११० आ० 43 (अ)/ 18 एफबी/ आई ही आर ए/ 78 -भारत सरकार के भूतपूर औद्योगिक विकास मन्त्रालय ( औद्योगिक विकास विभाग ) के श्रादेश म० का ०या ० 72 ( असा० )/ 18 एफबी/आईटी आर ए/ 74 तारीख 29 जनवरी , 1974द्वारा ( जिसे इसके पश्चात् उक्त भादेश कहा गया है ) , केन्द्रीय सरकार ने, उद्योग ( यिकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 - चबकी उपधारा ( 1 ) के खण्ड (ख ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , यह घोषणा की थी कि उक्त भावेश के जारी करने की तारीख ठीक पूर्व प्रवृत सभी संविदाओ, सम्पत्ति के हस्तान्तरण पत्रो, करारो , व्यवस्थापन्नो, पचाटो, स्थायी आवेशो या अन्य लिखतो ( उनसे भिन्न जो बैंको और वित्तीय सस्थाओं के प्रतिभूत दायित्वो से संबंधित हैं ) , जिसका मैमर्स हिन्द साइकिल्स लिमिटेड ( मुम्बई एकक ) मामक औद्योगिक उपक्रम या ऐसे श्रौद्योगिक उपक्रम की स्वामी कम्पनी एक पक्षकार है, या जो ऐसे श्रौद्योगिक उपक्रम था कम्पनी को लागू किए जा सकते है , का प्रवर्तन एक वर्ष की अवधि के लिए निलबित रहेगा और उक्त तारीख से पूर्व उनके अधीन प्रोद्भूत या उद्द्भूत होने वाले सभी अधिकार , विशेषाधिकार , बाध्यताए तथा दायित्व उक्त अधि के लिए निलबित रहेगे ,
और उक्त आदेश की अवधि समय- समय पर 28 जनवरी, 1978 तक बढ़ा दी गई थी ,

भौर केन्द्रीय सरकार का समाधान हो गया है कि उक्त आवेश की अवधि 2 जनवरी , 1979 तक की और अवधि के लिए , जिसमे यह तारीख भी सम्मिलित है, बढ़ा देनी चाहिए ,
अत , अब केन्द्रीय सरकार, उद्याग ( विकास और विनियमन) अधि- नियम, 1951 ( 1951 का 65) की धारा 18 अक्ष की उपधारा ( 2 ) के माथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, उक्त आदेश की अधि 2 जनवरी , 1979 तक जिममे यह तारीख भी मम्मिलित है , बढाती है ।

S.O. 43 (E) /18FB/IDRA/78.-Whereas by the Order of the Government of India in the late Ministry of Industrial Deve- lopment (Department of Industrial Development ) No. S.O. 72(E) /18FB / IDRA /74 , dated the 29th January , 1974 (here- inafter referredto as the said Order ) , the Central Government, in exercise of the powers conferred by clause (b ) of sub-sec- tion ( 1) of section 18FB of the Industries (Development and Regulation) Act , 1951 (65 of 1951 ) , declared that the opега- tion of all contracts , assurances of property , agreements , setlements , awards , standing orders or other instruments in force immediately before the date of issue of the said Order

(other than those relating to secured liabilities to banks and financial institutions ) to which the industrial undertaking known as Messrs . Hind Cycles Limited ( Bombay unit) , or the company owning such industrial undertaking is a pasty or which may be applicable to such industrial undertaking or company shall remain suspended for a period of one year and that all the rights , privileges , obligations and liabilities accruing or arising ( hereunder before the said date shall re- main suspended for the said period ;
And whereas the duration of the said Order was extended from time to time upto the 28th January , 1978 ;
And whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period upto and inclusive of the 2nd Januarу, 1979 ;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) , read with sub - section ( 2 ) of section 18FB of the Industries (Devclopment and Regulation ) Act , 1951 (65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto and inclusive of the 2nd January , 1979.

और उक्त आदेश की अर्वाध समय -समय पर 28 जनवरी , 1978 तक बढ़ा दी गई थी ,

And whereas the duration of the said Order was extended from time to time upto the 28th January , 1978 ;

आदेश
फा० ० 45 (अ) 15/आई० डी ०आर० ए०/ 78-मेसर्स मार्णष मन्म एण्ड कम्पनी लिमिटेड, हावड़ा नामक औद्योगिक उपक्रम का घुगुरी एकष ( जिसे इसमे इसके पश्चात उक्त कारखाना कहा गया है ) अनुसूचित उद्योगो, अर्थात भारी ट्रेलरों , विन्चो बाय मशीनरी के लिए पखों और बलोअरी , कन्क्रीट मिथकों तथा विभिन्न मशीनरी जैसे रोड शेलगे ट्रेलरी चाय शुष्कित्रों के फालतू पुर्गों और संघटकों में लगा है ।
और केन्द्रीय सरकार को यह सूचना प्राप्त हुई है कि उक्त कारखाने मे विनिर्मित वस्तुओं का उत्पादने का, उसके प्रबन्धको द्वारा उक्त कारखाने के बन्द किए जाने के परिणामस्वरूप ठप हो गया है, जिसके लिए , विद्यमान श्रार्थिक परिस्थितियो को ध्यान में रखते हुए , कोई औचित्य नहीं है ;
और केन्द्रीय सरकार की यह राय है कि उक्त कारस्नाने के बन्द होने से उत्पन्न होने वाली स्थित को सुधारने और यह सुनिश्चित करने के लिए कि उक्त अनुसूचित उद्योगो में उत्पादन में कमी न आए जो लोकहित के लिए उपायकर है , कुछ आवश्यक उपाय करना ममीचीन है ;
अतः अब, केन्द्रीय सरकार, उद्योग ( विकास तथा विनिमयन) श्रधि- नियम, 1951 (1951 का 65) की धारा 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मामले की परिस्थितियों का पूरा -पूरा और सम्पूर्ण श्रन्वेषण करने के प्रयोजनार्थ व्यक्तियो का एक निकाय निगुक्त करती है , जिसमें निम्नलिखित होगे:
अध्यक्ष श्री एम ० मी ० सरकार , सचिव, पश्चिमी बंगाल सरकार, बन्द और रुग्ण उद्योग विभाग , कलक्লা । सदम्य . श्री ए ० के० घोषाल , श्रऔद्योगिक इजीनियर, वैस्टिग हाउस सैबसबी फार्मर लिमिटेड , 17 -कान्वेंट रोड , फलकत्ता ।

ORDER
S.O. 45 ( E)/15/IDRA/78.-Whereas the Ghusuri unit (hereinafter referred to as the said factory ) , belonging to the industrial undertaking known as Messrs . Marshall Sons and Company Limited, Howrah , is engaged in the scheduled industries , namely , heary trailers , winches , fans and blowers for tea machinery , concrete mixers and spare parts and com- ponents of different machinery like road rollers , trailers , tea driers :
the And whereas it has come to the notice of the Central Govern- iment that the production of the articles manufactured in the said factory has come to a standstill consequent upon closure of the said factory by the management , for which , having regard to the economic conditions prevailing, there is no justification ;
And whereas the Central Government is of the opinion that it is expedient to take urgent measures to remedy the situa- tion arising out of the closure of the said factory and to en- sure that production in the said scheduled industries does not suffer to the detriment of the public interest ;
by Now, therefore , in exercise of the powers conferred section 15 of the Industries (Development and Regulation) Act , 1951 ( 65 of 1951 ) , the Central Government hereby appoints, for the purpose of making a full and complete in- vestigation into the circumstances of the case , a body of per- sons consisting of :-
