विषयः नयभ्बर 1977 से अक्तूबर , 1978 के दौरान फलों , मेये , नमकीन अथवा हर प्रकार के परिरक्षित खजूरों को छोड़कर अन्यथा जो उल्लिखित नहीं है (क्रम संख्या 08.01/ 13 ( 3 ) , ( 2) खजूर क्रम संख्या-08.01/ 13 ( 4 ) , ( 3 ) श्रौषधीय बूटियां ( अपरिष्कृत श्रौषधियां ) त्रम संख्या-12.07 ) , ( 4) हींग (श्रम संख्या-13.01/ 03 ( 5 ) तथा अन्य विविध मदों का ईरान से आयात ।
मिसिल सं ० बाई 2/1/77 पालिसीं- प्रस्तुत सार्वजनिक सूचना के अनुबन्ध 1 के लिए दिखाई गई मदों में से हर एक झलग मद के लिए नवम्बर, 1977 से अक्तूबर , 1978.की अवधि के लिए संस्थापित आयातकों को , जिन्होंने निहित आधार भूत वर्ष में आयात किया था, ईरान से विभिन्न पदार्थों के आयात के लिए लाइसेंस देने का निश्चय किया है । हर एक मव के लिए लाइसेंस देने की नीति वणित अनुबन्ध के कालम 6 में बताई गई है ।
2. वर्तमान श्रायात नीति के अन्तर्गत पात्र संस्थापित आयातकों को चाहिए कि वे अपना आवेदन पत्त्र संबन्धित लाइसेंस जारी करने वाले प्राधिकारी अर्थात्, गंयुक्त मुख्य नियंत्रक , आयात- निर्यात, बम्बई या संयुक्त मुख्य नियंत्रक ( केन्द्रीय लाइसेंस क्षेत्र ) नई दिल्ली को विहित प्रपत्र में घौर विधिरूप से 25 फ़रवरी 1978 तक अथवा उससे पहले भेज दें । पिछले किए गए श्रायात से सम्बद्ध दस्तावेजों को प्रस्तुत करने की आवश्यकता नहीं है, बशर्ते कि उन वस्तावेजों का सम्बद्ध लाइसेंस प्राधिकारी को ईरान से पदार्थों के भ्रायात लाइसेंसों के लिए, जिन पदार्थों का उल्लेख अनुबन्ध-1 में किया गया है, पहले भेजा गया था और वे मंजूर कर लिए गए थे । परन्तु उनके लिए यह आवश्यक होगा कि उन्होंने पूर्वतः दो अवधियों में जो लाइसेंस लिए थे, उनका ब्यौरा दें, परन्तु जहां संस्था- पित भ्रायातक पहली बार पत्र भेज रहे है , उन्हें चाहिए कि विहित आधार पर भूत वर्ष में से किसी भी एक वर्ष में ईरान से श्रायात की गई मदों का , जिनका ब्यौरा अनुबन्ध-1 में दिया गया है, उससे संबन्धित संशयातीत वस्तावेजों को प्रस्तुत करे ।
3. यह भी निश्चय किया गया है कि ऐसे भ्रायातक, जो प्रस्तुत सार्वजनिक सूचना के अनुबंध-2 के अन्तर्गत योग्य है, उन्हें केवल ईरान से प्रत्येक 8,500/ रुपए के समान मूल्य के आधार पर सूखे फ़लों के आयात के लिए लाइसेंस भी दिए जाएंगे । उन्हें चाहिए कि वे नवम्बर, 1977 से अक्तूबर, 1978 की लाइसेंस अवधि के लिए ईराम से केवल सूखे फ़लों के आयात के लिए आवेदन-पत्तों को हर प्रकार से पूरा करके विहित प्रपत्व में और विधिरूप से संयुक्त मुख्य नियंत्रक, भायात- निर्यात ( केन्द्रीय लाइसेंस क्षेत्र ) नई दिल्ली को 25 फ़रवरी , 1978 तक अथवा उससे पहले भेज दें ।
4. सूखे फ़लों के लिए लाइसेंसों का न्यूनतम मूल्य 8,500 रुपए होगा । खजूर, हींग और गोंद तथा रेजिन्स जो कोटा प्रतिशतता के आधार पर लाइसेंस के योग्य है, उनके लिए वर्ष के लिए लाइसेंस का भ्यूनतम मूल्य 1000 रुप होगा । लेकिन इस बात का स्पष्टीकरण किया जाता है कि उपयुक्त मामलों से संबंधित स्थापित श्रायातकों द्वारा कोटा के स्थानान्तरण/विभाजन की स्थिति में आयात व्यापार नियंत्रण नियम और कार्य विधि, हैण्ड बुक-1977-78 की कंडिका 45 ( 2 ) में दी गई व्यवस्थाओं के अनुसार अनुवर्ती पटियो मूल उद्योग के स्वीकृत कोटे में से अपने हिस्से के अनुपात में लाइसेंस प्राप्त करने के अधिकारी होगी । प्रस्तुत सार्वजनिक सूचना के अनुसार जहां समान मूल्य के आधार पर लाइसेंस दिए जाते है, कौटा अधिकारी के स्थानातरण/विभाजन होने की स्थिति में मूल उद्योग से संवन्धित विपाटी के भीतर हर एक पार्टी के हक का अनुपातिक रूप से आबंटन किया जाता है ।

5. यह ध्यान रहे कि सूखे फल जो अनुबन्ध-1 तथा2 दोनों के अन्तर्गत आयात के लिए अनुशन्त है , इनके सम्बन्ध में दोनों प्रकार के लाभ नहीं विए जाएंगे । सूखे फलों के आयात करने वाले आवेदकों को वाहिए कि वे या तो अनुबन्ध की शतों के अनुसार अथवा अनुबन्ध-2 की शर्तों के अनुसार केत्रल एक ही आवेवनपत्तन भेजें और उन्हें चाहिए कि वे अपने आवेदनपत्रों में स्पष्ट रूप से लिख दें कि उन्होंने केवल एक के लिए आवेदन -पत्र भेजा है न कि दोनों के लिए ।
6 सामान्य मुद्रा क्षेत्र , जिसमें ईरान मम्मिलित है, से अपरिष्कृत भेषजों के लिए कोटाधारी संस्थापित श्रायातक ओ इस नीति के अन्तर्गत लाइसेंस प्राप्त करने के इच्छुक है, उनके लिए यह अनिवार्य है कि जिस वर्ष के लिए उनके पास सामान्य मुद्रा क्षेत्र के लिए कोटा प्रमाण है , उससे भिन्न किसी एक मूल वर्ष में, भूतकाल में उन्होंने ईरान से अपरिष्कृत भेषजों का आयात किया हो । श्म सम्बन्ध में , लाइसेंम प्राधिकारी को साध्य प्रस्तुत करना चाहिए जिम से कि भूतकाल में किए गए एक ही प्रकार के आयातों के लिए वो तरफ़ा लाभ उपार्जित नकिया जाए ।
7. हर एक मद की निश्चित मौद्रिक सीमा के भीतर ही लाइसेंस दिया जाएगा । सभी देर से आने वाले अधूरे आबेदम-पत्रों को अस्वीकृत कर दिया जाएगा ।
8. वैध मामलों में दिए जाने वाले श्रवात लाइसेंसों का ईरान से नौव्रस्थान पोतों अथवा मागों से श्रायात के लिए वैध माना जाएगा। भूखे फलों के मामले में, लाइसेंसों के पूरे अंकित मूल्य तक पोतनाव द्वारा आयात करने की इजाजत होगी और ऐसे आयातों का प्राधार लागत -वीमा- भाड़ा होगा । यदि लाइसेंसों की वैधता अवधि के समय लाइनेंसधारी किसी समय ऐमा चाहे तो खजूरों के मामले में श्रायात स्थल मार्ग , मावपोतो या किसी भी देश के पोतों- जो भी पहले उपलब्ध हो उसी के द्वारा किया जा सकता है ।
9. प्रस्तुत सार्वजनिक सूचना के विषय में जारी किए गए लाइसेंस 31 अक्तूबर 1978 तक वैध होंगे तथा भविष्य में अनकी अवधि नहीं बढ़ाई जाएगी ।
10. अप्रैल , 77-मार्च , 78 अवधि के लिए श्रायात व्यापार नियंत्रण मीति पुस्तक (वा०-1 ) के खण्ड-1 की फंडिका 1.20 में दी गई व्यवस्थाएं जो लाइमेसों के न्यूनतम तथा यधिकतम मूल्य से संबंधित है, इस सार्वजनिक सूचना के अनुसार जारी किए गए लाइसेंसों के लिए लागू नहीं होगी ।
11. हींग के आयातकों का ध्यान खाद्य मिलावट निरोधक नियमों की ओर विलाया जातः है और अनके निजी हित के लिए उन्हें यह सुनिश्चित करने की सलाह दी जाती है कि ईरान से आयात किया हींग पूर्वोक्त नियमों के अन्तर्गत निर्धारित विशिष्टिकरण के अनुसार हो । यह सुनिश्चित करने के लिए कि आयतकों द्वारा आयात किया गया हींग निर्धारित मानम के अनुरूप है, पत्तन पर स्वास्थ्य संगठन हींग के प्रत्येक परेषित माल का परीक्षण करेगा । प्रत्येक बार परेषित माल का परीक्षण करने के बाद पत्तन स्वास्थ्य संगठन प्रपनी निजी सील के अन्तर्गत हींग के थैलों को सीलबंध करेगा । इन थैलों को राज्य/स्थानीय निकायों द्वारा आगे तब तक परीक्षण करने की आवश्यकता नहीं है, जब तक कि अनकी सील सम्पूर्ण है और जब तक विशेष कारणों से यह साध्य नहीं मिलता है कि अममें सम्मिश्रण किया गया है ।
12. इस सार्वजनिक सुचना से आयात व्यापार नियंत्रण नीति पुस्तक ( वा०-1) 1977-78 के परिशिष्ट 2 में श्राने वाली स्वतंत्र लाइसेंस योजना के अधीन खजूर और सूखे फलों के आयात से सम्बद्ध नीति पर कोई प्रभाव नहीं पड़ेगा ।

( 2) उन संस्थापित आयातक श्रायातकों को जिन्होंने साजे फलों का आयात 1951-52 से लेकर 1970-71 तक की अवधि के दौरान किसी सामान्य क्षेत्र में भाने वाले देशों में अफगानिस्तान को छोड़कर किन्तु पाकिस्तान शामिल है , अपने खाते से किया हो ।
( 3) उन संस्थापित आयातकों को जिनका ताजे फलों का श्रायात 1945-46 से 1950-51 की अवधि के दौरान किसी सामान्य क्षेत्र से श्राने वाले देशों में अफ- गानिस्तान को छोड़कर जिसमें पाकिस्तान शामिल है , अपने खाते से किया हो, बशर्ते कि 1960-64 की अवधि के दौरान पाकिस्तान से किये जाने वाले तदर्थ ताजे फलों के चायात लाइसेंसों को लाइसेंरा प्राधिकारी मंजूर कर लिया था । ने 72

( 4) उन संस्थापित आयातकों को जिनका सूखे फलों का आयात 1951-52 से लेकर 1970-71 की अवधि के दौरान उनके खाते में हो ।
( 5 ) ताजा फलों का व्यापार करने बाली सहकारी समितियों को निम्नलिखित प्रस्तुत करने पर:-
(क) सम्बद्ध सहकारी समितियों के पंजीयक से इस सम्बन्ध में एक प्रमाण-पत्र कि सहकारी समितियां अभी भी विद्यमान हैं;
(ख) संलग्न प्रपत्त में एक शपथ- पत्त देखें अनुबन्ध-3
(ग) सनवी लेखापाल से इस संबंध में एक प्रमाणपत्र कि वित्तीय वर्ष 1967-68, 1968-69, 1969-70, 1970-71 एवं 1971-72 के दौरान समिति का ताजे फलों का व्यवसाय 15,000 रु ० ( पन्द्रह हजार रुपये) से कम महीं था ।
यवि उपर्युक्त उप-कंडिका ( ग) में यथा संवभित एक प्रमाण-पत्र भूत में प्रस्तुत कर दिया गया था और यह ईरान से सूखे फलों के आयात के लिये लाइसेंस जारी करने के लिये लाइसेंस प्राधिकारी द्वारा स्वीकार कर लिया गया था, उसकी फोटोस्टेट कापी या प्रति जो शपथ भायुक्त या नोटरी पब्लिक या प्रथम श्रेणी के मजिस्ट्रेट या राजपत्रित अधिकारी द्वारा विधिवत् सत्यापित की गई हो , आवेदन -पक्ष के साथ भेजें ।

2. कि यदि उपर्युक्त पैरा ( 1 ) में उल्लिखित घोषणा गलत या झूठी पाई जाती है तो इस घोषणा के आधार पर पूर्वोक्त सहकारी समिति को प्रदान किया गया कोई भी लाइसेंस सरकार द्वारा आरोपित किसी भी वण्ड या यथा संशोधित श्रायात और निर्यात ( नियंत्रण ) अधिनियम और भायात (नियंत्रण) अधिनियम भौर आयात (नियंत्रण ) आदेश, 1955 के अधीन की जाने वाली किसी अन्य कार्रवाई को ध्यान में रखे बिना रद्द कर दिया जायेगा ।

5. It maybe noted that no double benefit will be given in respect of dry fruits , which is permitted for import both under Annexure I and Annexure II . The applicants for dry fruits should submit only one application either in terms of An- nexure I or in terms of Annexure II, and they should clearly mention in their application that they have applied in one capacity only and not under both.
Subject . Import of fruits ,dried , salted or preserved all sorts , n.o.s. excluding dates ( S. No. 08.01 / 13 ( 3 ) , ( ii) dates ( S. No. 08.01 /13 ( 4) ( iii ) medi- cinal herbs ( crude drugs) (S. No. 12.07 ) , ( iv ) asafoetida ( S. No , 13.01 /03 ( 5 ) and other miscel- laneous items from Iran during November , 1977 October , 1978 period .
6. Established importers , holding quota certificates for crude drugs on General Currency Area, which includes Iran , who are desirous of claiming licences under this policy have to have past imports of crude drugs from Iran in a different basic year than the one for which they hold quota certificates on General Currency Area , Evidence to this effect should be produced to the licensing authority , so that no double benefit accrues in respect of the same past imports .
7. Licensing will be done within the monetary limit fixed for each item . All late/ incomplete applications are liable to be rejected.
10 File No. 2/ 1 / 77 -Pol I. It has been decided grant licences for import of various commodities from Iran during November 1977 -October 1978 period to the established importers , having past imports within the prescribed basic years , as shown against each item in Annexure I to this Public Notice. The licensing policy for each item has been indicated in col. 6 of the aforesaid an- nexure .
8. Import licences granted in eligible cases will be valid for import from Iran either by sailing vessels or land route. In the case of dry fruits , import will be allowed by steam- ships upto the full face value of the licences and such im- ports will be on c.i.f. basis . In the case of dates , import may be effected by land route , salling vessels or steamship of either country whichever is available at the earliest, if the licensees so desire at any time during the validity period of the licences .
9. Import licences issued in pursuance of this Public Notice will be valid upto 31st October, 1978 and will not be ex- tended.
2. The established importers , eligible in terms of the cur- rent policy, may submit their applications to the respective licensing authority viz . , Jt . Chief Controller of Imports and Exports , Bombay or Jt . Chief Controller of Imports and Ex- ports , (Central Licensing Area ) , New Delhi on or before the 25th February, 1978 , in the usual form and manner . No past import documents are required to be produced, provided such documents were submitted to the licensing authority concerned in the past and were accepted by them for issue of licences for import of commodities from Iran indicated in Annexure-I . They should, however , quote details of lecences obtained in the preceding two periods. Where, however , the established importers are applying for the first time, they are required to produce unimpeachable documents relating to past imports from Iran in respect of the items as in Annexure - I for any one year within the prescribed basic years .
10. The provisions of Paragraph 120 of Section I of the Import Trade Control Policy Book ( Vol . I ) for the period April 1977- March 1978 , relating to minimum and maximum values of licences will not apply to the licences issued in terms of this Public Notice.
3. It has also been decided that the importers , who are eligible in terms of Annexure II to this Public Notice will also be granted licences for import of dry fruits only from Iran on equal value basis of Rs . 8,500 each . They may submit their applications for imports of dry fruits only from Iran for November 1977 October 1978 licensing period to be It. Chief Controller of Imports and Exports , ( Central Licens- ing Area), New Delhi on or before the 25th February, 1978 in the usual form and manner , complete in all respects .
11. Attention of importers of asafoetida is invited to the Prevention of Food Adultration Rules and in their own in- terest, they are advised to ensure that asafoetida imported from Iran conforms to the specifications prescribed under the aforesaid rules. In order to ensure that the asafoetida imported by the importers conforms to the prescribed standard , Port Health Organisations will test each consignment of asafoetida . Port Health Organizations after testing each consignment will seal the asafoetida ( hing ) bags under their own seal . These bags may not be further subjected to testing by State/Local bodies so long as their seals are intact and there is no evi- dence that the bags have been tampered with unless there are some special reasons for the same .
12. This Public Notice does not in any way affect the policy relating to the import of dates and dry fruits under the free licensing scheme covered by Appendix 2 to the I.T.C. Policy Book (Vol . 1 ) for 1977-78 .
4. The minimum value of licences for dry fruits will be Rs . 8,500 . The minimum value of licences for dates , asafoetida , gums & resins licensable on quota percentage basis , will be Rs. 1,000 for the year . It is , however , clarified that in the case of transfer/division of quota by established importers relating to above cases , the succeeding parties will be entitled to get licences in proportion to their share in approved quota ofthe original concern as provided in Para 45( 2 ) of the I.T.C. Hand Book of Rules and Procedure , 1977-78 . Where the licences are issued on equal value basis in terms of this Public Notice, the entitlement of each party is to be divided proрог-

(iv) Established importers who have imports of dry fruits to their credit from Pakis- tan during the period from 1951-52 to 1970-71 .
(v) Co- operative societies deal- ing in fresh fruits , subject to the production of :-
(a) A certificate from the concerned Registrar of Co-operative Societies that the co - operative society is still in exis- tence;
(b) An affidavit in the pro- form a enclosed vide Annexure - III ;
(c) A certificate from a Chartered Accountant to the effect that the society had a turn - over of not less than Rs . 15,000 ( Rs . Afteen thousand) during any one ofthe financial years 1967-68 , 1968-69 , 1969- 70, 1970-71 and 1971-72 infresh fruits.
If a certificate as referred to in sub - para (c) above had been produced in the past and ithad been accepted by the licensing autho- rity concerned for the issue of licences for import of dry fruits from Iran, photo-stat copy thereof or a copy duly attested by an Oath Commissioner or Notory Public or Magis- trate I Class or Gazetted Officer, maybe furnish- ed along with the appli- cation.
