सा. का . नि. 459 ( अ ) -केन्द्रीय सरकार वित्त अधिनियम , 1978 (1978 का 19) की धारा 35 की उपधारा (4 ) के साथ पठित सीमा शुल्क अधिनियम , 1962 ( 1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हु , यह समाधान हो जाने पर कि लोक हित में ऐसा करना आवश्यक है , विभिन्न राज्यों में बाढ़ से पीड़ित्त

व्यक्तियों के लिए, जाति , धार्मिक विश्वास या मूलवंश का भेदभाव किए बिना , गरीबों और जरूरतमंदों के बीच मुफ्त वितरण के लिए अथवा उन्हें राहत पहुंचाने के लिए किसी संगठन या स्वेच्छा से कार्य करने वाले अभिकरणों द्वारा , मुफ्त भेंट के रूप में भारत में आयात किए गए माल , जैसे खाद्य सामग्री, औषधि, उपयोज्य चिकित्सा सामग्री, कपड़े , कम्बल , तम्बू और तिरपालों को निम्नलिखित छूट देती है, अर्थात् : -
( 1 ) सीमा शुल्क टौरफ अधिनियम , 1975 (1975 का 51) की प्रथम अनुसूची के अधीन उन पर उद्भवणीय समस्त सीमा- शुल्क ।
(2 ) उक्त वित्त अधिनियम की धारा 35 की उपधारा ( 1 ) के अधीन उन पर उद्ग्रहणीय समस्त सहायक सीमा शुल्क ;
( 3 ) उक्त सीमा शुल्क रिफ अधिनियम की धारा 3 के अधीन उन पर उद्ङ्ग्रहणीय समस्त अतिरिक्त शुल्क:
परन्तु यह तब जब ऐसा संगठन या स्वेच्छा कार्य करने वाला अभिकरण-
( 1 ) सहायक सीमा शुल्क कलक्टर के समक्ष, भारत सरकार के कृषि और सिंचाई मंत्रालय के कृषि विभाग का ऐसा प्रमाणपत्र प्रस्तुत करें कि उसे विभिन्न राज्योंमें लोगों को सहायता देने के लिए विदेशी सहायता प्राप्त करने के लिए अनुज्ञात किया गया है ।
(2 ) सहायक सीमा -शुल्क कलक्टर का यह समाधान कर दे कि ऐसा माल वाढ़ पीड़ित व्यक्तियों में से गरीबों और जरूरतमंदों में , मूलवंश , धार्मिक विश्वास या जाति के भेदभाव के बिना, मुफ्त वितरण के लिए या राहत पहुंचाने के लिए हैं और सहायक सीमा शुल्क कलक्टर के समाधानप्रद रूप से ऐसे आयातकरण की तारीख से 6 मास के भीतर अथवा ऐसी बढ़ाई गई अवधि के भीतर से, जो सहायक सीमा शुल्क कलक्टर द्वारा अनुज्ञात की जाए, यह भी दर्शाता है कि माल का उपयोग ऐसे वितरण या राहत कार्य के लिए किया गया है ।

G.S.R. No. 459( E). In cxercise of the powers conferred by sub - section ( 1) of section 25 of the Customs Act , 1962 (52 of 1962) , read with sub- section 805

(4) of section 35 of the Finance Act , 1978 (19 of 1978 ) , the Central Govern- ment being satisfied that it is necessary in the public interest so to do , hereby exempts the goods such as foodstuff , medicines , consumabic medical stores , clothings , blankets , tents and tarpaulines imported into India as free gift by an organisation or a voluntary agency , for free distribution to or for relief work for the poor and needy among the flood affected people in the various States , without any distinction of caste , creed or race , from :-
(i) the whole of the duty of customs leviable thereon , under the First Schedule to the Customs Tariff Act, 1975 ( 51 of 1975) ;
(ii) the whole of the auxiliary duty of customs leviable thereon under sub - section ( 1 ) of section 35 of the said Finance Act ; and
( iii) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act :
Provided that the organisation or the voluntary agency-
(i) furnishes to the Assistant Collector of Customs a certificate from the Department of Agriculture in the Ministry of Agriculture and Irrigation , Government of India , that it has been permitted to receive foreign assistance for relief for the people in various States ; and
( ii ) satisfies the Assistant Collector of Customs that the goons are for free distribution to or for relief work for the poor and the needy among the flood affected people without any distinction of caste , creed or race and also shows to the satisfaction of the Assistant Collector of Customs within six months from the date of importa- tion or such extended period as the Assistant Collector of Customs may allow , that the goods , have been used for such distribution or relief work .
