( i ) संघ शासित क्षेत्र के मामले में , वहां का प्रशासक, जिसे संविधान के भनुच्छेद 239 के प्रधीन, रा ० रा ० संबंधी कार्यों के निष्पादन के लिये केन्द्रीय सरकार की पाक्तियां प्रत्यायोजित की गई

( ii ) सीमा सड़क संगठन के प्रभार में प्रशासनिक तौर से रखे राष्ट्रीय राजमागों के मामले में सीमा सड़क विकास मंडल और

( iii ) किसी अन्य मामले में राज्य सरकार, जिसे अधिनियम की धारा 5 के अधीन ऐसे कार्य प्रत्यायोजित किए गए हों ;

फा० प्रा० 718 (अ) राष्ट्रीय राजमार्ग अधिनियम, 1966 ( 1956 का 48 ) की धारा 9 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा पहली अप्रैल, 1976 को या इसके बाव पूरे कर के याता- यात के लिये खोले गये उन स्थायी पुलों , जो प्रत्येक पच्चीस लाख से अधिक लागत के हों , के प्रयोग संबंधी सेवाओं के लिये शुल्क लगाने हेतु निम्नलिखित नियम बनाती है, अर्थात्

1. संक्षिप्त नाम विस्तार और प्रारम्भ:

(ग ) " शुल्क निरीक्षक " से वह व्यक्ति अभिप्रेत है जिसे किसी स्थायी पुल को पार करने वाली किसी यांत्रिक गाड़ी का शुल्क लेने के लिये संबंधित कार्यकारी एजेंसी द्वारा अधिकृत किया गया हो और इसमें शुल्क लेने के लिये ऐसे पुल पर तैनात प्रत्त्येक सरकारी कर्मचारी शामिल हैं ।

( 1) इन नियमों का नाम राष्ट्रीय राजमार्ग ( स्थायी पुलों के प्रयोग के लिये शुल्क) नियम, 1978 है ।

( 2) इन नियमों का विस्तार सम्पूर्ण भारत पर होगा ।

( 3) ये राजपक्ष में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:

इन नियमों में, जब तक कि प्रसंग से अन्यथा अपेक्षित न हो:

( घ) "यांत्रिक गाड़ी " से वह लवी हुई या बिना लदी हुई गाड़ी अभिप्रेत है जो अपने ही अन्वर की मशीनरी से चले, इसमे 1939 के मोटर गाड़ी अधिनियम, 1939 की धारा 2 के खंड ( 18) में यथा परिभाषित गाड़ी शामिल है, परन्तु ठेला , तांगा, हथरिक्शा, साईकिल रिक्शा, बाईसिकल तीन पहियों की साई- फिल और हाथ से या पशुओं द्वारा खींची जाने वाली कोई बाहुन शामिल नहीं है ।

(क ) " प्रधिनियम" से राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) अभिप्रेत है,

(ख) "कार्यकारी एजेन्सी " से अभिप्रेत है

(ङ) ' स्थायी पुल' से वह पुल अभिप्रेत है जिसकी संरचना स्थायी हो और मुख्य पुल पहुंच मागौँ, नियंत्रक बांध और बचाव कार्यों और साथ ही शुल्क एकत्रित करने के लिये निर्मित संरचमाभों

को लांगतों सहित जिस पुल की लागत 25 लाख ६० से अधिक हो और जो पहली अप्रैल , 1976 को या उसके बाव रा० रा ० पर पूरे किए गए हों और यातायात के लिये खोले गये हों ।

(च) " अनुभागीय अधिकारी " से राज्य के लोक निर्माण विभाग (सड़क और भवन) या किसी अन्य विभाग का अधिकारी अभिप्रेत है जो इस पद नाम से रा ० रा ० कायों से संबंधित हो और रा ० रा ० पर स्थित किसी विशेष सड़क या पुल का प्रभारी हो ।

3. शुल्क दरें और इसका संवाय:

इन नियमों की अनुसूची में निविष्ट वरों पर स्थायी पुलों के प्रयोग के लिये यांत्रिक गाड़ियों का भारत सरकार की ओर से शुल्क लगाया जायगा और कार्यकारी एजेन्सी को वेय होगा ।

4. शुल्क दरों का प्रदर्शन:

किसी भी स्थायी पुल पर लगाये जाने वाले अधिकृत शुल्क की सूची शुल्क एकत्रित करने वाले कक्ष के निकट स्पष्ट विखाई देने वाले स्थान पर लगाई जाये जो अंग्रेजी हिन्दी और उस क्षेत्र जहां स्थायी पुल स्थित हो के क्षेत्रीय भाषा में मुद्रित हो या साफ-साफ लिखी हो ।

5. धनराशि एकत्रित करने/ वसूल करने और उसे रखने आदि की क्रियाविधिः

( 1) इस नियमों के अंतर्गत लगावे गये सभी शुल्क भारत सरकार की ओर से संबंधित ऐजेन्सी द्वारा विभागीय तौर से वसूल किए जाएंगे और इस प्रयोजन के लिए पर्याप्त संख्या में बसूली कक्ष ( परस्पर अथवा स्वव्यवस्थित अथवा दोनों द्वारा मिलाकर जैसा कार्यकारी एजन्सी उपयुक्त समझें सचालित ) बनाने की व्यवस्था संबंधित कार्यकारी एजन्सी द्वारा की जायेगी जिसमें इन वसूली कक्षों के लिए पहुंच मार्गों का सुधार कार्य और चौड़ा करने का कार्य शामिल है ।

(2 ) स्थायी पुल के वोनों सिरों पर शुल्क निरीक्षक ( सहायता के लिए अपेक्षित सख्या में पुलिस सहित ) तैनात किया जाएगा जो अनुसूची में निविष्ट वरों पर उक्त पुल पर से पार करने वाली किसी भी यांत्रिक गाड़ी से शुल्क वसूल करने के लिए अधिकृत होगा ।

( 3 ) स्थायी पुल के दोनों सिरों पर यांत्तिक गाड़ियों को रोकने के लिए मार्ग -रोधक की व्यवस्था की जायेगी ।

( 4) मार्ग-रोधक पर शुल्क निरीक्षक यह सुनिश्चित करेगा कि यांत्रिक गाड़ियों को उस समय तक गुजरने नहीं दिया जाएगा जब तक वे शुल्क अदा नहीं कर देती ।

6. शुल्क वसूल करने की रीति:

( 1 ) यांत्रिक गाड़ियों का प्रत्येक ड्राइवर, स्वामी या गाड़ो का प्रभारी जिसे इन नियमों के अधीन शुल्क चुकाना होता है स्थायी पुल पार करने से पूर्व या पुल पार करने के बाद अपनी गाड़ी मार्ग-रोधक पर रोकेगा, गाड़ी का शुल्क देने के लिए वसूली कक्ष में जाएगा और शुल्क निरीक्षक से इन नियमों के साथ सलग्न प्रपत्र 'क' में रसीद की दो प्रतियां फीस चुका देने पर प्राप्त करेगा और फिर उसे भागे जाने विया जायेगा ।

( 2) यदि एक ही कार्यकारी एजेन्सी के क्षेताधिकार में पार किए जाने वाले पहले पुल के प्रवेश मार्ग के प्रारंभिक स्थल से 20 कि० मी ० के अन्दर-अन्दर समीप -समीप दो या अधिक स्थायी पुल हों, तो एक से अधिक पुल पार करने वाली गाड़ियों के ड्राईवर , स्वामी या गाड़ी के प्रभारी से, यवि भावश्यक समक्षा जाय तो पार किए जाने वाले पहले, अंतिम या मध्यवर्ती पुल पर सफल शुल्क वसूल किया जायगा और वी गई फीस की रसीद धारी गाड़ी को पुलों पर तैमात शुल्क निरीक्षकों को रसीद दिखाने पर उपरोक्त अन्य पुलों से बेरोक टोक जाने दिया जायगा ऐसे पुलों का म्यौरा इस उपनियम के अधीस आने वाले पुलों के फीस वसूली कक्षों के निकट स्पष्ट स्थल पर लगाया जायगा ।

( 3 ) शुरुक निरीक्षक अनुसूची में निर्दिष्ट शुल्क प्राप्त करने के बाव प्रपत्र 'क' में रसीव की तीन प्रतियां बनायगा और दो प्रतियां ड्राईवर, स्वामी या उस गाड़ी के प्रभारी को देगा जिसकी फीस ली गई है, और तीसरी प्रति अपने पास कार्यालय में रखेगा । गाड़ी को भार्ग रोधक से भागे तभी गुजरने दिया जायगा जबकि वह इन नियमों के अधीन शुल्क भदा करदे और उसे रसीव दे दी जाय ।

(4) यवि आवश्यक हो तो कार्यकारी एजेंसी काउन्टर बैंकिंग कक्ष स्थापित कर सकती है । इस प्रयोजन के लिये जहां फीस वसूली कक्ष के आगे किसी उपयुक्त स्थान पर ऐसा कक्ष बनाया गया हो । यांत्रिक गाड़ी के पुल पार करने और निर्धारित शुल्क अदा करने के बाद काउन्टर चैंकिंग बूथ पर काउन्टर जाँच ड्यूटी शुल्क निरीक्षक यह सुनिश्चित करेगा कि ड्राईवर, स्वामी या गाड़ी के प्रभारी व्यक्ति से शुल्क भुगतान करने की रसीव की प्रतियों की जांच करने के बाव ही गाड़ी को काजन्टर बैंकिंग मार्ग- रोधक पार करने दिया गया है ।

7. एकत्रित शुल्क का भेजा जाना:

( 1 ) ड्यूटी पर शुल्क निरीक्षक अपनी ड्यूटी अवधि में शुरुक्क वसूल करने और एकक्षित की गई शुल्क राशि की सुरक्षा के लिये जिम्मेवार होगा और कक्ष से उस समय तक नहीं जायेगा जब तक दूसरा व्यक्ति उससे कार्यभार संभाल नहीं लेता ।

(2) शुल्क निरीक्षक इन नियमों के साथ संलग्न प्रपत्त 'ख' में रोकड़ बही बनाएगा और उसे हर समय तैयार रखेगा ।

( 3) अपनी ड्यूटी समाप्त होने पर शुल्क निरीक्षक एकक्षित धनराशि अपने स्थान पर आने वाले दूसरे व्यक्ति को सौंप देगा और रोकड़ बही के अपेक्षित स्तम्भ में उस व्यक्ति से हस्ताक्षर करवाएगा ।

( 4) प्रतिदिन दोपहर बाद 4 और 5 बजे की बीच ड्यूटी शुल्क निरीक्षक पिछले 24 घंटों में एकक्षित की गई फीस की संपूर्ण राशि पुल के प्रभारी अधिकारी के हवाले कर देगा और रोकड़ बद्दी से अपेक्षित स्तम्भ में उसके हस्ताक्षर करवाएगा ।

(5) अनुभागीय अधिकारी , शुल्क निरीक्षक से प्राप्त फीस की धनराशि उस तिजोरी में रखेगा जो उसके कार्यालय में इस कार्य के लिये वी गई है ।

( 6) प्रत्येक शनिवार को या उस विन छुट्टो होने पर अगले कार्य- दिवस को अनुभागीय अधिकारी पिछले सप्ताह की बसूल की गई धनराशि डिमांड ड्राफ्ट के जरिए वेतन तथा लेखा अधिारी ( रा ० रा० ) नौवहन और परिवहन मंत्रालय ( सड़क पक्ष ) नयी दिल्ली को भेजेगा । उक्त वेतन तथा लेखा अधिकारी प्राप्ति की इस राशि को अपने बही के सम्बन्धित प्राप्ति शीर्ष में वर्ज करेगा ।

( 7) अनुभागीय अधिकारी इन नियमों के साथ संलग्न प्रपत्त्र 'ग' में एक रजिस्टर रखेगा जिसमें वेतन तथा लेखा अधिकारी ( रा ० रा ०) नौवहन और परिवहन मंत्रालय ( सड़क पक्ष) नयी दिल्ली को भेजेगा और रजिस्टर को हर समय तैयार रखेगा ।

( 8) अनुभागीय अधिकारी फीस वसूल करने के लिये स्थायी पुल पर तैनात स्टाफ की और स्टाफ द्वारा रखे गये विशष लेखें और रिकार्ड की भी देख- रेख करेगा ।

( 9 ) जिस सड़क पर स्थायी पुल बना हो , उसके प्रभारी उप प्रभागीय अधिकारी शुल्क निरीक्षकों और प्रभारी अनुभागीय अधिकारी के फायर्यालयों में महीने में कम से कम दो बार आकस्मिक बौरा करके इन नियमों के अनुसार एकक्षित करके भेजी गई शुल्क राशि की जांच करेगा । वह शुल्क निरीक्षकों और प्रभारी अनुभागीय अधिकारियों द्वारा रखे रोकड़ मही पर इस आशय से हस्ताक्षर करेगा कि उसने जांच कर ली है । इस प्रकार के दौरे तीन महीने में कम से कम एक बार कार्यकारी इन्जीनियरों द्वारा भी किए जाएंगे ।

8. विवरणियों का भेजना:

सम्बन्धित कार्यकारी एजेन्सी वेतन तथा लेखा अधिकारी राष्ट्रीय राज भार्ग , नौवहन और परिवहन मंत्रालय ( सड़क पक्ष) नयी दिल्ली को जुलाई भारत का राजपत्र असाधारण

अक्तूबर, जनवरी और अप्रैल के प्रथम सप्ताह हर तिमाही का-

. (क ) एक समेकित विवरणी भेजेगी जिसमें प्रत्येक स्थायी पुल सम्बन्धी फीस के रूप में एकक्षिक की गई और भेजी गई महीनेवार धनराशि विखाई गई हो और उस डिमांड ड्राफ्ट की संख्या तथा तारीखों का ब्यौरा भी दिया गया हो जिसके साथ यह राशि भेजी गई;

(ख) ब्यौरा भेजेगी, जिसमें कार्यकारी एजेन्सी द्वारा , प्रत्येक पुल पर किया गया महीनेवार व्यय दिया गया हो जिसको किये गये वास्तविक व्यय के आधार पर शुल्क की राशि से प्रतिपूर्ति की जानी होती है ।.

जमानत देना

शुल्क निरीक्षक भौर प्रभारी अनुभागीय अधिकारी प्रत्येक कार्यकारी इंजीनियर के कोष नियमों में निर्धारित प्रपत्र में जमानत पत्र भर कर कम से कम 1000 रुपए नकद जमानत के रूप में जमा कराएगा ।

10. शुल्क से प्राप्त ग्राय को जमा करना और उसका उपयोग

( 1) फीस से प्राप्त राशि भारत की समेकित निधि होगी और वर्ष के दौरान प्राप्त होने वाली अनुमानित राशि के समान धनराशि की व्यवस्था की आयेगी जो मौवहन और परिवहन मंत्रालय की अनुदान मांगों में भ्रष्यपत धारक्षण निधि में अन्तरण के लिए होगी और केन्द्रीय सरकार द्वारा खोले गये भारत के सरकारी खाते में कोई ब्याज नहीं होगा । निधि में जमा राशि का भारत सरकार राज्यों भौर संघ शासित क्षेत्रों में राष्ट्रीय राजमार्गों के विकास के लिए नियतन करेगी । विभिन्न राज्यों घौर संघ शासित क्षेत्रों को नियत की जाने वाली राशि, जहां तक संभव हो इन नियमों के अधीन सम्बन्धित राज्यों में एकत्रित फीस बराबर होगी , समाहरण प्रभार कम से कम बिए जाएंगे जो राज्य के अन्दर एकक्षित की गई कुल फीस की राशि के 12 से अधिक नहीं होंगे । समाहरण प्रभार इस नियम के उपनियम ( 3 ) में बताए तरीके से सम्बन्धित कार्यकारी

एजेंसी को अदा कर दिए जाएंगे । राज्यों और संघशासित क्षेत्रों को इस प्रकार नियत की गई राशि सामान्य योजना नियतनों के अलावा होगी ।

(2) इस तरह के नियतन योजना के तौर तरीकों के अन्तर्गत होंगें और योजना व्यय होंगे जो शुल्क से प्राप्त धनराशि के समाहरण प्रभार निकाल देने के बाव निबल आय तक बढ़ाये जाएंगे । वित्तीय वर्ष के अन्त में अप्रयुक्त बची शुल्क की राशि उस वित्तीय वर्ष के अन्त में व्यपगत नहीं होगी, परन्तु केन्द्रीय सरकार द्वारा अनुमोदित अलग कार्यों के लिए बाव के वर्ष या वर्षों में प्रयुक्त की जा सकेगी ।

( 3) शुल्क सभाह्रण पर कार्यकारी एजेंसी द्वारा किए गए व्यय की प्रतिपूर्ति की राशि जो समाहृत फीस की कुल राशि के 12 % से अधिक नहीं होगी , की अदायगी, केन्द्रीय सरकार द्वारा वर्षानुवर्ष अपने बजट में किए गए विशेष बजट प्रावधानों में से विशेष भुगतान संस्वीकृतियों के जरिए भारत सरकार द्वारा की जायेगी ।

11. पुलिस सहायता

उस क्षेत्र के सभी पुलिस अधिकारी, जिसमें स्थायी पुल पड़ता हो, इन नियमों के अधीन शुल्क समाहरण में, जब श्रावश्यकता हो, शुष्क निरीक्षकों की सहायता करने के लिये बाध्य होंगे , और उस प्रयोजन केलिये उनकी शक्तियां वहीं होंगी , जिनका प्रयोग वे सामान्य पुलिस की ड्यूटी के समय करते हैं ।

टिप्पणी ( 1 ) जब उसी वाहन को दिन में पुल को एक से अधिक वार पार करना पड़ता है तो प्रयोक्ता पहले फेरे में ही पुल को पार करते समय उक्त दरों से डेढ़ गुना भुगतान कर सकता है ।

( 2) निम्नलिखत वाहन वीं आईपी संकेताक्षर वाले वाहन समझे जायेंगे: -

भारत के राष्ट्रपति और उपराष्ट्रपति, केन्द्रीय और राज्य मंत्री , लोक सभा राज्य सभा/ मंत्री के स्तर वाले राज्य विधान मण्डल में विपक्ष के नेता, राज्यरात्र/ उपराज्यपाल/क.येकारी पार्षद/केन्द्रीय और राज्य विधान मण्डलों के अध्यक्ष/ सभापति , भारत में सरकारी दौरे पर थाए विदेशी पदाधिकारी, सो को संकेताक्षरों वाले कारों को प्रयोग करने वाले भारत में स्थित विवेशी कूटनीतिक ।

NOTIFICATION

New Delhi, the 8th December , 1978

(1) All fees levied under these rules shall be collected by the executive agency concerned departmentally on behalf of the Government of India and for this purpose necessary arrangements shall be made by the executive agency concern- ed for putting up adequate number of collection booths (operated manually or by automatic arrangements or by combination of both as maybe considered suitable by the executive agency ) including improvement and widening of approach roads to serve the collection booths so set up.

In exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) , the Central Government hereby makes the following rules for the levy of fees for services rendered relating to the use of permanent bridges costing more than Rupees twenty five lakhs each , completed and opened to traffic on or after the 1st day of April , 1976 on national highways , namely :--

(2) There shall be posted at either end of the permanent bridge a Fee Inspector (with necessary police guard to assist ) who shall be authorised to collect fee in respect of any mecha- nical vehicle crossing , the said bridge at the rates specified in the Schedule .

1. Short title , extent and commencement.- ( 1 ) These rules may be called the National Highways (Fees for use of Per- manent Bridges ) Rules , 1978 .

(2) They shall extend to the whole of India .

(3 ) There shall be provided at either end of a permanent bridge , a cross bar for securing the stoppage of mechanical vehicles .

(3 ) They shall come into force on the date of their pub- lication in the Official Gazette .

the (4) The Fec Inspector shall ensure at the cross bar that passage is not allowed to mechanical vehicles unless fee leviable in respect thereof has been paid.

2. Definitions . In these rules , unless the context otherwise requires-

6. Mode of collection of fee

(a) 'Act' means the National Highways Act, 1956 (48 of 1956);

(b) ' executive agency' means-

(i) in the case of a Union Territory the Administrator thereof to whom the functions of the Central Government in relation to the execution of works pertaining to national highways are delegated under article 239 of the Constitution ;

(1) Every driver , owner or person incharge of a mechanical vehicle, required to pay fees under these rules shall before crossing the permanent bridge or after having crossed it stop his vehicle at the cross bar , go to the fee collection booth to pay the fee leviable in respect of the vehicle and obtain from the Fee Inspector a receipt in duplicate in Form A appended to these rules in token of having paid the fee, before he is allowed to proceed further .

( ii) in the case of national highways administratively placed under the charge of the Border Roads Organisation , the Border Roads Development. Board; and

(iii) in any other case , the State Government to which such functions are delegated under section 5 of the Act.

(c) 'Fee Inspector' means a person authorised by the executive agency concerned to collect fee in respect of any mechanical vehicle crossing a permanent bridge and includes every government employee posted on such bridge in connection with the collec- tlon of fees;

(2) In the event of two or more permanent bridges falling in close proximity to each other within twenty kilometres from a point at the beginning of the approach of entry of the first bridge to be crossed under the jurisdiction of the same executive agency , the aggregate fees for all such bridges may, if so deemed necessary , be collected from the driver, owner or person incharge of such of the vehicles which intend to cross more than one such bridge, on the first or the last bridge or any of intermediary bridges to be crossed and the vehicle holding the receipt of such a payment shall be allowed to pass through other aforesaid bridges unhindered after show- ing the receipt to the Fee Inspectors posted on those bridges . Details of such bridges shall be displayed at a conspicuous place near the fee collection booths of the bridges covered under this sub -rule , legibly written or printed in English , Hindi and the regional language of the area in which the sald bridges are situated .

(d) ' mechanical vehicle' means any laden or unladen vehicle designed to be driven under its own power Including a motor vehicle as defined in clause ( 18) of section 2 of Motor Vehicles Act, 1939 of 1939 but does not include a cart, tonga, hand-driven or cycle rickshaw, bicycle , tricycle and any other anl- mal or hand driven vehicle;

(3) The Fee Inspector shall , on receipt of the fee specified in the schedule, fill up a receipt in triplicate in Form 'A' and deliver two copies thereof to the driver , owner or the person incharge of the vehicle in respect of which the fee has been paid and retain the third in his office . The motor vehicle shall be allowed to go ahead of the cross bar only after the fee has been paid and receipt issued under these rules .

(e) ' permanent bridge' means a bridge with permanent structures , the cost of which including the cost of the bridge proper , approach roads , guide bunds and protective works as also structures constructed or Improved for collection of fees , is more than Rupees twenty five lakhs and which is completed and open- ed to traffic on national highways on or after 1st day of April , 1976; the

(f).'Sectional Officer' means an officer of the State Pub- Hc Works Department ( Roads and Buildings) or any other Department dealing with national highways having that designation and being incharge of particular road or bridge located on a national high- way. a

(4) Where, and if, found necessary , the executive agency may also set up counter -checking booths . For this purpose where such a booth has been set up at some location consi- dered suitable beyond a fee collection booth , after the mecha- nical vehical has crossed the bridge and also paid the pres- cribed fees , the Fee Inspector on counter checking duty at the counter checking booth shall ensure that the mechanical. vehicle is allowed to pass from the counter checking cross bar only after verifying on checking the coples of the receipt for payment of the fees from the driver, owner or person incharge of the vehicle .

7. Remittance of fees collected

3. Rates of Fees and its payment

There shall be levied and paid to the executive agency on behalf of the Government of India fees on mechanical vehicles for the use of permanent bridges at the rates specified in the Schedule to these rules .

(1) The Fee Inspector on duty shall be responsible for the collection and safe custody of the amounts collected towards fees during the period of his duty and shall not leave his booth till his reliever takes over from him .

4. Exhibition of rates of fees

(2) The Fee Inspector shall maintain a cash register in Form 'B' appended to these rules and keep it posted uptodate .

A Table of fees authorised to be levied at any permanent bridge shall be put up in a conspicuous place near a fee collection booth legibly written or printed in English , Hindi and the regional language of the area in which the permanent bridge is situated...

(3) The Fee Inspector shall at the end of the period of his duty, hand over the amount collected by him to his reliever after obtaining the signature of the latter in the relevant column of the cash register.

9. Furnishing of Security

(4) Every day between the hours of 4 and 5 in the after- noon the Fee Inspector on duty shall hand over the entire amount of fee collected during the preceding 24 hours to the Sectional Officer incharge of the bridge after obtaining his signature in the relevant column of the cash register.

The Fee Inspector and the Sectional Officer- in- Charge shall each deposit a cash security of not less than Rs . 1,000 by executing a security bond in the prescribed form laid down in the Treasury Rules of the Executive Engineer .

10. Credit of the proceeds of the fees and its utilisation (5) The Sectional Officer shall keep the amounts of collec- tlon received from the Fee Inspector in the chest provided for the purpose at his office .

(6) The Sectional Officer shall , on every Saturday or if it happens to be a holiday, on the next working day, remit the amount received by him in respect of the week preceding the Saturday by a demand draft to the Pay and Accounts Officer (National Highways ) , Ministry of Shipping and Transport (Roads Wing ) , New Delhi . The said Pay and Accounts Officer shall account the amount so received in the relevant receipt head in his books .

In (7) The Sectional Officer shall maintain a register Form 'C' appended to these rules showing the remittances made to the Pay and Accounts Officer (National Highways ) , Ministry of Shipping and Transport (Roads Wing ) , New Delhi and shall keep the register posted uptodate .

not (1) The procceds from the fees shall form part of the Consolidated Fund of India and a sum equal to the amount estimated to be received during a year shall be provided in the Demands for Grants of the Ministry of Shipping and Transport for transfer to a non lapsing Reserve Fund bearing interest within the Public Account of India, to be set up by the Central Government . The amount standing to the credit of the Fund wouldbe allocated by the Government of India for development of National Highways in the States and the Union territories . The amount to be allocated to varlous States and the Union territories , shall , as far as possi- ble, be equal to the fees collected in the respective States under these rules , reduced by collection charges not exceeding 12 per cent of the total collections within the State. The collection charges shall be reimbursed to the executive agency concerned in the manner indicated in sub - rule (3) of this rule . The allocations so made to the States and the Union territories shall be over and above their normal plan alloca- tions.

and (8) The Sectional Officer shall exercise supervision control over the staff posted at the permanent bridge in connection with the collection of the fees and over the main- tenance of proper accounts and records by such staff .

(2) The allocations so made shall , however, be subject to planning discipline and shall be a Plan expenditure which shall be augmented to the extent of the net proceeds after excluding the collection charges from the proceeds of the levy. The proceeds of the fees remaining unutilised at the end of the Financial year shall not lapse at the close of that financial year but shall be available for being utilised during subsequent year or years against individual works to be ap- proved by the Central Government .

(9) The Sub-Divisional Officer, incharge of the road on which the permanent bridge is situated, shall check the collec- tion and remittance of fees by the staff in accordance with these rules by paying surprise visits at least twice a month at the offices of the Fee Inspectors and the Sectional Officers- In-charge. He shall countersign the cash register maintained by the Fee Inspectors and Sertional Officers - in -Charge in token of such a check having been made . Such visits shall also be undertaken by the Executive Engineers concerned at least once in three months .

8. Submission of returns

(3) Payment of the amounts in relmbursement of the expenditure incurred by the executive agencies on collection of fees , not exceeding 12 per cent of the total collection of fees shall be made by the Government of India by specific payment sanctions from out of the specific budget provision to be made by the Central Government in its budget from year to year.

The executive agency concerned shall furnish to the Pay and Accounts Officer , National Highways , Ministry of Ship- ping and Transport ( Roads Wing) , New Delhi every quarter in the first week of July, October, January and April :-

11. Assistance by Police

( a) a consolidated statement showing month-wise the amount collected and remitted on account of fees proceeds in respect of each permanent bridge along- with the details of number and date of the demand draft with which this amount was remitted;

All police officers of the area in whose jurisdiction the permanent bridge falls shal be bound to assist the Fee Inspectors, when required in the collection of fees under these rules , and for that purpose , shall have the same power which they have in exercise of their normal police duties .

President and Vice- President of India , Central and State Ministers , Leaders of Opposition in Lok Sabha / Rajya Sabha/ State Legislaturos having the status of a Cabinet Minister , Governors /Lt . Governors /Executive Councilors /Speakers/ Chairmen of Central and State Legislatures , Foreign Dignitories on State visit to India , Foreign Diplomats stationed in India using cars with CD symbols .
