SUBJECT --Addition of Clauses relating to the certificates of commissioning of the plants /commencement of production in the formats of legal agreements for fulfilment of export obligations
No. 118-1 ( PN ) /77.-Appendix 35 of the Import Trade Contro Hand Book of Rules & Pine , 1977-78, contams the format of legal agreements which are adopted for the purpose of execution of suen regal agreemegal agreeme its by limited Companies and Partnership / Proo " ctory Firms for undertaking to fulfil the export obligation conditions referred to therein Clause ( 2 ) of these formats appearing in Part I to Part VI of the said Appendix 35, contains a provision relating to the commencement of export obligation period which is connected with the commissioning of the plant and machinery/ commencement of production/ additional production , as the case may be , but there has been no provision specifying the time - schedule and the authouties for fournishing such certificates relating to the commissioning of plant and machinery/ commencement of production / additional production In order to make this procedure more complete and satisfactory , it has been decided to include the following provisions at the

end of Clause ( 2 ) of the formats of the legal agreements appearing in Part I to Part VI of the above - referred Appendix 35 , -
"The Company/ Firm shall undertake to furnish a certificate on its printed letterhead , giving the correct date of commissioning of plant and equirement against the Import Licence , signed by its Chief Engineer or Works Manager, as the case may be , and duly countersigned by the legally authorised person of the Company / Firm and under its Common Seal /Official Stamp , within 30 days from the date of such commissioning . "
OR
"The Company / Firm shall undertake to furnish a certificate on its printeprinted letterhead giving the correct date of commencement of production or additional production against the import licelicence for plant and equipment/ approval of foreign collaboration / licence under the Indus- try ( Development & Regulation ) Act , 1951 , or Letter of Intent , signed by its Chief Engineer or Works Manager , as the case may be , and auly countersigned by the legally authorised person of the Company / Firm and under its Common Seal / Official Stamp , within 30 days from the date of such commencement of production or additional pro- duction , "
2 The above said provisions will come into force with immediate effect In respect of the existing agreements also , the certificates , as referred to above , will be applicable.

विषय. निर्यात वायित्व की पूर्ति के लिए कानूनी करार के प्रपत्ल्लो में संयंत्रो को शुरु करने/ उत्पादन श्रारम्भ करने के प्रमाण - पत्र के सम्बन्ध मे धाराएं जोडना ।
सं० 118 -धाई ० टी ० सी ० ( पीएम ) / 77.-आयात व्यापार नियंत्रण नियम तथा क्रियाविधि लैंड बुक 1977-78 के परिशिष्ट 35 में कानूनी करार प्रपत्र है जिन्हे उनमे उल्लिखित निर्यात आभारो की शर्तों को पूरा करने के लिए वचनबद्धता के लिए लिमिटेड कम्पनियो एवं भागीदार/ स्वाम्यफर्म द्वारा ऐसे कानूनी करारो के निष्पादन करने के प्रयोजनार्थ अपनाया जाता है । उक्त परिशिष्ट 35 के भाग 1 से भाग 6 में दर्शाए गए इन प्रपत्त्रो की धारा ( 2 ) मे निर्यात आभार की अवधि के प्रारम्भ के सम्बन्ध मे एक व्यवस्था है जो संयंत्र एवं मशीनरी/ उत्पादन के आरम्भ/ अतिरिक्त उत्पादन जैसा भी मामला हो से सम्बन्धित है , किन्तु इनमे ऐसी कोई व्यवस्था नहीं जो समय सारणी एव संयंत्र एवं मशीनरी /उत्पादन के आरम्भ/ अतिरिक्त उत्पादन से सम्बद्ध ऐसे प्रमाण- पत्त्रों को प्रस्तुत करने के लिए प्राधिकारियो का उल्लेख करे इस क्रियाविधि को और अधिक पूर्ण और संतोषप्रद बनाने के लिए यह निश्चय किया गया है कि उपर्युक्त उल्लिखित परिशिष्ट 35 के भाग 1 से भाग 6 में दर्शाए गए कानूनी करारो के प्रपत्तो मे धारा ( 2 ) के अन्त मे निम्नलिखित व्यवस्थाएं जोडी जाएं :
" कम्पनी/ फर्म अपने प्रिन्टिड शीर्पनामा पर एक प्रमाण -पत्र जिस में आयात लाइसेंस के मद्दे संयंत्र एव उपकरण के आरम्भ होने की सही नारीख दी जाएगी और भाग 1-खं . 1

उक्त प्रमाण- पत्र जैसा भी मामला हो उनके मुख्य अभियता या कार्य -प्रबन्धक द्वारा हस्ताक्षरित हो और यह कम्पनी/ फर्म के कानूनी तौर पर प्राधिकृत व्यक्ति द्वारा उस की कामन सील/ आफिशियल स्टैम्प के साथ विधिवत् प्रति हस्ताक्षरित भी हो प्रारम्भ की तारीख से 30 दिनों के भीतर प्रस्तुत करने का वचन वेगी । "
या
"कम्पनी/ फर्म अपने प्रिन्टिड णीषनामा पर एक प्रमाण- पत्त्र, जिस मे उद्योग ( विकास एव विनियम) अधिनियम 1951 या आशय -पत्र के अधीन सयंत्र एवं उपकरण/ विदेशी सहयोग के अनुमोदन/लाइसेस के लिए आयात लाइसेंस के मद्दे उत्पादन या अतिरिक्त उत्पादन के आरम्भ होने की सही तारीख दी जाएगी और उक्त प्रमाण-पत्र जैसा भी मामला हो उनके मुख्य अभियन्ता या कार्य प्रबन्धक द्वारा हस्ताक्षरित हो और यह कम्पनी फर्म के कानूनी तौर पर प्राधिकृत व्यक्ति द्वारा उसकी कामन सील, आफिशियल स्टैम्प के साथ प्रति हस्ताक्षरित भी हो, ऐसे उत्पादन या अतिरिक्त उत्पादन की तारीख से 30 दिनो के भीतर प्रस्तुत करने का वचन देगी ।"
2. उक्त व्यवस्थाए तत्काल से ही लागू होगी । वर्तमान करार के सम्बन्ध में भी ऊपर उल्लिखित प्रमाण-पत्र लागू होगे ।
