ORDER
New Delhi, the 10th November, 1978
S.O. 641(E)/18FA/18AA/IDRA/78.—Whereas Messrs Dr. Paul Lohmann (India) Limited, Calcutta owning an industrial under- taking at 145/1, Jessore Road, Calcutta-700055 (hereinafter referred to as the said industrial undertaking), is being wound up under the supervision of the Calcutta High Court and the business it the company is not being continued;
And whereas the Central Government, after obtaining per- mission from that High Court under section 15A of Industries (Development and Regulation) Act, 1951 (65 of 1951), (here- inafter in this Order referred to as the said Act) had caused an investigation to bo made by an Investigation Committee into the possibility of running or re-startng the said industrial undertaking;
And whereas the Central Government, being of the opinion that there arc possibilities of running or re-starting the said industrial undertaking and that the said' industrial undertaking should bo run or re-started, made an application under "ub- section (1) of section 18FA of the said Act to the Calcutta High Court praying for permission to appont the West Bengal pharmaceutical and Phytochemical Development Corporation Limited, Ilaco House (2nd Floor), 1 & 3, Brabourne Road, Calcurta-700001, to take over the mangement of the said in- dustrial undertaking and that the High Court, has, by its Order dated the 21st September, 1978, granotd the said permission.
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 18FA read with section 18AA of the said Act, the Central Government hereby authorises the West Bengal Pharmaceutical and Phytochemical Development Corporation Limited, Ilaco House (2nd Floor), 1 & 3, Bar- bourne Road, Calcutta-700001 (hereinafter referred to as the authorised person), to take over tho management of the whole of the said industrial undertaking owned by the Messrs Dr. Paul Lohmann (India) Limited, Calcutta, subject to the following terms and conditions, namely :—
(i) the authorised person shall comply with all directions issued from time to time by the Central Govern- ment;
(ii) the authorised person shall hold office for three yeari from the date of publication of this Order in tho Official Gazette; and
(iii) the Central Government may terminate the appoint- ment of the authorised person earlier if it consider it necessary to do so.
2. This Order shall have effect for a period of three y?8** commencing from the date of its publication in the Official Gazette.
