सा. का. मि . 872 ( अ ) -अखिल भारतीय सेवाएं अधिनियम 1951 ( 1951 का 61 ) की धारा 3 की उप -धारा ( 1 ) दद्वारा प्रवृत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार भारतीय पुलिस सेवा ( विशेष भत्ता) नियम 1977 में आगे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात् :-
1. ( 1 ) इन नियमों का नाम भारतीय पुलिस सेवा (विशेष भत्ता) (संशोधन) नियम 1978 है ।

(2 ) ये नियम 1 जुलाई 1978 से प्रवृत्त हुए माने जाएंगे ।
2. भारतीय पुलिस सेवा (विशेष भत्ता) नियम 1977 में, नियम 3 के उप- निगम ( 1 ) के खण्ड (ख ) के स्थान पर निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा अर्थात् :-
" ( ख ) दिल्ली पुलिस के अभारी के रूप में पदनामित पुलिस आयुक्त 1 जुलाई 1978 से" ।
व्याख्यात्मक ज्ञापन
दिल्ली पुलिस के प्रभारी के रूप में पढ़नामित पुलिस महानिरीक्षका को 1 अप्रैल , 1976 से 250 रु. प्रति माह विशेष भत्ता दिया जा रहा था । 1 जुलाई, 1978, को प्रख्यापित किए गए दिल्ली पुलिस अध्यादेश ( 1978 का 2 ) द्वारा उसी तारीख से पुलिस आयुक्त प्रणाली आरंभ की गई हैं । दिल्ली में पुलिस आयुक्त प्रणाली आरंभ करने के फलस्वरूप पुलिस आयुक्त दिल्ली पुलिस का प्रभारी होगा । दिल्ली में पुलिस आयुक्त प्रणाली के आरंभ हो जाने से दिल्ली पुलिस के प्रभारी के रूप में पदनामित अधिकारी के कार्यों और दायित्वों में कोई कमी नहीं होगी । अतः सरकार ने यह निर्णय किया है कि पुलिस आयुक्त मणाली के आरंभ से पूर्व पुलिस महानिरीक्षक को मिलने वाले वेतन तथा भत्तों में मुकाबले पुलिस आयुक्त के वेतन तथा भत्तों में कोई परिवर्तन नहीं होगा । नियमों में संशोधन सरकार के उपयुक्त निर्णय को लागू करने के लिए किया गया हूं । इस संशोधन को 1 जुलाई 1978 से पूर्व प्रभावी करने के परिणाम स्वरूप किसी भी अधिकारी पर प्रतिकूल असर पड़ने की आशंका नहीं हैं ।

New Delhi , the 14th July , 1978
G.S.R. 372 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951) , the Central Government hereby makes the following rules , further to amend the Indian Police Service ( Special Allowance) Rules , 1977 , namely :-
1. ( 1 ) These rules may be called the Indian Police ( Special Allowance ) (Amendment) Rules , 1978.
(2 ) They shall be deemed to have come into force on the 1st day of July , 1978.

2. In the Indian Police Service ( Special Allowance) Rules , 1977 , for clause ( b ) of sub - section ( 1 ) of rule 3 , the following clause shall be substituted namely : -
"( b) the Commissioner of Police designated to be incharge of Delhi Police , shall , with effect from the 1st of July , 1978 "
EXPLANATORY MEMORANDUM
The Inspector General of Police designated to be incharge of Delhi Police was being allowed a special allowance of Rs . 250 per month with eflect from 1st April , 1976. By the Delhi Police Ordinance , 1978 ( 2 of 1978 ) , which was promulgated on 1st July , 1978 , the Commissioner of Police system has been introduced with effect from the same date . With the introduction of the Commissioner of Police system in Delhi , the Commissioner of Police will be incharge of Delhi Police . There will no reduction in the duties and responsibili- ties of the officer designated to be incharge of Delhi police , as a result of the introduction of the Commissioner of Police system in Delhi . It has , therefore been decided by Government that there should be no change in the pay and allowances of the Commissioner of Police , Delhi vis - a- vis the Inspector General of Police prior to the introduction of the Commissioner of Police system . The amendment to the rules is to give effect to the above decision of Government . No officer is likely to be affected adversely by giving retrospective effect to this amendment with effect from 1st July , 1978 .
