ORDER
S.O. 61(E).—Whereas the Central Government being satis- fied that as on the 15th day of November, 1978, the Rai Bahadur Narain Singh Sugar Mills Limited (hereafter) in this Order referred to as the said sugar undertaking) manu- facturing sugar at Lhaksar in the district of Saharanpur in the Stale of Uttar Pradesh has fafle'tr to commence manufao ture of sugar by the 15th day of November, 1978 ;
And whereas, the said undertaking has, in relation to the cane purchased before the 15th day of November, 1978, arrears of cane dues to the extent of more than ten per cent of the total price *f;tl# came so purchased-for the purpose* , of the said sugar undertaking during the 1977-78 sugar year;
', And whereas, the Central Government on the 19th and Wilt days of November, 1978 issued Notices No, SUG/144/ 7$-79 under sub-section (I) of aoction 3 of Ihc Sugar Under- takings (Taking Over of Management) Ordinance, 1978 (5 of t$78) to the owner of the said sugar undertaking calling upon mrrt to report in writing within seven days from the date bl receipt of Ihc said notices the circumstances under which the said sugar undertaking has ; *" • •; ,
(i) failed to commence the manufacture of sugar on or before the 15th day of' November, 1978 and
(ii) failed to clear the said arrears of cane dues,
and to show cause as to why the management of Ihe said sUJai u n d e r t a ke should not be taken over by the Central Govcrntoent:
And whereas, the Central Government, having considered the report dated the 27th day of November, 1978 sent by the Director on behalf of the said sugar undertaking, speci- fied in its order No. SUG./144/78-79 dated 14th December 1978, the manner in which the said sugar undertaking should clear the said arrears of cane dues in three instalments, the first instalment of Rs, 58.83 lakhs being payable by the 28th December, 1978 ;
And whereas the said sugar undertaking has not paid the said first instalment of the said arrears ot cane dues by the 28th December, 1978 the date specified by the Central Gov- ernffibnt;
, An# whereas the Central Government is satisfied that it is rteCessary for the purposes of the Sugar Undertakings (Taking Over of Management) Act, 1978 (No. 49 of 1978) that the management of the said sugar undertaking shall be vested in the Central Government;
