SO 755 ( E ) -In exercise of the powers conferred by section 31 of the Burn Company and Indian Standard Wagon Company ( Nationalisation ) Act , 1976 ( 97 of 1976 ) , the Central Government hereby makes the following rules , namely 1 Short title and commencement ( 1 ) These rules may be called the Burn Company and Indian Standard Wagon Company ( Nationalisation ) Rules , 1977 . ( 11 ) They shall come into force on the date of their publication in the Official Gazette
2 Definitions -In these rules , unless the context otherwise requires-
( a) " Act " means the Burn Company and Indian Standard Wagon Com- pany ( Nationalisation ) Act , 1976 ( 97 of 1976 ) ,
(b ) " section " means a section of the Act
3 Time - limit for intimation - Every mortgagee of any property which has vested under the Act in the Central Government or a Government Company , and every person holding any charge , lien or other interest in or in relation to any such property shall give intimation of such mortgage , charge lien or other interest to the Commissioner within a period of thirty days from such date as may be specified by the Central Government under section 17 :

Provided that if the Commissioner is satisfied that the mortgagee or the person holding any charge , hen or other interest was prevented by sufficient cause from giving the intimation within the said period of thirty days , he may receive the intimation within a further period of thirty days and not thereafter
4. Manner of Intimation.- ( 1 ) Every ıntımation to be given to the Commissioner under rule 3 shall be in writing , addressed to the Commissioner , and shali contain the following particulars , namely
(a) Name, description and full address of the mortgagee/ charge , lien ог other interest holder ,
(b) name of the undertaking in respect of which the claim is made , (c) amount of claim ( in Indian currency ) ,
(d) particulars of the instrument , if any , by which the mortgage , charge , hen or other interest is secured , supported by an attested copy of the instrument;
( e) amount , if any already received , with particulars ,
( f ) any other particulars relevant to the claim ,
(g) relief claimed
( 2) Every intimation shall be duly signed and verifled by the mortgagee , or the person holding the charge , lien or other interest or a person duly authorised by him.
( 3) Intimations may be filled in the office of the Commissioner at Calcutin on all working days during office hours or may be sent to the Commissioner by regis- tered post , with acknowledgement due

फा० श्रा० 755 ( प्र ) . केन्द्रीय सरकार, बर्न कम्पनी और इण्डियन स्टैण्डर्ड वैगन कम्पनी (राराष्ट्रीयकरण ) अधिनियम, 1976 ( 1976 का 97 ) की धारा 31 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , निम्नलिखित नियम बनाती है, अर्थात् -
1 संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमो का सक्षिप्त नाम बर्न कम्पनी और इण्डियन स्टैण्डर्ड त्रैगन कम्पनी ( राष्ट्रीयकरण ) नियम , 1977 है ।
( 2 ) ये राजयत्न के प्रकाशन की तारीख को प्रवृत्त होगे ।
2. परिभाषाए-इन नियमो में , जब तक कि सदर्भ से अन्यथा अपेक्षित न हो, ---
(क) " अधिनियम " से बर्न कम्पनी और इण्डियन स्टैण्डर्ड वैगन कम्पनो (राष्ट्रीयकरण) अधिनियम , 1976 ( 1976 का 97 ) अभिप्रेत है ,
(ख) "धारा " मे अधिनियम की धारा श्रभिप्रेत है ।
3 सूचना के लिए समय-सीमा-किमी ऐसी सम्पत्ति का, जो न्द्रीय सरकार या किसी सरकारी कम्पनी मे इस अधिनियम के अधीन निहित हो गई है , प्रत्येक बधकदार और किसी ऐसी सम्पत्ति मे या उस के सबध में कोई भार, धारणाधिकार या अन्य हित धारण करने वाला प्रत्येक व्यक्ति, एीतारीख मे, जो केन्द्रीय सरकारधारा 17 के अधीन विनिदिष्ट करे, तीस दिन की अवधि के भीतर, ऐसे बंधक, भार, धारणाधीकार या अन्य हित की सूचना आयुक्त को देगा भाग II-खं . 3 ( ii )

परन्तु यदि आयुक्त का यह समाधान हा जाए कि बधकदार या कोई भार , धारणाधिकार या अन्य हित धारण करने वाला व्यक्ति पर्याप्त कारणों से उक्त तीम दिनो की अवधि के भीतर सूचना देने से निवारिन हो गया था तो आयुक्त तीस दिन को और अवधि भीतर, और उसके पश्चात् नही, सूचना ले सकेगा ।
4 सूचना की रीति ( 1 ) नियम 3 के अधीन आयुक्त को दी जाने वाली हर सूचना, लेखबद्ध रूप में. श्रायुक्त नाम से होगी और उमन निम्नलिखित विशिष्टिया होगी , अर्थात्
( क ) प्रधतदार भार , धारणाधिकार या अन्य हित धारक का नाम , वर्णन और पूरा पता
(ख ) उन उरकम का नाम, जिसकी बाबत दावा किया गया है ,
(ग) दावे की रकम ( भारतीय फ्रेमी प ) ,
(घ) ऐमी लिखन यदि कोई हो, की विशिष्टिया , जिम मे नधक, भार धारणाधिकार या ग्रन्य हित को प्रतिभति किया गया हो , जिमका समर्थन लिखिन की प्रमाणित प्रति में किया जाएगा
( ड) रकम, यदि कोई पहने की प्राप्त की गई हो, और उसकी विशिष्टिया
(च ) दावे मे सुमगन कोई अन्य विशिष्टिया
( छ) अनुनय जिसका दात्रा किया गया हो ।
( 2 ) हर सूचना वधकदार या भार धारणाधिकार या अन्य हित धारण करने वाने व्यक्ति द्वारा या उप द्वारा सम्यक रूप से प्राधिकृत किसी व्यक्ति द्वारा , सम्यक् रूप से हस्ताक्षरित और सत्यापित की जाएगी ।
(3) सूचना आयुक्त । कलकत्ता स्थित कार्यालय मे सभी कार्य दिवसो मे कार्यालय के समय के दौरान फाइल की जाएगी या श्रयवन को रमीदी रजिस्ट्री डाक द्वारा भेजी जाएगी ।

1 Short title and commencement- ( 1 ) These rules may be called the Braith- waite and Company ( India ) Limited ( Acquisition and Transfer of Undertakings ) Rules, 1977 ( 11 ) They shall come into force on the date of their publication in the Official Gazette
2 Definitions . In these rules , uniess the context otherwise requires- ( a ) "Act " means the Braithwaite and Company ( India ) Limited ( Acquisition and Transfer of Undertakings ) Act , 1976 ( 96 of 1976 ) ,
( b ) " section " means a section of the Act .
3 Time - limit for intimation - Every mortgagee of any property which has vested under the Act in the Central Government or a Government Company , and every person holding any charge , lien or other interest in , or in relation to , any such property , shall give intimation of such mortgage , charge , lien or other inte- rest to the Commissioner within a period of thirty days from such date as may be specified by the Central Government under section 17 :

4 Manner of intimation. ( 1 ) Every intimation to be given to the Commissioner under rule 3 shall be in writing , addressed to the Commissioner , and shall contain the following particulars , namely
( a) Name , description and full address of the mortgagee / charge , lien or other interest holder ,
(b) name of the undertaking in respect of which the claim is made ( c) amount of claim ( in Indian currency ) ,
(d ) particulars of the instrument , if any by which the mortgage charge , lien or other interest is secured supported by an attested copy of the instrument ,
( e ) amount ,if any already received , with particulars ,
( f ) any other particulars relevant to the claim ,
(g ) relief claimed
(2 ) Every intimation shall be duly signed and verified by the mortgagee , or the person holding the charge lien or other interest or a person duly authorised by him
(3 ) Intimations may be filed in the office of the Commissioner at Calcutta on all working davs during office hours or may be sent to the Commissioner by regis- tered post, with acknowledgement due

का ० प्रा ० 756 ( प) केन्द्रीय सरकार ब्रेथवेट एण्ड कम्पनी ( इण्डिया ) लिमिटेड ( उपक्रमो का अधिग्रहण तथा स्थानान्तरण ) अधिनियम , 1976 ( 1976 का 96 ) की धारा 30 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए निम्नलिखित नियम बनाती है अर्थात्
1 संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमो का मक्षिप्त नाम श्रेथवेट एण्ड कम्पनी (इण्डिया) लिमिटेड ( उपक्रमो का अधिग्रहण तथा म्थानान्तरण ) नियम 1977 है ।
( 2) ये राजपत्र से प्रकाशन की नारोख को पवृत्त होगे ।
2 परिभाषाए-इन निगमों में जब तक कि सदर्भ से ग्रन्यथा अपेक्षिन न हो, --
(क) " अधिनियम" से ब्रेथवेट एण्ड कम्पनी ( इण्डिया ) लिमिटेड ( उपक्रमो का श्रधि ग्रहण तथा स्थानान्तरण ) अधिनियम 1976 ( 1976 का 96) अभिप्रेत है ।
(ख) "धारा" में अधिनियम की धारा अभिप्रेत है ।
3 सूचना के लिए समय-सीमा-किमी ऐसी सम्पत्ति का जो केन्द्रीय सरकार या क्सिी सरकारी कम्पनी में इस अधिनियम अधीन निहित हो गई है , प्रत्येष बधषदार ग्रौर किमी ऐमी मभ्पत्ति में या उस सबंध में कोई भार, धारणाधिकार , या अन्य हित धारण करने वाला प्रत्येक व्यक्ति, ऐसी तारीख से, जो केन्द्रीय सरकार धारा 17 के अधीन विनिर्दिष्ट करे, तीस दिन की अवधि ये भीतर, ऐमे अधक भार धारणाधिकार या अन्य हित की सूचना आयुक्त को देगा
परन्तु यदि आयुक्त का यह समाधान हो जाए कि बधकदार या कोई भार, धारणाधिकार या अन्य हित धारण करने वाला व्यक्ति पर्याप्त कारणों से, उक्त तीस दिनो की अवधि के भीतर सूचना देने से निवारित हो गया था तो आयक्न तीस दिन की और अवधि के भीतर, और उमत्रे पश्चात् नही , सूचना ने महेगा ।

4. सूचना की रीति ( 1) नियम 3 के अधीन आयुक्त को दी जाने वाली हर सूचना, लेखबद्ध रूप में, आयुक्त के नाम से होगी और उससे निम्नलिखित विशिष्टिया होंगी, अर्थात :-- (क) बंधकदार भार, धारणाधिकार या अन्य हित धारक का नाम, वर्णन और पूरा पता ;
(ख) उस उपक्रम का नाम, जिसकी बाबत दावा किया गया है ;
(ग) वाये की रकम ( भारतीय करेंसी मे) ;
(घ) ऐसी लिखित , यदि कोई हो, की विशिष्टिया , जिस से बंधक , भार धारणाधिकार या अन्य हित को प्रतिभूत किया गया हो ; जिसका समर्थन लिखत की प्रमाणित प्रति से किया जाएगा ;
(ङ) रकम , यदि कोई पहले ही प्राप्त की गई हो, और उसकी विशिष्टियां , (घ) वावे से सुसंगत कोई अन्य विशिष्टियां ;
(छ) अनुतोष जिसका दावा किया गया हो ।
( 2 ) हर सूचना बंधकवार या भार, धारणाधिकार या अन्य हित धारण करने वाले व्यक्ति द्वारा या उसके द्वारा सम्यक् रूप से प्राधिकृत किसी व्यक्ति द्वारा , सम्यक् रूप मे हस्ताक्षरित और सत्यापित की जाएगी ।
(3) सूचना आयुक्त के कलकत्ता स्थित कार्यालय में सभी कार्य दिवसों में कार्यालय के समय के दौरान फाइल की जाएगी या आयुक्त को रसीदी रजिस्ट्री डाक द्वारा भेजी जाएगी ।
