सा० फा० ति० 564 (प्र ) केन्द्रीय सरकार , पुरावशेष तथा बहुमूल्य कलाकृति अधिनियम , 1972 ( 1972 का 52 ) की घारा 31 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , पुरावशेष तथा बहुमूल्य कलाकृति नियम, 1973 में निम्नलिखित संशोधन करती है, अर्थात्
(1 ) इन नियमों का नाम पुरावशेष तथा बहुमूल्य कलाकृति ( संशो- घन) नियम, 1978 है ।
( 2) ये राजपक्ष में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पुरात्रशेष तथा बहुमूल्य कलाकृति नियम, 1973 में, (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) नियम 3 में, स्पष्टीकरण के पश्चात् निम्मलिखित शब्द जोड़े जाएंगे , अर्थात्:-
"महानिदेशक द्वारा इस निमित्त सम्यक् रूप से प्राधिकृत" ।
3. उक्त नियमों के नियम 5 के उप नियम ( 2 ) के स्थान पर मिम्नलिखित रखा जाएगा , अर्थात्:-
"( 2 ) उपनियम ( 1 ) के अधीन धनुवत्त प्रत्येक अनुज्ञप्ति, जारी किए जाने की तारीख से वो वर्ष के लिए विधिमान्य होगी । दो वर्ष की यह अवधि अनुज्ञापन अधिकारी द्वारा एक वर्ष के लिए बढ़ाई जा सकती है , यवि ऐसे बढ़ाए जाने के लिए भावेदन उस प्रभु- ज्ञप्ति की समाप्ति की तारीख से कम -से -कम दो मास पूर्व उसे प्राप्त हो जाए और अनुज्ञप्तिधारी का कार्य अनुज्ञापन अधिकारी के समाधानप्रद रूप में हो । "

4. उक्त नियमों के नियम 6 में-
( 1) शर्त (क) में:-
(क) प्रथम परन्तुक में, प्रविष्टि "प्ररूप I" के स्थान पर प्रविष्टि 'प्ररूप I क' रखी जाएगी ;
(ख) द्वितीय परम्लुक के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्ः-
"परन्तु यह और कि अनुज्ञप्तिधारी की मृत्यु की दशा में, तब जब अनुज्ञप्तिधारी कोई व्यष्टि हो, भूतपूर्व अनुज्ञप्तिधारी के विधिक वारिस को, किसी फीस के संवाय के बिना, प्ररूप II क में एक मई अनुज्ञप्ति अन- वसित अवधि के लिए इस शर्त के अधीन रहते हुए अनुवत्त की जा सकती है कि ऐसे वारिस द्वारा अनुज्ञापन अधिकारी को प्ररूप I क में एक आवेदन किया जाए और प्रनुज्ञापन अधिकारी का आवेदक के संबंध में, नियम 5 में उल्लिखित तथ्यों की बाबत समाधान हो जाए"
( 2) विद्यमान शर्त ( ख ) के स्थान पर, मिम्नलिखित रखा जाएगा, अर्थात्:--
"(ख ) कोई अनुज्ञप्तिधारी अनुज्ञप्ति के प्रस्तर्गत माने वाले कारवार के संबंध में भागीदारी नहीं करेगा, या मवि अनुज्ञप्तिधारी पहले ही भागीदारी फर्म है तो, वह उसमें और भागीदारी नहीं करेगा:
परन्तु यषि अनुज्ञप्तिधारी धनुज्ञप्ति के अन्तर्गत भाने वाले कारबार के संबंध में यथास्थिति भागीदारी या बगे चौर भागीदारी करता चाहता है तो, सभी प्रस्थापित भागीवार, जिसमें वर्त- मान भागीदार भी हैं , अनुज्ञापन अधिकारी को प्ररूप Iफ में आवेदन करेंगे और यवि अनुज्ञापन अधिकारी का सभी प्रस्थापित भागीदार/ भागीदारों के संबंध में, नियम 5 में उल्लिखित सभी तथ्यों की 1120

बाबत समाधान हो जाता है तो यह बिना बिसी प मंदाय के एक नई अनुज्ञप्ति अनवसित अवधि के लिए , प्रत्त्प IIक, में जारी कर सकता है" ;
पर वह अनुज्ञापन अधिकारी को , प्ररूप VI में स्टाक की घोषणा भेजेगा ।"
5. उक्त नियमो के नियम 7 मे
( 3) विद्यमान प्रशर्तें ( ४ ) के स्थान पर निम्नलिखित रखा जायेगा,
अर्थात् --
" (ङ) कोई अनुज्ञप्तिधारी , अनुज्ञप्ति के चालू रहने के दौरान, श्रमुज्ञप्ति के अन्तर्गत आने वाले अपने कारबार को किसी नये परिसर में नहीं ले जायेगा । तथापि , यदि वह ऐसा करना चाहता है तो वह अनुज्ञापन अधिकारी को प्ररूप Iक में आवेदन कर सकता है और यदि अनुज्ञापन अधिकारी का, प्रस्थापित परिसर के संबंध में , उक्त अधिनियम की धारा 8 (ख ) में उल्लिखित तथ्य की बाबत समाधान हो जाता है तो यह श्रनुज्ञप्ति को तवनुसार उपान्तरित कर सकता है । उपान्तरित अनुज्ञप्ति नये परिसर के संबंध में केवल ऐसे उपान्तरण की तारीख से विधिमान्य होगी ";
(4) पार्टी ( क्ष) के पश्चात् निम्नलिखित शर्तें अन्त स्थापित की जायेंगी ,
अर्थात्
" ( अ) भागीदारी की समाप्ति/विधटन द्वारा अमुज्ञप्ति के पर्यवसाम की दशा में , अनुज्ञप्ति के भूतपूर्व धारकों को , पर्यवसान की तारीख को उनके कब्जे में के पुरावशेषों का, अनुज्ञप्ति के पर्यवसान की तारीख से छह मास के भीतर किसी प्रनुज्ञप्तिधारी या भारत के किसी मान्यता प्राप्त संग्रहालय को विक्रय करने के लिये अनुज्ञात किया आयेगा. परन्तु यह तब जब अनुज्ञप्ति के भूतपूर्व धारक ने , शर्ते ( ट) और ( ड) में आधकथित के अनुसार प्ररूप V में अपमा स्टाक समुचित रूप में घोषित किया हो ।
( ट) अनुज्ञप्ति की समाप्ति की ारीख से दो मास पूर्व प्रत्येक अनुज्ञप्तिधारी , अनुज्ञापन अधिकारी का प्ररूप V में , स्टाक की एक घोषणा भेजेगा और अनुज्ञप्ति की समाप्ति की तारीख से ठीक छह मास पश्चात् स्टाक की एक अन्य घोषणा प्ररूप VI मैं भेजेगा ।
(क) प्रानि के ग्रत्त्रान के लिये किसी शर्त के पालन न किये जाने के कारण अनुज्ञप्ति के प्रति संहरण की दशा में भूतपूर्व अनुशन्तिधारी प्रतिसंहरण के 15 दिन के भीतर प्ररूप V में स्टाक की घोषणा अनुज्ञापन अधिकारी को प्रस्तुत करेगा ।
( ड) अनुज्ञप्ति की धारक भागीदारी फर्म के विषटन की दशा मे, फर्म का प्रत्येक भागीवार विघटन होने पर तुरन्त संयुक्त रूप से या व्यक्तिगत रूप से अनुज्ञापन अधिकारी को प्ररूप V में स्टाक की षोषण। और विघटन की तारीख से छह मास के तुरन्त पश्चात् प्ररूप VI मे स्टाक की एक अन्य घोषणा भेजेगा ।
( ४) वह अनुज्ञप्तिधारी जो अपना अनुज्ञप्ति अभ्यर्पित करना चाहता है, अनुज्ञापन अधिकारी को प्ररूप X में आवेदन करेगा । आवेवन के साथ प्ररूप V में स्टाफ की घोषणा होगी । यदि अनुज्ञापन अधिकारी का यह समाधान हो जाये कि अनुज्ञप्ति- धारी ने अनुज्ञप्ति की सभी शर्तों का पालन किया है तो वह अभ्यर्पण स्वीकार कर सकता है और ऐसी स्वीकृति की तारीख से अनुज्ञप्ति पर्यवसित हुई समझी जायेगी । इससे अनुज्ञप्तिवारी किसी भी रूप में अनुज्ञप्ति फीस के प्रतिदाय के रूप में किसी प्रतिकर का हकदार नहीं होगा ।
(ण ) उस अनुज्ञप्तिधारी को, जिसने अपनी अनुज्ञप्ति अभ्यर्पित की है, घोषित पुरावशेषों को, उसकी अनुज्ञप्ति के अभ्यर्पण की स्वीकृति की तारीख से छह मास तक किसी अन्य अनुज्ञप्तिधारी या भारत के किसी मान्यताप्राप्त संग्रहालय को विक्रय करने के निरे प्रनुज्ञात किया जायेगा, परन्तु उक्त छह मास की समाप्ति (क) " ऐली अतिरिक्त अवधि के लिये नवीकृत किया जा सकेगा जो तीन वर्ष से अधिक न हो, जैसा अनुज्ञापन आफिसर उचिा ममझे" शब्दो के स्थान पर " एक समय पर दो वर्ष की और प्रवधि के लिये नवीकृत किया जा सकेगा" शब्द रखे जायेगे;
(ख) नियम 7 के पश्वात् निम्नलिखित परन्तुकः अन्ता स्थापित विया जायेगा, अर्थात्: -
"परन्तु यह तब जब ऐसा आवेदन, अनुज्ञापन अधिकारी को अनुज्ञप्ति की समाप्ति की तारीख से कम-से- कम दो मास पूर्व प्राप्त हो जाये और उसके साथ प्ररूप VI में स्टाक की घोषणा हो । "
6 उक्त नियमो के नियम 8 के उपनियम ( क) में से, "श्रीर बहुमूल्य कनाकृतिया" शब्दो का लोप किया जायेगा ।
7. उक्त नियमो के नियम 9 में , " धारा 12 के अधीन घोषणा" शब्दों के स्थान पर " धारा 12 और नियम 6 तथा 7 के अधीन घोषणा" शब्द रखे जायेंगे ।
8 नियम 11 के उपनियम ( 2 ) में , " पोस्टकार्ड या बड़े आकार की फोटोचित्र की चार प्रतियां" शब्दो के स्थान पर " पोस्ट काई या क्यार्टर प्राकार की फोटोचित की तीन प्रतियो, " शब्द रखे जायेंगे ।
9. नियम 14 के पश्चात्, निम्नलिखित भन्तःस्थापित किया जायेगा, अर्थात्:--
" 15.. अभियोजन की मंजूरी महानिदेशक देगा-
महानिदेशक अधिनियम की धारा 25 की उपधारा ( 1 ) के अधीन अपराधों के लिये अभियोजन संस्थित करने या अभियोजन चलाने को मजूरी देने के लिये अधिनियम की धारा 26 की उपधारा ( 1 ) के शब्दों में सक्षम अधिकारी होगा ।"
10. नियमो के पश्चात् निम्नलिखित टिप्पण अन्तःस्थापित किया जायेगा, अर्थात्
"टिप्पण: नियम 6 की ( आ) से ( ण) तक की शर्तों में और नियम 9 के उपनियम ( ख) में निदिष्ट प्ररूप V और VI में की घोषणायें रजिस्ट्रीकृत डाक द्वारा या व्यक्तिगत रूप से की जायेगी । "
11. प्ररूपों में,
(क) प्ररूप I के पश्चात् निम्मलिखित प्ररूप अन्तःस्थापितकिया जायेगा, अर्थात्:-
" प्ररूप I क [नियम 6 देखिए]
जिस अनुज्ञप्ति के धारक की मृत्यु हो गयी है, या जिसके धारक (धारकों) ने अन्य को अपना/ अपने कारवार अन्तरित कर विया है। विए हैं या जिसका ( के ) धारक भागीदारी/ और भागीदारी करने की प्रस्थापना करता है ( करते हैं ) । उस अनुज्ञप्ति के स्थान पर , पुरावशेषों के विक्रय या विक्रय की प्रस्थापना करने के कारबार को चलाने के लिए नई अनु- ज्ञप्ति के लिये आवेदन
1. आवेदक/भावेदकों का माम और पता ।
2. शाखाओं या उसके संमपाश्विकों सहित फर्म के नाम और पता और सम्य नाम ( उपनाम) और पत्ते जो पिछले दस वर्षों में रहे हों ।

3 उन भागीदारों , यवि कोई हा के नाम और पने , जिनमे कुटुम्ब के ये वयस्क सदस्य सम्मिलित होंगे जिनका कारबार में कोई हित अण है । या
टिप्पण यदि यह प्राबेदन विद्यमान भागीदारी में प्रस्थापित प्रवेश या उसके प्रस्थापित विस्तार के परिणामस्वरूप है तो, पपेक्षित ब्योरे विश्भनान धारकों और प्रस्थापित धारकों के लिये पृथक्रत. दिए जाने चाहिए ।
4 शोरूम/विक्रय परिसर के पते ।
5 सभी गोदामो और निक्षेपागारो के पने जिनने घटकों के निवासीय परिसर भी सम्मिलित हैं ।
6 अपने अनुभव का ब्वौरा देते हुए वह श्रवधि जिसके दौरान आवेदक कारद्वार करता रहा है ।
7. क्या आयेवक/फर्म ( सभी संषटको को व्यष्टित. और सयुक्तत: मम्मिलित करते हुए ) को पुरावशेष ( निर्यात नियंत्रण ) अधिनियम, 1947 के अधीन दण्डनीय किनी श्रपराध के लिये या पुरावशेषों की चोरी या मस्करी के किसी अन्य मामले में मिद्यदोप किया गया है , यदि ऐसा है तो उसके ब्यौरे दिये जायें ।
8. क्या आवेत्रक/फर्म (व्यष्टित. या संयुक्त. सभी संघटकों को सम्मिलित करते हुए ) पुरावशेष ( निर्यात नियंत्रण ) , अधिनियम, 1947 के उल्लधन या पुरावशेष या बहुमूल्य कलाकृति की चोरी के बारे में अभियोजन/ अन्वेषण/ जांच के अधीन है ।
9. क्या धावेदन की तारीख तक का सारा स्टाक भाषेवक के रजिस्टर में दर्ज कर दिया गया है ।
10. जिला और राज्य सहित वह प्राभ , कस्बा या नगर जहां धावेदक कारबार करने का आशय रखता है ।
11. प्रकृति, धर्थात् उन पुरावशेषो के प्रकारो के व्यौरे जिनमे आवेदक संव्यवहार करना चाहता है जैसे कि प्रस्तर कलाकृतियां धातु की वस्तुएं , काष्ठ की वस्तुएं, मिक्के, रगचित्त्र, पाण्डुलिपियां, आभूषण तथा उमी प्रकार की अभ्य वस्तुए ।
12 कब्जे मे उन सभी वस्तुओ की प्रवर्ग के अनुसार सूची जिनके बारे में आवेदक ने यह दावा किया है कि वे उसके पास पुरावशेष है , जिनमें वे वस्तुएं भी आती हैं जो रजिस्ट्रीकरण अधिकारी के यहा रजिस्ट्रीकृत हो गई है ।
13. उस अनुज्ञाप्ति की विशिष्टियां, जिसके बदले में नई अनुज्ञाप्ति की अवश्यकता है ।
(क) सं० ( ख) तारीख ( ग) श्रनुज्ञाप्तिधारी का ( क ) नाम ( घ) तारीख सहित वह अवधि , जिसके लिये जारी की गई/ नवीकृत कीगई है ।
14. वह परिस्थिति, जिसके परिणामस्वरूप यह भावेदन किया गया है । ( अनुशाप्तिधारी की मृत्यू/ कारबार क। अम्तरण/ भागीदारी में प्रवेश/ विश्द्यमान भागीदारी का विस्तार । मबूत दीजिए ।
15. मै/हम घोषण करता हू/ करते हैं कि उपरोक्त सूचना मेरे/ हमारे उत्तम ज्ञान और विश्वाम के आधार पर शुद्ध और पूर्ण है । मैं/ हम यह बचन भी देता हूं देते हैं कि में हम पुरावशेष तया बहुमूल्य कलाकृति अधिनियम, 1972 के उपबन्धों और तवधीन बने नियमों का पालन करूंगा। करेंगे । मैं / हम पूर्व वर्ष ( 19 19.) के लिये आयकर प्रभाणपत्र की अनुप्रमाणित प्रति तथा कारवार स्थापन का रजिस्ट्रीकरण मंख्या भी सलग्न करना हूं। करते हैं । मैं। हम यह बचन भी देता हूं/देते है कि पते के किसी पते के किसी परिवर्तन या मये गोदाम के अर्जन के बारे मे सूचना एक सप्ताह के अन्तर दूंगा देंगें ** । मैं/ हम यह वचन भी देता हूँ। देते है कि ऐसे अभिलेख , फोटोषित और रजिस्टर रखूंगा/ रखेंगे और अपने खर्चे पर ऐसी विशिष्टियो और फोटोचिस्रो सहित , जो नियम के अधीन अपेक्षित किए जाएं , कालिक विवरणियां प्रस्तुत करूंगा/ करेगे । मैं/ इम यह हर ना देशाते हैं कि मैं प्रत्येक अभिलेख , फोटोचित्त्र और रजिस्टर , जो डरा संबंध में रखे गये है, अनुज्ञापन अधिकारी या इस निर्मित अनुज्ञापन अधिकारी द्वारा लिखित रूप में प्राधिकृत सरकार के किसी अन्य राजपत्रित अधिकारी के निरीक्षण के लिये उपलभ्य करूंगा करेंगें ।

अनुज्ञप्ति उक्त अधिनियम के उपबन्धों तथा नियमों के अधीन अनुदत्त की जाती है और वह निम्नलिखित शर्तों के अधीन भी होगी;

New Delhi , the 30th November, 1978
G.S.R. 564(E). In exercise of the powers conferred by sec- tion 31 of the Antiquities and Art Treasures Act , 1972 (52 of 1972 ) , the Central Government hereby makes the follow- ing amendments in the Antiquities and Art Treasures Rules . 1973 , namely :-
(1) These rules may be called the Antiquities and Art Treasures (Amendment ) Rules , 1978 .
(2 ) They shall come into force on the date of their pub- lication in the Official Gazette
2. In the Antiquities and Ast Treasures Rules , 1973 (here- inafter referred to as the said rules ) , in rule 3 , at the end THE GAZETTE OF INDIA EXTRAORDINARY

of the explanation, the following words shall be added namely :-
"duly authorized in this behalf by the Director General" .
3. for sub - rule (2) of rule 5 of the said rules , the following shall be substituted, namely :-
"(2) Every licence granted under sub- rule ( 1 ) , shall be valid for two years from the date of issue . 'This period of two years may be extended by one year by the licensing officer , if application for such extension is received by him at least two months before the date of expiry and the licen- sing officer is satisfied with the performance of the licensee" .
4. In rule 6 of the said rules ,-
(i ) in condition (a ) ,-
(a) in the first proviso , for the entry " Form I " , the entry "Form IA" shall be substituted;
(b) for the second proviso , the following shall be substituted, namely :-
"Provided further that in the case of the death of licensee , when the licensee is an individual , a fresh licence for tho unexpired period of the licence can be granted in Form IIA . without payment of any fee , to the legal heir of the late licensee subject to the condition that an application in Form IA is made by that heir to the licensing officer , and the licensing officer is satisfied with the factors mentioned in rule 5, in regard to the applicant" ;
(ii) for the existing condition (b ) , the following chall be substituted , namely :-
"(b) No licensee shall enter into partnership , or if the licensee is already a partnership firm , into further partnership , in regard to the business covered by the licence :
Provided that if the licensee wants to enter into partner- ship or further partnership , as the case may be , in regard to the business covered by the licence , all the proposed partners including the existing one ( s ) may apply in Form IA to the licensing officer and if the licensing officer is satisfied with all the facts mentioned in rule 5 in regard to all the proposed partner (s ) he may issue a fresh licence in Form ILA for the unexpired period of the licence without payment of any fee" .;
(iii ) for the existing condition ( e ) , the following shall be substituted , namely :-
" ( e) No licensee shall shift his business covered by the licence to new premises during the currency of the licence . However, if he wants to do so , he may apply in Form IA to- the- licensing officer and if the licensing officer is satisfied with the fact mentioned in section 8 ( b ) of the said Act, in regardto the proposed premises , he may modify the licence accordingly . The modified licence shall be valid in regard to the new premises only from the date of such modification" ;
(iv) after condition ( i ) , the following conditions shall be inserted, namely :-
" (j ) In case of termination of a licence through expiry/ dissolution of partnership , the ex -holders of the licence shall be allowed to sell the antiquities in his/her/their possession on the date of termination to a licensee or recognised museum in India within six months of the date of termination of the licence provided the ex-holder of the licence has /have pro- perly declared his/her/ their stock in Form V as laid down In conditions (k) and (m) .
(k) Two months before the date of expiry of a licence , every licensee shall send to the licensing officer a declaration of stock in Form V and another declaration of stock in Form VI immediately after six months from the date of expiry .
(1) In the case of revocation of a licence for non - comp- liance with any condition for the grant of a licence , an ex- licensee shall submit a declaration of stock in Form V to the licensing officer within fifteen days of revocation .
(m) In the case of dissolution of a partnership firm , which holds a licence, every partner in the firm shall immediately on dissolution, jointly , or severally, send to the licensing officer a declaration of stock in Form V and another declara-

tion of stock in Form VI immediately after six months from the date of dissolution .
(n) A licensee who wants to surrender his licence shall apply in Form X to the licensing officer. The application shall be accompanied by a declaration of stock in Form V. If the licensing officer is satisfied that there has been comp liance with all the conditions of the licence by the licensee , he may accept the surrender and the licence shall be deemed to have terminated from the date of such acceptance . This shall not entitle the licensee to any compensation by way of refund of licence fee in any form .
(o) The licensee who has surrendered his licence shall be allowed to sell the antiquities declared to another licensee or recognised museum in India upto six months from the date of acceptance of the surrender of his licence provided that on the expiry of such six months , he shall send to the licen- sing officer a declaration of stock in Form VI .
5. In rule 7 of the sald rules :-
(a) for the words " for such further period not exceeding three years , as the licensing officer may deem fit " the words " for a further period of two years at one time " shall be substituted.
(b) after rule 7, the following proviso shall be inserted , namely :-
"Provided that such application is received by the licen- sing officer at least two months before the date of expiry of the licence and is accompanied by a declaration of stock in Form V" .
6. In rule 8 of the said rules , in sub - rule ( a) , the words "and art treasures " shall be deleted .
7. In rule 9 of the said rules for the words " declaration under section 12" the words " declaration under section 12 and rules 6 and 7 " shall be substituted .
8. In rule 11 , sub - rule ( 2 ) , for the words " four copies of photographs in post card or large size " the words " thiee copies of photographs in post card or quarter size " , shall be substituted.
9. After rule 14, the following shall be inserted , namely :-
"15. Director General to sanction prosecution . The Dir- ector General shall be the officer competent in terms of sub- section ( 1 ) of section 26 of the Act , to institute , or to sanc- tion institution of , prosecution for offences under sub - section (1) of section 25 of the Act."
10. After the rules , the following note shall be inserted , namely :-
"Note : The declarations in Form V and VI referred to in conditions ( j ) to ( o) of rule 6 and sub- rule (b) of rule 9 , shall be made either by registered post or in person" .
11. In the forms-
(a) After Form I, the following Form shall be inserted namely :-

Application for grant of a fresh licence for carrying on business of selling or offering to sell antiquities in lieu of one, the holder of which has died, or the holder(9) of which has/have transferred his/their business to other( s) or the holder( s) of which propose(s) to enter into partnership /further partnership.
