तथा नियंत्रण ) उपकर अधिनियम, 1977 ( 1977 का 36 ) की धारा 17 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है, अर्थात्ः--
1. संक्षिप्त नाम और प्रारंभः-
(क) इन नियमों का संक्षिप्त नाम जल ( प्रदूषण निवारण तथा नियंत्रण) उपकर नियम , 1978 है ;
(ख) ये राजपत्तन में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएंः-इन नियमों में , जब तक संदर्भ से अन्यथा श्रपेक्षित
न हो, --
(क) " अधिनियम" से जल ( प्रदूषण निवारण तथा नियंत्रण) उपकर अधिनियम, 1977 ( 1977 का 36) अभिप्रेत है;
(ख) " निर्धारण प्राधिकारी " से अभिप्रेत है ,
( 1) किसी संघ राज्यक्षेत्र के सम्बन्ध में, केन्द्रीय बोर्ड का सदस्य-सचिव; और
( 2 ) किमी राज्य के संबंध में , राज्य बोर्ड का सत्रस्य- सचिव;
(ग) " उपभोक्ता" से ऐसा व्यक्ति या स्थानीय प्राधिकारी अभिप्रेत है, जिसके द्वारा धारा 3 की उपधारा ( 1 ) के अभीन उपकर उस धारा की उपधारा ( 2 ) के अधीन संदेय है ।
(घ) "प्ररूप" से इन नियमों से उपाबद्ध प्राश्रय अभिप्रेत है;
(ङ) " धारा" से अधिनियम की धारा भभिप्रेत है ;
(च) किसी मंत्र राज्यक्षेय के संबंध में " राज्य सरकार " से संविधान के अनुच्छेद 239 के अधीन नियुक्त किया गया उसका प्रशासक अभिप्रेत है ।
3. मीटरों के मानक और वे स्थान , जहाँ उन्हें लगाया जाना है: --
( 1) उपभोग किए गए जल की मात्रा मापने और श्रभिलिखित करने के प्रयोजनों के लिए, प्रत्येक उपभोक्ता भारतीय मानक संस्थान द्वारा अधिकथित मानकों के अनुरूप सूचकों श्रौर अभिलेखितों सहित जल मीटर, बैटरी मीटर या ऑरिफिम मीटर लगाएगा और जहाँ उस संस्थान द्वारा कोई मानक अधिकथित नहीं किए गए हैं, वहाँ ऐसे मानकों के अनुरुप, जैसे बोर्ड द्वारा विनिदिष्ट किए जाएं ।
( 2) जहाँ उपधारा ( 1 ) में निविष्ट मीटर उपलम्य नहीं हैं , वहाँ
उपभोक्ता निर्धारण प्राधिकारी की अनुज्ञा अभिप्राप्त करने के पश्चात्, सूचकों और अभिलेखितों या दात्र प्रमापों और पम्पिंग संस्थापनों सहित, वी खाचे या आयताकार खाचे लगाएगा ।

(3 ) प्रत्येक उपभोक्ता अधिनियम की अनुसूची 2 के स्तम्भ ( 1 ) में उल्लिखित चार प्रयोजनों में से प्रत्येक के लिए उपभोग में लिए गए जल की मात्रा के निर्धारण केलिए पृथक मीटर की ध्यवस्था करेगा।
( 4) मीटर उपभोक्ता के परिसर के भीतर जल प्रदाय कनेक्शनों के प्रवेश स्थल पर या किसी अन्य स्थान पर जो निर्धारण प्राधिकारी द्वारा प्रनुमोदित किया जाए, लगाए जाएंगे जिससे कि निरीक्षण भौर अनुरक्षण के लिए और अधिनियम के अन्य प्रयोजनों के लिए ऐ से मीटरों तक सुगमता पूर्वक पहुंचा जा सके:
परन्तु यह स्थान जहाँ मीटर लगाया गया है, किसी भी दशा में , ऐसा स्थान नहीं होगा , जिसके पूर्व किसी भी प्रयोजनार्थ उपयोग के लिए उपभोक्ता द्वारा जल प्राप्त किया जाता है ।
4. विवरणियाँ देना
प्रत्येक उपभोक्ता, प्रत्येक कलेन्डर मास की 5 तारीख को या उसके पूर्व, निर्धारण प्राधिकारी को पूर्वतन मास में उपभोग किए गए जल की मात्रा वशित करते हुए , प्ररूप 1 में एक विवरणी देगा ।
5. केन्द्रीय सरकार को उपकर के संदाय की रीति और वह समय जिसके भीतर उसका संवाय किया जाएगा:
( 1 ) प्रत्येक राज्य सरकार उपभोक्ता से उपकर की बसूल की गई रकम उस मास के , जिसमें वह उपभोक्ता से वसूल की गई है , ठीक अगले फलेण्डर मास की 10 तारीख के पूर्व केन्द्रीय सरकार को विप्रे षित फरेगी ।
( 2) उपनियम ( 1 ) में निविष्ट उपकर की रकम , अदायगी और लेखा अधिकारी, निर्माण भौर भावास मंत्रालय , नई दिल्ली के हक मेंट तैयार किए गए बैंक ड्राफ्ट के रूप में केन्द्रीय सरकार को विप्रेषित की जाएगी और ऐसे अधिकारी की लेखा बहियों में ऐसी प्राप्तियों का अन्तिम रूप से समायोजन किया जाएगा ।
( 3) बैंक ड्राफ्ट के प्राप्त होने पर, निर्माण भौर श्रावास मंत्रालय , मुख्य शीर्ष के अधीन जमा करने के प्रयोजनार्थ भारतीय रिजर्व बैंक , नई विल्ली में , चालान के माध्यम से, उसे विप्रेषित करेगा ।
6. रिमेट: जहाँ कोई उपभोक्ता मल या व्यावसायिक बहिः स्त्राव के अभिक्रियण के लिए कोई संयंत्र लगाता है, वहाँ ऐसा उपभोक्ता उस तारीख से, जिसको ऐसा संमंत्र सफलतापूर्वक चालू किया जाता है और तब तक, जब तक वह सफलतापूर्वक कार्य करता रहता है , पन्द्रह दिन की समाप्ति की तारीख को भौर उससे , धारा 7 के अधीन रिबेट के लिए हकदार होगा ।
7. द्वारा 9 के अधीन राज्य सरकार के अधिकारी या प्राधिकारी द्वारा प्रयोग की जाने वाली शक्तियाँ :
धारा 9 के अधीन विशिष्टतः सशक्त किए गए राज्य सरकार के अधिकारी या प्राधिकारी को उस धारा के खण्ड ( क) और ( ख) में निर्दिष्ट शक्तियों के अतिरिक्त निम्नलिखित शक्तियाँ होंगी अर्थात् :--
(1) उपभोक्ला की विनिर्माण प्रक्रिया या संयंत्र का निरीक्षण करना ;
( 2) उपभोक्ता के सम्बन्ध में जल प्रदाय पद्धतियों और संस्थापनों का निरीक्षण करना ;
( 3) उपभोक्ता के सम्बन्ध में अपशिष्ट- उपचार पद्धति भोर संस्थापनों का निरीक्षण
(4) उपभोक्ता के संयंत्र में जलनिकास पद्धति और संस्थापनों क जिसके अन्तरगत संक्षुब्ध अल का व्यवन भी है, निरीक्षण करना ;
( 5 ) उपभोक्ता के संयंत्र में सामग्रियों और जल के उपयोग और उपभोग से संबंधित और उत्पादन से संबंधित अभिलेखों को मंगाना और उनका निरीक्षण करना ;
( 6 ) उपभोक्ता के संयंत्र में विद्युत के उपभोग से संबंधित प्रभिलेखों को मंगाना और उनका निरीक्षण करना ; और
( 7 ) उपभोक्ता के संयंत्र में जल के प्रदत्य, उपभोग और भभिक्रिया से संबंधित कोई अन्य जानकारी या अभिलेख मंगाना ।
8. धारा 11 के अधीन शास्ति अधियापित करने का प्राधिकार द्वारा 11 के अधीन शास्ति प्रधिरोपित करने वाला प्राधिकारी , निर्धारण प्राधिकारी होगा ।
अपील:--
( 1) घारा 6 के अधीन किए गए किसी निर्धारण आदेश से यः श्रारा 11 के अधीन शास्ति अधिरोपित करने वाले किसी आवेश से व्यथि कोई उपभोक्ता समिति के ( जिसे इसमें इसके पश्चात् अपील समिति कहा गया है) , जिसमें निम्नलिखित होंगे , अपील इममे उपाबद्ध प्ररूर 2 में कर सकेगा, अर्थात्:--
(क) जहाँ निर्धारण प्राधिकारी केन्द्रीय बोर्ड का सदस्य सचिव है, यहाँ उस बोर्ड का अध्यक्ष, जो समिति का अध्यक्ष होगा , भौर उस बोर्ड के वो सवस्य ओ बोर्ड के अध्यक्ष द्वारा नाम निर्दिष्ट किए जाएगें ;
( ख ) अहाँ निर्धारण प्राधिकारी राज्य बोने का सदस्य सचिव है , वहाँ उस बोर्ड का अध्यक्ष , जो समिति का अध्यक्ष होगा और उस बोर्ड के वो सदस्य , जो उस बोर्ड के अध्यक्ष द्वारा नाम- निविष्ट किए जाएगें ।
( 2) ऐसी अपील में मामले के तथ्यों और ऐसे आधारों का उल्लेख होगा जिन का अपील करने के लिए अवलम्ब अपीलार्थी ने लिया है और उसके साथ यथास्थिति, धारा 6 के अधीन किए गए निर्धारण, आवेश या धारा 11 के अधीन शास्ति-अधिरोपित करने वाले श्रावेश का एक प्रति होगी।
( 3 ) ऐसी अपील निर्धारण भावेश या अपीलार्थी पर शास्ति अधिरोपित करने वाले आवेश की संसूचना की तारीख से तीस दिन की अवधि के भीतर की जाएगी:
परन्तु यदि अपील समिति के अध्यक्ष का यह ममाधान हो जाता है कि अपील करने में विलम्ब के लिए अच्छा और पयप्ति कारण था , तों वह ऐसे कारणों से, जो लेखबद्ध किए जायंगे , अपीलार्थी पर निर्धारण मावेश या शास्ति अधिरोपित करने वाले भादेश की संसूचना की तारीख से पूर्वोक्त तीस दिन की अवधि की समाप्ति के पश्चात् किन्तु पैंतालीस दिन की समाप्ति के पूर्व , अपील करने की अनुजा दे सकेगा।
( 4 ) प्रत्येक अपील के साथ पचास रुपए फीस के दिए जाएंगे ।

New Delhi , the 24th July , 1978
G.S.R. 378(E) . In exercise of the powers conferred by section 17 of the Water ( Prevention and Control of Pollu- tion) Cess Act , 1977 ( 36 of 1977) , the Central Government hereby makes the following rules , namely :-
1. Short title and commencement . ( a) These rules may be called the Water ( Prevention and Control of Pollution) Cess Rules , 1978 ;
(b) They shall come into force on the date of their publi . cation in the official Ciazette .
2. Definitions . In these rules , unless the context other- wise requires :-
(a) " Act" means the Water ( Prevention and Control of Pollution) Cess Act, 1977 (36 of 1977) ;
(b) " assessing authority " means
(i ) in relation to Union Territory , the member - secretary of the Central Board ; and
(ii) in relation to a State , the member - secretary of the State Board ;
(c) " consumer " means a person or local authority by whom the cess under sub- section ( I ) of section 3 is payable under sub - section ( 2) of that section ;
(d) "form " means a form annexed to these rules ;
( e) " section" means a section of the Act ;
(f) "State Government " , in relation to a Union Territory , means the Administrator thereof appointed under article 239 of the Constitution .

3. Standards of meters and places where they are to be affixed. ( 1 ) For the purposes of measuring and recording the quantity of water consumed , every consumer shall affix water meters , venturi meters or Orifice meters with integra- tors and recorders in conformity with the standards laid down by the Indian Standards Institution and where no standards have been laid down by that institution in conformity with such standards as may be specified by the Board .
or (2) Wherever the meters referred to in sub-section ( 1) are not available , the consumer shall instal Vee notches rectangular notches , with indicators and recorders or pressure gauges and pumping installations , after obtaining the per- mission of the assessng authority.
(3) Every consumer shall provide a separate meter for assessing the quantity of water used for each of the four purposes mentioned in column ( 1 ) of Schedule Il to the Act .
(4) The meters shall be affixed at the entrance of the water supply connections within the premises of the consu- mer or at any other place to be approved by the assessing authority , so that such meters are easily accessible for ins- pection and maintenance and for other purposes of the Act :
Provided that the place where is affixed shall, in no case . be at a point before which water has been tapped by the consumer for utilisation for any purpose whatsoever .
4. Furnishing of returns . Every consumer shall furnish on or before the 5th of every calendar month , to the asses- sing authority, a return in Form I showing the quantity of water consumed in the previous month .
5. Manner of payment of the cess to the Central Govern- ment and the time within which it shall be paid.
(1) Every State Government shall remit to the Central Government , the amount of cess collected from the consumer before the 10th day of the calender month succeeding the month in which it is collected from the consumer.
(2) The amount of cess referred to in sub- rule ( J) shall be remitted to the Central Government in the form of a bank 654

8. Authority to impose penalty under section 11.-The authority to impose penalty under section 11 shall be the assessing authority .
draft drawn in favour of the Pay and Accounts Officer , Ministry of Works and Housing , New Delhi in whose books of accounts , the receipts would be adjusted finally.
(3) On receiving the bank draft , the Ministry of Works and Housing shall remit the same through a Challan into the Reserve Bank of India , New Delhi , for the purpose of crediting under relevant Major Head.
9. Appeal. ( 1 ) Any consumer aggrieved by an order of assessment made under section 6 or by an order imposing penalty made under section 11 may appeal in Form 11 annexed hereto , to a Committee ( hereinafter referred to as the appellate committee) consisting of-
(a) where the assessing authority is the member - secretary of the Central Board , the Chairman of that Board , who shall be the Chairman of the Committee , and two members of that Board , to be nominated by the Chairman thereof ;
6. Rebate . Where a consumer instals any plant for the treatment of sewage or trade effluent , such consumer shall be entitled to the rebate under section 7 on and from the expiry of fifteen days from the date on which such plant is successfully commissioned and so long as it functions suc- cessfully.
7. Powers to be exercised by the Officer or the Authority of the State Government under section 9 .
(b) Where the assessing authority is the member secretary of the State Board, the Chairman of that Board , who shall be the Chairman, of the Committee , and two members of that Board, to be nominated by the Chairman thereof.
The officer or authority of the State Government specially empowered under section 9 shall have , in addition to the powers referred to in clauses (a) and ( b) of that section , the power to :-
(2) Such appeal shall state the facts of the case and the ground relied upon by the appellant for preferring the appeal and shall be accompanied by a copy of the order of assess- ment made under section 6 or a copy of the order imposing penalty made under section 11 , as the case may be .
(i) inspect the manufacturing process or plant of the consumer ;
(ii) inspect the water supply systems and installations in the plant of the consumer ;
(3 ) Such appeal shall be preferred within a period of thirty days from the date of communications of the order of as- sessment or the order imposing penalty on the appellant :
(iii) inspect waste treatment system and installations in the plant of the consumer ;
(iv) inspect the drainage systern and installations , includ- ing storm water disposal in the plant of the consu- mer:
(v) call for and inspect records relating to the use and consumption of materials and water , and those relating to production , in the plant of the consumer ;
Provided that if the Chairman of the appellate Com- mittee is satisfied that there was good and sufficient reason for the delay in preferring the appeal , he may, for reasons to be recorded in writing , allow the appeal to be preferred after the expiry of the aforesaid period of thirty days and before the expiry of forty- five days from the date of com- munication of the order of assessment , or the order imposing penalty, on the appellant.
(4) Every appeal shall be accompained by a fees of rupees fifty.
(vi) call for and inspect the records relating to power consumption in the plant of the consumer ; and
(vii) call for any other information or records relating to the supply, consumption and treatment of water in the plant of the consumer .
