G.S.R. 666 ( E ) .-- In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act 1962 ( 52 of 1962 ) , the Central Government , being satisfied that it is necessary in the public interest so to do , hereby exempts photo- graphic , filming sound - recording and radio equipments , raw - films , video - tapes and sound - recording tapes , when imported into India, from the whole of the duty of customs leviable thercon under the First Schedule to the Customs Tariff Act , 1975 ( 51 of 1975 ) and the additional duty leviable thereon under section 3 of the second mentioned Act , subject to the following conditions , ramely.-
( 1 ) a certificate is produced to the Assistant Collector of Customs at the time of clearance of the goods from a duly authorised officer of the External Publicity Division of the Ministry of External Affairs , Government of India, that the importation is for a purpose which is in the public interest , and has been sponsored or approved by the Government of India ,
( 2) an undertaking is given by the importer or the sponsoring authority to the Assistant Collector of Customs at the time of clearance of goods that the goods in respect of which the exemption is claimed shall be re - exported within three months from the date of their importation or within such extended period , not exceeding 12 months from the date of importation , as the Assistant Collector of Customs may allow and that , in the event of the failure to re -export as aforesaid, to pay the duty which would have been levied but for the exemption contain- ed herein

सा० का ० मि ० 666 ( श्र) -केन्द्रीय सरकार , मीमा शुल्क श्रर्धािनयम , 1962 ( 1962 का 52 ) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और यह समाधान हो जाने पर कि ऐसा करना लोक हित मे श्रावश्यक है, फोटोग्राफी , फिल्म सबधी, साउन्ड रिकार्डिंग सबधी और रेडियो उपस्करो, कच्ची फिल्मों, वीडिओ टेपो और साउड रिकार्ड करने के टेपो को , तब जब उनका आयात भारत मे किया जाए , सीमा- शुल्क टैरिफ अधिनियम , 1975 ( 1975 का 51 ) की प्रथम अनुसूची के अधीन उन पर उद्ग्रहणीय समस्त सीमा- शुल्क से और उक्त अधिनियम की धारा 3 के अधीन उन पर उद्ग्रहणीय अतिरिक्त शुल्क मे , निम्नलिखित शर्तों पर छूट देती है , अर्थात्
( 1) उक्त माल की निकामी के मय सीमा शुल्क सहायक कलैक्टर के समक्ष भारत सरकार के विदेश मंत्रालय के विदेश विज्ञापन डिवीजन के सम्यक रूप से प्राधिकृत अधिकारी का इरा आशय का प्रमाणपत्र प्रस्तुत किया जाता है कि उक्त माल का आयात ऐसे प्रयोजन के लिए है जो लोक हित मे है और जिसका प्रायोजन और अनुमोदन भारत सरकार ने किया है ,
( 2) श्रायातकर्ता या प्रायोजनकर्त्ता प्राधिकारी द्वारा उक्त माल की निकासी के समय , सहायक सीमा शुल्क कलैक्टर के समक्ष यह वचन बध किया जाता है कि वह माल जिसके मबध में छूट का दावा किया गया है उसके श्रायात किए जाने की तारीख से तीन मास के भीतर अथवा ऐसी बढ़ाई गई अवधि के भीतर , जो हायक सीमा शुल्क कलैक्टर अनुज्ञान करे, किन्तु जो आयात की तारीख से 12 माम में अधिक नही होगी , उक्त माल का पुन निर्यात करेगा और यदि , उपर्युक्त रूप से पुन निर्यात करने में वह असफल रहता है तो उक्त माल पर उतने शुल्क का सदाय करेगा जो इस अधिसूचना मे दी गई छूट न दिए जाने की दशा मे उद्ग्रहणीय होता ।

In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act , 1962 ( 52 of 1962 ) , read with sub - section ( 4 ) of sections of the Finance Act , 1977 ( 11 of 1977 ) , the Central Government being satisfied that it is necessary in the public interest so to do herchy makes the following further amendment in the notification of the Government of India in the Department of Revenue and Banking No 123 - Customs , dated the 1st July , 1977, namely
In the Schedule annexed to the said notification after Serial No 161 and the entries relating thereto the following shall be Inserted , namely " 162 No 231 Custom dated the 1st November 1977 "

सा० का ० नि ० 667 ( अ ) केन्द्रीय सरकार, वित्त अधिनियम, 1977 ( 1977 का 11 ) की धारा 3 की उपधारा ( 4 ) के साथ पठित सीमा- शुल्क अधिनियम, 1962 (1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि ऐसा करना लोक हित मे आवश्यक है , भारत सरकार के राजस्व और बेकिग विभाग की अधिसूचना सं ० 123 सीमा शुल्क , तारीख 1 जुलाई , 1977 मे निम्नलिखित और संशोधन करती है , अर्थात्
उक्त अधिसूचना में उपाबद्ध अनुसूची मे, क्रम स ० 161 और उससे संबंधित प्रविष्टियो के पश्चात्, निम्नलिखित श्रन्त स्थापित किया जाएगा अर्थात्.--
" 162. म ० 231 सीमा-शुल्क, तारीख 1 नवम्बर 1977 " ।
