तूतीकोरिन सा०का ० नि० 510 ( श्र) केन्द्रीय सरकार , नय पतन न्यास ( बोर्ड के अधिवेशनों के लिये प्रक्रिया) नियम , 1978 का निम्नलित्तित प्रारूप, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38) की धारा 122 की उपधारा ( i ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त द्वारा की उपधारा ( 2 ) की अपेक्षानुसार, उन सभी व्यक्तियों की जासकारी के लिये प्रकाशित किया जा रहा है , जिनके उससे प्रभावित होने की संभावना है और इसके द्वारा सूचना की जाती है कि उक्त प्रारूप पर इस अधिसूचना के राजपक्ष में प्रकाशन की तारीख से पैंतालिस दिन की अवधि की समाप्ति पर या उसके पश्चात् विचार किया जाएगा ।
उक्त अवधि की समाप्ति से पूर्व उक्त प्रारूप की बाबत जो भी प्राक्षेप या सुझाव किसी व्यक्ति से प्राप्त होंगें केन्द्रीय सरकार उन पर विचार करेगी ।
नियमों का प्रारूप
1. संक्षिप्त नाम और लागू होना ( 1 ) इन नियमों का संक्षिप्त नाम नव सूतीकोरिन पत्तन न्यास ( बोर्ड के अधिवेशनों के लिये प्रक्रिया) नियम,1978 है ।

(2) ये अधिनियम की धारा 16 के उपबंधों के अधीन रहते हुए नव तूतीकोरिन पत्तन के न्यासी बोर्ड के अधिवेशनों में किए गए कामकाज को लागू होंगें ।
2. अधिवेशनों की आवृत्ति ( 1) बोर्ड का नियम 3 में निर्दिष्ट विशेष अधिवेशन से भिन्न, अधिवेणन प्रत्येक माम में कम से कम एक बार होगा ।
(2) बोर्ड समय -समय पर अपने अधिवेशन की तारीख और मनत्र अवधारित करेगा:
परन्तु जहां किसी कारणवश ऐसा करने में असमर्थ है वहां, उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , अध्यक्ष ऐसा कर सकेगा ।
(3 ) बोर्ड का अधिवेशन तूतीकोरिन के पत्तन परिसर में होगा ।
3. विशेष अधिवेशनों का बुलाया आना-अध्यक्ष, या उसकी अनु- पस्थिति में उपाध्यक्ष, यवि वह नियुक्त किया गया हो, तो जब कभी वह आवश्यक समझे, विशेष अधिवेशन बुला सकेगा और कम से कम तीन न्यासियों के लिखित अनुरोध पर वह ऐसा करेगा ।
4. कार्यसूची आवि का परिचालन बोर्ड के किसी अधिवेशन के लिये कार्यसूची और उस पर टिप्पण या शापन, यदि कोई हो, अधिवेशन की तारीख से कम से कम तीन दिन पूर्व न्यामियों को परिचालित किए जाएंगे:
परन्तु विशेष अधिवेशन की दशा में ऐसी कार्यसूची और टिप्पण या ज्ञापन, अधिवेशन की तारीख से कम से कम एक दिन पूर्व परिचालित किए जायेंगें ।

5 उन मदो पर विचार विमर्ण ओ कार्यसूची में मम्मिलित नही है- अध्यक्ष या उसकी अनुपस्थिति में उपाध्यक्ष , यदि वह निगुक्त किया गया हो, सो म्यविवेकानुसार बोर्ड के अधिवेशनो में, जिसमे विशेष अधिवेशन भी सम्मिलित है , किसी भी अधिवेशन में विचार विमर्श के लिये कार्य -सूची मे सम्मिलिन नही की गयी किसी मद को उस दशा में सम्मिलित कर मकेगा जबकि वह उसकी र.य में पर्याग्न महत्व की ष्टो या श्रति आवश्यक हो अथवा दोनो ही हो और जब उसे किसी पश्चात्यर्ती अधिवेशन में बोर्ड के विचारार्थ टाला न जा मकता हो ।
6 मभदान -यदि किसी प्रश्न पर मतदान की मांग की जाती है तो मत देने वाले न्यासियो के नाम तथा उनके मसो की प्रकृति अधिवेशन के सभापति द्वारा अभिलिखित की जाएगी ।
स्पष्टीकरण हम नियम और नियम 7 और 8 के प्रयोजनों के लिए 'सभापति' पद से अध्यक्ष , या उसकी अनुपस्थिति में उपाध्यक्ष, यांव वह नियुक्त किया गया है तो, और दोनो की अनुपस्थिति में उपस्थिति न्यासियो मे से उसके द्वारा अना गया काई व्यक्ति अभिप्रेत है ।
7 अधिवेशन के कार्यवृत्त ( 1 ) बोर्ड के प्रत्येक अधिवेशन की कार्यवाहियो के कार्यवृत्त ऐसी पुस्तक में अभिलिखित किए जाएगे जिसकी व्यवस्था बोर्ड द्वारा इम प्रयोजन के लिए की जाए और उन पर, यथा साध्यशीघ्रता से, ऐसे अधिवेशन के सभापति द्वारा हस्ताक्षर कर किए जाएगे और वह कार्यालय समय के दौरान किसी भी न्यासी के निरीक्षण के लिये उपलब्ध रहेगी ।
( 2) कार्यवृत्त, उसके ऐसे भाग को छोडकर जिसके लिए अध्यक्ष या उमकी अनुपस्थिति में उपाध्यक्ष, यदि वह नियुक्त किया गया हो तो, किसी विशिष्ट मामले मे निर्देश थे , बोर्ड के कार्यालय मे , कार्यालय के समय के दौरान जनता के निरीक्षण के लिये उपलब्ध रहेंगे ।
(3 ) प्रत्येक अधिवेशन में उपस्थित न्यामियो के नाम कार्यवृत्त पुस्तक में अभिलिखित किए जाएगे ।
५ अधिवेशनो का स्थगन अधिवेशन का राभार्यात , अधिवेशन मे उपस्थित न्यासियो की सहमति से अधिवेशन ऐसी पश्चान्यर्ती तारीख तक के लिए स्थगित कर सकेगा जिसके बारे में या तो उम अधिवेशन में घोषणा कर दी जायेगी , और ऐसी दशा में अधिवेशन से अनुपस्थित न्यासियो को कम मे कम सीन दिन पहले सूचना भेजी जायेगी, या श्रधिवेशन की तारीख म कम से कम तीन दिन पूर्व न्यासियों को ससूचित किया जाएगा ।

DRAFT RULES
1. Short title and application.-( 1 ) These rules may be called the New Tuticorin Port Trust ( Procedure at Board Meetings Rules , 1976 .
(2) They shall , subject to the provisions of section 16 of the Major Port Trusts Act , 1963 (38 of 1963 ) , apply to the business transacted at the meetings of the Board of Trustees of the Port of New Tuticorin .
2. Frequency of Meetings .( 1 ) A meeting of the Board other than a special meeting referied to in rule 3. shall be held at least once in every month .
(2) The Board shall from time to time determine the date and time of its meeting :
Provided that where the Board is unable to do so for any reason, the Chairman may do so , for reasons to be recorded inwriting.
(3) A meeting of the Board shall be held at the Port premises at Tuticorin .
3. Calling of special meetings. The Chairman or, in his absence, the Deputy Chairman, if appointed , may whenever he thinks fit, and shall upon the written request of not less than three Trustees , call a special meeting
4. Circulation of agendaetc .--Agenda and notes or memo- randa thereon , if any , for any meeting of the Board shall be circulated to the Trustees atleast three days before the date of the meeting :
Provided that in the case of a special meeting , such Agenda and notes or memoranda shall be circulated atleast one day before the date of the meeting .
5. Discussion of items not included in the agenda -The Chairman or , in his absence , the Deputy Chairman if appoin- ted, may at his discretion , include for discussion at any of the meetings of the Board , including a special meeting , any item not included in the agenda if the same is, in his opinion , of sufficient importance or urgency on both and cannot he held over for the consideration of the Board at any subse- quent mecting .
6. Poll. If a poll is demanded on any question, the names of the Trustees voting and the nature of their votes shall be recorded by the President of the meeting .

G.S.R. 510 (E) . The following draft of the Board of Trustees of the Port of New Tuticorin (Procedure at Board Meetings) Rules , 1978 which the Central Government pro- poses to make in exercise of the powers conferred by sub- section ( i) of section 122 of the Major Port Trusts Act, 1963 (38 of 1963 ) , is hereby published as required under sub- section (2) of the said section for the information of all per- sons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on after the expiry of a period of forty five days from the date of publication of this notification in the Official Gazette . ог
2. Any objections or suggestions which may be received from any person with respect to the said draft before expiry of the said period will be taken into consideration bv the Central Government . the Explanation. For the purposes of this rule and rules 7 and 8 the expression " President " shall mean the Chairman oi , in his absence, the Deputy Chairman, if appointed and in the absence of both , any person chosen by the Trustees present from among themselves .
7 Minutes of the meeting.( 1 ) Minutes of the proceedings at each meeting of the Board shall be recorded in a book tobe provided for the Board for this purpose , which shall be signed as soon as practicable by the President of such meeting and shall be open to inspection by any Trustee during office hours .
(2) Minutes of the proceedings excepting such portion thereof as the Chairman or , in his absence the Deputy Chair- man, if appointed, may direct in any particular case . shall also be open to the inspection of the public at the office of theBoard during office hours .
(3) The names of the Trustees present at each meeting shall be recorded in the minutes book .
Adjournment of meeting. The President of a meeting, may with the consent of the Trustees present in the meeting, adjourn it to a later date , which date shall either be announ- ced at the meeting in which case intimation would be sent to the Trustees absent at the meeting atleast three days in advance , or communicate to the Trustees atleast three days before the date of the meeting .

2. उक्त धर्वाध की समाप्ति से पूर्व उक्त प्रारूप की बाबत जो भी भ्राक्षेप या सुझाव किसी व्यक्ति से प्राप्त होंगें केन्द्रीय सरकार उन पर विचार करेगी ।
नियमों का प्रारूप
1. संक्षिप्त नाम और लागू होना इन नियमों का संक्षिप्त नाम नव तूतीकोरिन पत्तन न्यासी बोर्ड ( न्यासियों की फीस और भर्ती का संवाय ) नियम, 1978 है ।
( 2) ये महापत्तन न्याम अधिनियम , 1963 ( 1963 का 38) की धारा 18 के उपबन्धों के अध्यधीन , नव तूतीकोरिन पत्तन न्यासी बोर्ड को और उसकी समितियों को भी लागू होंगे ।
2. संदेय फीस: अध्यक्ष, उपाध्यक्ष, यर्याव उसे नियुक्त किया गया हो तो या ऐसा कोई अन्य न्यासी जो सरकार का सेवक है , से भिन्न, बोर्ड का प्रत्येक न्यासी निम्नलिखित फीस का हकदार होगा:--
( i) बोर्ड के प्रत्येक साधारण या विशेष अधिवेशन में उपस्थिति के लिये पच्चीस रुपये :
परन्तु किसी कैलेण्डर गारा के दौरान हुए अधिवेशनों की बाबत किसी न्यासी की संत्रेय फीस की कुल रकम किसी भी दिशा में 150 रुपये से अधिक नहीं होगी ;
(ii) बोर्ड के साधारण या विशेष अधिवेशन के अनुयर्तन या तैयारी में उसी बिन होने वाले समिति के अधिवेशन से भिन्न, किसी समिति के प्रत्येक अधिवेशन में उपस्थिति के लिये 15 रु ० ।
टिप्पण: बोर्ड या उसकी ममिति के किसी अधिवेशन में उपस्थित न्यासी इस प्रयोजन के लिये रखी गई पुस्तक या रजिस्टर में अपने हस्ताक्षर करेंगे ।
3. यात्त्रा भतों का संदाय ( 1 ) बोर्ड या उसकी समितियों में से किसी के अधिवेशन में उपस्थित होने वाले और बाहर से आने वाले सभी न्यासी, नियम 2 के अधीन संदेय फीस के अतिरिक्त, उस मापमान पर यात्रा भत्ता पाने के हकदार होंगें जो केन्द्रीय सरकार के अधिकारियों के उच्चतम वर्ग को लागू होता है, किन्तु में कोई दैनिक भत्ता पाने के हकदार नहीं होगें ।
( 2) ऐसा न्यासी, जो सरकार का सेवक है और जो बोर्ड या उसकी समितियों में से किसी के अधिवेशन में उपस्थित होता है, उसे लागू होने बाले सेवा नियमों के उपबंधों के अनुसरण में यात्रा भत्ता और दैतिक भत्ता पाने का हकदार होगा ।

DRAFT RULES

(2) They shall subject to the provisions of section 18 of the Major Port Trusts Act , 1963 ( 38 of 1963 ) , apply te the Board of Trustees of the Port of New Tuticorin also to the Committees thereof. Ad
2. Fees payable . Every Trustee of the Board other than the Chairman, the Deputy Chairman , when appointed , or any other Trustee who is a servant of the Government , shall be entitled to a fee of-
(i) rupees twentyfive for attendance at each ordinary or special meeting of the Board :
Provided that the aggregate amount of fees payable to any Trustee in respect of the meetings held during any calendar month shall not exceed rupees one hundred and fifty.
( ii) rupees fifteen for attendance at each meeting of any Committee , other than the meeting of the Committee held on the same day in continuation or preparatory to an ordinary or special meeting of the Board.
Note : Trustee present at or for any meeting of the Board or Committee thereof shall sign his name in a book or register to be kept for the purpose .
3. Payment of Travelling Allowance.-( 1 ) All outstation Trustees , other than those who are Government servants, attending any meeting of the Board or of any of its commit- tees shall , in addition to such fee as is payable under rule 2, be entitled to receive travelling allowance on the scale applicable to the highest class of officers of the Central Government but shall not be entitled to receive any daily allowance .
(2) A Trustee who is a Government servant and who attends any meeting of the Board or of any of its committees shall be entitled to receive travelling allowance and daily allowance in accordance with the provisions of the service rules applicable to him .
