सा ० फा० ति० 596 ( अ) -केन्द्रीय सरकार, तम्बाकू बोर्ड अधि- नियम, 1975 ( 1975 का 4) की धारा 32 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तम्बाकू बोर्ड नियम, 1976 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:--
1. ( 1) इन नियमों का नाम तम्बाकू बोर्ड ( द्वितीय संशोधन ) नियम, 1978 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. तम्बाकू बोर्ड जियन, 1976 में-
(1 ) (क) नियम 35 में, विद्यमान उपनियम ( 5 ) के स्थान पर, निम्नलिखित रखा जाऐगा, अर्थात्-
" ( 5 ) बोर्ड के साथ, उपधारा ( 1 ) के अधीन निर्यात- कर्ता, पैक करने वाले , नीलामकर्ता या व्यौहारी के रूप में रजिस्ट्रीकृत प्रत्येक व्यक्ति को, प्ररूप 6 में रजिस्ट्रीकरण का एक ऐसा प्रमाणपत्र विया जाएगा, जो ऐसी शर्तों के अधीन रहते हुए , जो बोर्ड द्वारा समय-समय पर मधिरोपित की जाएं, जारी किया जा सकेगा । "
(ख) उपनियम ( 5 ) के अधीन विद्यमान प्ररूप VI के स्थान पर, निम्नलिखित रखा आएगा , भर्थात्

तम्बाकू या तम्बाकू के उत्पादों के निर्यातकर्ता या तम्बाकू के पैक करने वाले या मीलामकर्ता या उसके ब्यौहारी के रूप में रजिस्ट्रीकरण के प्रमाणपक्ष का प्ररूप से रजिस्ट्री सं ० तक की एक वर्ष की अवधि के लिए विधिमान्य ।
यह प्रमाणित किया जाता है कि मैसर्स/श्री
को तम्बाकू थोर्ड के साथ तम्बाकू या उसके उत्पादों के निर्यातकर्ता या तम्बाकू के पैक करने वाले या मीलामकर्ता या उसके व्यौहारी के रूप में तम्बाकू बोर्ड अधिनियम, 1975 ( 1975 का 4 ) और उसके अधीन बनाए गए नियमों के अधीन रजिस्ट्रीकृत किया गया है । यह प्रमाणपत्र निम्म- लिखित शर्तों और ऐसी अन्य शर्तों के, जो तम्बाकू बोर्ड द्वारा समय-समय पर अधिरोपित की जाएं, अधीन जारी किया गया है, अर्थात्-
( 1) इस प्रमाणपत्र का धारक तम्बाकू थोर्ड अधिनियम, 1975 और उसके अधीन बनाए गए नियमों के उपबन्धों का पालन करेगा;
( 2) इस प्रमाणपक्ष का धारक तम्बाकू बोर्ड को ऐसी विवरणियां प्रस्तुत करेगा, जिनका प्रस्तुत किया आना उससे अपेक्षित है ;
( 3) इस प्रमाणपत्त का धारक तम्बाकू बोर्ड द्वारा तम्बाकू बोडे अधिनियम , 1975 या उसके अधीन बनाए गए नियमों और

विशिष्टतः उक्त प्रधिमियम की धारा 8 , के उपबन्धों के भनु- सरण में ऐसे सभी विनियमों, निदेशों, आदेशों, अनुबंधों, निबन्धनों और शर्तों का, जो जारी की गई हैं, या जारी की जाएं , पालन करेगा ।

(ii) नियम 36 में, विद्यमान उपनियम 11 (क ) के स्थान पर
निम्नलिखित रखा जाएगा , अर्थात्:-
" 11 (क) तम्बाकू या तम्बाकू के उत्पादों के निर्यातकर्ता या तम्बाकू के पैक करने वाले या नीलामकर्ता या उसके व्यौहारी के रूप में किसी व्यक्ति के रजिस्ट्रीकरण में था रजिस्ट्रीकरण के नवी- करण में या रजिस्टर करने से या रजिस्ट्रीकरण का नवीकरण करने से इंकार करने में , तम्बाकू या तम्बाकू के उत्पादों के निर्वात से या , यथास्थिति , तम्बाकू के पैक करने , या नीलाम करने या व्यवहार करने से संबंधित बातों में , श्रावेवक के अनुभव पर तथा ऐसे व्यक्ति के तम्बाकू या तम्बाकू के उत्पादों के निर्यात से या तम्बाकू पैक करने या उसका मीलाम करने या उसमें व्यवहार करने से संबंधित बातों में ऐसे व्यक्ति के उस भ्राचरण पर भी ध्यान दिया जाएगा कि क्या, यथास्थिति, निर्यातकर्ता या ब्यौहारी , तम्बाकू उगाने वाले या अन्यव्यौहारी को, जिससे तम्बाकू क्रय की गई हैं, तम्बाकू बोर्ड द्वारा अनु- बंधित/विनिश्चित ऐसा पत्ती -श्य वाउचर जारी करता है या नहीं जिसमें , क्रय की गई तम्बाकू या तम्बाकू के उत्पादों का परिमाण, श्रेणी, प्रति क्विंटल दर और कीमत के रूप में शोध्य कुल रकम दशित की गई है । तथा क्या वह तम्बाकू बोर्ड के उन विनियमों, निबन्धनों, शर्तों और अनुबंधों का, जो तम्बाकू बोर्ड द्वारा समय -समय पर उक्त वाऊचर के संबंध में जारी अधिकथित किए जाएं या तम्बाकू बोर्ड अधिनियम , 1975 की धारा 8 के अधीन अन्य उपायों का अनुसरण तथा अनु- पालन कर रहा है या नहीं" ;
( iii) (क) नियम 38 में , विद्यमान उपनियम ( 2 ) के स्थान पर,
निम्नलिखित रखा जाएगा, अर्थात्:-
" ( 2 ) वर्जीमिया तम्बाकू के संसाधक या तम्बाकू के पैक करने वाले या नीलामकर्ता या व्यौहारी के रूप में बोर्ड के साथ रजिस्ट्रीकृत प्रत्येक व्यक्ति , ऐसे अन्तरालों पर को बोर्ड द्वारा अधिकथित किए जाएं , बोर्ड को ऐसे प्ररूप में ओ बोर्ड द्वारा विनिविष्ट किया जाए; पूर्व गामी भास में अपने द्वारा , यथास्थिति, संसा- धित वर्जीनिया तम्बाकू या पैक की गई, नीलाम की गई या क्रय की गई या विक्रय की गई या अन्य प्रकार से व्यवहार की गई तम्बाकू दर्शित करने वाली विवरणी प्रस्तुत करेगा ।"
(ख ) विद्यमान उपनियम ( 3 ) ( क ) के स्थान पर ; निम्नलिखित रक्षा. जाएगा , अर्थात्:-
" 3 ( क ) तम्बाकू या तम्बाकू के उत्पादों के निर्यातकर्ता के रूप में बोर्ड के साथ रजिस्ट्रीकृत प्रत्येक व्यक्ति, बोर्ड को, ऐसे भन्तरालों पर को बोर्ड द्वारा भधिकथित किए जाएं, ऐसे प्ररूप में, जैसा बोर्ड द्वारा विनिर्दिष्ट किया जाए, निम्नलिखित वशित करने बाली विवरणियां प्रस्तुत करेगा,-
( i) तम्बाकू या तम्बाकू के उत्पादों के परिमाण और उसका मूल्य, जिसके निर्वात के संबंध में पूर्वगामी मास के दौरान ऐसे व्यक्ति द्वारा पक्की संविवाएं की गई हैं या पक्के प्रादेश प्राप्त हो चुके हैं ;

( ii ) पूर्वगामी मास के दौरान ऐसे व्यक्ति द्वारा निर्यात की गई तम्बाकू या तम्बाकू के उत्पादों का परिमाण तथा उसका मूल्य ;
( iii) तम्बाकू या तम्बाकू के उत्पादों का परिमाण तथा उसका मूल्य जिसके निर्यात के संबंध में की गई संविदाओं या प्राप्त प्रादेशों का अभी तक ( पूर्णतः या भागतः ) निष्पा- बम करना बाकी है और वह तारीख या वे तारीखें , जिनको या जिनके पूर्व संविदाओं या भावेशों का निष्पा- वन किया जाता ";
(iv) नियम 39 के उपनियम ( 2) ( ख) के पश्चात्, निम्मलिखित जोड़ा जाएगा, अर्थात्:--
" ( ग ) रजिस्ट्रीकृत व्यक्ति ने तम्बाकू बोर्ड प्रधिनियम और उसके अधीन बनाए गए नियमों तथा विशिष्टतः तम्बाकू बोर्ड अधि- नियम की धारा 8 के किसी उपबन्ध के अनुसरण में तम्बाकू बोर्ड द्वारा अधिकथित या पुरःस्थापित उपायों की बाबत तम्बाकू बोर्ड द्वारा अधिकथित विनियमों , निबंधमों, शतों और अनुबंधों में से किसी का , तथा ऐसे विनियमो, मिबंधनों, शर्तों और अनुबंधों का, जो नियम 36( 2) (क) में निविष्ट 'तम्बाकू पत्ती क्रय वाउचर' के संबंध में तम्बाकू बोर्ड द्वारा समय-समय पर अधिकथित या पुरःस्थापित किए जाएं, का उल्लंघन किया है; "
( v) नियम 39 के उपनियम ( 5 ) के पश्चात्, निम्नलिखित ओड़ा जाएगा, अर्थात्: -
" ( 6) इस नियम के अधीन कार्रवाई, तम्बाकू बोर्ड अधिनियम, 1975 की धारा 25 के अधीन कार्रवाई/ अभियोजन पर बिला कोई प्रतिकूल प्रभाव डाले, की जाएगी । "

New Delhi, the 28th December , 1978
G.S.R. 596(E). In exercise of the powers conferred by section 32 of the Tobacco Board Act, 1975 ( 4 of 1975) , the Central Government hereby makes the following rules further to amend the Tobacco Board Rules, 1976 , namely :-
1. (1) These rules may be called Tobacco Board (Second Amendment) Ruls, 1978.
(2) They shall come into force from the date of their publi- cation in the Official Gazette.
2. In the Tobacco Board Rules , 1976-
(i) (a) in rule 35, for the existing sub- rule (5), the fol- lowing shall be substituted, namely :-
"(5) every person registered with the Board as an exporter, packer, auctioneer or dealer under sub- rule ( 1) shall be given a certificate of registration in Form VI , which may be issued subject to such conditions as may be imposed by the Board from time to time;" 1203

(b) for the existing Form VI under sub - rule ( 5) , the fol- lowing shall be substituted , namely :

FORM OF CERTIFICATE OF REGISTRATION AS EXPORTER OF TOBACCO OR TOBACCO PRODUCTS OR AS PACKER OR AUCTIONEER OF OR DEALER

This isto certify that Messrs / Shri .
has been registered with the Tobacco Board as an exporter of tobacco or its products or as a packer or auctioneer of, or dealer in , tobacco under section 12 of ' the Tobacco Board Act, 1975 (4 of 1975) , and the rules made thereunder . This certificate is issued subject to the following conditions and subject to such other conditions as may be imposed by the Tobacco Board from time to time :
( 1) That the holder of this certificate shall abide by the provisions of the Tobacco Board Act , 1975 , and the rules made thereunder ;
(2) That the holder of this certificate shall submit to the Tobacco Board such returns as are required to be submitted by him;
(3) That the holder of this certificate shall comply with all regulations , directions , orders , stipulatoins , terms and conditions issued or which may be issued by the Tobacco Board in pursuance of the provisions of the Tobacco Board Act, 1975 or the rules made there- under, and in particular , section 8 of the said Act .

(ii) in rule 36 , for the existing sub-rule 11 (a) , the follow- ing shall be substituted , namely :-
"11 ( a) In registering or renewing the registration or refusing to register or renew the registration of any person as an exporter of tobacco or tobacco products as packer or auctioneer or dealer in tobacco, regard shall be had to the experience of the applicant in matters relating to the export of tobacco or tobacco products or in packing or auc- tioning or dealing in tobacco, as the case may be, and the conduct of such person in matters relating to export of tobacco or tobacco products packing or auctioning of tobacco or dealing in tobacco, such as , whether the exporter or the dealer, as the case may be , has been issuing to the grower or other dealer from whom tobacco is purchased a leaf purchase voucher stipulated/ decided by the Tobacco Board Indicating therein the quantity, the grade, the rate per quintal and the total amount due by way of price of the tobacco or tobacco product purchased and whe- ther he has been following and observing the regulations , terms , conditions and stipulations of the Tobacco Board , as may be issued / laid down by the Tobacco Board from time to time relating to the said voucher or any other measure under section 8 of the Tobacco Board Act , 1975; "
( lii) (a) in rule 38 , for the existing sub -rule ( 2) the follow- ing shall be substituted , namely :--
or "(2) Every person registered with the Board as a curer of virginia tobacco or as a packer auctioneer of, or dealer in tobacco, shall submit to the Board at such intervals as may be laid down by the Board a return , in such form as may be specified by the Board, showing the virginia tobacco cured or, as the case maybe, the tobacco packed, auctioned or bought or sold or otherwise dealt with by such person in the preceding month . "
(b) for the existing sub- rule (3)(a) the following shall be substituted namely :-
"3 ( a) Every person registered with the Board as an exporter of tobacco or tobacco products shall sub- mit to the Board at such intervals as may be laid down by the Board a return, in such form as may be specified by the Board , showing,-
(i) the quantity of tobacco or tobacco products and the value thereof in relation to the export of which firm contracts have been made or firm orders received by such person during the pre- ceding month ;
(ii) the quantity of tobacco or tobacco products and the value thereof exported by such person during the preceding month;
(iii ) the quantity of tobacco or tobacco products and the value thereof in relation to the export of which contracts made or orders received are yet to be executed (wholly or partly) and the date or dates on or before which such contracts or orders are to be executed";
(iv) after sub- rule (2)(b) of rule 39 , the following shall be added, namely :-
"(c) that if the person registered had contravened any of the regulations , terms , conditions and stipulations laid down by the Tobacco Board in respect of measures laid down or introduced by Tobacco Board in pursuance of any of the provisions of the Tobacco Board Act and the Rules made there- under and in particular section 8 of the Tobacco Board Act, 1975, and such regulations , terms, conditions and stipulations as may be laid down or Introduced by the Tobacco Board from time to time relating to the "Tobacco Leaf Purchase Voucher' , referred to in rule 36( 11)(a) . "
(v) after sub- rule (5) of rule 39 , the following shall be added, namely :-
"(6) Action under this rule shall be taken without pre- judice to the action/ prosecution under section 25 of the Tobacco Board Act, 1975. "
