G.S.R. 681 (E) .-In Exercise of the powers conferred by sub - section ( 2) of Section 33 of3 of the Indian Ports Act, 1908 ( 15 of 1908) , the Central Government hereby makes , with effect fom the expiration of sixty days from the date of publication of this notification in the Official Gazette , the following alterations in the First Schedule to the said Act , namely : -
In part II of the First Schedule to the said Act , in the entries relating to the Port of Cochin , in column 3 , in each of the entries ( a) , (b ) and (d) , for the words " rupee one and paise fifty " , the words "rupees five" shall be substituted .

अधिसूचना के प्रकाशन की तारीख से साठ दिन की समाप्ति से, उक्त अधिनियम की प्रथम अनुसूची मे निम्नलिखित परिवर्तन करती है , अर्थात्-
उक्त अधिनियम की प्रथम अनुसूची के भाग 2 मे , कोचीन पत्तन से सबधित प्रविष्टियों मे, स्तम्भ 3 में , ( क ) , ( ख ) भौर ( घ) प्रविष्टियों की प्रत्येक मे " एक रुपया और पचास पैमे" शब्दो के स्थान पर , " पाच रुपए" शब्द रखे जाएंगे ।

G.S.R. 68 ( E) -In exercise of the powers conferred by sub- section ( 1 ) of Section 33 read with Section 34 of the Indian Ports Act, 1908 ( 15 of 1908 ) , the Central Government hereby directs that, with effect from the day following the expiration of sixty days from the date of publication of the notification in the Official Gazette the following amendments shall be made in the notification ofthe Government of India in the Ministry ofShipping and Transport (Transport Wing ) No GS.R. 1277 dated the 15th November 1974 , relating to the levy of port - dues at the Port of Cochin , namely :-
In the said notification for the existing schedule, the following Schedule shall be substituted, namely:-

सा० का ० नि ० 682 ( प्र ) केन्द्रीय सरकार, भारतीय पत्तन अधिनियम, 1908 ( 1908 का 15 ) को धारा 34 के साथ पठित धारा 33 की उपधारा ( 1 ) द्वारा प्रदत्त माक्तियों का प्रयाग करते हुए , यह निर्देश करती है कि इस अधिसूचना के राजपत्र मे प्रकाशन की तारीख से मा 5 दिन को समाप्ति के पश्चात् ठीक आगामी दिन से , भारत सरकार के नौवहन और परिवहन मत्तालय ( परिवहन पक्ष ) की अधिसूचना संख्यांक सा ० का ० नि ० 1277 , तारीख 15 नत्रम्ब " 1974 मे, जो कोचीन पतन पर पत्तम शुल्क के उद्ग्रहण से सम्बन्धित है, निम्नलिखित सशोधन किए जाएगे , अर्थात्:-
उक्त श्रधिसूचना में मौजूदा अनुसूची के लिए निम्नलिखित अनुसूची रखी जायेंगी अर्थात्:

1. Short Title and Commencement.- ( 1 ) This order may be called the Cochin Port Pilotage and Other Services ( Fecs ) Amendment Ordu , 1977 .
(2) It shall come into force at once

(b ) Fou exemption from compulsory pilotage on certain vessels under section 31 of the In han Ports Act 1908
NOTFS I in the above entries , ' ship ' means a vessel propelled solely by wind power and 'steamer' means any vessel other than a ship .
2 In respect of sailing vessel fitted with auxiliary engines entering the port of Cochin Pilotage fees shall be charged at the rate applicable to ships .
The Government mav in special cases , remit the whole or any portion of the fees leviable in accordance with item 1 ( b ) above .
1 Vight Pilotage will be undertaken at the discretion of the Deputy Conservator
The vessel for whose convenience adjacent berth or berths is or are kept vacant due to the nature of cargo to be handled at that particular bath or for any other reason shall be charged additional pilotage fees for each of the berth so kept varani at the rate applicable to the particular vessel

NOTES : 1. In cases where a Pilot boards a steamer but has to return on being imformed that his services are not required ' Cancellation charges ' specified in sub - item III ( 1 ) above shall be levied .
2. If a pilot is made to wait for more than 30 minutes after boarding the steamer and is being informed that his services are not required ' detention charges ' specified in qub -item III ( 11 ) above shall be levied in addition to cancellat lon tharges se cified in sub - item III ( i ) above and also hire charges of tugs , if any , specified for the hire of Port's tugs , provided that the Deputy Conservator may , at hus dis- cretion, waive the whole or part of the detention or cancellation charges or tug hire so incurred , if the detention of cancellation is due to the circumstances beyond the control of the master of the steamer and if the pilot certifies to that effect Exblanation . ( 1 ) " Coasting Vessel " means an Indian or a foreign vessel arriving at the Cochin Port from another Indian Port either in ballast or with cargo loaded in or passengers embarked exclusively from Indian Ports or with both and which leaves for another Indian Port , either in ballast or with cargo or passengers exclusiva ly for Indian Ports or with both provided that the ship has obtained a licence from the Directorate General of Shipping for being treated as a vessel engaged in coastal trade .
( 2 ) " Foreign Vessel" means a vessel other than a coasting vessel . For the purpose of levy of charges sailing vessel will be deemed coasting vessel ' .

सा० का० नि० 683 ( श्र) केन्द्रीय सरकार , भारतीय पत्तन श्रधिनियम , 1908 (1908 का 15 ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कोचीन पत्तन मार्गदर्शन और अन्य सम्बन्धित कार्य ( फीस ) आदेश , 1977 , के संशोधन के लिए निम्नलिखित आदेश करती है, श्रर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस आदेश का संक्षिप्त नाम कोचीन पत्तन मार्गदर्शन और अन्य सम्बन्धित कार्य ( फीस ) संशोधन आदेश , 1977 है ।

टिप्पण : 1. उपरोक्त प्रविष्टियो मे "पोत " से पूर्णतया वायु शक्ति से चालित जलयान अभिप्रेत है तथा "स्टीमर" से पोत से भिन्न कोई जलयान अभिप्रेत हैं ।
2. सहायक (भ्राग्सीलरी ) इंजनों से युक्त सेलिग जलयानो की बाबत , जो कोचीन पत्तन में प्रवेश करे, मार्गदर्शन फीस पातो को लागू दरो पर ली जाएंगी ।
3. सरकार, विशेष मामलो मे , उपर्युक्त मद 1 ( ख ) के अन्तर्गत उदग्रहणीय फीस से पूर्णतया या उसके किसी भाग से छूट दे सकती है ।
4. रात्रि मार्गदर्शन पूर्णरूपेण उप - कनजरवेटर के विवेकानुसार किया जाएगा ।
5. उस जलयान से , जिसको सुविधा के लिए कोई समीपवर्ती बर्थ या बचें , उस स्थोरा की प्रकृति को ध्यान में रखते हुए जो उस बर्थ पर उतारा या चढ़ाया जाएगा, अथवा किसी अन्य कारण से , खाली रखी जाएगी, ऐसी प्रत्येक खाली रखी गई बर्थ के लिए , उस जलयान को लागू दर पर अतिरिक्त मार्गदर्शन शुल्क लिया जाएगा ।

टिप्पण : 1. जहां किसी पाइलेट को स्टीमर पर सवार होने के पश्चात् , यह सूचना पाने पर कि उसकी सेवा अपेक्षित नही है , वापस आना पष्ठे वहा उपरोक्त उप - मद III ( i ) में दी गई दर पर " रद्दकरण प्रभार " उङ्ग्रहणीय होगा ।
2. यदि किसी पाइलेट को स्टीमर पर सवार होने के पश्चात् 30 मिनट से अधिक प्रतीक्षा करनी पड़े और यह सूचित किया जाए कि उसकी सेवाए अपेक्षित नहीं हैं तो उपरोक्त उप - मद III ( ii ) में विनिर्दिष्ट " रोके रखने के लिए प्रभार " उपरोक्त उप - मद III ( i ) में विनिर्दिष्ट " रद्दकरण प्रभार " के अतिरिक्त उग्रहणीय होगा तथा टगो के लिए , यदि कोई हो, पत्तन टगों के किराये के लिए विनिर्दिष्ट दर पर , किराया भी लिया जाएगा । परन्तुयह कि उप- कनजर्वेटर , स्वविवेकानुसार रोके रखने या रद्दकरण के प्रभार या टगों के लिए उपगत किराया पूर्णतः या भागतः माफ कर सकता है यदि रोके रखना या रद्दकरण ऐसी परिस्थितियो के कारण हो जो स्टीमर के मास्टर के नियंत्रण में नहीं है और यदि पाइलेट इस आशय का प्रमाणपत्र दे ।
स्पष्टीकरण. ( 1 ) " तटीय जलयान" से ऐसा भारतीय या विदेशी जलयान अभिप्रेत हैं , जो या तो भार सहित या स्थोरा भर कर या केवल भारतीय पत्तनों से यात्रियो को पोतारोहित करके या दोनो के साथ अन्य भारतीय पत्तन से कोचीन पत्तन में पहुंचता ह और जो या तो भार सहित या स्थोरा भर कर या केवल भारतीय पत्तनों के लिए यात्रियों को पोतारहित करके या दोनो के साथ अन्य भारतीय पत्तन के लिए चलता हैं । परन्तु यह तब , जब कि पोत ने तटीय व्यापार मे रत जलयान के रूप में बरते जाने के लिए नौवहन महानिदेशालय से अनुज्ञप्ति श्रभिप्राप्त कर ली हो ।
( 2 ) "विदेणी जलयान " से तटीय जलयान से भिन्न जलयान अभिप्रत है । प्रभारो के उद्ग्रहण के प्रयोजनार्थ समुद्रगामी जलयान को तटीय जलयान समझा जाएगा । '
