नई निल्ली, 7 जुलाई 1978
का००० 433 ( अ) केन्द्रीय प्रत्यक्ष कर बोर्ड, आय- कर अधिनियम, 1961 ( 1961 का 43 ) की धारा 295 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भाय कर नियम , 1962 में और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का नाम भाय्-कर ( सातवां संशोधन ) नियम, 1978 है ।
(2) ये 10 जुलाई, 1978 को प्रवृत्त होंगे ।
2. आयकर नियम , 1962 में ( जिसे इसमें इसके पश्चात् भूल नियम कहा गया है) , नियम 45 में,
( i ) पाश्र्थ शीर्ष में " सहायक आयुक्त ( अपील) " शब्दों और कोष्ठकों के पश्चात् "तथा आयुक्त ( अपील ) " शब्द और कोष्ठक भन्तःस्थापित किए जाएंगे;
( ii ) उप-नियम ( 1) के स्थान पर, निम्नलिखित उप-नियम रखा जाएगा, अर्थात्: --
"( 1 ) सहायक आयुक्त ( अपील ) या आायुक्त ( अपील ) को अपील प्ररूप सं ० 35 में की जाएगी । "
3. मूल नियमों के नियम 46क में,-
(i) पाएर्व शीर्ष में "सहायक आयुक्त ( अपील ) " शब्दों और कोष्ठकों के पश्चात् "तथा भायुक्त ( अपील ) " शब्द मौर कोष्ठक अन्तःस्थापित किए जाएंगे;
( ii ) "सहायक भायुक्त ( अपील ) " शब्द और कोष्ठक जहाँ- जहाँ प्राएं हैं, उनके पश्चात् "या भायुक्त ( अपील ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे ।
4. मूल नियमों के परिशिष्ट 2 में,--
(i) प्ररूप सं ० 7 में-
(क) पैरा 8 में "सहायक आय -कर आयुक्त ( अपील ) " शब्दों और कोष्ठकों के पश्चात् "आय-कर आयुक्त ( अपील) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
(ख) पैरा 9 में, "श्राय-कर आयुक्त" शब्दों के स्थान पर "श्राय-कर आयुक्त ( अपील ) श्राय -कर आयुक्त" शब्द और कोष्ठक रखे जाएंगे;
(ii) प्ररूप सं ० 35 में, --
(क) "सहायक आय-कर श्रायुक्त ( अधील) को अपील" शब्दों के स्थान पर "महायक श्राय -फर आयुक्त ( अनीम) तथा आयुक्त (अपील) को अपील" शब्द अन्तःस्थापित किए जाएंगे;
(ख) " सहायक आयुक्त (प्रपील) " शब्दों और कोष्ठकों के पश्चात्"/भ्रायुक्त ( अपील ) " शब्द और कोष्ठक अन्तः- स्थापित किए आएंगे;
(ग) टिप्पण 4 में "सहायक आयुक्त ( अपील) " शब्दों और कोष्ठकों के पश्चात् "/धायुक्त ( अपील ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
(iii ) प्ररूप संख्या 36 में,-
(क ) मद 6 में "सहायक श्रायुक्त (भपील) " शब्दों और कोष्ठकों के पश्चात् "/ भायुक्त ( अपील) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे ;
(ख) मद 7 में से " 272-फ/" अंकों और अक्षर का लोप किया जाएगा।

NOTIFICATIONS
INCOME - TAX
New Delhi , the 7th July, 1978
S.O. 433 (E) . In exercise of the power's conferred by section 295 of the Income-tax Act, 1961 ( 43 of 1961 ) , the Central Board of Direct Taxes hereby makes the following rules further to amend the Income-tax Rules, 1962, namely :-
1. ( 1 ) These rules may be called the Income- tax ( Seventh Amendment ) Rules , 1978 .
(2) They shall come into force on the 10th day of July, 1978.
2. In the Income- tax Rules , 1962 , ( hereinafter referred to as the principal rules ) , in rule 45,-
(i) in the marginal beading , after the words " Appellate Assistant Commissioner " , the words and brackets " and Cominissioner ( Appeals ) " shall be inserted;
(ii) for sub - rule (1 ) , the following sub-rule shall be substituted , namely :-
"(1) An appeal to the Appellate Assistant Commis- sioner or , as the case may be , the Commissioner (Appeals ) shall be made in Form No. 35. "
3. In rule 46A of the principal rules , ---
(i) in the marginal heading, after the words "Appellate Assistant Commissioner " , the words and brackets "and Commissioner ( Appeals ) " shall be inserted;
(ii) after the words "Appellate Assistant Commis- sioner ", wherever they occur , the words and brac- kets " or , as the case may be , the Commissioner (Appeals ) " shall be inserted .
4. In Appendix II to the principal rules ,-
( i ) in Form No. 7-
(a) in paragraph 8 , after the words "Appellate Assistant Commissioner of Income - tax" , the words and brackets " / Commissioner of Income - tax (Appeals ) " shall be inserted;
(b) in paragraph 9 , for the words " Commissioner of Income -tax ", the words and brackets " Com- missioner of Income - tax ( Appeals ) / Commissioner of Income -tax " shall be substituted;
(ii) in Form No. 35-
(a) after the words " appeal to the Appellate Assis- tant Commissioner of Income- tax" , the words and brackets "and Commissioner of Income-tax (Appeals ) " shall be inserted;
(b) after the words " Designation Appellate Assistant Commissioner " , the words and brackets "/Com- missioner ( Appeals ) " shallbe inserted;
(c) in Note 4, after the words " Appellate Assistant Commissioner " , the words and brackets " / Com- missioner ( Appeals )" shallbe inserted;
( iii) in Form No. 36-
(a) in item 6 , after the words "Appellate Assistant Commissioner" , the words and brackets " / Com- missioner ( Appeals ) " shall be inserted;
(b) in item 7, the figures and letter " 272A / " shall be omitted.

कॉ०० 434( प्र) केन्द्रीय प्रत्यक्ष कर बोर्ड, धन-कर अधिनियम, 1957 ( 1957 का 27) की धारा 46 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , धन - कर नियम , 1957 में श्रौर संशोधन करने के लिए निम्नलिखित नियम बनाती है. अर्थात्
है । 1. ( 1) इन नियमों का नाम धन-कर ( संशोधन ) नियम, 1978
(2) ये 10 जुलाई, 1978 को प्रवृत्त होंगे ।
2. धन-कर नियम, 1957 में ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) , नियम 5 में, -
( i) पाश्र्व शीर्ष में " सहायक आयुक्त ( अपील ) " शब्दों और कोष्ठकों के पश्चात् "तथा आयुक्त ( अपील ) " शब्द और कोष्ठक अन्तः- स्थापित किए जाएंगे;
( ii) उप-नियम ( 1 ) में " सहायक आयुक्त ( अपील ) " शब्दों के पश्चात् "या, यथास्थिति, आयुक्त ( अपील) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
3. मूल नियमों के नियम 5 -क में,--
(i ) पार्श्व प्रीिर्ष में "सहायक आयुक्त ( अपील ) " शब्दों और कोष्ठकों के पश्चात्" तथा आयुक्त ( अपील ) " शब्द और कोष्ठक अन्तः- स्थापित किए जाएंगे;
( ii) "सहायक आयुक्त ( अपील ) " शब्द और कोष्ठक जहाँ-जहाँ श्राए हैं , उनके पश्चात् " या यथास्थिति, आयुक्त ( अपील ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे ।
4. मूल नियमों से उपाबद्ध प्ररूप ग में , पैरा 7 में,--
"सहायक धन-कर आयुक्त ( अपील ) " शब्दों और कोष्ठकों के पश्चात् "/ धन-कर आयुक्त ( अपील) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंग ।
5. मल नियमों से उपाबद्ध प्ररूप अ में,--
( i) "सहाययः धन -कर आयुक्त ( अपील ) को अपील का प्ररूप" शब्दों के पूर्व " धन -कर आयुक्त ( अपील) तथा " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे ;
( ii) टिप्पण ( 4 ) में "सहायक आयुक्त ( अपील ) " शब्दों के पश्चात् "/ आयुक्त ( अपील) " शब्द अन्तःस्थापित किए जाएंगे:
6. मूल नियमों से उपावद्ध प्ररुप च में,-
(i ) मद 6 में " सहायक आयुक्त (अपील ) " शब्दों के पश्चात् " आयुक्त (अपील ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
(ii) मद 7 में "/ 18 क ( 1 ) ग्रंक , अक्षर और कोठकों का लोप किया जाएगा ।

S.O. 434( E ) . In exercise of the powers conferred by sec- tion 46 of the Wealth-tax Act, 1957 ( 27 of 1957 ) , the Central Board of Direct Taxes hereby makes the follow- ing rules further to amend the Wealth -tax Rules , 1957 , namely:-
1. (1) These rules may be called the Wealth-Tax ( Amend- ment) Rules, 1978 .
(2) They shall come into force on the 10th day of July,

2. In the Wealth- tax Rules , 1957 ( hereinafter referred to as the principal rules) , in rule 5,-
(i) in the marginal heading , after the words " Appellate Assistant Commissioner " , the words and brackets "and Commissioner ( Appeals ) " shall be inserted;
(ii ) in sub -rule ( 1 ) , after the words " Appellate Assistant Commissioner " , the words and brackets " or, as the case may be , Commissioner (Appeals ) " shall be inserted.
3. In rule 5A of the principal ruies ,-
(i) in the marginal heading , after the words " Appellate Assistant Commissioner " , the words and brackets " and Commissioner ( Appeal ) " shall be inserted;
(ii) after the words " Appellate Assistant Commissioner ", wherever they occur , the words and brackets " or as the case maybe , the Commissioner ( Appeals ) " shall be inserted .
4. In Form C appended to the principal rules, in para- graph 7, after the words " Appellate Assistant Commissioner ofWealth - tax" , the words and brackekts " / Commissioner of Wealth - tax (Appeals ) " shallbe inserted.
5. In Form E appended to the principal rules ,--
( i) after the words " FORM OF APPEAL TO THE APPELLATE ASSISTANT COMMISSIONER OF WEALTH - TAX " , the words and brackets " AND COMMISSIONER OF WEALTH- TAX ( APPEALS ) " shall be inserted;
(ii) in Note ( 4 ) , after the words "Appellate Assistant Commissioner " , the words and brackets " /Com- missioner (Appeals ) " shall be inserted .
6. In Form F appended to the principať rules.-
(i) in item 6, after the words " Appellate Assistant Com-
missioner " , the words and brackets "/Commissioner (Appeals ) " shall be inserted;
( i) in item 7, the figures , letter and brackets " / 18A ( 11 " shall be omitted .

का०८३० 435 ( अ) केन्द्रीय प्रत्यक्ष कर बोर्ड, दान कर अधिनियम.
1958 ( 1958 का 18 ) की धारा 46 द्वारा प्रदत्त शक्तियों का प्रयोग 1958 में और संशोधन करने के लिए निम्न- करते हुए , दान कर नियम , लिखित नियम बनाता हैं, अर्थात्:--
1. ( 1 ) इन नियमों का नाम दान-कर ( संशोधन) नियम , 197821
(2) ये 10 जुलाई, 1978 को प्रवृत्त होंगे ।
2. दान-कर नियम, 1958 में (जिसे हममें इसके पश्चात् मूल नियम
कहा गया है ) , नियम 5 में, -
( i) पाश्वं शीर्ष में " महायक आयुक्त ( प्रनील) " शब्दों और कोष्ठकों के पश्चात् " तथा आयुक्त ( अपील) " प्रशब्द और कोष्ठक अन्तःस्थापित किए जाएंगे ।
( ii) उप-नियम ( 1 ) में " सहायक आयुक्त ( अपील) " शब्दों के पण्चात् "या' यथास्थिति आयुक्त ( अपील ) " शब्द और कोष्ठक श्रन्तःस्थापित किए जाएंगे ।
3. मूग्न नियमों के नियम 5 के में,-
( i ) पार्श्व शीर्ष में, "सहायक आयुक्त ( अपील) " शब्दों के पश्चात् "तथा आयुक्त ( अपील ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
(ii) "सहायक आयुक्त ( अपील ) " शब्द और कोष्ठक जहाँ-जहाँ आाए हैं, उनके पश्चात् "या यथास्थिति, आयुक्त ( अपील) " शब्द भौर कोष्ठक अन्तःस्थापित किए जाएंगे ।
4. मूल नियनों से उपावद्ध प्रश्ध ग में , पैरा 6 में, -
"सहायक दानकर श्रानुक्त (अपोल ) " शब्दों और कोडकों के पश्चात् "/दान-कर श्रायुक्त ( अपील ) " शब्द और कांठक श्रवस्थापित किएजाएंगे ।
5. मूल नियमों से डाबद्ध प्रकन थ में,--
(i ) "महायक दान-कर आयुक्त (अपील) को श्रॉल " शब्दों के पूर्व "आयुक्त दान- कर ( योग ) शब्द अन्नःस्वानिकि जाएंगे ।
(ii ) "महायक आयुक्त ( ग्ररीत्र) का पदनाम " शब्दों और कांड कों के पूर्व "/ भावुक्त ( श्रत) ओ किए जाएगे;
(iii) "य विशिष्टियां सहायक श्रायुक्त ( अपील ) के कार्यालय में भरी जाएगी" शब्दों ओर करण्डारस्वाडियां महायक आयुक्त ( जाल) श्रागुक्त (अन ) के कार्यालय में भरी जाएगी" शब्द श्रौर काठक एवं जाने ।
6 मूल नियमों से आबद्ध प्ररूर घ में, मर 5 में,-
(i) "नहायक वाल-कर आयुक्त ( ल ) " शब्दों के पश्चात् "/ श्रायुक्त दान- कर ( अगाल ) " शब्द और कोष्ठक अन्तःस्थापित किए जाएंगे;
(ii) "धारा 17 ( 3) या धारा 17 क के अधीन" शब्दों, कोष्ठकों , अंकों श्रोर अक्षर के स्थान पर "बाद 17 ( 3 ) के अवीन" शब्द और अंतर जाएंगे ।

3. in rule 5A of the principal rules ,-

(i ) after the words " Appeal to the Appellate Assistant Commissioner of Gift - tax " , the words and brackets "/ Commissioner of Gift - tax (Appeal's ) " shall be inserted;
(ii) after the words "Designation of the Appellate Assis- tant Commissioner " , the words and brackets "/ Com- missioner ( Appeals ) " shall be inserted;

6. In Form H appended to the principal rules , in item 5,-

का० श्रा० 436 ( श्र.) केन्द्रीय प्रत्यक्ष कर बोर्ड , कम्पनी ( लाभ) अति- कर अधिनियम, 1964 ( 1964 का 7) की धारा 25 द्वारा प्रदन्न शक्तियों का प्रगोग करते हुए , कम्पनी ( लाभ) प्रतिकर नियम, 1964 में श्रौर संशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थातः--
1. ( 1 ) इन नियमों का नाम कम्पनी (लाभ) अति -कर ( संशोधन) नियम, 1978 है ।
( 2) ये 10 जुलाई, 1978 को प्रवृत होंगे ।
2. कम्पनी (लाभ) अति-कर नियम , 1964 में ( जिसे इममें इसके पश्चात मूल नियम कहा गया है ) , नियम 8 में, --
( i ) पार्श्व शीर्ष में " महायक आयुक्त ( श्रपीन ) " शब्दों और कोष्ठकों के स्थान पर "आयुक्त ( अपील ) " शब्द भौर कोष्ठक रखें जाएंगे;
( ii) उपनियम ( i) में " सहायक आयुक्त कोष्ठकों के स्थान पर "श्रायुक्त कोष्ठक रखे जाएंगे । ( अपील) " शब्दों और (अपील)" गब्य और
3. मूल नियमों के नियम 8 क में,--
(i ) पाश्वं शीर्ष में " सहायक आयुक्त ( अपील ) " शब्दों प्रौर कोष्ठकों के स्थान पर " श्रायुक्त ( अपील ) " शब्द और कोष्ठक रखे जाएंगे ;
(ii ) "सहायक आयुक्त ( अपील) " शब्द और कोष्ठक जहाँ जहाँ आए हैं, उनके स्थान पर "मायुक्त ( अनोल) " शब्द श्रोर काष्ठरु रखे जाएंगे ।
4. मूल नियमों के परिशिष्ट में--
(1) प्ररूप सं० 3 में-
(i) पैरा 8 में " सहायक झायुक्त ( अपील) को अपील" शब्दों और कोष्ठकों के स्थान पर " श्रायुक्त ( अपील) को अपाल" शब्द चौर कोष्ठक रखे जाएंगे ;
( ii) "सहायक आयुक्त ( अपील ) का पदनाम" शब्दों और कोष्ठकों के स्थान पर "आयुक्त (अपील ) " शब्द और कोष्ठक रखे जाएंगे;
( iii) टिपण 4 में " सहायक श्रायुक्त ( अपील) " शब्दों और कोष्ठकों के स्थान पर " आयुक्त ( अपील ) " शब्द भौर कोष्ठक रखे जाएंगे;

S.O. 436 (E) -In exercise of the powers conferred by section 25 of the Companies (Profits ) Surtax Act, 1964 (7 of 1964) , the Central Board of Direct Taxes hereby

makes the following rules further to amend the Companies (Profits) Surtax Rules , 1964 , namely :-
1. ( 1) These rules may be called the Companies (Profits) Surtax (Amendment) Rules , 1978 .
(2) They shall come into force on the 10th Day of July , 1978.
2. In the Companies ( Profits ) Surtax Rules , 1964 ( herein- after referred to as the principal rules ) , in rule 8,-
(i ) in the marginal heading. for the words " Appellate Assistant Commissioner " , the words and brackets "Commissioner ( Appeals) " shall be substituted :
(ii) in sub -rule ( 1 ), for the words " Appellate Assistant Commissioner " the words and brackets " Commis- sioner ( Appeals ) " shall be substituted .
3. In rule 8A of the principal rules.-
(i) in the marginal heading , for the words " Appellate Assistant Commissioner " , the words and brackets "Commissioner (Appeals ) " shall be substituted;

कॉ० श्रां ० 437 ( अ) केन्द्रोथ प्रत्यक्ष कर बोर्ड , व्याज-कर अधि- नियम, 1974 (1974 का 45) की धारा 27 द्वारा प्रवस शक्तियों का प्रयोग करते हुए , व्याज-कर नियम , 1974 में और संशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थात्ः-
1. ( 1) इन नियमों का नाम ब्याज-कर 1978 है । (संशोधन) नियम,
(2) ये 10 जुलाई , 1978 को प्रवृत्त होंगे ।
2. ब्याज-कर नियम, 1974 में ( जिसे इसमें इसके पश्चात मूल नियम कहा गया है) नियम 5 में,--
(i) पार्श्व शीर्ष में "सहायक श्रायुक्त ( अपील ) " शब्दों के स्थान पर "आयुक्त (अपील) " शब्य भौर कोष्ठक रखे जाएंगे;
(ii) उप नियम ( 1 ) में " सहायक आयुक्त ( अपील ) " शब्दों के स्थान "पर आयुक्त (अपील) " शब्द भौर कोष्ठक रखे जाएंगे 846/1

3. मूल नियमों के परिशिष्ट में--
(क) प्ररूप सं ० 3 में,--
i ) " सहायक श्राय- कर आयुक्त ( अपील ) को अपील" शब्दों के स्थान पर "आय-कर आयुक्त ( अपील ) को अपील" शब्द रखे जाएंगे;
( ii) " सहायक आयुक्त ( अपील) का पदनाम " शब्दों और कोष्ठकों के स्थान पर "श्रायुक्त ( अपील ) " शब्द और कोष्ठक रखे जाएंगे;
( iii) टिप्पण 3 में, "सहायक आयुक्त ( अपील ) " शब्दों के स्थान पर "आयुक्त (अपील ) " शब्द और कोष्ठक रखे जाएंगे ;
(ख) प्ररूप सं० 4 में , मव 6 में, "सहायक श्रायुक्त ( अपील ) " शब्दों और कोष्ठकों के स्थान पर " श्रायुक्त ( अपील) " शब्द और कोष्ठक रखे जाएंगे ;
(ग) प्ररूप सं० 6 में, पैरा 6 में, " सहायक आय- कर आयुक्त ( अपील ) शब्दों के स्थान पर " श्राय- कर आयुक्त ( अपील) " शब्द और फोष्ठक रखे आएंगे

INTEREST - TAX
S.O. 437 (E ) . In exercise of the powers conferred by sec- tion 27 of the Interest -tax Act, 1974 (45 of 1974 ) , the Cen- tral Board of Direct Taxes hereby makes the following rules further to amend the Interest- tax Rules , 1974 , namely : --
1. ( 1 ) These rules may be called the Interest -tax (Amend- ment) Rules , 1978 .
(2) They shall come into force on the 10th day of July, 1978 .
2. In the Interest - tax Rules , 1974 ( hereinafter referred to as the principal rules ) , in rule 5,---
(i) in the marginal heading , for the words "Appellato Assistant Commissioner " , the words and brackets "Commissioner (Appeals ) " shall be substituted ;
( ii ) in sub - rule ( 1 ) , for the words " Appellate Assistant Commissioner" , the words and brackets " Commis- sioner ( Appeals ) " shall be substituted .
3. In the Appendix to the principal rules ,-
(a) in Form No. 3-
(i) for the words " Appeal to the Appellate Assistant Commissioner of Income-tax " , the words and brackets "Appeal to the Commissioner of Income- tax (Appeals) " shall be substituted ;
( ii) for the words "Designation of the Appellate Assis- tant Commissioner", the words and brackets "Designation of the Commissioner (Appeals ) " shall be substituted ;
( iii) in Note 3 , for the words " Appellate Assistant Commissioner " , the words and brackets " Commis- sioner (Appeals ) " shall be substituted;
(b) in Form No. 4, in item 6 , for the words "Appellate Assistant Commissioner " , the words and brackets "Commissioner (Appeals ) " shall be substituted ;
(c) in Form No. 6, in paragraph 6 , for the words "Appellate Assistant Commissioner of Income- tax" , the words and brackets " Commissioner of Income- tax ( Appeals ) " shall be substituted.
