सा० का० ति० 177 ( अ) केन्द्रीय सरकार , आवश्यक वस्तु अधि- नियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, विलायक निस्सारित तेल , वितैलित भोजन और खाने योग्य भाटा ( नियंत्रण) आवेश, 1967 मे और संशोधन करने के लिये निम्नलिखित प्रदेश करती है , अर्थात्-
1. ( 1 ) इस आदेश का नाम विलायक- निस्सारित तेल, वितैलित भोजन कौर खाने योग्य भाटा (नियंत्रण) सशोधन श्रादेण , 1978 है ।
(2) यह अप्रैल 1978 के प्रथम विन को प्रवृत्त होगा और ऐसी समाप्ति से पूर्व की गई या न की गई बातो को छोड़कर , अपने प्रारम्भ की तारीख से बारह मास के अवसान पर प्रवृत्त मही रहेगा ।
2. बिलायक निस्सारित तेल, वितैलित भोजन और खाने योग्य भाटा (नियंत्रण) श्रादेश, 1967 (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) में खंड 2 के उपखंड ( गग ) में , मव ( ii ) के पश्चार निम्न- लिखित मव अन्त. स्थापित की जायेगी , अर्थात्-
" ( iii ) प्रवर्ग ' च' के उत्पादक के मम्बन्ध में , " 31 मार्च , 1978 को, " ।
3. उक्त भादेश के खंड 3 के उपखंड ( 2) मे, प्रवर्ग 'ङ' से मम्बन्धित मद ( v) के पश्चात् निम्नलिखित मद और प्रवर्ग अन्त.स्थापित किया जायेगा , श्रर्थात्

"( vi) प्रवर्ग 'च' ऐसा उत्पादक, जिसके कारखाने में यद्यपि विला यक- निस्सारण संयंत्र नहीं लगा है , फिर भी वह ऐसे तेलों वाले पवार्थों से, जिन पर किसी अन्य उत्पादक के कारखाने में प्रत्यक्ष विलायक-निस्सारण प्रक्रिया की जाती है , वनस्पति विनिर्माण , औद्योगिक भारी तेलों , वसा विपाटम या वसा अम्ल विनिर्माण तक सीमित तेलों के प्रसंस्करण सम्बन्धी कारबार में नियोजित है, तथा इग प्रकार प्रसंस्कृत तेल को किसी अन्य व्यक्ति को न तो बेधा जाता है और न अन्यथा अन्तरित किया जाता है, किन्तु वह किसी अन्य वस्तु के विनिर्माण के लिये स्वयं उसके अपने परिसरों में इस्तेमाल में लाया जाता है । "
4. उक्त श्रावेश के माड 4 में,
(i ) उपखंड ( 1 ) के प्रथम परन्तुक में , मद ( ii ) के पश्चात् निभ्स- लिखित मद अन्तःस्थापित की जायेगी, अर्थात्ः-
"( ii ) प्रवर्ग ' च' के उत्पादक की दशा में, फरवरी , 1978 से" ;
( ii) उपखंड ( क) मे, " प्रवर्ग ' ङ' " पाम्य और अक्षर के पश्चात् "या प्रवर्ग ' त्र' " शब्द और अक्षर भन्तःस्थापित किये जायेंगे ;
( iii) उपखंड ( 5) की मव ( i ) के पश्चात् निम्नलिखित मव अन्तः- स्थापित की जायेगी, अर्थात्
"( iक) प्रवर्ग 'न' के नये उत्पादको की दशा में 150 रु ० " ।
5. उक्त आदेश के खण्ड 5 में , विश्वमाम परन्तुक के पश्चात् निम्न- लिखित परन्तुक जोड़ा जायेगा , अर्थात्-
"परन्तु यह और कि प्रवर्ग ' च' के उत्पादकों की दशा में , अनुज्ञप्ति की विधिमान्यता की अवधि अनुज्ञप्ति जारी करने की

तारीख से बारह कलेण्डर मास या इस आवेश के अवसान की तारीख , इन में से जो भी पूर्वतर हो , होगी" ।
6 रक्त आदेश की पथम पनम्त्री में ,-
(i) पंरा 1 म, " जिसन भावदम का ताराख से ठाक पूत्र क बारह कलेण्डर मासों की अवधि के पूर्व के दौरान विलायक निस्सारित तेल का उत्पादन प्रारम्भ किया था, घौर " शब्दों के पश्चात् निम्नलिखित भन्तःस्थापित किया जायेगा, अर्थात्ः
"या
विलायक निस्सारण संयंत्र से सज्जित नही है , फिर भी वह ऐसे तेलों वाले पवार्थों से, जिन पर किसी अन्य उत्पावक के कारखाने मे प्रत्यक्ष विलायक निस्सारण प्रक्रिया की जाती है , वनस्पति विनिर्माण, श्रौद्योगिक भारी तेलों, वसा विपाटन या वसा अम्ल विनिर्माण तक नीमित तेलों के प्रसस्करण सम्बन्धी कारबार में निगोजित है तथा इस प्रकार प्रसंस्कृत तेल को किसी अन्य व्यक्ति को न तो बेचा जाता है और न अन्यथा अन्तरित किया जाता है , किन्तु वह जो किसी अन्य वस्तु के विनिर्माण के लिये स्वयं उसके अपने परिसरों में इस्तेमाल में लाया जाता है ।
कारखाने का नाम उत्पादक का नाम श्रनुज्ञप्ति स ० प्रवर्ग
(ii ) पैरा 3 के उप -पैरा ( 3 ) के नीचे की सारणी के स्थान पर निम्नलिखित सारणी रग्बी जायेगी, अर्थात्ः--

(iii ) अन्त में निम्नलिखित जोड़ा जायेगा, अर्थात्
"केवल प्रवर्ग 'च ' में श्रनुज्ञप्तिधारियों के लिये
(1 ) ऐसे तेल वाले पदार्थों से, जिन पर सीधे विलायक निस्सारण प्रक्रिया की जाती है , विलायक निस्सारित तेल और वितेलित भोजन का विनिर्माण ग्रा 1 में विनिदिष्ट उत्पादकों के कारखाने/ कारखानो में ही किया जा सकता है न कि अन्य किसी कारखाने मे ।
(2) उपरोक्त ( 1) में निविष्ट विनिर्माण स्थल के होते हुए भी, श्रनुज्ञप्तिधारी की यह जिम्मेदारी होगी कि वह यह मुनिश्चित कर ले कि
(i) बिनायक -निस्सारित तेल न तो बेचा जाये और न अन्यथा किसी अन्य व्यक्ति को अन्तरित किया जाये , किन्तु उसका उपयोग उसके द्वारा किसी अन्य वस्तु के विनिर्माण के लिये उसके अपने परिमर में किया जाये;
(ii ) कोई भी वितेलित भोजन, विक्रय के लिये या पशुओं के चारे के रूप में उपयोग के लिये उसके द्वारा तब तक न प्रस्थापित किया जाये जब तक कि वह चतुर्थ अनुसूची में विनिविष्ट क्वालिटी के मानकों के अनुरूप न हो"।
7. उक्त आदेश की द्वितीय अनुसूची में,-
(क) मद 4 में,--
(i ) उपमद ( i ) में,--

क. (ग ) के पश्चात् निम्नलिखित भन्तस्थापित किया जायेगा, अर्थात्ः "(घ) वनस्पति, भौद्योगिक भारी तेल, बसा विपाटन या बसा अम्ल; " ;
ख. "झौर ( ग ) " शब्द, कोष्ठक और अक्षर के स्थान पर " ( ग ) और (१) " योष्ठका , अक्षर श्रऔर शब्द रखे आगे ,
(ii) उप मद ( iii ) में, "और ( ग) " शब्द, कोष्ठक और अक्षर के स्थान पर, " ( ग) और ( घ) " कोष्ठक, अक्षर और शब्द रखे जायेंगे;
(ख) मद 7 में--
(i ) प्रारम्भिक पैरा में, " विक्रय के लिये " शब्द के पश्चात् " या स्थैतिक उपयोग के लिये" शब्द अन्तःस्थापित किये जायेगे;
(ii) उप मव (ख) मे, "प्रवर्ग ' ङ' " शब्द और अक्षर के पश्चात् "या प्रवर्ग ' च " शब्द और अक्षर अन्त.स्थापित किये जायेगे ।
8. उक्त श्रादेश की सातवी अनुसूची में,--
(i) प्ररूप एस ० ई० श्रो० ( 1 ) भाग (ख ) और उसके नीचे सारणी के पश्चात् निम्नलिखित अन्तःस्थापित किया जायेगा, अर्थात्ः--
'भाग ( ग )-वनस्पति, श्रौद्योगिक भारी तेल वसा विपाटन या वसा अम्ल संयंत्र ।

(ii) प्ररूप एस ० ६० ओ० ( 2 ) , ( 3 ) , (4) और ( 5) मे,-
(क) शीर्षक में, " और 'ङ' " शब्द और अक्षर के स्थान पर " 'ड ' और 'च' " अक्षर और शब्द रखे जायेंगे ,
(ख) पाठ्य में, "प्रवर्ग 'ङ ' शब्द और रखे अक्षर के स्थान पर " प्रवर्ग ' ङ' और ' च' " शब्द और अक्षर रखे जायेंगे।

ORDER
New Delhi , the 18th March , 1978
G.S.R. 177 (E ). -In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955) , the Central Government hereby makes the following Order further to amend the Solvent Extracted Oil , De- oiled Meal and Edible Flour ( Control ) Order , 1967 , namely :
1. (1 ) This Order may be called the Solvent Extracted Oil , De-oiled Meal and Edible Flour ( Control ) Amend- ment Order , 1978 .
(2) It shall come into force from the 1st day of April , 1978, and shall cease to operate on the expiry of twelve months from the date of its commencement except as respects things done or omitted to be done before such cessor ,
2. In the Solvent Extracted Oil , De-oiled Meal and Edible Flour ( Control) Order, 1967 ( hereinafter referred to as the said Order) , in sub-clause ( cc) of clause 2 , after item ( ii ) , the following item shall be inserted , namely :-- 241

"(iii) on the 31st March , 1978 in respect of producer of Category 'F' , "
3. In sub-clause (2 ) of clause 3 of the said Order , after item (v) , relating to Category ' F' , the following item and category shall be inserted , namely
"(vi ) Category ' F' in respect of a producer whose factory though not equipped with solvent extraction plant is still engaged in the business of processing of oils restricted to vanaspati manufacture , indus- trial hard oils, fat splitting or fatty acid manufacture from oil bearing materials subjected to direct sol- vent extraction in the factory of any other producer and the oil so processed is not sold or otherwise transferred to any other person , but is used by him in his own premises for the manufacture of any other commodity" .
4. In clause 4 of the said Order,-
(i) in the first proviso to sub - clause ( 1 ) , after item ( ii) , the following item shall be inserted , namely : -
"( iii ) from the February, 1978 , in the case of producer of Category ' F' , " ;
(ii) in sub -clause ( A ) , after the word and letter " Cate- gory 'E' " , the words and letter "or Category ' F ' " shall be inserted ;
(iii) after item ( i ) of sub- clause ( 5 ) , the following item shall be inserted, namely :
"(ia) in the case of new producers of Category ' F' . Rs. 150" .
5. In clause 5 of the said Order , after the existing proviso , the following proviso shall be added , namely :-
"Provided further that in the case of producers of Cate- gory 'F' , the period of validity of the licence shall be twelve calendar months from the date of issue of the licence or shall end with the date of expiry of this Order , whichever is earlier" .
6. In the First Schedule to the said Order,-
( i) in paragraph 1, before the sub - paragraph beginning with the words " who commenced production of sof- vent extracted oil" and ending with the words "the date of application, and" , the following shall be in- serted , namely :- "or
not equipped with a solvent extraction plant, is still engaged in the business of processing of oils res- tricted to vanaspati manufacture , industrial hard oils , fat splitting or fatty acid manufacture from oil bearing materials subject to direct solvent extraction in the factory of any other producer and the oil so processed is not sold or other wise transferred to any other person , but is used by him in his own premises for the manufacture of any other commo- dity.

(iii) the following shall be added at the end, namely :-
"For Category ' F' licensees only
(1) The manufacture of solvent extracted oil and de- oiled meal from the oil bearing materials subjecte. ! to duect solvent extraction may be carried out only in the factory /factories of the producers specified in paragraph 1 , and not in any other factory.
(2) Notwithstanding the place of manufacture referred to in ( 1 ) above , it will be the responsibility of the licensee to ensure that ,-
( i) solvent -extracted oil is not sold or otherwise transferredto any other person , but is used by him in his own premises for the manufacture of any other commodity ;
( ii ) no de - oiled meal is offered by him for sale or for use as live-stock feed unless it conforms to the standards of quality specified in the Fourth Schedule" .
7. In the Second Schedule to the said Order,-
(a) in item 4,-
(i) in the sub- item ( i ) ,-
(A) after ( c ) , the following shall be inserted, name- ly :-
"(d) vanaspati , industrial hard oils , fat splitting or fatty acid; " ;
(B) for the word , bracket and letter " and ( c ) " , the brackets, letters and word " (c ) and (d ) " shall be substituted ;
(ii) in sub - item ( iii ) , for the word, brackets and letter "and (c)" , the brackets , letters and word " ( c) and (d) " shall be substituted ;
(b) in item 7 ,
(i ) in the opening paragraph , after the words " for sale" , the words " or for captive use " shall be in- serted;
(ii) in sub- item ( b ) , after the word and letter " cate- gory 'E' ", the words and letter " or category 'F' " , shall be inserted .
8. In the Seventh Schedule to the said Order ,-
(i) in Form S.F.O. ( 1 ) , after Part ( b ) and the Table thereunder , the following shall be inserted , name- ly :-
"Part ( c) vanaspati, industrial hard oils , fat-splitting or fatty acid plants .
