Now Delhi the 26th December, 1978

ORDER

S.0.726(E).—Whereas the Central Government being satisfied

that as on the 15th day of November, 1978, Shree Sitaram Sugar

Co. Ltd., (hereinafter in this Order referred to as the said sugar

undertaking) manufacturing sugar at Baitalpur in the District

of Deoria in the State of Uttar Pradesh has failed to commence

manufacture of sugar by the 15th November, 1978;

And whereas the Central Government on the 19th day of

November, 1978 issued Notice No. SUG/146/78-79 under sub-

notice the circumstances under which the said sugar under- taking had failed to commence manufacture of sugar on or before the 15th day of November, 1978;

And whereas the Central Government having considered the report dated the 28#i November, 1978 sent by the said sugar undertaking, specified the 11th day of December, 1978 as the date ijnpr, ^before which the said sugar undertaking should commence production of sugar;

And whereas the said sugar undertaking has not so far

commenced manufacture of sugar;

ORDER

Now, therefore, in exercise of the powers conferred by sub- section (3) of section 3 of the said Ordinance, the Central Government hereby declares that the management of the said sugar undertaking shall vest in the Central Government for a period of throe years cOiiimencing on and from the 27th day of December, 1978.

S.0.727(E)>—Whereas the Central Government being satisfied that as on the 15th day of November, 1978, the Dcoria Sugar Mills Limited (hereinafter in this Order referred to as the said sugar undertaking) manufacturing sugar at Dcoria in the District of Deoria in the State of Uttar Pradesh has failed to commence manufacture of sugar by the 15th November, 1978;

And whereas the Central Government on the 18th day of November, 1978 issued Notice No. SUG/131/78-79 under subsection (1) of section 3 of the Sugar Undertakings (taking over of Management) Ordinance, 1978 (5 of 1978) to the owner of the said sugar undertaking calling upon him to report in writing within seven days from the date of receipt of the said notice the circumstances under which the said sugar under- taking had failed to commence manufacture of sugar on or before the 15th day of November, 1978;

And whereas the Central Government having considered the report dated the 25th November, 1978 sent by the said sugar undertaking, specified the Uth day of December, 1978 as the date on or before which the said sugar undertaking should commence production of sugar;

And whereas the said sugar undertaking has not so far

commenced manufacture of sugar;

Now, therefore, in exercise of the powers conferred by sub- section (3) of section 3 of the said Ordinance, the Central Government hereby declares that the management of the said sugar undertaking shall vest in the Central Government for a period of three years commencing on and from the 27th day of December, 1978.
