रुः० ८१० 704 ( श्र ) केन्द्रीय सरकार का यह समाधान हो गया है कि 15 नवम्बर , 1978 को राजस्थान राज्य के बूंदी जिले में स्थित केशोरायपाटन मेंस्थित चीनी का विनिर्माण करने वाली श्री केशोरायपाटन सहकारी चीनी मिल लिमिटेड (जिसे इस आवेश में इसके पश्चात् उक्त श्रीनी उपक्रम कहा गया है ) के पास, 15 नवम्बर, 1978 के पूर्व क्रय किए गए गश्न के संबंध में, गन्ना विकास संबंत्री देव, चोनी गई 1977-78 के शेरान उक्स चोती उपक्रम के प्रयोजनों के लिए इस प्रकार क्रय किए गए गन्ने को हुन कोपन के वस प्रतिशत से अधिक बकाया है ;
और केन्द्रीय सरकार ने उक्त चीनी उपक्रम केस्वामी को श्रीनी उपक्रम ( प्रबन्ध ग्रहण) अध्यादेश, 1978 ( 1978 का 5 ) की धारा 3 की उपधारा ( 1) के अधीन 20 नवम्बर, 1978 को सूचना संख्या चीनी/ 226/78-79 जारी की थी जिसमें उससे यह कहा गया था कि उक्त सूचना की प्राप्ति की तारीख से सात दिन के भीतर उन परिस्थितियों को लिखित रूप में बताए , जिनके कारण उक्त चीनी उपक्रम 15 नवम्बर, 1978 को या उसके पूर्व चीनी का विनिर्माण प्रारम्भ करने में असफल रहा है तथा उक्त चीनी उपक्रम गश्ना संबंधी वेय के उक्त बकाया को चुकता करने में असफल रहा है और यह हेतुक वशित करे कि उक्त चीनी उपक्रम का प्रबन्ध केन्द्रीय सरकार द्वारा क्यों न ग्रहण कर लिया जाए ;
और केन्द्रीय सरकार का, उक्त चीनी उपक्रम की ओर से श्री केशोराय- पाटन सहकारी चीनी मिल लिमिटेड, डा ० घर केशोरायपाटन , जिला बूंदी,

राजस्थान के पदेन अध्यक्ष द्वारा भेजी गई रिपोर्ट तारीख 1-12-78 पर विचार करने के पश्चात्, उन परिस्थितियों की बाबत जिनके कारण 15 नवम्बर, 1978 तक चीमी का उत्पावन भ्रारम्भ नहीं कर सका और गश्ना संबंधी देय वस प्रतिशत से अधिक बकाया रह गया है और गन्ना संबंधी देय के उक्त बकाया को चुकता करने में उक्त चोनी उपक्रम की असमर्थता की बाबत समाधान नहीं हुआा है ।
अतः, अब , केन्द्रीय सरकार , उक्त अध्यादेश की धारा 3 की उपधारा ( 2) के खण्ड ( ख) द्वारा प्रवल शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि उक्त चीनी उपक्रम का प्रबन्ध , 13 दिसम्बर , 1978 को और उससे प्रारम्भ होने वाली तीन वर्ष की अवधि के लिए केन्द्रीय सरकार में निहित होगा ।

S. O. 704(E) . Whereas the Central Government being satis- fied that as on the 15th day of November , 1978, the Shri Keshoraipatan Sahkari Sugar Mills , Limited (hereinafter in this Order referred to as the said sugar undertaking ) manufacturing sugar at Keshoraipatan in the District of Bundi in the State of Rajasthan has failed to commence manufacture of sugar by the 15th day of November , 1978 and has , in relation to the cane purchased before the 15th day of November , 1978 ,

arrears of cane dues to the extent of more than ten per cent of the total price of the cane so purchased for the purposes of the said sugar undertaking during the 1977-78 sugar year ;
And whereas , the Central Goernment on the 20th day of November , 1978 issued Notice No. SUG/ 226/ 78-79 under sub -section ( 1) of section 3 of the Sugar Undertakings (Taking Over of Management ) Ordinance , 1978 ( 5 of 1978 ) to the owner of the said sugar undertaking calling upon him to report in writing within seven days from the date of re- ceipt of the said notice the circumstances under which the said sugar undertaking has failed to commence the manu- facture of sugar on or before the 15th day of November , 1978 , and the said sugar undertaking has failed to clear the said arrears of cane dues , and to show cause as to why the management of the said sugar undertaking should not be taken over by the Central Government ;
And whereas, the Central Government ,having considered the report , dated the 1st December , 1978 sent by the Ex - Officio Chairman of Shri Keshoraipatan Sahakari Sugar Mills Ltd. , P. O. Keshoraipatan , Dt. Bundi , Rajasthan on behalf of the said sugar undertaking is not satisfied with the circumstances for the failure to commence manufacture of sugar by the 15th day of November , 1978 and for having the arrears of cane dues in excess of ten per cent and with the inability of the said sugar undertaking to clear the said arrears of cane dues :
by Now, therefore , in exercise of the powers conferred clause (b) of sub- section (2) of section 3 of the said Ordinance , the Central Government hereby declares that the management of the said sugar undertaking shall vest in the Central Govern- ment for a period of three years commencing on and from the 13th December , 1978 .
S.O. 705(E ) . Whereas the Central Government being satis- fied that as on the 15th day of November, 1978 , the Jijamata Sahkari Sakhar Karkhana Ltd. (hereafter in this Order re- ferred to as the said sugar undertaking ) manufactuuring sugar at Shankarnagar in the District of Buldana in the State ofMaharashtra has , in relation to the cane purchased before the 15th day of November , 1978 , arrears of cane dues to the extent of more than ten per cent of the total price of the cane so purchased for the purposes of the said sugar under- taking during the 1977-78 sugar year ;
And whereas, the Central Government on the 21st day of November , 1978 , issued Notice No. SUG/ 257 / 78-79 under sub- section ( 1) of section 3 of the Sugar Undertakings (Tak- ing Over of Management) Ordinance , 1978 ( 5 of 1978) , to the owner of the said sugar undertaking calling upon him to report in writing within seven days from the date of receipt of the said notice the circumstances under which the said sugar undertakings has failed to clear the said arrears of cane dues and to show cause as to why the management of the said sugar undertaking should not be taken over by the Central Government ;
And whereas the Central Government, having considered the report No. GEN/ AD/ 1 / 1978-79 , dated 1st December , 1978 sent by the Chairman and the Managing Director, Jija- mata Sahakari Sakhar Karkhana Ltd. , Shankarnagar (Dusar- bid), Maharashtra on behalf of the said sugar undertaking , is not satisfied with the circumstances for having the arrears of cane dues in excess of ten per cent . and with the inabi- lity of the said sugar undertaking to clear the said arrears of cane dues ;

फा० प्रा० 705 ( प्र) केन्द्रीय सरकार को यह समाधान हो गया है कि15 नवम्बर, 1978 को महाराष्ट्र के बुल्दाणा जिले में शंकर नगर स्थित चीनी का विनिर्माण करने वाला जीजा माता सहकारी शंकर कार- खाना लिमिटेड (जिसे इस आदेश में इसके पश्चात् उक्त चीनी उपक्रम कहा गया है ) के पास, 15 नवम्बर , 1978 के पूर्व क्रय किए गए गन्ने के संबंध में, गश्ता संबधी वेय, चीनी वर्ष 1977-78 के दौरान उक्ल चीनी उपक्रम के प्रयोजनों के लिए इस प्रकार क्रय किए गए गने की कुल कीमत के बस प्रतिशत से अधिक बकाया है ;
और केन्द्रीय सरकार ने उक्त श्रीनी उपक्रम के स्वामी को चीनी उपक्रम ( प्रवन्ध ग्रहण ) अध्यादेश , 1978 ( 1978 का 5) की धारा 3 की उपधारा ( 1 ) के अधीन 21 नवम्बर, 1978 को सूचना सं० चीनी 257/ 78-79 जारी की थी , जिसमें उससे यह कहा गया था कि वह उक्त सूचना की प्राप्ति की तारीख से सात विम के भीतर उन परिस्थितियों को लिखित रूप में बताएगा, जिसके कारण उक्त चीनी उपक्रम गन्ना संबंधी देय के उक्त बकाया को चुकता करने में असफल रहा है और यह हेतुक वशित करे कि उक्त चीनी उपक्रम का प्रबन्ध केन्द्रीय सरकार द्वारा क्यों न ग्रहण कर लिया जाए ;
और केन्द्रीय सरकार का, उक्त चीनी उपक्रम की घोर से जीजामाता सहकारी शंकर कारखाना लि० शंकरनगर ( ठुसारविव) , महाराष्ट्र के अध्यक्ष एवं प्रबन्ध निदेशक द्वारा भेजी गई रिपोर्ट सा०/ ०० डी०/ 1/ 78- 79, तारीख1-12-1978 पर विचार करने के पश्चात्, उन परिस्थितियों की बाबत जिनके कारण , गत्ता संबंधी बेय दस प्रतिशत से अधिक बकाया रह गया है और गन्ना संबंधी देय के उक्त बकाया को चुकता करने में उक्त चीनी उपक्रम की असमर्थता की बाबत समाधान नहीं हुआ है ;
अतः अब , केन्द्रीय सरकार , उक्त अध्यादेश की धारा 3 की उपधारा ( 2) के खण्ड ( ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि उक्स बीनी उपक्रम का प्रबन्ध, 13 , दिसम्बर, 1978 को और इससे प्रारम्भ होने वाली तीन वर्ष की अवधि के लिये केन्द्रीय सरकार में निहित होगा ।
Now, therefore , in exercise of the powers conferred by clause (b) of sub - section (2) of section 3 of the said Ordinance the Central Government hereby declares that the management of the said sugar undertaking shall vest in the Central Govern- ment for a period of three years commencing on and from the 13th December , 1978 .

फा०ग्रा० 706 ( २) केन्द्रीय सरकार का वह समाधान हो गया है कि 15 नवम्बर , 1978 को महाराष्ट्र राज्य के धूलिया जिले में पुरुषोत्तम नगर स्थित चीनी का बिनिर्माण करने वाले सतपुड़ा तापी परिसर सहकारी शकर कारखाना लिमिटेड (जिसे इस श्रादेश में इसके पश्चात उक्त चीनी उपक्रम कहा गया है) के पास , 15 नवम्बर , 1978 के पूर्व क्रय किए गए गन्ने के संबंध में , गश्ता संबंधी देय , श्रीनी वर्ष 1977-78 के दौरान उक्त धीनी उपक्रम के प्रयोजनों के लिए इस प्रकार क्रय किए गए गन्ने को कुल कीमत के यस प्रतिशत से अधिक बकाया है ;
चौर केन्द्रीय सरकार ने उक्त चीनी उपक्रम के स्वामी को चीनी उपक्रम ( प्रबन्ध ग्रहण) अध्यादेश , 1978 ( 1978 का 5) की धारा 3 की उपधारा ( 1) के अधीन 21 नवम्बर, 1978 की सूचना सं ० चीनी / 258/ 78-79 जारी की थी जिसमें उससे यह कहा गया था कि वह उक्त सूचना की प्राप्ति की तारीख से सात दिन के भीतर उन परिस्थितियों को लिखित रूप में बताए , जिनके कारण उक्त चीनी उपक्रम गत्ता संबंधी वेय के उक्त बकाया चुकता करने में असफल रहा है और यह हेतुक वशित करे कि उक्त चीनी उपक्रम का प्रबन्ध केन्द्रीय सरकार द्वारा क्यों न ग्रहण कर लिया जाए ;

और केन्द्रीय सरकार का , उक्त चीनी उपक्रम की श्रोर से श्री मतपुड़ा तापी परिसर सहकारी शकर कारखाना लि० , ( धुलिया, महाराष्ट्र के प्रशासक द्वारा तारीख 2-12-78 को भेजी गई रिपोर्ट पर विषार करने के पश्चात, उन परिस्थितियों की बाबत जिनके कारण गन्ना संबंधी देय वस प्रतिशत से अधिक बकाया रह गया है और गन्ना संबंधी देय के उक्त सफाया को चुकता करने में उक्त श्रीनी उपक्रम की असमर्थता की बाबत साभाधान नहीं हुआ है ।

(here- after in this Order referred to as the said sugar undertaking) manufacturing sugar at Purushottam Nagar in the District of Dhulia in the State of Maharashtra has , in relation to the cane purchased before the 15th day of November, 1978, arrears of cane dues to the extent of more than ten per cent of the total price of the cane so purchased for the purposes of the said sugar undertaking during the 1977-78 sugar years ;
And whereas the Central Government on the 21st day of November , 1978 , issued Notice No. SUG/ 258/ 78-79 under sub - section ( 1) of section 3 of the Sugar Undertakings (Tak- ing Over of Management) Ordinance , 1978 ( 5 of 1978) to the owner of the said sugar undertaking calling upon him to report in writing within seven days from the date of receipt of the said notice the circumstances under which the said sugar undertaking has failed to clear the said arrears of cane dues, and to show cause as to why the management of the said sugar undertaking shoud not be taken over by the Cen- tral Government ;
And whereas the Central Government , having considered the report dated 2-12-1978 sent by the Administrator , Shree Satpuda Tapi Parisar Sahakari Sakhar Karkhana Ltd. , Dist . Dhulia , Maharashtra , on behalf of the said sugar undertaking , is not satisfied with the circumstances for having the arreas of cane dues in excess of ten per cent and with the inability of the said sugar undertaking to clear the said arrears of cane dues ;
Now, therefore , in exercise of the powers conferred by clause ( b ) of sub - section 3 of the said Ordinance , the Central Government hereby declares that the management of the said sugar undertaking shall vest in the Central Government for a period of three years commencing on and from the 13th December , 1978 .
