NOTIFICATION
New Delhi , the 29th October 1977
GSR 658 ( E ) -The following draft of certain rules further to amend the Drugs and Cosmetics rules , 1945 , which the Central Government proposes to make, after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by section 8, 12,lion 8 , 12, 16 and 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , is hereby published as required by the said sections , for the in- formation of all persons likely to be affected thereby , and notice is hereby given that the said draft will be taken into consideration after the expiry of three months from the date of publication of this notification in the Official Gazette
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into consideration by the Central Government .
DRAFT RULES
1 These rules may be called the Drugs and Cosmetics ( Amendment ) Rules , 1977 . 2 In the Drugs and Cosmetics Rules , 1945 , in Schedule V, after entry 1 , the following entry shall he inserted namely
" 2. Standards for patent or proprietary medicines , contaınıng vitamins ,
(2059) 2060 Thepatent or proprietary medicines containing vitamins for prophylactic therapeutic or paediatric use shall contain the vitamins in quantities not less than and not more than those specified below in single or in two divided daily doses namely :

NOTE I
भाग11-खं.3(1) The patent or proprietary medicines containing vitamms intended for prophylactic , therapeutic or paediatric use shall bear on the label the words "For Prophylactic Use " " For Therapeutic Use " , or " For Paediatric Use " as the case may be . In case of paediatric preparations the age of the in- fant or the child for whose use it is intended , shall be given in addition to the particulars required to be given under these rules .
NOTE 2 The above standards shall not apply to any preparation containing a single vitamin only and also to any preparation containing vitamins intended forparenteral use" .

नई दिल्ली , 29 अक्तूबर, 1977
सा० फा ० नि ० 658 ( अ) केन्द्रीय सरकार , ओषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 8 , 12 , 16 और 33 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् , औषधि और प्रसाधन सामग्री नियम, 1945 में और संशोधन करने के लिए कतिपय नियम बनाने का प्रस्ताव करती है । जिसका निम्नलिखित प्रारूप उक्त धाराओं की अपेक्षानुसार, उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया आ रहा है जिनके उससे प्रभावित होने की सम्भावना है , और इसके द्वारा सूचना दी जाती है कि इस श्रधि- सूचना के राजपत्र में प्रकाशन की तारीख से तीन मास की समाप्ति के पश्चात् उक्त प्रारूप पर विचार किया जाएगा ।
इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के पूर्व उक्त नियमो के प्रारूप की बाबत जो भी आपत्ति और सुझाव किसी व्यक्ति से प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।
नियमों का प्रारूप
1. इन नियमों का नाम औषधि और प्रसाधन सामग्री ( सशोधन ) नियम , 1977 है ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 की अनुसूची V मे , प्रविष्टि के पश्चात निम्नलिखित प्रविष्टि अन्तःस्थापित की जाएगी अर्थात्
" 2. विटामिन वाले पेटेन्ट या सापत्तिक औषधियों के मानक:-
रोगनिरोधी , उपचारार्थ या बालचिकित्सा के उपयोग के लिए विटामिन वाली पेटेन्ट या सांपत्तिक औषधियो मे , एक या विभाजित दो दैनिक खुराको में विटामिनो की माना नीचे विनिर्दिष्ट से अन्यून और अनधिक नही होगी , अर्थात्

भागII-खं3(1) टिप्पणी-1 रोगनिरोधी या उपचारार्थ या बालचिकित्सा के उपयोग के लिए आशयित विटामिनो वालो पेटेन्ट या सापत्तिक ओषधियों पर, यथास्थिति , " रोगनिरोधी उपयोग के लिए " या " उपचारार्थ उपयोग के लिए " या " बालचिकित्सा के उपयोग के लिए " शब्दों वाला लेबल लगा होगा । बालचिकित्सार्थ निर्मितियो की दशा मे इन नियमों के अधीन अपेक्षित विशिष्टियो के अलावा, उन शिशुओ या बच्चो की उम्न भी दी जानी चाहिए जिनके लिए वे आशयित हैं ।
टिप्पणी- 2 उपर्युक्त मानक एक विटामिन वाली किसी निर्मिति और आन्वेतर उपयोग के लिए आशयित विटामिन वाली किसी औषधि को भी लागू नही होंगे ।
