सा० फा० ति० 382 ( अ) केन्द्रीय सरकार, पंजाब पुनर्गठन अधिनियम , 1966 ( 1966 का 31 ) की धारा 72 की उप धारा ( 2 ) और ( 3 ) के साथ पठित उपधारा ( 1 ) के अधीन जारी की गई भारत सरकार के गृह मंत्रालय की अधिसूचना संख्यांक का ० भा० 63 ( प्रसा० ) तारीख 3 फरवरी , 1978 द्वारा यथा उपांतरित सिख गुरुद्वारा अधिनियम, 1925 की धारा 146 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सिख गुरुद्वारा बोर्ड निर्वाचम नियम, 1969 में और संशोधन करने के लिये निम्नलिखित नियम बनाती है , अर्थात्:--

संक्षिप्त नाम और प्रारम्भः ( 1 ) इन नियमों का संक्षिप्त नाम सिख गुरुद्वारा बोर्ड निर्वाचन ( संशोधन) नियम , 1978 है ।

( 2 ) ये तुरन्त प्रवृत्त होंगे ।

2. सिख गुरुद्वारा बोर्ड निर्वाचन नियम , 1959 में--

(I) मियम 2 में--

(क) खंड ( ग) में बोर्ड शब्द के पश्चात् " मुख्य श्रायुक्त, गुरुद्वारा निर्वाचन" शब्द अन्तःस्थापित किये जायेंगे ।

(ख) खंड ( का) में 'पंजाय राज्य' शब्द के पश्चात् ' सम्बद्ध राज्य ' शब्द रखे जायेंगे और

(ग) खंड (न) के पश्चात् निम्नलिखित खंड अन्नःस्थापित किया जायेगा, अर्थात्-

(ट) ' राज्य' से पंजाब पुनर्गठन अधिनियम, 1966 के प्रर्थान्त र्गत स्थानान्तरित राज्य क्षेत्र के संबंध में यथास्थिति, पंजाब राज्य या हरियाणा राज्य या हिमाचल प्रवेश राज्य अभिप्रेत है या चंडीगढ़ संघ राज्य क्षेत्र अभिप्रेत है ।

( II) नियम 4 में , उपनियम ( 1 ) में,

(क) खंड ( क) में अन्त में आने वाले शब्द ' और' का लोप किया जायेगा ।

(ख) खंड ( ख ) में शब्द 'भोर' अन्त में अंतःस्थापित किया जायगा,

(ग) खंड (ख) के पश्चात् निम्नलिखित खंड अन्तःस्थापित किया जायेगा, अर्थात्:--

" (ग) ऐसा अधिकारी जिसे मुख्य आयुक्त , गुरुद्वारा निर्वाचन, संबंधित राज्य के राजपत्र में अधिसूचना द्वारा मियुक्त करे , यदि निर्वाचन क्षेत्र एक से अधिक राज्य पर विस्ता रित है,"

(घ ) परन्तुक में " आयुक्त , गुरुद्वारा निर्वाचन " शब्दों के पश्चात् 'या मुख्य श्रायुक्त गुरुद्वारा निर्वाचन' , शब्द जोड़े जायेंगे ,

(III ) नियम 5 के स्थान पर निम्नलिखित नियम अंतःस्थापित किया

जायेगा अर्थात्--

" 5 नामावली का प्ररुप प्रत्येक निर्वाचन क्षेत्र के लिये नामा- बली ऐसे प्ररूप और ऐसी भाषा में होगी जैसी मुख्य श्रायुक्त, गुरुद्वारा निर्वाचन विनिविष्ट करे । "

(4) नियम 6 , 14 , 21 , नियम 54 के उपनियम ( 2 ) और नियम 55 में ' राज्य सरकार ' शब्द जहां कहीं भी आये हैं उनके स्थान पर 'मुख्य आयुक्त गुरुद्वारा निर्वाचन' शब्द रखे जायेंगे,

(5) नियम 9 , 13 नियम 24 के उपनियम ( 3 ) , नियम 27 ,

29, 33 , 37 , 39 , 55, 56 और 58 में 'आयुक्त, गुरुद्वारा निर्वाचन' शब्द जहां कहीं भी आये हैं उनके स्थान पर ' मुख्य आयुक्त , गुरुद्वारा निर्वाचन' शब्द रखे जायेंगे ,

(6) नियम ii में--

(क) उपनियम ( 2 ) में ' पंजाब सरकार' शब्दों के स्थान पर 'केन्द्रीय सरकार ' शब्द रखे जायेंगे ,

(ख) उपनियम ( 3 ) में " इसलिये " शब्द के स्थान पर "पूर्व " शब्द रखा जायेगा,

(ग) उपनियम ( 4 ) में खंड (घ ) और खंड ( ङ ) के उपखंड ( iii ) में " आयुक्त गुरुद्वारा निर्वाचन " शब्दों के स्थान पर " सम्बद्ध श्रायुक्त, गुरुद्वारा निर्वाचन" शब्द रखे जायेंगे,

(7) नियम 13 में उपनियम ( 1 ) के परन्तुक में ' पन्द्रह दिन' शब्दों के स्थान पर ' मात दिन ' शब्द रखे जायेंगे ,

(8) नियम 16 में उपनियम ( 3 ) के पश्चात् निम्नलिखित स्पष्टी- करण जोड़ा जायेगा, अर्थात्: --

"स्पष्टीकरण-इस उपनियम में और उपनियम ( 5 ) श्रौर (6) में पक्ष " राज्य सरकार" से वह राज्य सरकार अभिप्रेत है जिसमें सम्बद्ध उम्मीदवार, मतदाता के रूप में रजिस्ट्रीकृत है,"

(9) नियम 24 में उपनियम ( 2 ) के स्थान पर निम्नलिखित उप नियम रखा जायेगा अर्थात्--

"( 2 ) रिनिंग श्राफिसर निर्वाचन उम्मीदवारों के नाम मुख्य आयुक्त, गुरुद्वारा निर्वाचन और जहां निर्वाचम क्षेत्र एक से अधिक राज्य पर विस्तारित हो, वहां सम्बद्ध श्रायुक्त, गुरुद्वारा निर्वाचन

को भी भेजेगा"

(10) नियम 42 में उपनियम ( 3 ) में " सरकार " शब्द के स्थान पर " उस राज्य की सरकार जिसमें मतदान केन्द्र स्थित है " शब्द रखे जायेंगे ।

(11) नियम 48 में--

(क) उपनियम ( 1 ) में " जैसे निर्वाचन पर " शब्वों के स्थाम पर "यदि निर्वाचन पर" शब्द रखे जायेगे; और

(ख) उप नियम ( 2 ) में---

( 1) "और आयुक्त, गुरुद्वारा निर्वाचन" शब्द जहां के प्रथम बार आये हों उनके स्थान पर " सम्बद्ध आयुक्त, गुरुद्वारा निर्वाचन और मुख्य आयुक्त-गुरुद्वारा निर्वाचन " शब्द रखे जायेंगे,

( 2) "श्रायुक्त गुरुद्वारा निर्वाचन " शब्द जहां कहीं वे दूसरी यार आये हों उनके स्थान पर " मुख्य आयुक्त, गुरुद्वारा निर्वाचन" शब्द रखे जायेंगे ;

(12) नियम 49 में, उपनियम ( 2 ) में 'आयुक्त गुरुद्वारा निर्वाचन को और यथासम्भव शीघ्र आयुक्त , गुरुद्वारा निर्वाचन के अनुमोदन से" शब्दों के स्थान पर " सम्बद्ध आयुक्त, गुरुद्वारा निर्वाचन और मुख्य श्रायुक्त, गुरुद्वारा निर्वाचन और यथासंभव शीघ्र मुख्य आयुक्त गुरुद्वारा निर्वाचन के अनुमोवन से" शब्द रखे जायेंगे ,

(13) नियम 54 में उपनियम ( 1 ) में--

(क) " राज्य सरकार और आयुक्त , गुरुद्वारा निर्वाचन को भेजेगा" शब्दों के स्थान पर " मुख्य आयुक्त, गुरुद्वारा निर्वाचन को भेजेगा" शब्द रखे जायेंगे ,

(ख) अन्त में निम्नलिखित परन्तुक जोड़ा जायेगा , अर्थात्-

"परन्तु यह और कि तब के सिबाये जहां निर्वाचन क्षेत्र एक से अधिक राज्य पर विस्तारित हो, रिटर्निग श्रफिसर विवरणी या विवरणियां यथास्थिति सम्बद्ध श्रायुक्त, गुरुद्वारा निर्वाचन को भी भेजेगा । "

( 14) नियम 56 में " राज्य सरकार " शब्द जहां कहीं भी वे आये हों, उन के स्थान पर " मुख्य श्रायुक्त, गुरुद्वारा निर्वाचन और जहां मुख्य आयुक्त, गुरुद्वारा निर्वाचन न हो, केन्द्रीय सरकार" शब्द रखें जायेंगे ,

(15) नियम 58 में " राज्य सरकार" शब्द जहां कहीं वे आये हों उनके स्थान पर " केन्द्रीय सरकार" शब्द रखे जायेंगे ।

( 16) प्ररुप 1 में " जाति" शब्द का लोप किया जायेगा ।

MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi , the 26th July, 1978

G.S.R. 382(E) . In exercise of the powers conferred by section 146 of the Sikh Gurdwaras Act , 1925 ( Punjab Act 8 of 1925) , as modified by the notification of the Govern- ment of India in the Ministry of Home Affairs number S.O. 63 ( E ) dated the 3rd February , 1978 , issued under sub- section ( 1 ) , read with sub-sections (2 ) and ( 3 ) , of section 72 of the Punjab Reorganisation Act , 1966 (31 of 1966 ) , the Central Government hereby makes the following rules further to amend the Sikh Gurdwaras Board Election Rules . 1959 , namely :-

1. Shrot title and commencement . ( 1 ) These rules may be called the Sikh Gurdwaras Board Election (Amend- ment) Rules , 1978 ,

(2) They shall come into force at once ,

2. In the Sikh Gurdwaras Board Election Rules , 1959.-

( 1) in rule 2,-

(a) in clause ( c) , after the word " Board" , the words "Chief Commissioner , Gurdwara Elections " shall be inserted;

(b ) in clause (j ) , for the words "State of Punjab" . the words "the concerned State" shall be substitu- ted ; and 663

' (k) " State " means the State of Punjab or the State of Harayana or the State of Himachal Pradesh in relation to the transferred territory within the meaning of the Punjab Reorganisa- tion Act , 1966 , or the Union territory of Chandigarh , as the case may be . "

( ii) in rule 4, in sub - rule ( 1 ) ,

(a) in clause ( a) , the word " and " occurring at the end shall be omitted ;

(b) in clause ( b ) , the word "and " shall be inserted at the end ;

"(c) such officer as the Chief Commissioner , Gurdwara Elections may, by notification in the Official Gazette of the State concerned , appoint , If the constituency extends over more than one State :

(d) in the proviso , after the words " Commissioner , Gurdwara Elections " , the words "or the Chief Commissioner , Gurdwara Elections ," shall be inserted;

(ii ) for rule 5, the following rule shall be substituted, namely,-

"5. Form of roll . The roll for each constituency shall be in such form and in such language as the Chief Commissioner , Gurdwara Elections , may specify. " ;

( iv) in rules 6. 14, 21 , sub - rule (2) of rule 54 and 1le 55, for the words , " State Government" , wherever they occur , the words " Chief Commis sioner , Gurdwara Elections " shall be substituted ;

(v) in rules 9 , 13 , sub -rule ( 3 ) of rule 24, rules 27, 29 , 33, 37, 39, 55 , 56 and 58 for the words , "Com- missioner , Gurdwara Elections " , wherever they occur, the words "Chief Commissioner , Gurdwara Elections ," shall be substituted ;

(vi) in rule 11 ,-

(a) in sub -rule (2) . for the words "the Punjab Government " , the words " the Central Govern- ment " shall be substituted ;

(b) in sub - rule (3 ) , for the word " therefore " , the word " before " shall be substituted ; and

(c) In sub - rule (4 ) , in clause ( d) and sub -clause ( iii) of clause ( e ) . for the words "Commis- stoner . Gurdwara Elections" , the words " concer- ned Commissioner , Gurdwara Elections" shall be substituted;

(vii) in rule 13 , in the proviso to sub - rule ( 1 ) , for the words " fifteen days " , the words " seven days " shall be substituted ;

(viii) in rule 16, after sub - rule (3 ) , the following Explana- tion shall be added , namely,

'Explanation. In this sub-rule and in sub- rules ( 5) and (6 ) , the expression "State Government" means the Government of the State in which the candidate concerned is registered as a voter. ' ;

(ix) in rule 24 , for sub - rule ( 2) , the following sub- rule shall be substituted, namely,-

"(2) The returning officer shall forward the names of the elected candidate (s ) to the Chief Com missioner , Gurdwara Elections and, except where a constituency extends over more than one State, alsoto the concerned Commissioner , Gurd- wara Elections " ;

(x) in rule 42, in sub- rule ( 3 ) , for the word " Govern- ment " , the words " the Government of the State in which the polling station is situate , " shall be substituted;

(xi) in rule 48 ,

(a) in sub- rule ( 1 ) , for the words "As if at election" , the words "If at an election " shall be substituted: and

(b) in sub - rule (2 ),-

(1) for the words " and Commissioner , Gurdwara Elections" where they occur for the first time , the words " concerned Commissioner , Gurd- wara Elections and the Chief Commissioner , Gurdwara Elcctions ," shall be substituted;

(2) for the words " the Commissioner, Gurdwara Elections" , where they occur for the second time, the words " the Chief Commissioner , Gurdwara Elections " shall be substituted :

(xii) in rule 49 , in sub - rule ( 2 ) , for the words " to the Commissioner , Gurdwara Elections , and shall , soon as may be , with the approval of the Com- missioner, Gurdwara Elections , " , the words " to the concerned Commissioner , Gurdwara Elections and the Chief Commissioner , Gurdwara Elections , and shall as soon as may be , with the approval of the Chief Commissioner, Gurdwara Elections , " shall be substituted;

(xiii) in rule 54 , in sub - rule ( 1 ) ,-

( a) for the words " forward to the State Government and to the Commissioner , Gurdwara Elections ," , the words "forward to the Chief Commissioner , Gurdwara Elections , " shall be substituted :

(b) the following proviso shall be inserted at the end , namely,-

"Provided further that , except where a constitu- ency extends over more than one State, the returning officer shall forward the return returns , as the case may be , to the concerned Commissioner , Gurdwara Elections also . " ;

(xiv) in rule 56 , for the words " the State Government ", wherever they occur , the words " the Chief Commis- sloner , Gurdwara Elections , and , where there is no Chief Commissioner, Gurdwara Elections , the Cen- tral Government " shall be substituted ;

(xv) in rule 58 , for the words ' the State Government , wherever they occur , the words " the Central Gov- crument" shall be substituted :

(xvi) in form I , the word , " caste" shall be omitted.
