सा० का० नि० 358 ( भ):- अखिल भारतीय सेवाएं श्रधिनियम, 1951 ( 1951 का 61) की धारा 3 की उप-धारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार सिक्किम सरकार के परामर्श से भारतीय वन सेवा ( वरिष्ठता का विनियमन ) नियम 1968 , में और भागे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, भर्वात्ः
1. ( 1) इन नियमों का नाम भारतीय बन सेवा ( वरिष्ठता का विनियमन) संशोधन नियम , 1978 है ।
( 2) से नियम सरकारी राजपत्ता में प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. नियम 4 के पश्चात् निम्नलिखित नियम जोड़ा जाएगा, अर्थात्ः
"4 क. सिक्किम संवर्ग के प्रारम्भिक गठन पर उक्त सेर्वां में नियुक्त अधिकारियों की वरिष्ठताः
सिक्किम राज्य के संबंध में इन नियमों में दी गई किसी बात के बावजूद भी, राज्य संवर्ग के प्रारम्भिक गठन के समय उक्त सेवा में नियुक्त अधिकारियों के आवंटन का बर्ष तथा उनकी बरिष्ठता

केन्द्रीय सरकार द्वारा निम्नलिखित ढंग से निर्धारित की जाएगी , अर्थात्ः
(क) सिक्किम राज्य वन सेवा के मूल सवस्यों में से चयन द्वारा नियुक्त अधिकारियों के संबंध में ।
आबंटन का वर्ष राज्य सरकार तथा संघ लोक सेवा आयोग के परामर्थ से तदर्थ निर्धारित किया जाएगा ।
किन्तु शर्त यह है कि इस प्रकार निर्धारित किया गया किसी अधिकारी का भाबंटन वर्ष उसी वर्ष तक सीमित होगा जो सिक्किम राज्य बन सेवा में उसके ऐसे आसन्न बरिष्ट अधिकारी को मिलता है जिसका अयन भारतीय वन सेवा के सिक्किम संवर्ग के प्रारम्भिक गठत के समय होजाता है ।
( ब ) स्थानान्तरण पर सिक्किम संवर्ग में नियुक्त अभ्य संवगों संयुक्त संवर्गों में आबंटित भारतीय वन सेवा अधिकारियों के संबंध में ।
ऐसे अधिकारियों का आवंटन वर्ष उनका, मूल भाबंटन वर्ष हो होगा तथा अपनी परस्पर वरिष्ठता के प्रयोजन के लिए वे नियम 6 के प्रावधानों द्वारा शासित होंगे । "

NOTIFICATION
powers conferred G.S.R. 358 ( E) . In exercise of the by sub -section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951 ) , the Central Government , in consultation with the State Government of Sikkim , hereby makes the following rules further to amend the Indian Forest Service (Regulation of seniority ) Rules , 1968 , namely :-
(1) These rules may be called the Indian Forest Service (Regulation of Seniority ) Amendment Rules , 1978 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. After rule 4, the following rule shall be added , namely :-
"4A Seniority of officers appointed to the Service at the initial constitution of the Cadre of Sikkim :
Notwithstanding anything contained in these rules in relation to the State of Sikkim , the year of allot- ment and the seniority of officers appointed to the Service at the time of the initial constitution of the State cadre shall be determined by the Central Government in the following manner , namely :
(a) In respect of officers appointed through selection from amongst the substantive members of the Sikkim State Forest Service :
The year of allotment shall be determined ad - hoc in consultation with the Union Public Service Commission and the State Government :
Provided that the year of allotinent of an officer so arrived at shall be limited to the year to which his immediate senior in the Sikkim State Forest Service , who is selected to the Indian Forest Service Cadre of Sikkim at its initial constitution obtains .
(b) In respect of Indian Forest Service Officers borne on the cadres / Joint Cadres of other States , ap- pointed to the Cadre of Sikkim on transfer : Officer shall retain their original year of allot- ment and for purpose of their inter-se - seniority they shall be governed by the provision of rule 6. "

सा० का० नि० 359 ( अ):-अखिल भारतीय सेवाएं अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 को उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार सिक्किम राज्य सरकार के परामर्श से भारतीय वन सेवा ( भर्ती ) नियम , 1966 में और आगे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्ः-
1. ( 1) इन नियमों का नाम भारतीय वन सेवा ( भर्ती ) संशोधन नियम, 1978 है ।
(2 ) ये नियम भारत के राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. नियम 4 के उप- नियम ( 5 ) के बाव , निम्नलिखित उप नियम जोड़ा जाएगा , अर्थात्ः-
"( 6 ) सिक्किम राज्य के संबंध में इस नियम में इसके पहले वी गई किसी बात के होते हुए भी , प्रारम्भिक गठन पर राज्य संवर्ग

में भर्ती ऐसी पद्धति द्वारा की जाएगी, जैसाकि केन्द्रीय सरकार राज्य सरकार तथा आयोग के परामर्श से निर्धारित करे " ।

(1) These rules may be called the Indian Forest Service (Recruitment ) Amendment Rules , 1978 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. After sub- rule ( 5) of rule 4, the following sub-rule shall be added , namely :-
"(6) notwithstanding anything hereinbefore contained in this rule in relation to the State of Sikkim , recruit- ment to the State Cadre on its initial constitution shall be made by such method, as the Central Gov- ernment may , after consultation with the State Gov- ernment and the Commission prescribe . "

सा० का० ति० 360 ( प्र):-भारतीय वन सेवा ( संवर्ग ) नियम, 1966 के नियम 4 के साथ पठित अखिल भारतीय सेवाएं अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार संबंधित राज्य सरकार के परामर्श से भारतीय वन सेवा ( संवर्ग संख्या का नियतन ) विनियम , 1966 में और भागे संशोधन करने के लिए एत्वद्वारा निम्नलिखित विनियम बनाती है, अर्थात्ः-
1. ( 1 ) इन विनियमों का नाम भारतीय वन सेवा ( संवर्ग संख्या का नियतन) द्वितीय संशोधन विनियम, 1978 है ।
( 2) ये विनियम भारत के राजपत्र में प्रकाशित होने की तारीख से प्रक्त्त होंगे ।
2. भारतीय वन सेवा ( सवर्ग सख्या का नियतन) विनियम , 1966 की अनुसूची में "जम्मू तथा कश्मीर" शीर्षक के अधीन "उप वनपाल प्लांट इन्ट्रीडक्शन डिवीजन " प्रविष्टि के लिए निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जाएगा, अर्थात्ः-
"उप वमपाल, अनुसंधान प्रभाग"

1. (1 ) These regulations may be called the Indian Forest Service (Fixation of Cadre Strength ) Second Amend- ment Regulations, 1978 .
(2) They shall come into force on the date of their publication in the Gazette of India .

2. In the Schedule to the Indian Forest Service ( Fixation of Cadre Strength) Regulations , 1966 , under the heading , "Jammu and Kashmir " for the entry " Deputy Conservator of Forests , Plant Introduction Division" , the following entry shall be substituted , namely :-
"Deputy Conservator of Forest, Research Division" .

सा० का० ति० 361 ( श्र): भारतीय यन सेवा ( वेतन) नियम 1968 के नियम 11 के साथ पठित अखिल भारतीय सेवाएं अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार सबधित राज्य सरकार के परामर्श से भारतीय वन सेवा (वेतन ) नियम, 1968 में और सशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, श्रर्थात्:--
1. ( 1 ) इन नियमों का नाम भारतीय वन सेया ( वेतन) चौथा संशोधन , नियम , 1978 है ।
( 2) ये नियम भारत के राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. भारतीय वन सेवा (वेतन) नियम, 1968 के साथ संलग्न अनुसुची III में ( 1 ) जम्मू तथा कश्मीर से संबंधित तालिका में उप शीर्षक "ख-राज्य सरकार के अधीन समय वेतनमान में वेतन के अतिरिक्त विशेष वेतन याले पदों सहित भारतीय वन सेवा के वरिष्ठ वेतनमान में वेतन वाले पद में " उप वनपाल , प्लांट इन्ट्रोडक्शन प्रभाग" प्रविष्टि के लिए निम्नलिखित प्रविष्टि प्रतिस्थापित की जाएगी , अर्थात्ः-
"उप वनपाल, भनुसंधान प्रभाग" ।

In exercise of the powers conferred by sub-section ( 1 ) of section 3 of the All India Services Act, 1951 (61 of 1951 ) , read with rule 11 of the Indian Forest Service ( Pay ) Rules , 1968 , the Central Government, in con- sultation with the State Government concerned , hereby makes the following rules further to amend the Indian Forest Service (Pay ) Rules , 1968 , namely :-
1. (1 ) These Rules maybe called the Indian Forest Service ( Pay) Fourth Amendment Rules , 1978 .
(2) They shall come into force on the date of their publication in the Gazette of India ,
2. In Schedule III appended to the Indian Forest Service (pay) Rules , 1968-
(1) In the sub - heading "B. Posts carrying pay in the senior time scale of the Indian Forest Service under the State Governments including posts carrying special pays in addition to pay in the time scale", in the table relating to Jammu and Kashmir, for the entry "Deputy Conservator of Forests , Plant Intro- duction Division " the following entry shall be subs- tituted, namely :-
"Deputy Conservator of Forests , Research Division" .

सा० का० नि० 362 ( प्र): अखिल भारतीय सेवाएं अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार सिक्किम राज्य सरकार के परामर्श से भारतीय वन सेवा ( वेतन) नियम, 1968 में और आगे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, श्रर्थात्ः-

(2) ये नियम भारत के राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. भारतीय वन सेवा ( वेतन) नियम , 1968 में नियम 10 के बाद निम्नलिखित जोड़ दिया जाएगा, भ्रमर्थात्ः-
" 10-क--सिक्किम राज्य में भारतीय वन सेवा के ( प्रारम्भिक गठन) पर नियुक्त अधिकारियों के वेतन का नियतन:
सिक्किम राज्य के संबंध में इन नियमों में दी गई किसी भी बात के होते हुए भी, राज्य संवर्ग के प्रारम्भिक गठन के समय भारतीय वन सेवा में नियुक्त होने वाले अधिकारियों का वेतन कनिष्ठ अथवा वरिष्ठ वेतनमानों में ऐसे सिद्धान्तों के अनुसार निर्धारित किया जाएगा जैसाकि केन्द्रीय सरकार , राज्य सरकार के परामर्श से निर्धारित करे" ।

(1) These rules may be called the Indian Forest Service (Pay) Fifth Amendment , Rules , 1978 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Indian Forest Service ( Pay ) Rules , 1968 , after rule 10, the following shall be added, namely :---
" 10A Fixation of pay of officers appointed to the Indian Forest Service at its initial constitution in the State ofSikkim .
Notwithstanding anything contained in these rules in relation to the State of Sikkim , the pay of the, offi- cers appointed to the Indian Forest Service at the time of the initial constitution of the State Cadre shall be fixed in the junior or senior scales of pay in accordance with such principles as the Central Government may , in consultation with the State Government , determine .'
