का० प्रा ० 20 ( अ) / 18 चख/उ ०/ वि० वि० श्र/ 78.- केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 चख की उपधारा ( 1 ) के खण्ड (क) और ( ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के उद्योग मन्त्रालय (प्रौद्योगिक विकास विभाग ) , के आदेश सं ० का ० श्र ० 39 ( अ) / 18 चख/उ ० वि० वि ० प्र० /77 तारीख 22 जनवरी , 1977 द्वारा (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) यह घाषणा की थी कि -
(क ) औद्योगिक वियाद अधिनियम , 1947 ( 1947 का 14 ) , इन अनुकूलनों सहित कि

उक्त अधिनियम की धारा ५ क, अध्याय 5क और 5व और धारा 3.3 ग का लोप किया जाएगा , मैसर्स बंगाल पाटरीज लिमिटेड , कलकता के स्वामित्वाधीन दो श्रीश्योगिक उपक्रमो को लागू होगा, और
(७) राजपत्र मे उक्त आवेश के प्रकाशन की तारीख से ठीक पूर्व प्रवृप्त ऐसी सभी सविदाओं , संपत्ति के हस्तान्तरण -पत्तों, करारो , व्यवस्थापनो, पंचाटो , स्थायी आदेशो या अन्य लिखतों का प्रवर्तन, उनसे भिन्न जिनका संबंध बैंको और वितीय संस्थाओ के प्रतिभूत वायित्वों से है ) , जिनके उक्त औद्योगिक उपक्रम पक्षकार है या ऐसे श्रौद्योगिक उपक्रमो की स्वामी कम्पनी पक्षकार है या जो, यथास्थिति, उन औद्योगिक उपक्रमो या कम्पनी को लागू होते हों, और उक्त तारीख के पूर्व उनके अधीन , प्रोद्भूत या उद्भूत सभी या कोई अधिकार , विशेषाधिकार , बाध्यताए , और दायित्व निलम्बित रहेंगे;
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त भादेश को एक वर्ष की और अवधि तक बढ़ाया जाना चाहिए;
अतः , भष , केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18चख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) के खण्ड ( क ) और ( ख) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, उक्त भादेश की भवधि 21 जनवरी , 1979 तक के लिए, जिसमें यह तारीख भी सम्मिलित है , बढ़ाती है ।

ORDER
New Delhi , the 16th January , 1978
S.O. 20 (E ) /18FB/IDRA/78.-Whereas by the Orde rof the Government of India in the Ministry of Industry (Department of Industrial Developn.ent ) No. S.O. 39 ( E ) / 18FB / IDRA / 77 dated the 22nd January , 1977 , ( hereinafter referred to as the said Order) , the Central Government in exercise of the powers con- ferred by clauses (a) and (b) of sub - section ( 1 ) of section 18FB of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , declared that
(a) the Industrial Disputes Act , 1947 ( 14 of 1947) , shall apply to the two industrial undertakings owned by Messrs . Bengal Potteries Limited, Calcutta , with the adaptations that section 9A , Chapters VA and VB and section 33C of the said Act shall be omitted ; and
(b) the operation of all contracts , assurances of property , agreements , settle- ments , awards , standing orders or other instruments in force immediately before the date of publication of the said Order in the Official Gazette ( other than those relating to secured liabilities to banks and financial instituumons ) to which the said indus dustrial undertakings are parties , or the company owning such industrial under- takings is a party or which may be applicable to the industrial undertakings or the company as the case may be, and all or any of the rights , privileges , obligations and liabilities accruing or arising thereunder before the said da'e shall remain suspended ;

And , whereas , the Central Government is satisfied that the said Order should be extended for a further period of one year ;
Now, therefore , in exercise of the powers conferred by clauses ( a) and ( b ) of sub- section ( 1 ) , read with section ( 2 ) , of section 18FB of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto and inclusive of the 21st January , 1979 .
