New Delhi , the 15th December 1977
8.0. 840 (E ) /18A/IDRA/77.-Whereas the Central Government is of opinion that Bengal Chemical and Pharmaceutical Works Limited , Calcutta , an industrial undertaking in respect of which an investigation has been made under section 15 of the Industries ( Development and Regulation) Act 1951 ( 65 of 1951 ) , is being managed in a manner highly detrimental to public interest ;
Now, therefore , in exercise of the powers conferred by section 18A of the said Act, the Central Government hereby authorises the body of persons ( in this Order referred to as the Board of Management ) comprising : -

1. Sri A. B. Dasgupta, 127 , Jodhpur Park , Calcutta-702268.
Members
2. Shri P. K. Rudra, Manager , ( Planning and Personnel Services ), Engineers India Limited , New Delhi .
3.3. M. Sebgal , Representative of the Custodian of Undertakings of Smith, Stanistreet and Company Limited, Calqutia.
4. Shri K. K. Ray , Manager , Industrial Reconstruction Corporation of India, Calcutta .

to take over the management of the whole of the said undertaking , namely , Bengal Chemical and Pharmaceutical Works Limited , Calcutta , subject to the following terms and conditions , namely .
( i ) The Board of Management shall comply with all directions issued from time to time by the Central Government ;
( ii ) The Board of Management shall hold office for two years from the date of publication of the Order in the Official Gazette , and ( iii) The Central Government may terminate the appointment of any of the persons comprising the Board of Management earlier if it considers necessary to do so .
2 This Order shall have effect for a period of two years commencing on the date of its publication in the Official Gazette .

फा० प्रा० 840 ( प्र ) / 18 ए/ भाई ० डो ० ग्रार ० ए ०/ 77.-केन्द्रीय सरकार की राय है कि बंगाल कैमिकल एण्ड फार्मास्यूटिकल वर्क्स लिमिटेड कलकत्ता का, जो एक श्रौद्योगिक उपक्रम है और जिसकी बाबत उधोग ( विकास और विनियमन ) अधिनियम 1951 ( 1951 का 65 ) की धारा 15 के अधीन जांच की गई है , प्रबन्ध ऐसी रीति से किया जा रहा है जो लोकहित में बहुत ही अपायकर है ;
अतः अब , उक्त अधिनियम की धारा 18 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , व्यक्तिमों के ऐसे निकाय को ( जिसे इस आदेश मे प्रबन्ध बोर्ड कहा गया है ) और जिसमें निम्नलिखित सम्मिलित हैं, उक्त पूरे उपक्रम , अर्थात् बंगाल कैमिकल एण्ड फार्मास्यूटिकल बक्से लिमिटेड , कलकत्ता का प्रबन्ध अपने हाथ मे ले लेने के लिए प्राधिकृत करती है .

किन्तु यह प्रबन्धग्रहण निम्नलिखित निबंन्धनो और शर्तों पर होगा, अर्थात्: -
( i ) प्रबन्ध बोर्ड , केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए सभी निदेशा का पालन करेगा ;
( ii ) प्रबन्ध बोर्ड राजपत्र में इस आदेश के प्रकाशन को तारीख से 2 वर्ष तक के लिए अपना पद भार सम्भालेगा ; और
( iii ) केन्द्रीय सरकार प्रबन्ध बोर्ड के किसी भी सदस्य की नियुक्ति, यदि वह वैज करना आवश्यक समझती है तो, उसके पूर्व भी समाप्त कर सकती है ।
2. यह आदेश यो वर्ष की अवधि के लिए प्रवृत रहेगा जो राजपत्र में आदेश के प्रकाशन की तारीख को प्रारम्भ होगी ।
