8.O. 787 ( E ) / 18A / IDRA / 77 -Whereas by the Order of the Government of India in the late Ministry of Industrial Development ( Department of Industrial Deve- lopment) No S.O. 727 ( E ) / 18A / IDRA / 72 , dated the 29th November , 1972 , ( here- inafter referred to as the said Order ) . the management of the industrial under- taking known as Messrs , Containers and Closures Limited Calcutta had been taken over for a period upto and inclusive of the 28th November , 1977 ,
And, whereas the Central Government is of the opinion that it is expedient in the public interest that the said Order should continue to have effect for a further period of two years ;
Now, therefore, in exercise of the powers conferred by the proviso to sub- section ( 2 ) of section 18A of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby directs that the said , Order shall continue to have effect for a further period upto and inclusive of the 28th November , 1979

का० प्रा० 787 ( प्र) 18क/ उ ० वि ० वि ० प्र०/ 77.--- भारत सरकार के भूतपूर्व औद्योगिक विकास मंत्रालय ( श्रौद्योगिक विकास विभाग ) के आदेश सं ० का ० श्रा ० 727 (प्र)/ 18 क/ उ ० वि ० वि ० प्रा ० / 72 , तारीख 29 नवम्बर, 1972 द्वारा ( जिसे इसमें इसके पश्चात् उक्त प्रदेश कहा गया है ) , मेसर्स कन्टैनर्स एण्ड क्लोजर्स लिमिटेड कलकत्ता , नामक औद्योगिक उपक्रम का प्रबन्ध 28 नवम्बर, 1977 , जिम में यह तारीख भी सम्मिलित है , तक की अवधि के लिए ग्रहण कर लिया गया था ;
और केन्द्रीय सरकार की यह राय है कि लोक हित में यह समीचीन है उक्त आदश दा वर्ष की और प्रषधि के लिए प्रभावी बना रहे ,
1951 अत , अब, केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम , ( 1951 का 65) की धारा 18 क की उपधारा ( 2 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निवेश देनी है कि उक्त आदेश 28 नवम्बर , 1979 , जिस में यह तारीख भी मम्मिलित है , तक की और अवधि तक प्रभावी बना रहेगा ।

S.O. 788 ( E ) / 18FB / IDRA / 77 . Whereas by the Order of the Government of India in the late Ministry of Industrial Development ( Department of Industrial Development ) No S.O. 34 ( E ) / 18FB / IDRA / 73 , dated the 19th January , 1973 (hereinafter referred to as the said Order ) the Central Government in exercise of the powers conferred by clause ( b ) cf sub - section ( 1 ) of section 18FB of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) declared that the operation of all contracts , assurances of property , agreements , settlements . awards , standing orders or other instruments in force immediately before the date of issue of the said Order in the Official Gazette ( other than those relating to secured Habilities to banks and financial institutions ) to which the industrial undertaking known as Messrs Containers and Closures Limited , Calcutta , is a . party or which may be applicable to the said industrial undertaking , shall remain suspended upto the 18th January 1974 , and that the all the rights , privileges , obligations and liabilities accruing or arısıng thereunder before the said date shall remain suspended upto the 18th January 1974 ;
And , whereas the duration of the said Order was extended from time to time upto the 28th November , 1977 ,
And, whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period upto and inclusive of the 18th January , 1978 ;
Now , therefore , In exercise of the powers conferred by sub - section ( 1 ) read with sub - section ( 2 ) of section 18FB of the Industries ( Development and Regu- lation) Act , 1951 ( 65 of 1951 ) , the Central Government hereby extends the dura- tion of the said Order upto and inclusive of the Lath Januaгу 1978

का० ग्रा० 788 ( *) / 18 चत/ उ ० वि० वि०० / 77.--केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18चख की उपधारा ( 1 ) के भ्रष्ट ( ख) द्वारा प्रदत्त शक्त्तिया का प्रयोग करते हुए, भारत सरकार के भूतपूर्व प्रौद्योगिक विकास मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं ० का ० श्र ० 34 ( अ) / 18 च ख/उ ० वि ० वि ० श्र ०/ 73 तारीख 10 जनवरी, 1973 द्वारा ( जिसे इस मे इसके पश्चात् उक्न आदेश कहा गया है ) यह घोषणा की थी कि राजपत्त मे उक्न आदेश के जारी किए जाने की तारीख से ठीक पूर्व प्रवत्त सभी संविदाएं , सपत्ति के हस्तान्तरण पत्र. करार व्यय- स्थापन , पंचाट , स्थायी आदेश या अन्य निखत ( उन से भिन्न जा वैको और वित्तीय संस्थाओं के प्रतिभूत दायित्वा से संबंधित है । जिनका मैसर्स कन्टेनर्स एण्ड क्लोजर्स लिमिटेख , कलकत्ता नामक औद्योगिक उपक्रम एक पक्षकार है या जो उक्त औद्योगिक उपक्रम को लागू हो सकते हो, 18 जनवरी, 1974 तक निलंबित रहेगे और उक्त तारीख से पूर्व उस के अधीन प्रोद्भूत या उद्भूत सभी अधिकार. विशेषाधिकार, बाध्यताएं यौ दायि व 18 जनवरी , 1974 तक निलम्बित रहेंगे :
और उक्त आदेश की अवधि समय -समय पर 28 नवम्बर ,, 1977 तक बढ़ा दी गई थीः
और केन्द्रीय सरकार का समाधान हो गया है कि उक्म आदेश की अवधि 18 जनवरी 1978. जिम में यह दिन भी सम्मिलिन है , तक की और अवधि के लिए बढ़ा दी जानी चाहिए ;
अत, अत्र , केन्द्रीय सरकार, उद्योग ( विकास और विनियमन ) अधिनियम 1951 (1951का 65) की धारा 18 चश्म्र की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत शक्त्यिो का प्रयोग करते हुए, उक्त आदेश की अवधि 18 जनवरी , 1978 तक , जिसमें यह दिन भी सम्मिलित है, के लिए बढ़ाती है ।
