New Delhi , the 16th November 1977
G.S.R. 703 ( E ) .- The following draft of certain rules further to amend the Pre- vention of Food Adulteration Rules , 1955 , which the Central Government proposes to make in exercise of the powers conferred by section 23 of the Prevention of Food Adulteration Act , 1954 ( 37 of 1954 ) , in the circumstances which in the opinion of the Central Government render it necessary to make rules without consultation with the Central Committee for Food Standards ,is hereby published as required by sub - section ( 1 ) of the said section for the information of all persons likely to be effected thereby and notice is hereby given that the said draft will be taken into consideration after 10 days of its publication in the Gazette of India . Any objections or suggestions received from any person with respect to the said draft rules on or before the date so specified shall be considered by the Central Govern- ment
Draft Rules
In exercise of the powers conferred by section 23 of the Prevention of Food Adulteration Act, 1954 ( 37 of 1954 ) , the Central Government hereby makes the following rules further to amend the Prevention of Food Adulteration Rules, 1955 , namely: -
1 These rules may be called the Prevention of Food Adulteration ( Amend- ment ) Rules , 1977 .

2 In the Prevention of Food Adulteration Rules , 1955 , in Rule 44, after the existing provisos , the following proviso shall be inserted, namely
"Provided further that clause ( e ) shall remain inoperative in respect of admixture of rape - seed oil with mustard oil to be processed and sold by the Government of India in the Ministry of Civil Supplies , or their authorised agents , for a period of one year from the date of commencement of the Prevention of Food Adulteration ( Amendment) Rules , 1977 The proportion of the two oils in the mixture shall be indicated on the label on the container in which the mixture of the aforesaid oils is sold ,"

सा० का ०मि० 703 ( श्र ) केन्द्रीय सरकार, खाद्य श्रमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 द्वारा प्रदरु शक्तियो का प्रयोग करते हुए , खाद्य अपमिश्रण निवारण नियम , 1955 का और सशोधन करने के लिए , कतिपय नियमो का निम्नलिखित प्रारूप उन परिस्थितियो में बनाना चाहती है जिनमे वह केन्द्रीय खाद्य मानक समिति से परामर्श किए बिना इन नियमो का बनाना आवश्यक समभगी है । जैसा कि उक्त धारा की उपधारा ( 1 ) में अपेक्षित है , उक्त प्रारूप उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया जा रहा है जिनके उससे प्रभावित होने की संभावना है , पौर सूचना दी जाती है कि उक्त प्रारूप पर इस अधिसूचना के भारत के राजपत्र में प्रकाशन के दस दिन के पश्चात विचार किया जाएगा । इस प्रकार विनिर्दिष्ट तारीख से पूर्व नियमों के उक्त प्रारूप की बाबत जो भी आक्षेप या सुझाव किसी व्यक्ति से प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।
नियमो का प्रारूप
केन्द्रीय सरकार , खाद्य श्रपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37) की धारा 23 द्वारा प्रदत्त भश्तियो का प्रयोग करते हुए , खाद्य श्रपमिश्रण निवारण नियम , 1955 मे और सशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्
1. इन नियमो का नाम खाद्य अधमिश्रण निवारण ( संशोधन ) नियम, 1977 है ।
2. खाद्य श्रपमिश्रण निवारण नियम, 1955 के नियम 44 में विद्यमान परन्तुकों के पश्चात् निम्नलिखित परन्तुक अन्त स्थापित किया जाएगा, अर्थात् --
"परन्तु यह और कि खंड ( ङ) भारत सरकार के नागरिक पूर्ति मंत्रालय अथवा उसके प्राधिकृत अधिकर्ताओ द्वारा प्रसंस्कृत किए और बेचे जाने वाले उस मिश्रण की बाबत , जो रेप -सीड तेल को सरसो के तेल से मिलाकर बनता है, खाद्य श्रपमिश्रण निवारण ( संशोधन ) नियम , 1977 के प्रारम्भ की तारीख से एक वर्ष की अवधि तक के लिए श्रप्रवर्तनशील भारत का असाधारण राजपत्र

बना रहेगा । मिश्रण के दोनो तेलो का अनुपात उस श्राधार पर , जिसमे पूर्वोक्त तेलो का मिश्रण बेचा जाता है , लगे लेबल पर उपशित किया जाएगा ।"
