का. आ. 65 (अ ) / 18 कक/आई. की. आर. ए. / 78.- केन्द्रीय सरकार का समाधान हो गया है कि बाब्बिली, जिला श्री काकलम , आन्ध्र प्रदेश राज्य में चीनी विनिर्माण करने वाली मंरार्स श्री राम शुगर्स एण्ड इन्डस्ट्रीज लिमिटेड की यूनिट ( जिसे इसमें इसके पश्चात् उक्त औद्योगिक उपक्रम कहा गया है ) को तीन मारा से अधिक की अवधि के लिये बन्द कर दिया गया है और इस प्रकार की बदी सबधित अनुचित उद्योग के हित के प्रतिकूल हैं और उक्त औद्योगिक उपक्रम की रवामी कम्पनी की वित्तीय वशा और उक्त आंद्योगिक 276 GI / 77 140 THE GAZETTE OF INDIA EXTRAORDINARY [ PART II-SEC . 3 ( ii) ]
उपक्रम के रांयंत्र और मशीनों की दशा ऐसी है कि उक्त औद्योगिक उपक्रम का पुनः चालू करना संभव है तथा उसका इस प्रकार से पुनः चालू किया जाना चीनी के पर्याप्त उत्पादन को सुनिश्चित करने के लिये लोकहित में आवश्यक है ।
अतः अब केन्द्रीय सरकार, उदयोग (विकास और विनियमन ) अधिनियम , 1951 (1951 का 65 ) की धारा 18 कक की उपधारा ( 1 ) के खण्ड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये आन्ध्र प्रदेश रारकार के उपक्रम निजाम शुगर फैक्ट्री लिमिटंड को (जिसे इसके पश्चात् 'अधिकृत नियंत्रण' कहा गया हैं ) उक्त औद्योगिक उपक्रम का निम्नलिखित निबन्ध और शर्तों के अधीन रहते हुये प्रबन्ध तुरन्त ग्रहण करने के लिये प्राधिकृत करती है अर्थात् :-
( 1 ) प्राधिकृत नियंत्रक केन्द्रीय सरकार द्वारा समय -समय पर जारी किये गये सभी निर्देशों का अनुपालन करेगा ।
(2 ) प्राधिकृत नियंत्रक इस आदेश के राजपत्र में प्रकाशन की तारीख के तीन वर्ष की अवधि के लिये पद धारण करेगा ।
(3 ) केन्द्रीय सरकार , यदि वह ऐसा करना आवश्यक रामझती है तो, प्राधिकृत नियंत्रक की नियुक्ति को पहले भी समाप्त कर सकेंगी ।
यह आदेश राजपत्र में इसके प्रकाशन की तारीख से तीन वर्ष की अधि तक प्रभावी रहेगा।

S.O. 65 ( F ) / 18AA / IDRA / 78 .IDRA/ 78.--WhereWhereas the Central Government is satisfied
that the unit of Messis . Sri Rama Sugars and Industries Limited manufacturing sugar at Bobbili in District Srikakulam in the State of Andhra Pradesh ( here- after referred to as the said industtial undertaking ) has been closed for a period of more than three months and that such closure is prejudicial to the concerned scheduled industry and that the financial condition of the company owning the said industrial undertaking and the condition of the plant and machinery of the said industrial undertaking are such that it is possible 10 re -start the said industrial undertaking and that such re -starting is necessary in the interests of the general public to ensure adequate production of sugar ,
Now , therefore , in exercise of the powers conferred by clause ( b ) of sub- section ( 1 ) of section 18AA of the Industries ( Development and Regulation) Act , 1951 ( 65 of 1951 ) , the CentralGovernment hereby authonses the Nizam Sugar Factory Limited , an undertaking of the Government of Andhra Pradesh 141

(hereinafter referred to as ' Authorised Controller ' ) , to take over the manage- ment of the said industrial undertaking , subject to the following terms and con- ditions , namely : --
(1) The Authorised Controller shall comply with all duections issued from time to time by the Central Government .
(2) The Authorised Controller shall hold office for a period of three years from the date of publication in the Official Gazette of this Order.
( 3 ) The Central Government may terminate the appointment of the Authorised Controller earlier , if it considers it necessary to do so .
2. This Order shall have effect for a period of three years commencing from the date of publication in the Official Gazette .
