New Delhi , the 11th November 1977
G.S.R. 697 ( E ) . Whereas certain draft rules further to amend the Drugs and Cosmetics Rules , 1945 were published , as required by section 33 of the Drugs and Cosmetics Act , 1940 ( 23 of 1940 ) , at page 383 o the Gazette of India Extra- ordinary Part II , Section 3 , Sub - section ( 1 ) dated the 11th March , 1977 , under the notification of the Government of India in the Ministry of Health and Family Welfare ( Department of Health ) No. GS.R 110 ( E ) dated the 11th March , 1977 Inviting objectionsobjections and suggestions from all persons likely to be affected thereby . before thethe expiry of thirty days from the date of publication of the said notification in the Official Gazette;
And whereas the objections and suggestions received from the public on the said draft have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by section 33 of the said Act, the Central Government , after consultation with the Drugs Technical Advisory Board hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely :
1. ( 1 ) These rules may be called the Drugs and Cosmetics ( Fifth Amendment ) Rules , 1977 .
(2 ) They shall come into force on the date of their publication in the Official Gazette.

2. In the Drugs and Cosmetics Rules , 1945 , in Schedule K , after item 19 and the entry relating thereto , the following item and entry shall be inserted , namely .

20. Tablets of Chloroquine Salts
The provisions of Chapter IV of the Act and rules thereunder, which require them to be covered by a sale licence , provided the drug instrip park is sold under the Commercial Distribution Scheme of the National Malaria Eradication Programme and duly labelled as " National Malaria Eradication programme - Ministry of Health and Family Welfare , Government of India ."

सा ० फा ० ति ० 697 ( प्र) -औषधि और प्रसाधन सामग्री नियम , 1945 में और मशोधन करने के विए कतिपय नियमो का प्रारूप औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 33 की अपेक्षानुमार , भारत के राजपत्त , असाधारण, भाग 2 , खण्ड 3 , उपखण्ड ( 1 ) , तारीख 11 मार्च, 1977 के पृष्ठ 383 पर , भारत सरकार के स्वास्थ्य और परिवार कल्याण मन्त्रालय ( स्वास्थ्य विभाग ) की अधि- सूचना सं ० सा ० का ० नि ० 110 ( श्र ) , तारीख 11 मार्च, 1977 के साथ प्रकशित किया गया था , जिसमे उन सभी व्यक्तियो से , जिनके उससे प्रभावित होने की सम्भावना थी , राजपत्र में उक्त अधि- सूचना के प्रकाशन की तारीख से तीस दिनो के श्रवसान के पूर्व , आक्षेप और सुझाव मागे गए थे;
और जनता से उक्त प्रारुप की बाबत आज्ञेपो और मुझात्रो पर केन्द्रीय सरकार ने विचार कर लिया है;
अत , अब , केन्द्रीय सरकार उक्त अधिनियम की धारा 33 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात , औषधि और प्रसाधन सामग्री नियम , 1945 मे भौर सशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्
नियमों का प्रारूप
1. ( 1 ) इन नियमो का सक्षिप्त नाम औषधि और प्रसाधन सामग्री ( पाचवा मंशोधन ) नियम, 1977 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगे ।

2. औषधि और प्रसाधन सामग्री , नियम , 1945 की अनुसूची ट में , मद 19 और उससे सबंधित प्रविष्टियो के पश्चात्, निम्नलिखित पद और प्रविष्टि अन्तः स्थापित की जाएगी , अर्थात्:-
श्रौषधियों का वर्ग
छूट की सीमा और शर्ते
20. क्लोरोक्विन लवण की गोलिया अधिनियम के अध्याय 4 के और उसके अधीन बने नियमो के उपबन्ध , जिनमें यह अपेक्षित है कि ये गोलिया विक्रय लाइसेस पर ही बेची जाए , परन्तु यह तब जब स्ट्रिप पैक में श्रौषधि राष्ट्रीय मलेरिया उन्मूलन कार्यक्रम की वाणिज्यिक वितरण स्कीम के अधीन बेची जाए और उस पर " राष्ट्रीय मलेरिथा उन्मूलन कार्यक्रम-स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार " का लेबल सम्युक रूप से लगा हुआ हो ।
