STATEMENT OF OBJECTS AND REASONS

The Public Wakfs (Extension of Limitation; Act, 1959, as amended from time to time by Pariiamentai y legislation provided for the exten- sion of the period of limitation, in respect of suits for recovering posses- sum of immovable properties forming part of public wak£s which were under adverse possession, up to the 31st December, 1970. Further, in respect of the Union territory of Delhi, this limitation peried was further extended first up to the 31st December, 1972, and subsequently up to the 31bi December, 1975.

2 The extension in the period of limitation was primarily intended to enable the Wakt Boards constituted under the Waki Act, 1954 to insti- tute suits for the ifcovery of such properties after a survey of wakfs was made under Chapter II of the said Act. It has been reported by the Delhi Admnrstiatiori that it has not been possible to complete the survey of wakt pioperties an Delhi. Unless the survey is completed and the ultmvi+e findings arc known, it will not be possible for the Delhi Waki Board to institute legal proceedings for the recovery of possession of such propei ties Under the circumstances, it is deemed expedient to extend the limitation period in the Union terntory of Delhi up to 31st December, • : ,/fl 1980
