सा० का० नि० 474 (प्र): संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारत सरकार के भूतपूर्व स्वास्थ्य मंत्रा- लय की दिनांक 18 जनवरी , 1960 की अधिसूचना संख्या सी ० एस ० आर ० 113 का अतिक्रमण करते राष्ट्रपति एतद्वारा राष्ट्रीय संचारी रोग संस्थान तमा राष्ट्रीय मलेरिया उन्मूलम कार्यक्रम में ग्रुप डी के पदों पर भर्ती की विधि का नियमन करने के लिए निम्नलिखित नियम बनाते है; नामतः
1. संक्षिप्त शीर्षक और प्रारम्भः ( 1 ) इन नियमों को राष्ट्रीय संचारी रोग संस्थान एवं राष्ट्रीय मलेरिया उन्मूलन कार्यक्रम ( प्रुप की पद ) भर्ती नियमा- बली, 1978 कहा जायेगा ।
( 2 ) ये सरकारी राजपत्न में प्रकाशित होने की तिथि से लागू होंग ।
2. उपधोजन: ये नियम सलग्न अनुसूची के स्तम्भ 1 में निर्विष्ट पदों पर लागू होंगे ।
3. संख्या , वर्गीकरण तथा बेतनमान: पदों की संख्या, उनका वर्गीकरण तथा वे सभमान वहीं होंगे जैसाकि प्रमुसूची के स्तम्भ 2 से 4 में निर्दिष्ट हैं ।
4. भर्ती की विधि, भायु सीमा, भर्हताएं आदि उक्त पदों पर भर्ती की विधि, श्रायु-सीमा, मर्हताएं तथा मन्य बातें वही होंगी जैसा कि उक्त अनुसूची के स्तम्भ 5 से 13 में निर्दिष्ट हैं ।
5. अनर्हता: कोई व्यक्ति-
(क) जो किसी ऐसे व्यक्ति से विवाह करता करती है जिसका कि पति या जिसकी पत्नी जीवित हो , अथवा
( ख) जो व्यक्ति एक पति/पत्नी के जीवित रहते हुए किसी व्यक्ति के साथ विवाह करता/ करती है अथवा विवाह की संविदा करता/ करती है, उक्त पदों में से किसी पर नियुक्त होने का पाक्ष नहीं होगा परन्तु केन्द्रीय सरकार यह समाधान होने पर कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दूसरे पक्षकार पर लागू होने वाली स्वीय विधि के अधीन अनुज्ञेय है, और ऐसा करने के अन्य श्राधार हैं, किसी भी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है ।

6. छूट देने की प्रशक्तिः जहां केन्द्रीय सरकार का यह विचार हो कि छूट देना भावश्यक या उचित है वहां वह लिखित कारणों के आधार पर आवेश द्वारा किसी श्रेणी या वर्ग के व्यक्तियों अथवा पदों को इन निययों के किसी संबंध से छूट दे सकती है ।
7. म्यावृप्ति: इस संबंध में केन्द्रीय सरकार द्वारा समय -समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जाति/अनुसूचित जनजाति तथा विशेष बर्गों के व्यक्तियों के लिए जिन भारक्षणों और अन्य रियायतों की व्यवस्था करना अपेक्षित है, उन पर इन नियमों की किसी बात का प्रभाव नहीं पड़ेगा ।

यदि सेलेक्शन की किसी स्टेज पर सक्षम अधिकारी की यह राय हो कि अनुसूचित जाति अथवा अनु- सूचित जनजाति के उम्मीदवारो के लिए जो रिक्तियां भारक्षित हैं उनको भरने के लिए अपेक्षिम अनुभव बाले इम जातियों के काफी उम्मीदवारों के उपलब्ध होने की सभावना नहीं है तो सक्षम अधि कारी के विवेक पर उन जातियों के उम्मीदवारों को अनुभव के सबध में छूट वी जा सकती है ।

NOTIFICATION
New Delhi , the 28th Sept. , 1978.
G.S.R. 474 (E) : In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the notification of the Government of India in the late Ministry of Health No.G.S.R. 113, dated the 18th January , 1960 , the President hereby makes the following rules regulating the method of recruitment to Group ' D ' posts in the National Institute of Communicable Diseases and the National Malarla Eradication Programme , namely :
1. Short title and commencement ( 1 ) These rules maybe called the National Institute of Communicable Diseases and the National Malaria Eradication Programme (Group D Posts ) Recruitment Rules , 1978.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application : These rules shall apply to the posts specified in column I of the Schedule annexed of these rules
3. Number , Classification and scale of pay: The number of the posts , their classification and the scale of pay attached thereto, shall be as specified in column 2 to 4 of the Schedule aforesaid.
4. Method of recruitment , age limit and other qualifications : The method of recruitment , age limit , qualifications and other matter relating to the said posts shall be as specified in column 5 to 13 of the said Schedule.
5. Disqualification : No person :-
(a) who has entered into or contracted a marriage with a person having a spouse living , or
(b) who having a spouse living has entered into or contracted a marriage, with any person, shall be eligible for appointment to any of the sald posts :
Provided that the Central Government may, if satisfied , that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exmpt any person from the opera- tion of these rules .
6. Power to relax: Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons or posts .
7. Saving : Nothing in these rules shall effect reservation , relaxation of age limit and other concessions to be provided for the Scheduled Castes and Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
