परन्तु यह तब जब कि-
उपर्युक्त उपमव ( ग ) में वी गई दरों पर प्रतिश्रदायगी तभी लागू होगी जब निर्यात के समय निर्यातकर्ता सीमाशुल्क के सहायक समाहर्ता के समाधानप्रद रूप में यह साक्ष्य प्रस्तुत कर देता है कि माल का निर्माण, यथास्थिति, स्केल्प अथवा सी ० आर ० पट्टियों से किया गया है और इस प्रकार के, यथास्थिति, स्केल्प सी० आर ० पट्टियों पर केन्द्रीय उत्पादनशुल्क और नमक अधिनियम 1944 ( 1944 का 1) की प्रथम अनुसूत्री की मद सं ० 26 कफ के अन्तर्गत स्कैल्प सी० आर ० पट्टियों पर लागू दर पर उपयुक्त शुल्क अदा किया गया है ।
(घ) सीवनहीन पाइपों और ट्यूबों से भिन्न 5 मि ० मी० से कम भित्ति मोटाई के पाइप और ट्यूब जिनमें उपर्युक्त (ग) में उल्लिखित पाइप और ट्यूब शामिल नहीं :--
(i ) अगालविनिकृत 445.00 रु० (केवल बार सौ पैंतालीस रुपये ) प्रति मीट्रिक टन ।

परन्तु यह तथ, अबकि पाइपों तथा ट्यबों आदि के विनिर्माण में प्रयुक्त इस्पात खंडों पर अदा किये गये केन्द्रीय उत्पावनशुल्क में छूट का लाभ, केन्द्रीय उत्पादनशुल्क नियमावली के अन्तर्गत नहीं उठाया गया हो अथवा निर्यात बंधपत्र के अन्तर्गत नहीं किया जा रहा हो ।
3609. (क) पटरियां और स्लीपर छड़ें ब्रांड वर , अलग-अलग निर्माता/ निर्यातकर्ता से प्रार्थना-पत्र प्राप्त होने पर नियत की जानी है ।
(ख) रेलपथ-सामग्री, जो भ्रन्यथा अविनिविष्ट है और ( भुलवा इस्पात से भिन्न ) इस्पात से बनी है--
(i ) अगालविनिकृत 311.00 रु ० ( केवल तीन सौ ग्यारह रुपये ) प्रति मीट्रिक टन ।
(ii) गालवितिकृत 515.00 रु० ( केवल पांच सौ पन्द्रह रुपये ) प्रति मीट्रिक टन ।

नोट:-प्रतिअदायगी की उपर्युक्त दरें तभी लागू होंगी जब उत्पाद के निर्माण में प्रयुक्त कच्चे माल पर श्रदा किये गये के ० उ ० शु० में छूट अथवा निर्यात किये जाने बाले उत्पाद पर ही अदा किये गये केन्द्रीय उत्पादन शुल्क में छूट का लाभ केन्द्रीय शुल्क नियम , 1944 के अंतर्गत नहीं उठाया गया हो , और निर्यात बंधपत्र के अंतर्गत नहीं किया गया हो ।

Strips as the case may be under item 26AA of the First Schedule to the Central Excises and Salt Act , 1944 (1 of 1944) has been paid on such skelp / C.R . Strips.

परन्तु शर्त यह है कि ( i) ऊपर मद (ख) के सामने विनिद्दिष्ट दर पर प्रतिश्रदायगो उस मामले में मंजूर की जाएगी जिसमें निर्यातकर्ता विक्रय संविदा अथवा आदेश के अन्तर्गत आने वाले विद्युत पारेषण लाइन टावर के साथ सप्लाई किये गये काबलों और डिबरियों पर शुल्क अदा किये जाने का सीमा शुल्क के सहायक समाहर्ता के समाधान -प्रव रूप में उसके समक्ष साक्ष्य पेश करता है और प्रति अदायगी प्रश्नगत निर्यात उत्पाद के प्रति मीट्रिक टन के हिंसाब से 50 किलोग्राम काबलों और डिवरियों पर वास्तव में श्रदा किये गये शुल्क तक सीमित रखी जायेगो और ( ii) निर्माता द्वारा अथवा मिर्यातकर्ता द्वारा प्रसंगाधीन काबलों और डिबरियों पर अदा किये गये केन्द्रीय उत्पादन शुल्क की छूट का केन्द्रीय उत्पादन शुल्क नियम , 1944 के अन्तर्गत दावा नहीं किया गया हो/लाभ नहीं उठाया हो ।
