फा० भा० 136 ( प्र) / 18 एफ ० बी०/ माई ० डी० पार० ए०/ 79 .--- भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं० का० भा० 190 (६०)/ 18 एफ० बी० आई ० डी० भार० ए०/ 78, तारीख 21 मार्च, 1978 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) द्वारा केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 चख की उपधारा ( 1 ) के खण्ड ( ख) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए यह घोषणा की थी कि उक्त आवेश के जारी होने की तारीख के ठीक पूर्वक प्रवत ऐसी सभी संविदाओं , सम्पति के हस्तांतरण पत्रों करारों, व्यवस्थापत्तों, पंचाटों, स्थायी आदेशों या अन्य लिखितों का ( उसमें भिल, ओ बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से संबंधित हैं ) जिनका मैमर्स नैशनल रबर मैनुफैक्चरर्स लिमिटेड कलकत्ता या ऐसे औद्योगिक उपक्रम का स्वामित्व रखने वाली कम्पनी एक पक्षकार है या जो ऐसे औद्योगिक उपक्रम या कम्पनी को लागू हो, प्रवर्तन एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख के पूर्व उसके अधीन प्रेद्भूत या उद्भूत होने वाली सभी अधिकार, विशेष अधिकार, बाध्यताएं और वायित्व उक्त अवधि के लिए निलम्बित रहेंगे।
और केन्द्रीय सरकार का गमाधान हो गया है कि उक्त भावेश की अवधि 20 मार्च , 1980 तक, जिसमें यहदिन भी सम्मिलित है, एक वर्ष की और अवधि के लिए बढ़ा दी जानी चाहिये ।
अतः अम उद्योग ( बिकाम और विनियमन) अधिनियम , 1951 (1951 का 65) की भांग 18 चख की उपधारा ( 2 ) के साथ पठित

उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , उक्त आदेश की अवधि 20 मार्च, 1980 तक जिसमें यह दिन भी सम्मिलित है, बढ़ाती है ।

S.O. 136(E ) /18FB/IDRA/79.-Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S.O. 190 (F ) / 18FB/ IDRA/78 dated the 21st March , 1978, (hereinafter referred to as the said Order) , the Central Government in exercise of the powers conferred by clause (b) of sub- section ( 1 ) of section 18FB of the Industries (Development and Regulation) Act , 1951 (65 of 1951 ) , had declared that the operation of all contracts , assurances of property , agreements , settlements , awards , standing orders or other instruments in force immediately before the date of issue of the said Order (other than those relating to secured liabilities to banks and financial institutions ) to which the industrial undertaking known as Messrs . National Rubber Manufacturers Limited , Calcutta or the company owing such industrial undertaking is a party or which maybo applicable to such industrial undertaking or company shall remain sus- pended for a period of one year and that all the rights , privileges , obligations and liabilities accruing or arising the reunder before the said date shall remain suspended for the said poriod;
And whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period of one year upto and inclusive of the 20th March , 1980;

Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) , read with sub - section (2) of section 18FB of the Industries ( Development and Regulation ) Act , 1951 (65 of 1951 ) , the Contral Government hereby extends the duration of the said Ordor upto and inclusive of the 20th March , 1980 .

फा० आ० 137 ( अ) 18ई० आई० डी० आर ० ए०/ 79 . केन्द्रीय मरकार ने , उद्योग ( विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 कक के अधीन जारी किये गये भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकाम विभाग ) के आदेश सं ० का० प्रा० 852 ( अ०मा० ) / 18 कक/ आई ० डी० भार ० ए०/ 77 तारीख 23 दिसम्बर , 1977 द्वारा व्यक्तियों के एक निकाय को मैसर्स नेशनल रखर मैन्यूफैववरर्स लिमिटेड, कलकत्ता जिसे इसके पश्चात् उक्त औद्योगिक उपक्रम कहा गया है, का प्रबन्ध्र उसमें विनिर्दिष्ट अवधि के लिये ग्रहण करने के लिये प्राधिकृत किया है ।
अतः अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा 18 की उप धारा ( 2 ) द्वारा प्रश्प्स शक्तियों का प्रयोग करते हुए , इससे उपाबद्ध अनुसूची में ऐमे अपत्रादों, निर्बन्धनों और परिसीमाओं को विनिर्दिष्ट करती है जिनके अधीन रहते हुए कम्पनी अधिनियम 1956 ( 1956 का 1) उक्त औद्योगिक उपक्रमों को उसी रीति मे लागू होता रहेगा जैसे वह धारा 18 क के अधीन श्रादेश जारी किये जाने के पूर्व उसे लागू होता था ।

S.O. 137 ( E) /18E/IDRA/79.-Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development ) No. S.O. 852 (E) / 18AA/IDRA/ 77 dated the 23rd December, 1977 , issued under section 18AA of the Industries ( Development and Regulation) Act , 1951 (65 of 1951) , the Central Government has authorised a Body of Persons to take over the management of Messrs . National Rubber Manufacturers Limited , Calcutta (hereinafter referred to as the said industrial undertaking) for the period specified thercin ;
Now, therefore, in exercise of the powers conferred by sub- section (2 ) of section 18E of the said Act , the Central Govern- ment hereby specifies , in the Schedule annexed hereto the exceptions , restrictions and limitations subject to which the

फा० प्रा० 138 ( अ) / 18 एफ० जी०/प्राई ० डी ० आर ० ए०/ 79. भारत सरकार के भूतपूर्व औद्योगिक विकास मंत्रालय ( औद्योगिक विकास विभाग ) के आवेश सं ० का० भा० 455 ( असा० )/ 18 चख/ उ ० वि ० वि ० अ०/ 73, तारीख 31 अगस्त, 1973 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) केन्द्रीय सरकार ने उच्चोग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 चा की उपधारा ( 1 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए, घोषित किया था कि राजपत्र में उक्त श्रादेश के प्रकाशन के ठीक पूर्व प्रवृत्त ऐसी सभी या किसी संविदा, सम्पत्ति के हस्तांतराणपक्ष, करार, समझौते, पंचाट, या अन्य लिखत का जिनका/ जिसका मैसर्स कार्टर पूलर एण्ड कम्पनी प्राइवेट लिमिटेड , कलकत्ता नामक औद्योगिक उपक्रम एक पक्षकार है या जो उक्त उपक्रम को लागू हों या हो, प्रवर्तन एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व तवधीन प्रोभूत या उद्भूत होने वाले सभी अधिकार, विशेषाधिकार, माध्यताएं और दायित्व एक वर्ष की अवधि के लिए निलम्बित रहेंगे ;
और उक्त प्रादेश की कालावधि 30 अगस्त, 1978 तक बढ़ा दी गई थी,
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त प्रादेश की कालावधि 30 अगस्त, 1979 तक, जिसमें वह दिन भी सम्मिलित है, को और अवधि के लिए बढ़ा दी जानी चाहिये ।
अतः, अब केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधि- नियम, 1951 ( 1951का 65) की धारा 18 चख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदस शक्तियों का प्रयोग करते हुए , उक्त आदेश की कालावधि 30 अगस्त, 1979 तक, जिसमें वह दिन भी सम्मिलित है, को और अवधि के लिए बढ़ाती है ।

(hereinafter referred to as the said Order) , the Central Govern- ment in exercise of the powers conferred by sub - section ( 1 ) of section 18FB of the Industries (Development and Regulation Act, 1951 (65 of 1951 ) , doclared that the operation of all or any ) of the contracts , assurances of property , agreements , settle- ments, awards or other instruments in force immediately before the publication of the said Order in the Official Gazette to which the industrial undertaking known as Mossrs . Carter Pooler and Company Private Limited , Calcutta , is a party or which may be applicable to the said industrial undertaking shall remain suspended for a period of one year and all rights , privileges , obligations and liabilities accruing or arising thereunder beforc
the said date shall remain susponded for a period of one year ; And whereas the duration of the said Order was extended upto the 30th August , 1978 ;
And whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period upto and inclusive of the 30th August , 1979;

का० मा० 139 ( म) केन्द्रीय सरकार ने , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 कक की उपधारा ( 2 ) के अधीन जारी किए गए भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के आदेश सं ० का० श्रा० 405 ( म) तारीख 20 जून, 1977 के साथ पठित उक्त अधिनियम की धारा 18क की उपधारा ( 1 ) के खण्ड ( ख ) के श्रधीन जारी किए गए भारत सरकार के भूत्तपूर्व उधोग और नागरिक पूति ( औद्योगिक विकास विभाग ) के आदेश सं० का० भा० 375(श्र) तारीख 22 जुलाई, 1975 द्वारा , व्यक्तियों के एक निकाय को , ग्लूकोनेट लिमिटेड , कलकत्सा नामक सम्पूर्ण औद्योगिक उपक्रम का प्रबंध उसमें विनिर्दिष्ट अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया है :
अतः अब केन्द्रीय सरकार, उक्त अधिनियम की धारा 183० की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उससे उपाबद्ध अनुसूची में ऐरो अपवादों , निर्बन्धनों, और परिसीमाओं को विनिविष्ट करती है, जिसके अधीन रहते हुए , कम्पनी अधिनियम, 1956 ( 1956 का 1) उक्त औद्योगिक उपक्रम को उसी रीति से लागू होता रहेगा जैसे वह धारा 18 कक के अधीन आदेश जारी किए जाने के पूर्व उसे लागू होता था ।
कंपनी अधिनियम, 1956 के अपवाव , निर्बन्धन और परिसीमाएं, जिनके के उपबन्ध अधीन रहते हुए, स्तम्भ ( 1) में वर्णित उपबन्ध उपक्रम को लागू होंगे

Now, therefore , in exercise of the powers conferred by sub- section (2) of section 18E of the said Act , the Central Govern- ment heroby specifles in the Schedule annexed hereto , the ex- ceptions , restrictions and limitations subject to which the Com panies Act , 1956 (1 of 1956) shall continue to apply to the Indus trial undertaking in the same manner as it applied thereto before the issue of the order under section 18AA . Section 166 Section 210 (1 )
Provisions of these sections shall not apply to the extent that the Balance Sheet and Profit and Loss Account of the industrial undertaking need not be placed before the Annual General Meeting . The industrial undertaking will have to prepare the Balance Sheet and Profit and Loss Account as usual and shall file its statutory returns and balance shoet and profit and loss account with the Registrar of Companies . The exemp- tion does not affect the provisions of the Section 159 (1 ) of the Companies Act , 1956 ( 1 of 1956) .

फा० श्रा० 140 ( प) / 18 ई०/ आई० डी ० आर० ए०/ 19 -केन्द्रीय सरकार से, उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की द्वारा 18क के अधीन जारी किये गये भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग ) के आदेश सं ० का० ग्रा० 85 (भसा० ) 18क/आई० डी० आर ० ए० / 78 तारीख 10 फरवरी 1978 द्वारा व्यक्तियों के एक निकाय को मैसर्स नैशनल रबर मैन्यूफैक्चरर्स लिमिटेड (कल्याणी एकक ) , कलकत्ता ( जिसे इसके पश्चात् उक्त श्रौष्योगिक उपक्रम कहा गया है ) का प्रबन्ध उसमें विनिविष्ट अवधि के लिये ग्रहण करने के लिये प्राधिकृत किया है ।
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 188 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये , इससे उपाबद्ध अनभूची में ऐसे अपवादों, निर्बन्धनों और परिसीमात्रों को विनिविष्ट करती है जिसके अधीन रहते हुये कम्पनी अधिनियम 1956 ( 1956 का 1 ) उक्त प्रौद्योगिक उपक्रमों को उसी रीति से लागू होता रहेगा जैसे वह धारा 18 क के अधीन आदेश जारी किये जाने के पूर्व उसे लागू होता था ।

अतः भ्रम , केन्द्रीय सरकार , उक्त अधिनियम की धारा 188 की उप धारा ( 2 ) द्वारा प्रवरत शक्तियों का प्रयोग करते हुये , इससे उपाबद अनुसूची में ऐसे प्रपवाषों, निर्बन्धमों और परिसीमाओं को विनिदिष्ट करती है जिनके अधीन रहते हुए कम्पनी अश्रिनियम 1956 ( 1956 का 1 ) उक्त श्रौद्योगिक उपक्रमों को उसी रीति से लागू होता रहेगा जैसे वह धारा 18क के अधीन आदेश जारी किये जाने के पूर्व उसे लागू होता था ।

S.O.- 141 (E)/18E/IDRA/79.-Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S.O. 266(E)/ 18A/IDRA/ 78 dated the 13th April, 1978 , issued under secton 18A of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government has authorise a Body of Persons to take over the Management of Messrs . Inchek Tyres Limited Calcutta (hereinafter referred to as the said industrial under taking) for the period specified therein;
Now, therefore , in exercise of the powers conferred by sub- section (2) of section 18E of the said Act, the Central Government hereby specifies , in the Schedule annexed hereto the exceptions , restrictions and limitations subject to which the Companies Act, 1956 ( 1 of 1956) , shall continue to apply to the said industrial undertaking in the same manner as it applied thereto before the issue of the Order under section 18A .
