सीमा-शुल्क
सा.का. नि. 43 (अ). केन्द्रीय सरकार, सीमा शुल्क अधिनियम, 1962 ( 1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तिर्या का प्रयोग करते हुए और भारत सरकार के वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं. 8-सीमा शुल्क, तारीख 6 जनवरी, 1978 को अधिक्रान्त करते हुए, यह संमाधान हो जाने पर कि लोक हित में ऐसा करना आवश्यक हैं. ऐसे सभी चिकित्सीय. शल्य...चिकित्सीय और संग निदान उपस्करों. उपकरणों और संयंत्रों को जिनके अन्तर्गत उनके पूर्ज, संघष्टक भाग और उपसाधन भी है और जिनका आयात भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय या स्वास्थ्य सेवाएं महानिदेशालय, द्वारा नीचे मारणी में विनिर्दिष्ट अस्पतालों में उपयोग के लिए आवश्यक के मेंया तो साधारणतया या प्रत्येक मामले में अनुमोदित क्रिया गयों हैं सीमा शुल्क टौरफ अधिनियम, 1975 ( 1975 का 51 ) की
(69) 1130 GI/78.
प्रथम अनुसूची के अधीन उस उद्ङ्ग्रहणीय समस्त सीमा शुल्क और उक्त सीमा शुल्क टौरफ अधिनियम की धारा 3 के अधीन उस पर उद्द्महणीय अतिरिक्त शुल्क से छूट देती हैं ।
सारणी
1. सभी ऐसे अस्पताल जो निम्नलिखित वाग चलाए जाते
(क) केन्द्रीय सरकार, राज्य सरकार , संघ राज्यक्षेत्र प्रशासन या स्थानीय प्राधिकरण,
(ख) विधि द्वारा या उसके अधीन स्थापित संस्थान
(ग) सोसाइटियों के रजिस्ट्रीकरण से संबंधित किसी विधि के अधीन रजिस्ट्रीकृत और खण्ड (क) में निर्दिष्ट प्राधिकारियों में से किसी के द्वारा नियंत्रित होने वाली सोसाइटियां ।
2. सभी ऐसे अस्पताल, जिनके बारे में स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार द्वारा यह प्रमाणित्त किया जाए कि वे ऐसे पूर्त संगठनों द्वारा , जिन्हें उक्त मंत्रालय द्वारा समय -समय पर अनुमोदित किया गया है। चलाए जाते हैं या उनमें पर्याप्त महायत्ता प्राप्त 'करते हैं [PART II-SEC. 3 ( 1) 1 THE GAZETTE OF INDIA EXTRAORDINARY

3. सभी ऐसे अस्पताल , जिनके चारे में स्वास्थ्य और परिवार कल्याण मंत्रालय भारत द्वारा , या तो साधारणतया या प्रत्त्येक मामले में यह प्रमाणित किया जाए कि वे रोगनिदान था उपचार संबंधी सुविधाएं न केवल जाति, मत वर्ण, धर्म या भाषा के आधार पर भल्कि निम्नलिखित रूप में भी देते हैं-
Revenue) No. 8 - Customs , dated the 6th January . 1978 , the Central Government being satisfied that it is necessary in the public interest so to do, hereby exempts all medical, aurgical and diagnostic equipment , apparatus and appliances includ- ing spare parts , component parts and accessories thereof, the import of which is approved , either generally or in each case, by the Ministry of Health and Family Welfare, or the Dir- ectorate General of Health Services , Government of India . as essential for use in the hospitals specifled in the Table below, from the whole of the duty of customs leviable there- on under the First Schedule to the Customs Tariff Act, 1975 (51 of 1975 ) and the additional duty leviable thereon under section 3 of the said Customs Tariff Act .
(क) अपने सभी बहिरंग रोगियों में से कम से कम 40 प्रतिशत रोगियों को निशुल्क
TABLE
1. All hospitals run by-
(ख ) मभी ऐसे अंतरंग रोगियों को निःशुल्क , जो ऐसे परिवारों के है जिनकी मासिक आय तीन सौ रूपये से कम हैं । सभी पलंगों में से कम से कम 10 प्रतिशत पलंग ऐसे रोगियों के लिए आरक्षित रखे आएंगें ; और
( a) the Central Government , a State Government, Union Territory Administration or a local antho- rity;
(ग) खण्ड (क) और खण्ड ( ख ) में विनिर्दिष्ट रोगियों से
(b ) institutions established by or under a law:
भिन्न रोगियों को, या तो संबंधित गंगियों की आय के आधार पर या अन्यथा, युक्तियुक्त प्रभारों पर ।
(c) societies registered under any law relating to regis tration of societies , such societies being controlled by any of the authorities referred to in clause (4) .
2. All such hospitals as may be certified by the Mindalry of Health and Family Welfare , Government of India, to be run or substantially aided by such charitable organisations as are approved , from time to time, by the said Ministry.
3. All such hospitals which may be certified by the Min- istry of Health and Family Welfare, Government of India . cither generally or in each case , to be providing diagnostic ar treatment facilities not only without any distinction of cable . creed , race , religion or language but also,
(a) free to at least 40 per cent of all their out-door patients:
(b) free to all indoor patients belonging to familios with an income of less than rupees three hundred per month , keeping for this purpose at least 10 per cent of all the beds reserved for such patients ; aud
(c) at reasonable charges either on the basis of the in- come of the patients coricerned or otherwise, patients other than those specified in clauses (a ) and (b). 10 4. कोई अन्य ऐसा अस्पताल, जिसके बारे में स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार ऐसे अस्पताल में उपलब्ध चिकित्मीय, शल्य चिकित्सीय या रोग निदान संबंधी उपचार को, उसकी भौगोलिक स्थिति को या ऐसे वर्ग के रोगियों को, जिनको चिकित्मीयः शल्य चिकित्सीय था रोगिनिधान संबंधी उपंथार दिया जाता है, ध्यान में रखते हुए , साधारणतया था प्रत्येक गामले में यह प्रमाणित करें कि अस्पताल , यद्यपि वह उक्त उपचार के लिए प्रभार लेता है फिर भी, लाभ न कमाने के आधार पर चलाया जाता हैं और शुल्क के संवाय से छूट पाने का पात्र है परन्तु यह तब जब कि ऐस चिकित्सीय, शल्य चिकित्सीय और रोगनिखन सम्बन्धी उपस्कर, उपकरण साच्चिय तथा उसके पूर्जी और उपसाधन, जिनकी बाबत छूट चाही गई है ऐसे अस्पताल द्वारा विदेशी दाताओं से मुफ्त दान के रूप में आयात किए जाते हैं या विदेश में विदेशी मुद्रा में प्राप्त किए गए दान से क्रय किए गए हैं ।
परन्तु, यदि भाल विदेश में विदेशी मुद्रा में प्राप्त किए गए दान में से क्रय किथा जाता है तो विदेश में दान में प्राप्त निधियों के प्रयोजनार्थ भारतीय रिजर्व बैंक द्वारा अस्पताल को विदेश में खाता रखने की अनुज्ञा दी गई है ।
स्पष्टिकारकटिय
"अस्पताल" पद के अन्तर्गत, अन्य बातों के साथ , कोई ऐसा संस्थाभ, केन्द्र, न्यास, सोसाइटी, संथा प्रयोगशाला, क्लिनिक, प्रसूति गृह भी है जिसमें रोगनिदाम, निवारण या रोग दूर करने संबंधी चिकित्सीय देखरेख की माती है ।
4. Any other hospital in respect of which the Ministry of Health and Family Welfare , Government of ludia , may. having regard to the type of medical , surgical or diagnostic treatment available there, the geographical situation thereof, or class of the patients for whom the medical , surgical or diagnostic treatment is provided , certify generally or in cach case, that the hospital , even though it makes a charge for the said treatment , is nevertheless run on non- profit basis and is deserving of exemption from payment of duty, provided . bowever , that the medical , surgical and diagnostic equipment 、 apparatus and appliances including spare parts , colapotion parts and accessories thereof in respect of which the ofemp tion is sought , are imported by such a hospital by way of free gift from donor abroad or have been purchased ont of donations received abroad in foreign exchange :

Provided where the goods have been purchased out of donations received abroad in foreign exchange , the hoàpil fias been permitted to maintain an account abroad by the Reserve Bank of India for the purpose of receiving funds donated overseas .

सा. का. जि. 44 (अ). केन्द्रीय सरकार , वित्त अधिनियम, 1978 (1978 का 19 ) की धारा 35 की उपधारा ( 4 ) के साथ पठित, सीभा- शुल्क अधिनियम, 1962 (1962 का 52) की धारा 25 की उपधारा (1 ) द्वारा प्रकृत शक्तियों का प्रयोग करते हुए, अपना यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 96 -सीमा- शुल्क, तारीख12 मई, 1978 में निम्नलिखित और संशोधन करती हूँ, अर्थात्:-
उक्त अधिसूचना की अनुसूची में, -
(1) क्रम मं. 169 और उससे संबंधित प्रविष्टियों का लोप किया जाएगा:
(2) क्रम सं. 223 और उससे संबंधित प्रविष्टियों के पश्चात, निम्मलिखित अन्तःस्थापित किया जाएगा, अर्थात्:-

In exercise of the powers conferred by sub- section ( 1 ) of Section 25 of the Customs Act, 1962 ( 52 of 1962) , read with sub -section (4) of section 35 of the Finance Act, 1978 (19 of 1978) , the Central Government, being satis- fied that it is necessary in the public interest so to do , hereby makes the following further amendments , in the notification of the Government of India in the Ministry of Finance (Department of Revenue ) No. 96 - Customs , dated the 12th May , 1978 , namely :-
In the Schedule to the said notification ,-
(i) Serial No. 169 and the entries relating thereto shall be omitted;
( ii ) after serial No. 223 and the entries relating thereto the following shall be inserted , namely :- "224 No. 17-Customs , dated 25-1-1979 " . [No. 18 F. No. 460/265/ 78 -Cus . V. ] S. BASU , Under Secy.
