SUBJECT - Import of palm oil under free licensing schemc-Import policy for April 1977-March 1978 .
No. 73 - JTC ( PN ) / 77 --Attention is invited to the policy set down in column 3 against S No 1507 in Section It read with column 3 against S No 19 of Appen- dix 2 to the Import Trade Control Policy Book ( Vol I ) for the period April 1977 -March 1978 as amended
2 On a review of the position , it has been decided that no licences for the import of palm oil refined for direct human consumption shall be issued under the aforesaid provisions in future
3 In cases where firm commitments have been entered into with foreign sup- pliers for import of palm oil refined for direct human consumption prior to the date of this Public Notice , import licences will be granted by the licensing autho- rities concerned to the extent of quantity /value of commitments entered into by the applicants , after satisfying themselves about the nature of such commitments

विषय -स्वतन्त्र लाइसेंस योजना के अन्तर्गत ताड़ के तेल का श्रायात अप्रैल , 1977- मार्च, 1978 के लिए आयात नीति ।
सं० 73- माई ० टी० सी० पी० एन ०) / 77 अप्रैल, 1977-मार्च, 1978 भवधि श्री यथा संशोधित श्रायात ब्यापार नियंत्रण नीति ( वा -1 ) के परिशिष्ट-2 की क्रम संख्या-19 के सामने कालम 3 के साथ पड़े जाने वाले , खण्ड 2 में क्रम संख्या-15.07 के सामने कालम 3 में निर्धारित मायात नीति की ओर ध्यान प्राकृष्ट किया जाता है ।
2. स्थिति की पुनरीक्षा करने पर यह निश्चय किया गया है कि मानव के सीधे उपभोग के लिए ताड़ के शुद्ध तेल के आयात के लिए पूर्वोक्त शर्तों के अधीन भविष्य में कोई भी लाइसेंस जारी नहीं किया जाएगा ।
3. जिन मामलो में इस सार्वजनिक सूचना की तिथि से पहले मानव के सीधे उपभोग के लिए ताड़ के शुद्ध तेल के आयात के लिए विदेशी संभरको के साथ पक्के सौदे कर लिए गए हों उन में आवेदको द्वारा किए गए सौदे की मात्रा/ मूल्य की सीमा तक सम्बन्ध लाइसेंस प्राधिकारियों द्वारा ऐसे सौदों के स्वरुप के विषय में अपनी संतुष्टि कर लेने के बाद आयात लाइसेंस प्रदान किए जाएंगे ।
SUBJECT- Import of viscose filament licences to actual users for yard and cuprammonium yarn- Issue of the licensing period April , 1977-March , 1978 .
No. 74- ITC ( PN )/ 77 . Attention 15 invited to Ministry of Commerce Public Notice , No. 52- ITC ( PN ) / 77 , dated the 25th July , 1977 , in terms of which import of viscose filament yarn is allowed on free licensing basis to the specifted cate gories of Actual Users as indicated in para 2 of the aforesaid Public Notice . 2. On a review of the position, it has been decided to add the following cate. gories of Actual Users to the said Public Notice :-
( i) Warp knitting machine and auto shuttle embroidery machine owners ;
( ii) Hosiery and knitwear manufacturers , doublers and twisters ;
( ii) Gas Mantle manufacturers ;
(iv) Zari industry and embroiders ; and
(v ) Co- operative societies / registered associations / corporations of handloom weavers .
3. All the above categories of Actual Users will also be allowed to import cuprammonium yarn in the same manner as viscose filament yarn Import licen- ces issued for viscose filament yarn in terms of Public Notice No 52- ITC ( PN ) / 77 , dated the 25th July, 1977 , shall also be automatically valid for import of cupram- monium yarn and shall be deemed to have been issued , subject to the condition that the licence holder shall submit returns to the Textile Commissioner , Bombay, as prescribed in this Public Notice It will not be necessary for the licensees to obtain specific endorsement for import of cuprammonium varn from the licensing authorities in respect of licences already issued for viscose filament yarn
4 Eligible Actual Users should submit applications for import licences to the licensing authorities concerned , invariably indicating the source of import , 1.e the country from which imports are desired to be made, along with photostat copies of the industrial licences or registration certificates issued to them under भाग 1-खं . 1

Item No. 23 ( 5 ) of the 1st Schedule to the Industries ( Development & Regulation) Act , 1951 , or he peunits issued by the Textile Commissioner , Bombay , under the Artsilk Textile Control Order In view of the fact that applicants mentioned in para 2 ( 11 - v ) are not required to obtain permits from the Textile Commis sioner , Bombay, such an application may be accompanied only by the certificates from the State Director of Industries / lianaloom or other concerned State Gov- ernment Authorities , as the case may be , indicating in clear terms that the applicant unit is an Acual User of viscose filament yarn , cuprammonium yarn.
5. Import Licences issued will have a validity period of six months from the date of issue , subject to the condition that firm contracts should be entered into with foreign suppliers within a period of three months from the date of issue of the licence .
6. It has also been decided that the import licences to be issued in terms of this Public Notice and to be issued in future under the Public Notice referred to in para 1 above shall be subject to the condition that as soon as contracts are entred into by the licensees , they shall furnish information regarding such con- tracts , indicating quantity contracted and priceice and denier of yarn, etc. , to the Textile Commissioner , Bombay , in the proforma annexed to this Public Notice .
7. The following amendments shall be made at the appropriate places in the Import Trade Control Policy Book ( Volume I ) for the period 1977-78 :-
( 1) The description of item in Remark ( 8 ) against heading No. 51.01/ 03 , 56.01 / 04 and 56.05/ 06 at page 42 in Section II of the Policy Book , inserted vide Public Notice No. 52 - ITC ( PN ) /77 , dated the 25th July . 1977 , may be deemed to have been amended as under:
"Viscose filament yarn/ cuprammonium yarn " .
( 11) The following additional categories of actual users may be deemed to have been inserted in remark ( 8 ) against heading No. 51.01/08 56.01/04 and 56 05/06 at page 42 in Section 11 of the policy book. incorporated vide para 5 ( 1 ) of Public Notice , No 52- ITC ( PN ) / 71 , dated the 25th July , 1977.-
" ( c ) Warp knitting machine and auto shuttle embroidery machine owners;
(d ) Hosiery and knitwear manufacturers , doublers and twisters ;
(e) Gas Mantle manufacturers ;
(f) Zarı industry and embroiders , and
( g ) Co - operative societies / registered associations / Corporations of hand- loom weavers . "
( fit ) The description of item No 5A in Appendix 2, page 116 inserted vide para 5 ( 11) of Public Notice No. 52- ITC ( PN ) / 77 , dated the 25th July, 1977 , in the import policy book for 1977-78 , may be deemed to have been amended as under .--
"Viscose filament yarn / Cuprammonium yarn " .
( IV) The following additional categories of actual users may be deemed to have been inserted after " ( b ) " in column 3 in Appendix 2 , page 116 against S. No 5A incorporated vide Public Notice No. 52 - ITC (PN ) / 77 , dated the 25th July , 1977 , of the import policy book for 1977-78:-

विषय --अप्रैल , 1977 मार्च , 1978 की लाइसेस अवधि के लिए वास्तविक उपयोक्ताभो को विस्कोस वन्तु धागे और कप्रेमोनियम धागे के आयात के लिए लाइसेंस जारी करना ।
सं ० 74 - प्राई ० टी० सी० पी ० एन ० ) / 77.--वाणिज्य मन्त्रालय की सार्वजनिक सूचना सख्या -52 आईटी सी ( पी एन ) / 77 दिनाक 25 जुलाई , 1977 की ओर ध्यान आकृष्ट किया जाता है जिसके अनुसार उपर्युक्त सार्वजनिक सूचना की कडिका 2 में यथा सकेतित वास्तविक उपयोक्ताओ की विशिष्ट श्रेणियो को स्वतन्त्र लाइसेंस आधार पर विस्कोस तन्तु धागे के आयात की अनुमति है ।
2. स्थिति की पुनरीक्षा करने पर यह निश्चय किया गया है कि उपर्युक्त सार्वजनिक सूचना मे वास्तविक उपयोक्ताओ की निम्नलिखित श्रेणियो को ओडा जाए --
( 1) ताना बुनने की मशीन ओटो और शटल कशीदाकारी मशीन के मालिकों को ;
( 2 ) होजरी एंव निटवीयर विनिर्माताओं डब्लर्स एंव ट्विस्टर्स को ;
( 3 ) गैस मेन्टल विनिर्माताओं को ;
( 4) जरी उद्योग एंव कशीदाकारों को ; एवं
( 5 ) सहकारी समितियो/ पंजीकृत संस्थाश्रो/ हथकरघा जुलाहों के निगमों को ।
3. वास्तविक उपयोक्तानों की उपर्युक्त सभी श्रेणियों को कैप्रेमोनियम धागे को आयात करने के लिए उसी तरह स्वीकृति दी जाएगी जिस तरह विस्कोस तत्तु धागे को दी गई है । सार्वजनिक सूचना संख्या 52 - आई टी सी(पी एन) / 77 दिनांक 25-7-1977 के अनुसार विस्कोस तन्तु धागे के लिए जारी किए गए आयात लाइसेंस के प्रेमोनियम धागे के आयात के लिए स्वतः वैध होंगे और इस शर्त के अधीन जारी किए गए समझे जाएगे कि लाइसेसधारी इस सार्वजनिक सूचना भारत का असाधारण राजपत्र

मे यथा निर्धारित एक रिपोर्ट वस्त्र आयुक्त को प्रस्तुत करेगा । लाइसेंसधारियो के लिए यह आवश्यक नही होगा कि ये विस्कोस तन्तु धागे के लिए पहले से ही जारी किए गए लाइसेंसो के सबध में कप्रेमोनियम धागे के आयात के लिए लाइसेसो पर लाइसेस प्राधिकारियो से पृष्ठाकन कराएं ।
4. पात्त्र वास्तविक उपयोक्ताओं को चाहिए कि वे निरपवाद रुप से सबंध लाइसेस प्राधिकारियो को आयात लाइसेंस के लिए आवेदन पत्र भेजे जिसमे आयात के स्रोत अर्थात् वह देश जिस से भ्रायात किए जाने की मांग की गई है और इसके साथ उद्योग ( विकाम एंव विनियमन ) अधिनियम, 1951 के लिए प्रथम अनुसूची की मद स ० 23 ( 5 ) के अन्तर्गत उन्हे जारी किए गए औद्योगिक लाइसेंस या पंजीकरण प्रमाण -पत्त्र या कृत्रिम रेशम वस्त्र नियन्त्रण आदेश के अन्तर्गत वस्त्र आयुक्त, बम्बई द्वारा जारी कि गए परमिट की फोटो-स्टेट प्रतियो को भी भेजे । उपर्युक्त कडिका 2 ( 2-5) में उल्लिखित आवेदकों के लिए वस्त्र आयुक्त , बम्बई से परमिट प्राप्त करने की भावश्यकता नहीं है इस तथ्य को ध्यान में रखते हुए ऐसे आवेदनपत्त्रो के साथ केवल राज्य उध्योग हथकरघा निदेशक या अन्य सबद्ध राज्य सरकार प्राधिकारियो, जो भी हो, उससे प्राप्त प्रमाणपत्र भेजे जाने चाहिए जिनमे यह साफ-साफ दर्शाया जाए कि आवेदक एकक विस्कोस तन्तु धागे/ कप्रेमोनियम धागे का वास्तविक उपयोक्ता है ।
5 जारी किए गए आयात लाइसेसो की वैधता अवधि लाइसेंस जारी होने की तारीख से 6 मास के लिए होगी परन्तु शर्त यह है कि विदेशी सभरकों के साथ लाइसेंस जारी होने की तारीख से 3 मास की अवधि के भीतर ही पक्की सविदाए कर ली जानी चाहिए ।
6. यह भी निश्चय किया गया है कि इस सार्वजनिक सूचना के अनुसार जारी किए जाने वाले श्रायात लाइसेस और उपर्युक्त कडिका 1 मे उल्लिखित सार्वजनिक सूचना के अधीन भविष्य में जारी किए जाने वाले श्रयात लाइसेस इस शर्त के अधीन होगे कि जैसे ही लाइसेंसधारी द्वारा संबिदा कर दी जाएगी वे ऐसे सविदाओं के बारे मे सविदा की मात्रा और कोमत और धागे के डिनीयर आदि को दर्शाते हुए इम सार्वाजनिक सूचना से संलग्न प्रपत्ता में जानकारी वस्त्र आयुक्त, बम्बई को भेजेंगे ।
7. 1977-78 श्रवधि के लिए आयात व्यापार नियंत्रण नोति ( वा०-1) में निम्म- लिखित संशोधन उपयुक्त स्थानों पर किए जाएं '--
( 1 ) नीति पुस्तक के खंड -2 मे पृष्ठ 42 पर शीर्षक सं ० 51.01 / 03 , 56.01 / 04 और 56.05 / 06 के सामने टिप्पणी ( 8 ) मे जोडी गई मद के विवरण देखें सार्वजनिक सूचना सं ० 52- आई टी सी ( पी एन ) / 77 दिनांक 25-7-77 को इस प्रकार संशोधित किया गया समझा जाए:-
"विस्कोस तन्तु धागे, कप्रेमोनियम धागे "
( 2 ) वास्तविक उपयोक्ताओं की निम्नलिखित अतिरिक्त श्रेणियां नीति पुस्तक के खंड -2 में पृष्ठ 42 पर शीर्षक सं ० 51.01 / 03 , 56.01/ 04 और 56.05/ 06 के सामने टिप्पणी ( 8 ) मे जोडी गई समझी जाए । देखें सार्वजनिक सूचना संख्या 52 आई टी सी ( पी एन ) / 77 दिनांक 25-7-77'—

(जी) सहकारी समितियो/पजीकृत संस्थाओं/ हथकरघा जुलाहों के निगमो को । " (3) 1977-78 के लिए आयात नीति के पृष्ठ 116 के परिशिष्ट 2 मे जोडी गई मद स ० 5 ए के विवरण को देब्रे सार्वजनिक सूचना स ० 52 - आई टी सी (पी एन) / 77 दिनाक 25-7-77 का पैरा 5 ( 2 ) निम्नलिखित अनुसार संशोधित किया गया समझा जाए .

( 4 ) वास्तविक उपयोक्ताओ की निम्नलिखित अतिरिक्त श्रेणियों 1977-78 के लिए भायात नीति के " पृष्ठ संख्या 116 , क्रम सख्या 5 ए परिशिष्ट 2 के कालम 3 में ( ख) " के बाद जोडी गई समझी जाए , देखें सार्वजनिक सूचना सख्या 52-भाई टी सी ( पी एन) / 77 दिनांक 25-7-77 :---
