G.S.R. 676 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of Section 33 of the Indian Ports Act , 1908 ( 15 of 1908 ) the Centtal Government hereby makes the following amend- ment in the notification of the Government of India in the Ministry of Shipping and Transport (Transport Wing ) No GSR 381 ( E ) , dated the Ist July , 1973 , with effect from the day following the expiration of sixty days from the date of publication of this notification in the Official Gazette , namely :-
In the said notification , for the Schedule , the following Schedule shall be substituted , namely

Explanation - In this Schedule ,
(a) ' ship' means a vessel propelled solely by wind power ,
(b) ' steamer ' means any vessel other than a ship ,
(c) ' coasting ship' and ' coasting steamer ' mean respectively a ship or steamer which is engaged in the carriagcarriage by sea of passengers or goods from any port of ort of place in India to any other port or place in India;
(d) ' foreign ship ' and ' foreign steamer' mean respectively a ship of steamer employed in trading between any port or place in India and other port or place on between ports or places outside India . "

सा ० का०मि० 676 ( श्र) केन्द्रीय सरकार, भारतीय पत्तन श्रधिनियम, 1908 ( 1908 का 15 ) की धारा 33 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के नौवहन और परिवहन मंत्रालय ( परिवहन पक्ष ) की अधिसूचना सं ० सा ० का ० नि ० 381 ( श्र ) , तारीख 1 जुलाई, 1975 मे, राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से साठ दिन की समाप्ति के पश्चात् के ठीक आगामी दिन से, निम्नलिखित संशोधन करती है, अर्थात्
उक्त अधिसूचना मे , अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी , अर्थात्:-

स्पष्टीकरण. उस अनुसूची मे ,
( क ) ' पोत' से पूर्णत वायु- शक्ति से चालित जलयान अभिप्रेत है ;
(ख) 'स्टीमर' से पोत से भिन्न कोई भी जलयान अभिप्रेत है ;
(ग) ' तटवर्ती पोत' और 'तटवर्ती स्टीमर' से क्रमश ऐसा पोत या स्टीमर अभिप्रेत है , जो भारत स्थित एक पत्तन या स्थान से भारत में स्थित किसी अन्य पत्तन या स्थान को यात्रियों या मास को समुद्र से लाता या ले जाता है ;
(घ ) ' विदेशी पोत' या ' बिदेशी स्टीमर ' से क्रमश ऐसा पोत या स्टीमर अभिप्रेत है, जो भारत स्थित किसी एक पत्तन या स्थान और किसी अन्य पत्तन या स्थान के बीच या भारत के बाहर पत्तनों और स्थानों के बीच व्यापार से लगा हो । "

G.S.R. 677 ( E) -In exercise of the powers conferred by sub- section ( 1 ) of section 35 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby makes the following order to amend the Port of Madras Pilotage and Other Services (Fees ) Order , 1975 , namely :--
1. ( 1 ) This order may be called the Port of Madras Pilotage and Other Services ( Fees ) Amend- ment Order, 1977-
(2) It shall come into force at once .

NOTF -These charges include the cost of ordinary diver's charges but are exclusive of any special charges which may be necessary in certain cases , such as the use of tugs , barges or other craft which will be charged at actual cost or at the rates set forth in the Port's Scales of Rates , as the case may be In case of goods hable to damage by water the above percentage shall be recovered on the sale value or Customs valuation , as the case may be .

NOTE -The salvage charges specified above shall be levied in all cases of diving work carried out on special requisitions for the services of the Port Submarine Diver irrespective of the results of search or examinations by the divers , where a search is undertaken for recovery of goods lost over -board and such goods are recovered , charges as per salvage shall be levied .

टिप्पण -इन प्रभारों के अन्तर्गत साधारण गोताखोर के प्रभारी का व्यय आता है किन्तु उनमे कोई ऐमे विशेष प्रभार सम्मिलिन नही है जो कतिपय दशाओ में आवश्यक हो, जैसे कि टगो, बाबो , या अन्य यानो का प्रयोग , जिसके लिए प्रभार, यथास्थिति, वास्तविक खर्च या पत्तन के लिए उपणित दरो पर लिया जाएगा जल में नुकसान योग्य माल की दशा में , उपर्युक्त प्रतिशत प्रभार , यथास्थिति , विक्रय मूल्य पर या सीमा-शुल्क मूल्याकन के आधार पर बसूल किया जाएगा ।

टिप्पण ( 1 ) . ऊपर विनिर्दिष्ट का निस्तारण प्रभार , पत्तन के अन्त. समुद्र गोताखोर की सेवाओ के लिए विशेष अपेक्षाओ पर किए गए गोताखोर के कार्य की सभी दशाओ मे, गोताखोरो द्वारा तलाशी या परीक्षाओ के परिणामो का विचार किए बिना उद गृहीत किए जाएंगे । जहां जहाज पर खोए माल के प्रत्युद्धरण के लिए कोई तलाशी की जाती है और ऐसा माल प्रत्युदधूत हो जाता है तो निस्तारण के अनुसार प्रभारण उदगुहीत किए जाएंगे ।
टिप्पण ( 2 ).-ऊब गोताखोर नौका किसी लाच द्वारा कर्षित की जाती है तो कर्षण प्रभार इसके अतिरिक्त उवगृहीत किए जाएंगे ।"
(घ) अनुसूची मे
( i ) पैरा 1 के स्थान पर निम्नलिखित पैरा रखा जाएगा , अर्थात्

(ji ) पैरा 2 में, अक्षर और अंक " 50 रु ० " के स्थान पर अक्षर और अंक " 60 रु" रखे जाएंगे ,
क्रमश अक्षर और अंक " 6 रु ० " ( iii ) पैरा 3 में , अक्षर और अंक " 5 रु० " और " 125 रु ० " के स्थान पर और " 150 रु ० " रखे जाएंगे ।
" 100 रु० " और " 6 रु ० " के स्थान पर ( iv) पैरा 4 में, अक्षर और अंक क्रमश: अक्षर और अंक " 120 रु ० " और " 7.20 रु ० " रखे जाएंगे ।
(v) पैरा 6 में , अक्षर और अंक " 1000 रु ० " के स्थान पर , अक्षर भौर अंक " 1200 रु ० " रखे जाएंगे । "
(vi) पैरा 7 में , अक्षर और अंक 500 रु ० के स्थान पर अक्षर भोर अंक " 600 रु ० " रखे जाएंगे ।
