New Delhi , the 23rd December 1977
S. O. 852 ( E ) ./ 18AA/ IDRA/ 77.- Whereas the Central Government is satisfied from the documentary evidence in its possession that the undertaking of Messrs National Rubber Manufacturers Limited , Calcutta ( hereinafter referred to as the sand industrial undertaking ) has been closed for a period of not less than three months and that such closure is prejudicial to the concerned scheduled industry , namely , Rubber Goods industry and that the financial condition of the company wning the said industual undertaking and the condition of the plant and mach- inery of the said undertaking are such that it is possible to restart the undertaking and such restarting is necessary in the interests of the general public ;
Now , therefore , an exercise of the powers conferred by clause ( b ) of sub- section ( 1 ) of section 18AA of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) the Central Government hereby authorises a body of persons (hereinafter referred to as the 'Authorised Person' ) consisting of-

to take over the management of the said industrial undertaking , subject to the following terms and conditions , namely
( 1 ) the authorised person shall comply with all directions issued from time to time by the Central Government ,
( 2 ) the authorised person shall hold office for a period of five years from the date of publication of this Order in the Official Gazette , and ( 3 ) the Central Government may terminate the appointment of the authori- sed person , earlier , if it considers it necessary to do so
This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette

फा० प्रा० 852 ( प्र) / 18 फक/ आई डी ब्रार ए/ 77.--केन्द्रीय सरकार कॉ समाधान हो गया है कि उसके पास जो दस्तावेजी साक्ष्य है उससे उसका समाधान हो गया है कि मैसर्स नैशनल रबर मैन्यूफैकचरर्स लिमिटेड, कलकत्ता नामक उपक्रम ( जिसे इसमें इसके पश्चात् उक्त औद्योगिक उपक्रम कहा गया है ) कम से कम तीन मास से बन्द कर दिया गया है और उसे बन्द करने से अनुसूचित उद्योग अर्थात रबड के सामान के उद्योग पर प्रति- कूल प्रभाव पड़ता है , और उस कम्पनी की, जो उक्त औद्योगिक उपक्रम की स्वामी है , वित्तीय स्थिति तथा उक्त उपक्रम के संयंत्र और मशीनरी की दशा ऐसी है कि उपक्रम को फिर से चालू करना संभव है और सामान्य जनता के हित में इस प्रकार उपका फिर से चालू किया जाना आवश्यक है ,
अतः , अब , केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 कक की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , व्यक्तियो के एक निकाय को ( जिसे इसमे इसके पश्चात् प्राधिकृत व्यक्ति कहा गया है ) और जिसमे निम्नलिखित व्यक्ति होगे

उक्त औद्योगिक उपक्रम के प्रबन्ध को निनलिखित निबन्धनों और शतों पर, अपने हाथ मे ले लेने के लिए प्राधिकृत करती है, अर्थात्:-
( 1 ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय -समय पर जारी किए गए सभी निदेशो का अनुपालन करेगा ;
( 2 ) प्राधिकृत व्यक्ति राजपत्त्र में इस आदेश के प्रकाशन की तारीख से पांच वर्ष तक के लिए पद धारण करेगा;
( 3 ) केन्द्रीय सरकार , यदि वह वैसा करना आवश्यक समझे तो, इससे पूर्व भी प्राधि- कृत व्यक्ति की नियुक्ति को समाप्त कर सकती है ।
होगा । 2. यह प्रादेश राजपत्त्र में प्रकाशन की तारीख से पांच वर्ष तक के लिए प्रभावी
