CENTRAL EXCISES
New Delhi , the 4th November 1977
GS.R 678 ( E ) . In exercise of the powers conferred by sub rule ( 1 ) of rule 8 of the Central Excise Rules, 1944 , the Central Government hereby exempts Com- bined Tablets of Iron and Folic Acid and Liquid Preparations thereon , falling under item No 14E of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944 ) , from the whole of the duty of excise leviable thereon , subject to the conditions that -
( 1 ) Such Tablets or Preparations do not bear either on themselves or on their containers or both the brand name , that is , the name or the registered trade mark under the Trade and Merchandise Marks Act , 1958 ( 4.3 of 1958 ) or any other mark such as a symbol, monogram , label , signature or invented words or any writing which is used in relation to such Tablets or Preparations for the purpose of indicat- ing or so as to indicate a connection in the course of trade bet- ween such Tablets or Preparations and some person having the right either as proprietor or otherwise to use the name or mark with or without any indication of the identity of that person ;

( ii) the manufacturer furnishes to the proper officer a certificate from an officer authorised by the Ministry of Health and Family Welfare within a period of ninety days or such extended period as the proper officer may allow , from the date of clearance of such Tablets or preparations , showing that they are intended exclusively for supply to the Ministry of Health and Family Welfare or any other organisa- tion as may be authorised by that Ministry or both for distribution free of cost under the National Family Welfare Programme .
2. The exemption granted under this Notification , shall remain in force upto and inclusive of the 31st day of March , 1978

सात्र फा० नि० 678 ( प्र) -केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उप -नियम ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करने हुए , केन्द्रीय उत्पाद शुल्क और नमक, प्रधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची की मद म ० 14-० के अन्तर्गत सम्मिलित लोह एत्र फोलिक अम्ल मिश्रित टिकियों को और उनकी द्रव विनिर्मितियो का , उन पर उदग्रहणीय समम्न उत्पाद-शुल्क से , निम्नलिखित शर्तों पर छूट देती है , अर्थात्-
(i ) उन टिकियों या विनिर्मितियो पर या उन के आध। नो पर या दोनो पर उनका ब्राण्ड-नाम अर्थात व्यापार और पण्यवस्तु चिह्न अधिनियम 1958 ( 1958 का 43) के अधीन रजिस्ट्रीकृत पण्य चिह्न या नाम या कोई अभ्य चि जैसे कोई प्रतीक, नाम चिह्न ( मोनोग्राम ) , लेबिल , हस्ताक्षर या कोई ऐसे अविकृत शब्द या लिखावट नही लगे होगे जो ऐमी वाणिज्य के अनुक्रम में ऐसी टिकिया या विनिमिति और किसी ऐसे व्यक्ति , जो म्वत्वधारी के रूप मे या अन्यथा उसकी पहचान दर्शाने के लिए या उसके बिना नाम या चिह्न के उपयोग का अधिकारी के बीच सम्बन्ध उपर्दाशत कराने में प्रयोजन लिए हो या जगसे एसा सम्प्रन् उपर्दाशत होता हो;
( ii) विनिर्माता, उचित अधिकारी को, ऐमी टिकियो या विनिमितियों की निकासी की तारीख से नब्त्र दिनों के भीतर या ऐसी बढ़ाई गई अधि के भीतर जो उचित अधिकारी अनुज्ञात करे , स्वास्थ्य और परिवार कल्याण मन्त्रालय द्वारा प्राधिकृत अधिकारी का ऐसा प्रमाण-पत्र प्रस्तुत करेगा जिसमे ये दर्शित किया गया हो कि उनका प्रदाय केवल स्वास्थ्यऔर परिवार कल्याण मन्त्रालय या उस मंत्रालय द्वारा प्राधिकृत किसी अन्य संगठन को या दोनों को , राष्ट्रीय परिवार कल्याण कार्यक्रम के अधीन मुफ्त वितरण के लिए श्रयित है ।
