ORDER
New Delhi, the 3rd February, 1979
S. O, 65(E)—Whereas the Central Government being satisfied that as on the 15th day of November, 1978, the Cauvery Sugar and Chemicals Limited Cauvery Factory (hereinafter in this Order referred to as the said sugar under- taking) manufacturing sugar at Pettajvaytalai in the District of Tiruchirapalli in the Stale of Tamil Nadu has failed to commence manufacture of sugar by the 15th November, 1978 ;
And whereas the Central Government on the 18th day of November, 1978 issued Notice No. SUG/181/f978-79 under sub-section (1) of section 3 of the Sugar Undertakings (Taking Over of Management) Ordinance, 1978 (5 of 1978) to the owner of the said sugar undertaking calling upon him to report in writing within seven days from the date of receipt of the said notice the cir- cumslances under which the said sugar undertaking had failed to commence manufacture of sugar on or before the I5ih day of November, 1978 ;
And whereas the Central Government having considered the report dated the 27th November, 1978 sent by the Chief Executive on behalf of the said sugar undertaking, is not satisfied with the circumstances for failure to com- mence manufacture of sugar by the 15th day of November, 1978 ;
Now, therefore, in exercise of the powers conferred by sub-section (3) of section 3 of the Sugar Undertaking (Taking Over of Management) Act, 1978 (No. 49 of 1978), the Central Government hereby declares that the management of the snid sugar undertaking shall vest in the Central Government for a period of three years commencing on and from the 7th day of February, 1979.
