New Delhi , the 18th October 1977
GSR. 649 ( E ) -In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951 ) , the Central Government , after consultation with the Governments of the States concerned , hereby makes the following rules , namely
1 Short title - These rules may be called the Indian Police Service ( Special Allowance ) Rules , 1977
2. Definitions . In these rules , unless the context otherwise requires , -
( a) " leave " means leave as defined in the All India Services ( Leave ) Rules , 1955 ,
(b ) " Service " means the Indian Police Service
3. Payment of special allowance to certain members of the service .- ( 1 ) A member of the service appointed as-
( a) Director , Sardar Vallabhbhal Patel National Police Academy , Hydera bad , or Inspector General of Police designated to be In - charge of the State Police in respect of the States of Andhra Pradesh , Assam , Bihar Gujarat , IHaryana , Himachal Pradesh , Jammu and Kashmır , Karnataka , Kerala , Maharashtra Madhya Pradesh , Orissa , Punjab , Rajasthan , Tamil Nadu , Uttar Pradesh and West Bengal , shall , with effect from the 1st of January , 1973 , and

(b) the Inspector General of Police designated to be in - charge of Delhi Police , shall , with etſect from the 1st of April , 1976
be entitled to a special allowance at the rate of Rs 250 per mensem .
( 2) The special allowance payable under this rule shall also be admissible to . a member of the Service referred to in sub - rule ( 1 ) when he is on leave for a period not exceeding 120 days , if it is certified that but for his proceeding on leave he would have continued to hold a post to which the special allowance is admissi- ble, but shall not be admissible during periods of suspension or joining time 3 Interpretation . If any question arises as to the interpretation of these rules , it shall be referred to the Central Government who shall decide the same.
EXPLANATORY MEMORANDUM
These rules are being framed to implement the decisions taken by the Govern- ment of India to grant special allowance to the members of Indian Police Service holding posts mentioned in clause ( a) of sub - rule ( 1 ) of rule 3 of these rules in pursuance of the recommendation of the Third Central Pay Commission and to the Inspector- General of Police designated to be in charge of Delhi Police The special allowance is proposed to be given retrospectively from the date mentioned in rule 3 of the rules No officer is likely to be adversely affected by the granting of the special allowance from such retrospective dates

सा० फा० ति० 649 ( प्र) -केन्द्रीय सरकार , अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उपधारा 1 द्वारा प्रदन शक्तियो का प्रयोग करते हुए, संबद्ध राज्य सरकारों से परामर्श करने के पश्चात् निम्नलिखित नियम बनाती है, अर्थात्
1. संक्षिप्त नाम -इन नियमों का सक्षिप्त नाम भारतीय पुलिस सेवा ( विशेष भत्ता) नियम , 1977 है ।
2. परिभाषा.-इन नियमो मे , जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,- 1
( क ) " छुट्टी " से अखिल भारतीय सेत्रा ( छुट्टी ) नियम, 1955 में परिभाषित छुट्टी अभिप्रेत है;
(ख) "सेवा" से भारतीय पुलिस सेवा अभिप्रेत है ।
जिसे-- 3. सेवा में से कतिपय सदस्यों को विशेष भत्ता का संवाय. ( 1 ) सेवा के ऐसे सदस्य को,
(क) निदेशक , सरदार वल्लभभाई पटेल राष्ट्रीय पुलिस अकादमी, हैदर। बाद या श्रन्ध्र प्रवेश , आसाम , बिहार , गुजरात , हरियाणा, हिमाचल प्रदेश, जम्मू कश्मीर , कर्नाटक , केरल , महाराष्ट्र, मध्य प्रदेश , उडीमा, पजाब , राजस्थान , तमिलनाडु, उत्तर प्रदेश और पश्चिमी बगाल राज्यो की बाबत राज्य पुलिस के भार सावक के रूप मे पदाभिहित पुलिस महानिरीक्षक, 1 जनवरी , 1973 से , श्रीर भारत का असाधारण राजपत्र

ख ) दिल्ली पुलिस के भारसाधक के रूप में पदाभिहित पुलिस महानिरीक्षक 1 अप्रैल , 1976 से , नियुक्त किया गया है , 250 रु ० प्रतिमास की दर से विशेष भत्ते का हकदार होगा ।
) इस नियम के अधीन सदेय विशेष भत्ता उपनियम ( 1 ) मे निर्दिष्ट सेवा के सदस्यों ( 2
को उस समय भी अनुज्ञेय होगा जब वे 120 दिन से अनधिक अवधि तक छुट्टी पर हों और यह प्रमाणित किया गया हो कि यदि वे छुट्टी पर न जाते तो उस पद पर बने रहते जिसके लिए विशेष भत्ता अनुज्ञेय है, किन्तु निलम्बिन काल या पदग्रहण अवधि के दौरान अनुज्ञेय नही होगा ।
3. निर्वाचन-यदि इन नियमो के निर्वाचन की बाबत कोई प्रश्न उठता है तो उसे वेन्द्रीय सरकार को निर्दिष्ट किया जाएगा जो उसका विनिश्चय करेगी ।
व्याख्यात्मक ज्ञापन
ये नियम तीसरे वेन्द्रीय वेतन आयोग की सिफारिशो के अनुमरण मे इन नियमों के नियम 3 के उप नियम ( 1 ) के खण्ड में उल्लिखित पदों पर कार्य कर रहे भारतीय पुलिस सेवा के सदस्यो तथा दिल्ली पुलिस के इन्चार्ज के रूप में पदनामित पुलिस महा निरीक्षक को विशेष भत्ता मजूर करने के वाम्ते भारत सरकार द्वारा किए गए निर्णयों को लागू करने के लिए बनाए जा रहे है । विशेष भत्तो उक्त नियमों के नियम 3 में उल्लिखित तारीख से पूर्व व्याप्त रूप से दिए जाने का प्रस्ताव है । विशेष भत्तों की ऐसी पूर्व तारीखो से मजूरी के कारण किसी अधिकारी पर प्रतिकूल प्रभाव पड़ने की संभावना नही है ।
