(Department of Industrial Development) का०ओ० 6( अ) - केन्द्रीय सरकार, उद्योग ( विकास और विनि- यमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18छ मौर 25 द्वारा प्रवस शक्तियो का प्रयोग करते हुए, सीमेंट नियंत्रण आदेश , 1967 में और संशोधन करने के लिए निम्नलिखित भ्रादेश करती है , अर्थात्
ORDER
1. ( 1 ) इस आदेश का संक्षिप्त नाम सीमेंट नियंत्रण (संशोधन) आदेश , 1978 है ।

(2) यह तुरम्त प्रवृत्त होगा ।
S.O. 6(E) . In exercise of the powers conferred by Sections 18-G and 25 of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government hereby makes the following order further to amend the Cement Control Order , 1967 , namely :
2. (क) सीमेंट नियंत्रण भावेश , 1967 के नियम 8 के उपनियम (क) (जिसे इसके बाद उक्त प्रादेश प्रयोग किया जायेगा) में अंक "263 65 को अक " 280.65" से प्रतिस्थापित किया जायेगा ।
1. ( i ) This order may be called the Cement Control (Amendment ) order , 1978 .
(ख) उक्त आदेश के नियम 8 के उपनियम (ख ) में अंक " 254 65" को अंक " 271.65 " से प्रतिस्थापित किया जायेगा ।
(ii) It shall come into force with immediate effect .
( ग) उक्त श्रवेश के नियम 8 के उप -नियम ( ग) में अंक " 231 65 को अक " 248. 65 " से प्रतिस्थापित किया जायेगा
2. ( a) In sub-clause ( a) of clause 8 of the Cement Control Order, 1967 (hereinafter referred to as the said order) for the figure " 263.65 " the figure " 280.65 " shall be substituted.
3. सीमेट नियंत्रण आदेश , 1967 में , खण्ड 11 के उपखण्ड ( 2 ) , में, मद ( ii ) के स्थान पर निम्मलिखित मव रखी जाएगी , अर्थात्ः
(b) In sub -clause (b) of clause 8 of the said order , for the figure " 254.65" the figure " 271.65" shall be substituted .
"( ii ) कीमत, भाड़ा या सरकार या जनता को प्रदाय के विषय में या खण्ड 8 के द्वितीय पुस्तक के अधीन निर्यात के प्रयोजनों

(11) (c) In sub -clause ( c) of clause 8 of the said order, for the figure "231.65 " the figure " 248.65" shall be substituted.

3. In the Cement Control order , 1967 , in sub-clause (2) of clause 11, for item ( ii ) , the following item shall be substituted namely :--
"(ii ) equalising concession , if any, granted in the matter of price , freight, supplies to Government or public or for purposes of export under the second proviso to clause 8 or for import .

श्रादेश
का ०आ० १ ( प्र):-केन्द्रीय सरकार, आवश्यक वस्तु अधिनयम, 1955 ( 1955 का 10) की धारा 3 द्वारा प्रवत्त शक्तियो षा प्रयोग करते हुए, निलिखित आदेश करती है, अर्थात्
1 मक्षिप्त नाम, विस्तार और प्रारम्भ
( 1 ) इम श्रावेण का मक्षिप्त नाम आयातित सीमेट नियंत्रण आदेश 1978है ।
(2) इसका विस्तार सम्पूर्ण भारन पर है ।
( 3 ) यह तुरन्त प्रवृत्त होगा ।
2. परिभाषाए
हम आवेश में, जय तक कि संदर्भ से अन्यथा अपेक्षित न हो-
(क) "सीमेट" से भारम मे श्रायानित किमी भी प्रकार का सीमट अभिप्रेत है किन्तु इसमे तेल- कुछ मीभेन्ट और श्वेत सीमेन्ट और रगीन मीमेन्ट ( धूमर पोर्टलैण्ड सीमेन्ट से भिन्न) सम्मि लित नही है ;
(ख) " नियंत्रक " में मीमेट नियत्रण आवेश , 1967 के अधीन नियुक्त नियंत्रक या ऐसा कोई अन्य अधिकारी अभिप्रेत है, जिस केन्द्रीय सरकार ने राजपत्र में अधिसूचना द्वार। , उस रूप में सम्यक् रूप से निगुक्त किया है ,
(ग) " अभिकर्ता" से भारतीय राज्य व्यापार निगम लिमिटेड या ऐना कोई व्यक्ति श्रभिप्रेत है, जो राज्य व्यापार निगम से मीमेंट प्राप्त करता है , किन्तु इसमे ऐमा कोई व्यक्ति या व्यक्तियो वा वर्ग सम्मिलित नही है जो खण्ड 3 के अधीन सोमेट प्राप्त करना है ,
(घ) "व्यवहारी" से अभिकर्ता में भिन्न ऐसा कोई व्यक्ति भिप्रेत है जो थोक या फुटकर, मीमेट के विक्रय का कारबार करता है ।
3 विक्रय या परिवहन कारने का निदेश देने की शक्ति
( 1 ) काई अभिकर्ता, केन्द्रीय सरकार की लिखित पूर्व-अनुज्ञा के बिना , सीमेट न तो वेवेगा और न बेचने की अनुशा वेगा ।
( 2) केन्द्रीय सरकार , भादेश द्वारा , किसी अभिकर्ता से यह अपेक्षा कर सकती है कि वह सीमेंट का विक्रय ऐसे व्यक्ति या व्यक्तियों के वर्ग को करे या विक्रय के लिए सीमेंट का परिवहन , ऐसे व्यक्ति या व्यक्तियो के वर्ग को, या ऐसे गन्तव्य स्थानों को परिवहन के उम तरीके से, और ऐसे निबन्धनो और शर्तों पर करे जो इस निमित्त विनिर्दिष्ट की जाएं ।
4 रटाको का व्ययन करने का निवेश देने की शक्ति
खण्ड 3 में श्रन्तविष्ट उपबन्धो पर प्रतिकूल प्रभाव डाले बिना, केन्द्रीय सरकार , सीमेंट के स्टाको के उचित वितरण और व्ययन को सुनिश्चित करने की दृष्टि से, किसी अभिकर्ता को इस बारे में ऐसे, साधारण या विशेष आदेश दे सकेगी जो आवश्यक हो ।
5. लेखानों आदि का रखना और प्रस्तुत करना:
( 1) प्रत्येक अभिकर्ता , सीमेंट को प्राप्त करने , बेचने, हटाने या उसका परिवहन करने के सम्मान्ध में ऐसी पुस्तके, लेखा और श्रभिलेख रखेगा , जैसी केन्द्रीय सरकार अपेक्षा करे , और
( 2) प्रत्येष अभिकर्ता भौर सीमेट को प्राप्त करने , बेचने, हटाने या उसका परिवहन करने के संबन्ध में ऐसे अभिकर्ता द्वारा नियोजित प्रत्येक व्यक्ति , केन्द्रीय सरकार द्वारा वैसा करने की अपेक्षा की जाने पर और ऐसी अवधि के भीतर जिसकी इस निमित्त अनुशा दी जाए,--
(क) सीमेंट प्राप्त करने , बेचने , हटाने और उसके परिवहन के कार- बार से सम्बन्धित ऐमी पुस्तके , लेखा, अभिलेखा या अन्य दस्त। वेजें प्रस्तुत करेगा और निरीक्षण के लिए उपलब्ध कराएगा ; और
(ख) ऐसे फारबार से सम्बन्धित ऐसी विवरणिया और अन्य जान- कारी देगा जो केन्द्रीय सरकार द्वार। विनिदिष्ट की जाए ।
6 कीमत जिस पर अभिकर्ता सीमेंट का विश्य कर गकेगा :
प्रत्येक अभिकर्ता स्वय या अपनी ओर से किसी व्यक्ति द्वारा पैक्ड सीमेट का। विक्रय रेल गतव्य स्थान रेलवे स्टेशन तक नि शुल्क प्रति मीटरी टन 355.28 ६० पर कर सकेगा
परन्तु केन्द्रीय सरकार , पूति श्रौर व्ययन महानिदेशालय के माध्यम से सरकार को बेचे गए सीमेट की कीमत में रिमेट , छूट या कमीशन की अनुशा दे सकेगी :
परन्तु यह और कि अभिकर्ता द्वारा, ऐसे सव्यवहारों की वाथन, परिवहम की सबसे सस्ती पद्धति द्वारा या जहा केन्द्रीय सरकार द्वार। खण्ड 3 के अधीन परिवहन की कोई अन्य पद्धति विनिदिष्ट की गई हैं। वहा परिवहन की ऐसी पद्धति द्वारा, भाडे पर जागत व्यय की प्रतिपूर्ति केन्द्रीय सरकार द्वारा अभिकर्ता को की जाएगी ।
स्पष्टीकरण इस खण्ड के प्रयोजन के लिए, 'रेल गतव्य स्थान रेलने स्टेशन तक निशुल्क" श्रभिव्यक्ति से अभिप्रेत है गतव्य स्थान पर कीमत जिसमें वहां के सिवाय जहां केन्द्रीय मरकार द्वारा परिवहन की कोई अन्य पद्धति विनिविष्ट की गई है, फेन्द्रीय सरकार द्वार । परिवहन व्यव सम्मि सित है ।
7. थोक और फुटकर कीमत
(1) अधिकतम कीमत जिस पर मोमेट किसी व्यवहारी द्वारा (थाक या फुटकर) बेचा जाएगा वह कीमत होगी , जो राज्य सरकार द्वारा नियत की जाए , और कोई व्यवहारी सीमेट का ( योक या फुटकर ) विक्रय ऐसी अधिकतम कीमत से अधिक कीमत पर नहीं करेगा और
( 2) उपखण्ड ( 1 ) के अधीन अधिकतम कीमत नियत करने में, राज्य सरकार निम्नलिखित का ध्यान रखेगी-
( i) खण्ड 6 के अधीन नियत कीमत ;
(ii ) उठाने धरने और परिवहन के प्रभार ;
( iii) गोदाम प्रभार ;
( iv) व्यवहारी की लाभ की माता ;
(v ) स्थानीय कर, यदि कोई हो ; श्रीर
(vi) अतिरिक्त सड़क परिवहन प्रभार , जहा अनुशात हो ।
परन्तु मद ( ii ) , ( iii) और ( iv) की बावत प्रभार , केन्द्रीय सरकार के पूर्व अनुमोदन के सिवाय, प्रति मीटरी टन बीस रुपये से अधिक नही होगा ।

8. प्रत्यायोजन:
इस आदेश के अधीन खण्ड 6 के अधीन के सिवाय , केन्द्रीय सरकार द्वारा प्रयोक्तभ्य सभी शक्तियों का प्रयोग नियंलक द्वारा भी किया जाएगा ।

ORDER
S.O. 7 (E) . In exercise of the powers conferred by Section 3 of the Essential Commodities Act , 1955 ( 10 of 1955) , the Central Government hereby makes the following Order , namely :-
1. Short title , extent and commencement.( 1 ) This Order maybe called the Imported Cement Control Order , 1978 .
(2) It extends to the whole of India.
(3) It shall come into force with immediate effect .
2. Definitions . In this Order , unless the context otherwise requires-
( a) ' Cement' means any variety of cement imported into India but does not include oil- well cement and white cement and coloured cement ( other than grey port- Jand cement ) ;
(b) 'Controller ' means the Controller appointed under the Cement Control Order , 1967 or any other officer duly appointed as such by the Central Government by Notification in the Official Gazette;
(c) ' Agent ' means the State Trading Corporation of not India Limited or any person who acquires cement from the State Trading Corporation but does include a person or class of persons who acquire ( s ) cement under clause 3 .
(d) ' dealer' means any person other than an Agent , carry- ing on the business of selling cement, whether who'e- sale or retail .
3. Power to direct sale or transport .-( 1 ) No Agent shalt sell or permit the sale of cement except with the previous permission in writing from the Central Government .
( 2) The Central Government may , by order , require any Agent to sell cement to such person or class of persons or to transport cement for sale to such person or class of persons or to such destinations by such mode of transport and on such terms and conditions as may be specified in this behalf .
4. Power to direct disposal of stocks . Without projudice to the provisions contained in clause 3 , the Central Government may, with a view to securing proper distribution and disposal of stocks of cement , issue such orders , general or special , as may be necessary , to any Agent in this regard .
5. Maintenance and Production of accounts , etc.( 1 ) Every Agent shall keep such books , accounts and records relating to the acquisition, sale , removal and transport of cement as the Central Government may require ; and
(2) Each Agent and every person employed by such Agent in connection with the acquisition , sale, removal and trans- port of cement shall, on being required so to do by the Central Government and within such period as may be allowed in this behalf-
(a) produce and make available for inspection such books , accounts , records or other documents relating to the business of acquisition , sale , removal and transport of cement; and
(b) furnish such returns and other information relating to such business ;
as may be specified by the Central Government .
6. Price at which Agent may sell cement :
Every Agent shall , himself or by any person on his be- half, sell packed cement at Rupees 355.28 per metric tonne free on rail destination railway station.
Provided that the Central Government may allow rebate , discount or commission in the price of cement sold to the Government through the Directorate General of Supplies and Disposals.
Provided further that the expenditure incurred by the Agent on freight by the cheapest mode of transport or where any other mode of transport has been specified by the Central Government under clause 3 , by such mode of transport in respect of such transactions , shall be reimbursed to the Agent by the Central Government .
Explanation :
For the purposes of this clause , the expression 'free on rail destination railway station' means the price ( including the cost of transport by the cheapest mode except where any other mode of transport has been specified by the Cen- tral Government under clause 3 ) at the destination point .
7. Wholesale and retail prices :
(1) The maximum price at which cement may be sold by a dealer ( whether wholesale or retail ) shall be such as may be fixed by the State Government and no dealer shall sell cement ( whether wholesale or retail ) exceeding such maximum price; and
(2) In fixing the maximum price under sub- clause ( 1 ) , the State Government shall have due regard to-
( i ) the price fixed under clause 6 ;
( ii ) handling and transport charges ;
( iii) godown charges ;
( iv) dealer's margin of profit ;
( v) local taxes , if any ; and
( vi) additional road transport charges where allowed.
Provided that the charges in respect of items ( ii ) , ( iii ) and ( iv) shall not exceed rupees twenty per metric tonne except with the prior approval of the Central Government .
8. Delegation :
All powers exercisable by the Central Government under this Order except under clause 6 shall also be exercisable by the Controller .
