विपय:--1-1-1978 से 31-12-78 तक शुले सामान्य लाइसेंस 3 के अंतर्गत पटसन , रेशम और फ्लैक्स को छोड़कर कपास , ऊन और हाथ से तैयार रेशों से बने वस्त्रों का संयुक्त राज्य अमरीका और यूरोपीय आर्थिक समुदाय सदस्य राज्य को निर्यात करने के लिए योजना ।
मिसिल से ० 2 ( 6 ) / 78-६० : यह योजना कोटा वर्ष । जनवरी 1978 से 31 दिसम्बर 1978 के लिए ( क ) संयुक्त राज्य अमरीका के लिए श्रेणी 106 के अंतर्गत आने वाले और ( ब) यूरोपीय आर्थिक समुदाय सदस्य राज्य अर्थात् जर्मनी , फ्रांस , इटली, बेनिलक्स , यू ०के ० , श्रायरिण गणतंत्र और डेनमार्क के अंतर्गत भाने वाले वस्त्रों के निर्यात से संबंधित है ।
2. कोटा झाबंटन के प्रयोजन के लिए पोतलदान की अवधि दो छः मासिक अवधियों अर्थात् 1 जनवरी 1978 से 30 जून 1978 तक और 1 जुलाई 1978 से 31 दिसम्बर 1978 तक विभाजित की जाएगी । कोटे का 60% प्रथम छः मास के दौरान आबंटित किया जाएगा और कोटे का 40% दूसरे छः मास के दौरान । सूती वस्त्र निर्यात संर्वधन परिषद दौरा कांटे के आबंटन उन पोतवणिकों को किए जाएंगे जो सूती वस्त्र निर्यात संर्वधन परिषद्, बम्बई, हथकरघा निर्यात संवर्धन परिषद्, मद्रास , रेशम तथा रेयान वस्त्र निर्यात संर्वधन परिषद् बम्बई एवं ऊन तथा ऊनी वस्त्र निर्यात गंवर्धन परिषद् बंबई के पास पंजीकृत हैं । लेकिन बनी बनाई पौशाकों के लिए भी कोटे उन पोतवणिकों को आवंटित किए जाएंगे जो सूती यन्त्र

निर्यात संवर्धन की बनी बनाई पोशाकों के लिए नाम सूची में सदस्य के रूप में दर्ज कर दिए गए हैं ।
3. भारत के किसी भी पत्तन से निर्यात करने की स्वीकृति दी जाएगी ।
4. वस्त्रों और तैयार वस्तुओं के लिए कोट के 75% का नियतम उच्च कीमत के आधार पर किया जाएगा और कोर्ट के इस भाग के लिए प्रथम छः मास के लिए सूती वस्त्र निर्यात संवर्धन परिषद प्रस्ताव मांगने के लिए तुरन्त कदम उठाएगी और उचित समय के भीतर ही कोटे के आबंटन का निश्चय करेगी ।
वस्त्रों और तैयार वस्तुओं के लिए कोटे के 25 % का नियतन प्रथम आए सो प्रथम पाए के माधार पर किया जाएगा । इनका प्रथम प्राधा भाग पक्की संविदाओं के लिए सुरक्षित रखा जा सकता है और द्वितीय श्राधा भ.ग उन संविधाओं के लिए रखा जा सकता है जिनके मद्दे माल तैयार हैं और पोतलदान के लिए उनका निरीक्षण कर लिया गया है ।
सिजाई से बुने हुए मोजे, बनियान और बनी बनाई पौशाकों के लिए कोटे के 80 % का नियतन उच्च कीमत के आधार पर आबंटित किया जा सकत. है । बाकी का 50 % पहले आए सो पहले पाए के आधार पर आबं- टित किया जाएगा जिसमें से भ्राधा पक्की संविदशों के मद्दे सुरक्षित रखा जाएगा और बाकी का श्राधा उन संविदाओं के भदवे होगा जिनका माल पोतलदाम के लिए तैयार है और निरीक्षण हो चुका है ।
5. प्रारम्भ में 1 जनवरी 1978 से और आगे परामर्श प्राप्त होने तक पोतलदान की स्वीकृति पत्तनों के सीमाशुल्क प्राधिकारियों द्वारा सूती बरल निर्यात संवर्धन परिषद् अम्बई और इसके कार्यालय एयर कारगो बम्पलैक्स सान्ताज हवाई अड्डा मंबई और इसके क्षेत्रीय और पत्तन कार्यालय दिल्ली कलकत्ता, मद्राम, बंगलौर, कोचीन और अहमदाबाद द्वारा जारी किए गए व्यक्तिगत प्रेषणों के लिए मूल पोनलदान बिलें और उनकी धनुलिपि प्रति पर कोटे के पुष्ठांकन के श्राधार पर दी जाएगी । लेफिन

संयुक्त राज्य अमरीका के संबंध में पोतलदान की अनुमति देने से पूर्व सोना-शुल्क प्राधिकारी , सूती वस्त्र निर्यात संवर्धन परिषद्, बम्बई या इसके प्राधिकृत प्रतिनिधियों द्वारा जारी किए गए विशेष सीमाशुल्क बीजक सं० 5515 पर प्रवेश पत्र के लिए किए गए दृष्ठाकंन का भी मत्यापन करेगे । यूरोपीय अधिक समुदाय के संबंध में सूती वस्त्र निर्यात संर्वधन परिषद् कोर्ट के पृष्ठांकन के साथ-साथ ये श्रेणियां जो व्यक्तिगत श्रेणी सीमा की है उन्हें निर्यात प्रमाण पत्न और उद्गम प्रमाण पत्र और अन्य श्रेणियों को भी उद्गम प्रमाण पत्र जारी करेगी जो व्यक्तिगत श्रेणी सीमा की नहीं है जिससे कि वे गंतव्य स्थान से निकासी प्राप्त करने के लिए श्रायातकों को इन प्रमाण पत्रों को भेज दें ।
6. जहां व्यवहार्य हो तो सूती वस्त्र निर्यात संवर्धन परिषद् निम्नतम मुश्य प्रणाली के माध्यम से उचित वसूली का सुनिश्चय करने के लिए प्रयत्न करेगी ।
7. योजना के अंतर्गत ग्राने वाले सूती उत्पाद की श्रेणियों की सूची सुती यस्त्र निर्यात संवर्धन परिषद् के पास उपलब्ध है ।
8. जहां तक यूरोपीय श्रधिक समुदाय के संबंध में 7 , 8 , 26 और 27 श्रेणियों से भिन्न श्रेणियों के अंतर्गत आने वाले और संयुक्त राज्य अमरीका के संबंध में 336, 340, 341, 347 एवं 343 श्रणियों से भिन्न श्रेणियों के अंतर्गत आने वाले हृथकरघा वस्त्रों, हथकरघे वस्त्रों से तैयार वस्तुओं और हथकरघे वस्त्रों से बुनी हुई पोशाकों का संबंध है पोत- सवान की स्वीकृति वस्त्र समिति द्वारा प्रमाणीकरण के अःधार पर सूती वस्त्र निर्यात संवर्धन परिषद् द्वार कोटे के पृष्ठांकन के बिन. ही दी जाएगी ।
9. भारत की उन मदों के संबंध में जो विशिष्ट रूप से भारतीय परम्परा- गत लोकवर्ग के वस्त्र उत्पाद हैं , संयुक्त राज्य अमरीका को निर्यात करने के लिए पांतलदान की स्वीकृति सीमा शुल्क द्वारा अखिल भारतीय हस्तशिल्प बोर्ड या भारतीय मदों के अंतर्गत आने वाली पौशाकों के संबंध में वस्त्र समिति द्वारा जारी किए गए उपयुक्त प्रमाण पत्र के आधार पर दीं जाएगी । जओ मयें भारतीय मदों के रूप में प्रमाणित की गई हैं उमके लिए सीमा शुल्क प्राधिकारियों द्वारा पोतसदान बिलों पर सूती वस्त्र निर्यात संवर्धन परिषद् के किसी प्रकार के पृष्ठांकन की आवश्यकता नहीं होगी । यूरोपीय आर्थिक समृक्षय सदस्य राज्यों को भारतीय मदों के निर्यात के संबंध में क्रियाविधि की घोषणा सूती वस्त्र निर्यात संवर्धन परिषद द्वारा बाद में की जाएगी । भारतीय मदों के विवरण परिषद् के पास उपलब्ध हैं ।
10. संयुक्त राज्य अमरीका सलाहकार समिति और यूरोपीय श्रार्थिक समु- दाथ जिसमें ५० के ० लाइसेंस सलाहकार समिति भी शामिल है कि ये कार्य हींग ( क) सम्पूर्ण योजना का पर्यवेक्षण करना ( ख) समय-सभय पर कार्य पालन की निगरानी रखना । ( ग) योजना के परिचालन से संबंधित उत्पन्न हुए विभिन्न मामलों का विवेचन करना और निर्णय देना और ( घ ) योजना में ऐसे परिवर्तन करना जिन्हें समिति समय - समय पर उपयुक्त समझे । कोटा प्राप्त करने के लिए पात्र बनने से पहले की शर्तों का आवेदक से पालन कराने के लिए अन्य शर्तों के साथ-साथ परिषद, समय- समय पर नियम एवं विनियम बमाने के लिए भी प्राधिकृत होगी । उसे बिना कोई कारण बताए कोर्ट को रोकने या रह करने या कोट के लिए आवेदनपत्तों को अस्वीकार करने का भी अधिकार होगा ।

PUBLIC NOTICE NO . 9 - ETC ( PN ) /78
New Delhi , the 14th February , 1978-
Subject : Scheme for exports under CGL- 3 of textiles made from cotton, wool and man-made fibre ex- cluding jute , silk and flax to USA and FEC Member States from 1-1-1978 to 31-12-1978 .
F. No. 2(6)/78-E.I- The scheme relates to the export of textiles ( a) falling under 106 categories to the USA; and (b) 114 categories to the EEC Member States , viz . West Germany, France , Italy , Benelux, U.K. , Irish Republic and Denmark for the quota year 1st January, 1978 to 31st December, 1978 .
2. For the purposes of quota allotment, the shipment period will be divided into two six- monthly periods , i.e. , from 1st January, 1978 to 30th June , 1978 and from 1st July, 1978 to 31st December, 1978. 60 per cent of the quota will be allocated during the first six months and 40 per cent of the quota during the next six months . Quota allotments will be made by the Cotton Textiles Export Pro- motion Council to these shippers who are registered with the Cotton Textiles Export Promotion Council, Bombay , Handloom Export Promotion Council , Madras , Silk and Rayon Textiles Export Promotion Councils , Bombay, Wool and Woollen Export, Promotion Council , Bombay. However , quotas for readymade garments shall also be allotted to those shippers who are admitted as member of the Readymade Garments Panel of the Cotton Textiles Export Promotion Council .
3. Exports will be allowed from any part in India .
4. For fabrics and made - up articles , 75 per cent of the quota wouldbe allocated on high price basis and for this portion of the quota, for the first six months the Cotton Textiles Export Promotion Council will immediately take steps to call for offers and decide the quota allotments with- in a reasonable time .
25 per cent of the quota for fabrics and made - up arti- cles would be allocated on first- come, first- served basis . Half of it may be reserved for firm contracts and the other half for contracts against which goods are ready and ins- pected for shipment .
For knitwear, hosiery and readymade garments , 50 per cent of the quota will be allocated on high price basis . The rest 50 per cent would be allocated on first-come, first- served basis , half of which may be reserved against firm con- tracts and the other half against contracts against which goods are ready and inspected for shipment .
5. Initially from 1st January , 1978 , and until further ad- vice shipments will be allowed by the Customs Authorities at the ports of shipment on the basis of quota endorsement on the original and duplicate of the shipping bills for indivi- dual consignments issued by the Cotton Textiles Export Pro- motion Council , Bombay , its office at Air Cargo Complex, Santa Cruz Airport , Bombay; its regional and port offices at Delhi, Calcutta, Madras , Bangalore , Cochin and Ahmedabad. In respect of USA , however , before allowing shipments , the Customs Authorities would also verify the visa endorsement on the Special Customs Invoice No. 5515 issued by the Cotton Textiles Export Promotion Council , Bombay , or its authorised representatives . In respect of exports to EEC Member States , alongwith the quota endorsement , the Cotton Textiles Export Promotion Council will issue certificate of export and certificate of origin for categories having indi- vidual category limits and certificate of origin in respect of other categories not having individual category limits for forwarding these certificates to importers for obtaining clear- ance at the destination .
will 6. The Cotton Textiles Export Promotion Council make efforts to ensure reasonable realisation through floor price mechanism, where practicable .

7. The lists of categories of textile products covered under the scheme are available with the Cotton Textiles Export Promotion Council .
8. In so far as handloom fabrics , made - up articles made from handloom fabrics and woven garments made from handloom fabrics falling under categories other than cate- gories 7, 8 , 26 and 27 in respect of EEC and other than categories 336 , 340, 341 , 347 and 348 in respect of USA are concerned , shipments will be permitted by the Customs on the basis of the certification by the Textiles Committee without the requirements of the quota endorsement by the Cotton Textiles Export Promotion Council,

In respect of India items which are typically Indian traditional folklore textile products , shipments will be per- mitted by the Customs for exports to USA on the basis of appropriate certificates issuedby All India Handicrafts Board or the Textiles Committee in respect of garments falling under India items . For items certified as India items , no quota endorsement by the Cotton Textiles Export Promotion Council will be required for endorsement of the shipping bills by the Customs Authorities . In respect of export of India Items to EEC Member States , the Cotton Textiles Ex- portPromotion Council will notify the procedure later . De- tails of India items are available with the Council .
10. The USA Textiles Licensing Advisory Committee and the EEC including UK Licensing Advisory Committee shall ( a) supervise the entire scheme ; (b ) kcep a watch over the performance from time to time ; (c) interpret and give deci- sions on various matters arising out of the operation of the scheme; and ( d) make such changes in the scheme as the Committees deem fit from time to time. The Licensing Committee shall be empowered to frame rules and regula- tions from time to time , inter- alia , providing for the condi- tions to be complied with by the applicant before he would be entitled to quotas. They shall also have the right to with- hold or cancel the quotas and reject applications for quotas without assigning any reasons .
