्रों का प्रयोग करते हुए , केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 ( 1944 का 1) की प्रथम अनुसूची की मद सं ० 33 के अन्तर्गत सम्मिलित बिजली के पंखे के रेगुलेटरों को, जिनकी निकासी देशी उपभोग के लिए किसी विनिर्माता द्वारा या उसकी ओर से किसी वित्तीय वर्ष में 1 अप्रैल को या उसके पश्चात् एक या अधिक कारखानो में से की जाएगी , उन पर उग्रहणीय समस्त उत्पाद शुल्क से छूट देती है, यदि ऐसे अधिकारी का , जो रैंक में सहायक केन्द्रीय उत्पाद शुल्क कलक्टर से कम न हो, यह समाधान हो जाता है कि ऐसे प्रौद्योगिक एकक में , जिसमे निकासीगत माल का विनिर्माण हुआ है, स्थापित संयंत्र और मशीन मात्र पर समय -समय पर किया गया पूंजी विनिधान दस लाख रुपए से अधिक मही है :
परन्तु इस अधिसूचना मे दी गई छूट, इस अधिसूचना मे निर्दिष्ट विनिर्माता द्वारा , या उसकी श्रोर से , एक या अधिक कारखाने से, देशी उपभोग के लिए ,-
( i ) वित्तीय वर्ष 1977-78 के पश्चातवर्ती किसी वित्तीय वर्ष के दौरान दो लाख रुपए से अनधिक सकल मूल्य तक , और
( ii ) 16 अगस्त, 1977 को प्रारम्भ और 31 मार्च , 1978 को समाप्त होने वाली अवधि के दौरान एक लाख पच्चीस हजार रुपए से अनधिक सकल मूल्य तक , की केवल प्रथम निकासियो को लागू होगी ।
स्पष्टीकरण. पूजी विनिधान के मूल्य को अवधारित करने के प्रयोजनो के लिए , ऐसे विनिधान के उस समय के केवल अंकितमूल्य को गणना मे लिया जाएगा जब ऐसा विनिधान क्रिया गया था ।

G.S R. 576 (E) .-In exercise of the powers conferred by sub - rule ( 1) of rule 8 of the Central Excise Rules , 1944, the Central Government hereby makes the following amend- ment in the notification of the Government of Indra in the Ministry of Finance ( Depart- ment of Revenue ) No 217 / 77 - Central Excises , dated the 15th July , 1977, namely : - In the second proviso to the said notification , for the words " only in respect of" , the words " in respect of the output of not more than one soda fountain and in respect of" shall be substituted

सा० का ० ति ० 576 ( प्र ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उप - नियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना स ० 21777-केन्द्रीय उत्पाद - शुल्क , तारीख 15 जुलाई , 1977 मे निम्नलिखित संशोधन करती है , अर्थात्:-
उक्त अधिसूचना के द्वितीय परन्तुक मे, " अधिक से अधिक दो भराई की मशीनो की बाबत दी जाएगी" शब्दों के स्थान पर , " अधिक से अधिक एक सोळा फाउन्टेन के उत्पादन की बाबत और अधिक से अधिक दो भराई की मशीनों की बाबत दी जाएगी " शब्द रखे जायेंगे ।
