ORDER
New Delhi , the 30th November 1977
S.O. 794 ( E ) . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order further to amend the Jute ( Licensing and Control ) Order , 1961 , namely-
1. ( 1 ) This Order may be called the Jute ( Licensing and Control ) Amend- ment Order , 1977 .
(2) It shall come into force at once
2. In the Jute ( Licensing and Control ) Order , 1976 ,-
( i ) in sub - clause ( c ) clause 2 , for the words " in a State" ; the word " also " shall be sulsubstituted ,
(ii) to sub - clause ( 1 ) of clause 3 , the foliowing provisos shall be added , namely
"Provided that the Jute Commissioner may, by notification in the Official Gazette, exempt any such person or class of such persons from the provisions of this sub clause'

Provided further that in granting such exemption under the preceding proviso the Jute Commissioner shall have regard to the following matters , namely:-
(1 ) the volume of business in ' raw jute or jute textiles carried on by such person or class of such persons;
(ii ) the quantity of raw jute or jute textiles in the possession of such person or class of such persons;
(iii ) the period for which the stocks of raw jute or jute textiles are ordinarily held by such person or class of such persons for the purpose of sale or storage ,
(Iv) price situation and availability position of raw jute or jute textilew in the country , and
(v) any other relevant factor
(iii) for item ( b ) of sub - clause ( 2 ) of clause DA, the following shall be sub- stituted , namely
"(b) the maximum quantityqu of raw jute which the manufacturer has had in his possession during the period of two years immediately pre- ceding the commencement of the Jute (Licensing and Control) Amendment Order , 1977 " .

का० प्रा० 794 ( प्र ) केन्द्रीय सरकार, श्रावश्यक वस्तु अधिनियम, 1955 ( 1955 करें 10 ) की धारा 3 द्वारा प्रदत्त शक्तियो का प्रयाग करते हुए , पटसन ( अनुज्ञापन भौर नियंत्रण ) श्रादेश, 1961 में भौर संशोधन करने के लिए निम्नलिखित प्रादेश करती है , अर्थात्: -
1. ( 1 ) इस श्रादेश का नाम पटसन ( अनुज्ञापन और नियंत्रण ) संशोधन आदेश , 1977 है ।
( 2) यह तुरन्त प्रवृत्त होगा ।
2. पटसन ( अनुज्ञापन और नियंत्रण ) आदेश , 1961 में,--
(i ) खण्ड 2 के उपखण्ड ( ग ) में, " किसी राज्य में " शब्दों का लोप किया जाएगा ;
( ii ) खण्ड 3 के उपखण्ड ( 1 ) में, निम्नलिखित परम्तुक जोडे जाएंगे , अर्थात्-
"परन्तु पटसन श्रायुक्त , राजपत्र में अधिसूचना द्वारा , इस उपखण्ड के उपबन्धों से ऐसे किसी व्यक्ति या ऐसे व्यक्तियों के वर्ग को छूट वे सकेगा:
परन्तु यह और कि पूर्ववर्ती उपबन्ध के अधीन ऐसी छूट देने में पटसम श्रायुक्त निम्नलिखित बातों का ध्यान रखेगा, अर्थात्:-
( i ) ऐसे व्यक्ति या ऐसे व्यक्तियों के वर्ग द्वारा चलाए गए कच्चे पटसन या पटसन वस्त्रों में कारबार का परिमाण ;
( ii ) ऐसे व्यक्ति या ऐसे व्यक्तियो के वर्ग के कब्जे में कच्चे पटसन या पटसन वस्त्रों की मात्रा भारत का असाधारण राजपत्र

( iii ) यह अवधि , जिसके लिए कच्चे पटसन या पटसम वस्त्रों के स्टाफ विक्रय या भण्डारकरण के प्रयोजनार्थ ऐसे व्यक्ति या ऐसे व्यक्तियोंके वर्ग द्वारा साधारणतः रोके रखे जाते हैं
( iv ) वेश में कच्चे पटसन या पटसम बस्त्रो की कीमत-स्थिति और उपलभ्यता-स्थिति; तथा
( v ) कोई अम्य सुसंगत कारक" ।
( iii ) खण्ड 9क के उपखण्ल ( 2 ) की मद ( ख ) के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात्:-
" (ख ) कच्चे पटसन की वह अधिकतम मात्रा, जो पटसन ( अनुज्ञापन और नियंत्रण) संशोधन आदेश , 1977 के प्रारम्भ के ठीक पूर्ववर्ती दो वर्षों की अवधि के दौरान विनिर्माता ने अपने कम्ज मे रखी हुई थी" ।
