फा० प्रा० 169 (अ) केन्द्रीय सरकार की राय है कि कागज
के, जो एक प्रावश्यक वस्तु है, प्रश्राय बनाए रखने और उसमें वृद्धि करमे
के लिए तथा साम्यापूर्ण वितरण और उचित मूल्यों पर उसकी उपलभ्यता सुनिश्चित करने के लिए ऐसा करना आवश्यक तथा समीचीन है;
श्रतः , अब , केन्द्रीय सरकार , आवश्यक वस्तु अधिनियम, 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित श्रावेश करती है , अर्थात्
1. संक्षिप्त नाम तथा प्रारम्भ ( 1 ) इस आदेश का संक्षिप्त नाम कागज ( उत्पावन का विनियमन ) आवेश, 1978 है ।
( 2 ) यह तुरन्त प्रवृत्त होगा ।
2.परिभाषाएं इस आदेश में, जब तक कि संदर्भ में अन्यथा अपेक्षित न हो--
(क) "रंगीन छपाई कागज " से तात्पर्य छपाई के लिए सामान्य प्रकार का रंगीन कागज अभिप्रेत है, जो एक सा बना हो, और जो धब्बों, छिद्रों तथा धन्य दोषों से रहिम हो , और छपाई के लिए उपयुक्त हो;
(ख) "क्रीम लेड या वोव कागज" से लिखाई में प्रयुक्त सामान्य मफेद या चिकना काराज अभिप्रेत है , जिसमें लेड या बोव के निशान हों, और जिसकी सतह लिखने के लिए चिकनी हो;

(ग) " डुप्लीकेटिग कागज " से साइक्लोस्टाइल मशीन से प्रतियां बनाने में प्रयुक्त अवशोषक किस्म का कोई भी बिना निर्दिष्ट माप का या आधे माप का कागज अभिप्रेत है;
(घ) "विनिर्माण" से वह प्रक्रिया श्रभिप्रेत है जिसके द्वारा कोई विनिर्माता तैयार कागज या कागज के गत्ते का उत्पादन करता है;
(ङ) "विनिर्माता" से कागज अथवा कागज का गत्ता या दोनों का विनिर्माता अभिप्रेत है जो तकनीकी विकास महानिदेशालय , भारत सरकार के यहां इस रूप में रजिस्ट्रीकृत हो;
(च) " आफ्सेट या लीथो काराज " से वह कागज अभिप्रेत है जो आफ्सेट या सीथो प्रक्रिया से छपाई के लिए उपयुक्त हो;
(छ) " कागज और कागज के गत्ते " से वह सामग्री अभिप्रेत है जो साधारणतया कागज तथा कागज के गत्ते के रूप में जानी जाती है, और जिनमें पैक करने का कागज, लपेटने का कागज, तथा विशिष्ट प्रकार का कागज भी शामिल है लेकिन इसमें अखबारी कागज शामिल नहीं है;
(ज) " टाइप का कागज " से ऐसा पक्का कागज अभिप्रेत है जिस पर या तो लेड या बोव के निशान हों, आधे माप का हो भौर जिसे टाइप मशीनों पर प्रयोग के लिए विशेष रूप से चमकाया गया हो;
(झ) "छपाई का सफेद कागज " से छपाई के लिए सामान्य प्रकार का सफेद कागज अभिप्रेत है जिसकी बनावट एक सी हो, ओ एक सार हो तथा सामान्यतया धब्बों, छिद्रों या अन्य दोषों से रहित हो और छपाई के लिए समुपयुक्त हो;

(अ) "परिणाम" से भार के अनुसार परिमाण अभिप्रेत है ।
(ट ) "विक्रय कीमत" से वह कीमत अभिप्रेत है जिसमें किसी कागज या कागज के गले का माल- भाड़ा , केन्द्रीय विक्रय कर और स्थानीय कर सम्मिलित नही है;
(ठ) "फुटकर विक्रय कीमत" से अभिप्रेत है वह अधिकतम कीमत जिस पर कागज या कागज का गत्ता उपभोक्ता को बेचा जाता है और उसमें सभी कर, परिवहन प्रभार और अन्य शोध्य सम्मिलित हैं ।
3. कागज़ के उत्पादन का विनियमन प्रत्येक विनिर्माता । अप्रैल, 1978 से प्रारभ होने वाले प्रत्येक मास में और 1 अप्रैल, 1978 को और से प्रारंभ होने वाली प्रत्येक तिमाही में निम्नलिखित कागज का उत्पादन करेगा:--
(क) यथास्थिति, सम्बन्धित मास या तिमाही के दौरान, उसके द्वारा विनिर्मित कागज तथा कागज के गत्ते के कुल परिमाण का कम-से- कम 30 प्रतिशत छपाई का सफेद कागज; और
(ख) यथास्थिति, किसी मास या तिमाही के दौरान, उसके द्वारा विनिर्मित कागज और कागज के गत्ते के कुल परिमाण का कम -से -कम 33 प्रतिशत तक , यथास्थिति, रंगीन छपाई कागज , क्रीमलेड या वोष कागज , डुप्लीकेटिंग कागज , ऑफसेट या लीथो कागज और टाइप का कागज , जिसमें से कम से कम 20 प्रतिशत क्रीमलेठ या बोव कागज होगा ।
4. खण्ड 3 में विनिर्दिष्ट प्रतिशतों में भिन्नता जहां किसी विनिर्माता की प्रतिष्ठापित, क्षमता खण्ड 3 में विनिर्दिष्ट प्रतिशत के अनुसार कागज के विनिर्माण करने के लिए पर्याप्त नहीं हैं, वहां वह निम्नलिखित थिनिमित करेगा:--
(क ) उक्त खण्ड की भद ( क ) में विनिविष्ट सीमा तक या यथा- स्थिति, उस मास या तिमाही के लिए छपाई सफेद कागज़ के विनिर्माण के लिए प्रतिष्ठापित क्षमता तक, जो भी कम हो, छपाई का सफेद कागज;
(ख ) उक्त खण्ड की मद (ख ) में विनिर्दिष्ट सीमा तक या यथास्थिति उस मास या तिमाही के लिए क्रीमवोव कागज के विनिर्माण के लिए प्रतिष्ठापित क्षमता तक, जो भी कम हो, क्रीमलेड या बोव कागज; और
(ग) रंगीन छपाई कागज , डुप्लीकेटिंग कागज , आफसेट या लोथो कागज या टाइप का कागज , मव ( क ) और (ख ) मे विनि- दिष्ट कागज के परिमाण के विनिर्माण के बाद बचे उस परि- माण के अतिशेष की सीमा तक विनिर्मित करेगा जो, यथास्थिति उस मास या तिमाही के दौरान उसके द्वारा विनिर्मित कागज और कागज के बोर्ड के कुल परिमाण के 63 प्रतिशत तक को पूरा करने के लिए अपेक्षित हो ।
5. छपाई के सफेद कागज की विशिष्टियां (1 ) खंड 3 के अधीन विनिर्माण के लिए अपेक्षित छपाई का सफेव कागज हरे , नीले, गुलाबी' अथवा किन्ही अन्य रंगों से ऐसे अनुपात में रंगा जाएगा जो केन्द्रीय सरकार समय-समय पर विनिविष्ट करे तथा उसका भार प्रति वर्गमीटर 60 ग्राम से अधिक नाही होगा । किन्तु उसकी सहायता सीमा बह होगी जो सुसंगत भारतीय मानक संस्था विनिर्देश के अनुसार अंकित ग्रामेज पर अनुज्ञात कीजाए ।
( 2 ) छपाई का सफेद कागज भारतीय मानक संस्था द्वारा समय-समय पर अधिसूचित विशिष्टियों के अनुरूप होगा ।

6. विनिर्माता, कागज , की कतिपय किस्मों का विनिर्माण नही करेगा :-कोई भी विनिर्माता किसी अन्य किस्म के ऐसे कागज का विनिर्माण नही करेगा जो किसी ऐसे रंग से रंगा गया हो जिससे खड 5 के उपखंड ( 1 ) के अधीन छपाई के मफेव कागज का रंगा जाना अपेक्षित है ।
7 कीमतों का अंकन प्रत्येक विनिर्माता, अपने द्वारा विनिर्मित कागज के प्रत्येक रीम और कागज के गत्ते के प्रत्येक ग्रास पर उस कागज या कागज के गत्ते की कारखाना-द्वारा-विक्रय-कीमत और फुटकर विक्रय कीमत स्टाम्पित करेगा ।
8. यहियों, लेखाओं श्रादि का रखा जाना तथा पेश किया जाना, श्रादि: -( 1 ) प्रत्येक विनिर्माता अपने कारखाने में अधिष्ठापित मशीनों के प्रकार, प्रत्येक मशीन की उत्पादन क्षमता, कागज तथा कागज के गत्ते के विनिर्माण और विक्रय से सम्बन्धित बहियां तथा अन्य अभिलेख रखेगा ।
( 2 ) ऐसो प्रत्येक बही, लेखा तथा अभिलेख, निरीक्षण हेतु, केन्द्रीय सरकार के अथवा उस सरकार द्वारा इस निमित्त विनिर्दिष्ट किसी अन्य अधिकारी के समक्ष , अपेक्षा की जाने पर, पेश किया आएगा ।
( 3) प्रत्येक विनिर्माता, केन्द्रीय सरकार, को ऐसी विवरणियां, ऐसी रीति से और ऐसे समयों पर देगा जो केन्द्रीय सरकार विनिदिष्ट करे ।
9. छूट देने की शक्ति केन्द्रीय सरकार, लोकहित में या कागज उद्योग के विकास के लिए या इस तथ्य को ध्यान में रखते हुए कि विनिर्माता की प्रतिष्ठापित क्षमता कागज की कतिपय विशेषित किस्मो के विनिर्माण के लिए हैं या इस तथ्य को ध्यान में रखते हुए कि कोई विनिर्माता खंड 3 में निर्दिष्ट कागज की किसी भी किस्मे को , भारी लागत के बिना, उसमें विनिर्दिष्ट सीमा तक उत्पादित नहीं कर सकता, उस विनिर्माता को आदेश में यथा-विनिर्दिष्ट अवधि के लिए इम खण्ड की किन्ही अपेक्षाओं से पूर्णतया या भागतः छूट दे सकती है ।
10. इस आदेश के कतिपय उपबन्ध, कतिपय विनिर्माताओ को लागू नही होंगे -खण्ड 3 , 4 और 5 में की कोई बात ऐसे विनिर्माता को लागू नहीं होगो जिसकी कागज या कागज के गत्ते के विनिर्माण की प्रति- ष्ठापित क्षमता 25 टन प्रति दिन से कम है ।
11. निरसन और व्यावृत्ति कागज ( उत्पादन पर नियंत्रण) श्रादेश , 1974 को, सिवाय उन बातो के जो इस प्रकार निरसित आदेश के अधीन की गई हो , या करने से रह गई हो, निरसित किया जाता है ।

ORDER
S. O. 169 (E) . Whereas the Central Government is of opi- nion that it is necessary and expedient so to do for maintain- ing and increasing supplies and for securing the equitable distribution and availability at fair prices , of paper , an essen- tial commodity;
Now, therefore , in exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 ( 10 of 1955), the Central Government hereby makes the follow- ing Order namely.-
1. Short title and commencement.-
(1) This Order may be called the Paper (Regulation of Production ) Order, 1978 .
(2) It shall come into force at once.

2. Definitions . In this Order , unless the context otherwise requires,-
(a) " coloured printing paper " means the common type of coloured printing paper of uniform formation evenly finished and free from specks , holes or other blemishes , and suitable for printing;
(b) "cream laid or wove paper " means ordinary white or creamy writing paper, containing laid or wove marks , and having a smooth surface for writing;
(c) "duplicating paper " means any unsized or half- sized paper of absorbent nature used for making copies by means of cyclostyling;
a (d) " manufacture " means the process by which manufacturer produces finished paper or paper board;
(c) "manufacturer " means a manufacturer of paper or paper boards or both, and registered as such with the Director General of Technical Development , Government of India:
(f) " offset or litho paper " means paper suitable for offset or litho printing process ;
(g) " paper and paper board " means the material com- monly known as paper and paper boards , and includes packing paper , wrapping paper and speciality paper , but does not include newsprint ;
(h) " typing paper " means strong paper, bearing either laid or wove marks . half- sized and specially glazed for use on typewriters ;
( i) "white printing paper " means the common type ofwhite printing paper of uniform formation , evenly finished and generally free from specks , holes other blemishes , and suitable for printing; or
(j ) " quantity " means quantity by weight ;
(k) " sale price " means the price , exclusive of freight , Central Sales Tax and local taxes of any paper or paper board;
at the (1 ) " retail sale price " means the maximum price which paper or paper board may be sold to consumer , inclusive of all taxes , transport charges and other dues .
3. Regulation of production of paper. Every manufactu- rer shall manufacture in respect of every month commencing on and from the 1st day of April , 1978 , and every quarter commencing on and from the 1st day of April , 1978-
(a) white printing paper upto the extent of at least 30 per cent of the total quantity of paper and paper boards manufactured by him during the month oг the quarter , as the case may be ; and
(b) coloured printing paper , creamlaid or wove papeг , duplicating paper , offset or litho paper and typing paper, upto the extent of at least 33 per cent of the total quantity of paper and paper boards manu- factured by him during the month or the quarter, as the case may be , of which not less than 20 per cent shall be creamlaid or wove paper .
4. Variation of percentages specified in clause 3. Where the installed capacity of a manufacturer is not sufficient to manufacture paper according to the percentages specified in clause 3 , he shall manufacture--
(a) white printing paper to the extent specified in item (a) of the said clause or the installed capacity for the manufacture of white printing paper for the month or quarter, as the case may be, whichever is lower;
(b) creamlaid or wove paper to the extent specified in item (b) of the said clause or the installed capacity for the manufacture of cream wove paper for the month or quarter , as the case may be , whichever is lower; and
(c) coloured printing paper , duplicating paper, offset or litho paper or typing paper up to the extent of the balance of such quantity left after the manufac- ture of the quantities of paper referred to in items (a) and (b ) above as may be required to cover upto 63 per cent of the total quantity of paper and paper boards manufactured by him during the month or the quarter as the case may be .
5. Specification of white printing paper . ( 1 ) The white printing paper icquired to be manufactured under clause 3 shall be tinted with green , blue , pink or any other colours in such proportions as the Central Government may , from time to time , specify and its weight shall not exceed 60 grams per square metre , subject however , to the tolerance limit permitted on nominal grammage as per relevant Indian Standards Institution Specification .
(2) The white printing paper shall also conform to the specifications for white printing paper notified by the Indian Standards Institution from time to time .
6. Manufacturer not to manufacture certain varieties of paper-No manufacturer shall manufacture any other variety of paper tinted with any colour with which white printing paper is required to be tinted under sub- clause ( 1 ) of clause 5.
7. Marking of price . Every manufacturer shalf stamp on every ream of paper and every gross of paper board manu- factured by him , the ex factory sale price and retail sale price of such paper or paper board .
8. Maintenance and production of books , accounts , etc.- ( 1) Every manufacturer shall keep books of accounts and other records relating to the types of machineries installed in his factory , the production capacity of each machinery, the manufacture and sale of paper and paper boards .
SO (2) Every such book , account or record , shall, when required , be produced for inspection before the Central Government or any other officer specified by that Government in this behalf.
(3 ) Every manufacturer shall furnished to the Central Government such returns in such manner and at such times as the Central Government may specify .
a 9. Power to exempt . The Central Government may in the public interest or for the development of paper industry of having regard to the fact that the installed capacity of manufacturer is for the manufacture of certain specialised varieties of paper or to the fact that a manufacturer cannot produce any of the varicties of paper referred to in clause 3 to the extent specified therein except at a heavy cost , exempt such manufacturer from the whole or part of any of the requirements of that clause for such period as may be specified in the order.
10. Certain provisions of the Order not to apply to certain manufacturers . Nothing in clause 3, 4 and 5 shall apply to a manufacturer whose installed capacity for the manufacture of paper and paper boards is less than 25 tonnes per day .
11. Repeal and Saving. The Paper ( Control of Produc- tion) Order 1974 is hereby repealed except as respects things done or omitted to be done under the Order so re- pealed.
