शा०पा० 700 ( ८) .- केन्द्रीय सरकार, उद्योग ( विकास और विनि- यमन) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 -छ और 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सीमेंट नियंत्रण आदेश, 1967 में अग्रेतर संशोधन करने के लिए निम्नलिखित आवेश करती है, प्रर्यात्ः-
1. ( 1 ) इस आदेश का संक्षिप्त नाम सीमेंट नियंत्रण ( चतुर्थ संशोधन) आदेश 1978 है ।
( 2) यह तुरन्त प्रवृत्त होगा ।
2. (क) सीमेंट नियंत्रण आदेश , 1967 के नियम 8 के उप- नियम (क) (जिसे इसके बाद उक्त आदेश प्रयोग किया जायेगा) में अंक 285.35 को अंक 325.26 से प्रतिस्थापित किया जाएगा ।
(ख) उक्त श्रादेश के नियम 7 के उपनियम (ख ) में अंक 276.35 को अंक 316.26 से प्रतिस्थापित किया जाएगा ।
(ग) उक्त प्रदेश के नियम 8 के उपनियम (ग ) में अंक 253.35 को अंक 293.26 से प्रतिस्थापित किया जाएगा ।

टिप्पणी ( 1 ) शीघ्र कड़ा होने वाले सीमेंट , निम्न प्रकार ताप सीमेंट और उच्च प्रबलता की मामूली पोर्टलैंड सीमेंट की दशा में 12 रु ० प्रति मी० टन की अतिरिक्त कीमत और जलसह (जल विरागी ) सीमेंट की दशा में 21 रु ० प्रति भी० टन की अतिरिक्त कीमत ऊपर विनिर्दिष्ट कीमत में जोड़ दीजाएगी ।
( 2) दुर्गापुर सीमेंट वर्क्स, दुर्गापुर की बाबत सीमेंट की कारखाना बाह्य कीमत इस आधार पर निकाली गई है कि 4 लाख मी० टन स्लैग सीमेंट का उत्पादन करने में , कच्चे माल में 2 लाख मी० टन स्लैग , एक लाख मी० टन क्लिंकर जो सिल्वा विस्तार स्कीम द्वारा सप्लाई किया किया जायेगा, और एक लाख मी ० टन क्लिंकर जो विद्यमान यूनिटों द्वारा सप्लाई किया जाएगा, होगा ।
( 3) ऊपर लिखी कीमत के अतिरिक्त , बोकाजन मामलूह चेरा स्थित सीमेंट यूनिटें, सरकारी संकल्प सं ० 1-32/ 74 केम० तारीख 1 जुलाई, 1977 के अनुसर , प्रति मी० टन क्रमशः 90.65 रु० और 79.10 अतिरिक्त प्रतिधारण कीमत लेने की पात होगी ।
(4) पण्यम सीमेंट एंड मिनरल इण्डस्ट्रीज लिमिटेड और कैशोराम सीमेंट लि० की कारखाने से निकालते समय की सीमेंट की कीमत पुनः सरकार के संकल्प सं ०1-22/ 76 सीमेंट दिनांक 9 सितम्बर , 1977 के अनुरूप उनके द्वारा क्रमशः 4.88 से 5.31 और 4.5 से 7 लाख मी० टन प्रति वर्ष क्षमता विस्तार के कारण पुनः निर्धारित की गई है ।

ORDER
S.O. 700 (E) In exercise of the powers conferred by Sections 18G and 25 of the Industries ( Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government hereby makes the following order further to amend the Cement Control Order, 1967, namely :-
1. ( i) This Order may be called the Cement Control (Fourth Amendment) Order , 1978
[PART II- SEC . 3 ( ii ) ]
(ii) It shall come into force with immediate effect .
2. (a) In sub-clause ( a) of clause 8 of the Cement Control Order , 1967 (hereinafter refferred to as the siad Order) , for the figure " 285.35" , the figure " 325.26 " shallbe substituted
(b) In sub -clause (b) of clause 8 of the sald Order , for the figure " 276.35 " , the figure " 316-26 " shall be substituted,
(c) In sub -clause ( c) of clause 8 of the said order, for the ligure " 253.35" , the figure " 293.26 . " shall be substituted .
3. For the Schedule to the said Order , the following Schedule shall be substituted , namely :-

NOTE :-( 1 ) In the case of rapid hardening cement , low heat ce- ment and high strength ordinary portland cement an additional price of Rs . 12 per tonne and in the case of water - proof (hydrophobic ) coment , an additional ) price ) of Rs . 21/- per tonne may be added to price specified above .
(2) The ex- factory price of cement in respect of Durgapur cement works, Durgapur , has been arrived at on the basis that in producing 4 lakh tonnes of slag cement the raw materials will consist of 2 lakh tonnes of slag one lakh tonnes of clinker to be supplied by Tilda expansion scheme and one lakh tonnes of clinker to be supplied by existing units .
(3) In addition to the price noted above , the Coment units at Bokajan and Mawmluh - Cherra will be eligible to an additional retention price of Rs . 90.65 and Rs . 79.10 per tonne respectively in terms of Government Resolution No. 1-32/74- Cem. dated the 1st July , 1977 1504/1

(4) Ex -works prices of Panyam Cements & Mineral Industries Ltd. & Kesoram Cements Ltd. have been refixded in the light of the Government Resolution No. 1-22/ 76 - Cem . dated the 9th Sept. 1977 consequent on the expansion of their capacity from 4.88 . to 5.31 and from 4.5 to 7 lakh tonnes per annum respectively .

का० ग्रा० 701 ( प्र). केन्द्रीय सरकार आवश्यक वस्तु अधिनियम 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा प्रायातित सीमेंट नियंत्रण आदेश, 1978 में निम्नलिखित प्रग्रेतर संशोधन करती है , अर्थात्ः-
1. ( 1 ) यह आदेश आयातित सीमेंट मियंत्रण ( पांचवां संशोधन) आवेश, 1978 कहलायेगा ।
( 2) यह तुरन्त लागू होगा ।
(3) आयातित सीमेंट नियंत्रण आदेश 1978 की धारा 6 में 368.95 अंक के स्थान पर 408.86 अंक प्रतिस्थापित किए जाएंगे ।

1. (1) This order may be called the Imported Cement Control (Fifth Amendment) Order , 1978
(ii) It shall come into force immediately .
2. In clause 6 of the Imported Cement Control Order , 1978 , for the figure " 368.95 " , the figure " 408.86" shall be substituted.
