New Delhi , the 22nd October 1977
G.S.R. 651 ( E ) .- Whereas certain draft rules further to amend the Prevention of Food Adultèration Rules , 1955 were published as required by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act , 1954 ( 37 of 1954 ) at pages 1919 of the Gazette of India , Part II , Section 3 , sub - section ( 1 ) under the notifica- tion of the Government of India in the Mimstry of Health and Family Welfare (Deprtment of Health ) No. GSR 624 ( E ) dated 29th September , 1977 , inviting comments , objections / suggestions from the persons likely to be affected thereby #ill the 9th October , 1977;
And whereas the sald Gazette was made available to the public on the 29th September , 1977 ,
And whereas objections / suggestions received from the public on the said draft motification have been considered by the Central Government ,

Now , therefore , in exercise of the powers conferred by sub- section ( 1 ) of sec- tion 23 of the said Act , the Central Government , after consultation with the Cen- tral Committee for Food Standards, hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955 , namely :-
Rules
1 ( 1) These rules may be called the Prevention of Food Adulteration ( Fourth Amendment ) Rules , 1977 .
(11) They shall come into force on the date of their publication in the Official . Gazette
2. In the Prevention of Food Adulteration Rules , 1955 ,
( 1) After rule 42 ( N ) , the following shall be inserted , namely:
" ( O) Every package contaınıng an admixture of palmolein with groundnut oil shall carry the following label , namely.-
BLEND OF PALMOLEIN AND GROUNDNUT OIL

PALMOLEIN

GROUNDNUT OIL
(ii ) In rule 44 , after the existing proviso , the following shall be inserted , namely :-
"Provided also that the prohibition in clause ( e ) shall remain inoperative for a period of three months from the date of commencement of the Prevention of Food Adulteration ( Fourth Amendment ) Rules , 1977 in respect of admixture of pal- molein with groundnut oil , where ,
(1 ) the proportion of groundnut oil in the admixture is not less than ten percent by weight ;
( ii ) the admixture is processed and sold by the Department of Civil Sup- plies , Government of India or their authorised agents , and
( 111 ) the palmolein and the groundnut oil in the admixture conform to the specifications laid down in the rules . "

सा० का ० नि० 651 ( प्र ) -खाद्य अपमिश्रण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उप-धारा ( 1 ) द्वारा अपेक्षित के अनुसार खाद्य श्रपमिश्रण निवारण नियम , 1955 में आगे संशोधन करने के लिए कतिपय नियमों का प्रारूप भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की तारीख 29-9-77 को अधिसूचना संख्याक सा ० का ० नि ० 624 (अ ) मे भारत के राजपत्त्र के भाग 2 , खण्ड 3 , उप-खण्ड ( i ) के पृष्ठ 1920 पर प्रकाशित किया गया था और उन व्यक्तियों से जिनके उन नियमों से प्रभावित होने की संभावना थी टिप्पणियां , आपत्तियां, सुझाव 9 अक्तूबर , 1977 तक मांगे गये थे ;
और उक्त राजपत्र 29 सितम्बर , 1977 को जनता को उपलब्ध कर दिया गया था ;
और उक्त अधिसूचना के प्रारूप की बाबत जनता से प्राप्त प्रापत्तियों/ सुझावों परर केन्द्रीय सरकार ने विचार कर लिया है ;

भत. , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 23 की उप-धरा ( 1 ) द्वार प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय खाद्य मान्वभि से परामर्श कर लेने में प ६चात खाद्य अपमिश्रण नियम , 1955 मे और संशेधन करने के लिए निम्नलिखित नियम बन्र्सी है, अर्थात्:-
नियम
1. ( i ) इन नियमों का नाम खाद्य अपमिश्रण निवारण ( चतुर्थ सशोधन ) नियम, 1977 है ।
( ii ) थे राजपत्न मे प्रकाशन की तारीख को प्रवृत्त होगे ।
2. खाथ श्रपमिश्रणी नियम , 1955 मे,-
(i) नियम 42 ( क ) के पश्चात्, निम्नलिखित अन्त स्थापित किया जाएगा, अर्थात्:-
" (ण) मूगफली तेल के साथ पामोलीन तेल के मिश्रण के प्रत्येक पैकेज पर निम्नलिखित लेबल लगाया जाएगा , अर्थात् :--
पामोलीन और मूगफली के तेल का मिश्रण
प्रतिशत
पामोलीन .
प्रतिशत
मूगफली तेल ..........

( ii) नियम 44 मे विद्यमान परन्तुको के पश्चात् निम्नलिखित परन्तुक अति थाप्ति किया जाएगा अर्थात् -
" परन्तु यह भी कि मूंगफली के तेल के साथ पामोलीन के मिश्रण के संबंध में खाध श्रपमिश्रण निवारण ( चतुर्थ संशोधन ) नियम , 1977 के प्रारम्भ की तारीख से तीन महीने की अवधि तक खण्ड ( ड ) का प्रतिषेध अप्रवर्तनशील रहेगा , यदि -
( i ) मिश्रण में मूंगफली के तेल का भाग भार के दस प्रतिशत से अन्यून नही है ;
( ii ) मिश्रण नागरिक पूर्ति विभाग, भारत सरकार अथवा उसके प्राधिकृत अभि- कर्ताओ द्वारा प्रसंस्कृत किया और बेचा जाता है , और
( iii ) मिश्रण मे पामोलीन और मूंगफली का तेल इन नियमों में निर्धारित विशिट्यो के अनुरूप है । "
