सा०का० नि० 254 ( अ) खाद्य श्रमिश्रण निवारण नियम , 1955 में और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार, खाद्य श्रनमिश्रण निवारण श्रधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात बनाने का प्रस्ताव करती है , उक्त धारा 23 की उप-धारा ( 1) की अपेक्षानुसार , उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है जिनके उससे प्रभावित होने की संभावना है और यह सूजना वी जाती है कि उक्त नियमों के प्रारूप पर उस तारीख से पेंतालीस दिन की समाप्ति पर विवार किया जाएगा जिस तारीख को भारत के उस राजपत्त की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती हैं ।
नियमों के उक्त प्रारूप की बाबत जो भी प्रापत्तियां या सुझाव इस प्रकार विनिविष्ट अवधि की समाप्ति से पूर्व किसी व्यक्ति से प्राप्त होंगे , उन पर केन्द्रीय सरकार विचार करेगी ।
नियनों का प्रारुप
1. इन नियमों का नाम खाध श्रपमिश्रण निवारण ( संशोधन ) नियम 1979 है ।
2. खाद्य अपमिश्रण निवारण नियम, 1955 (जिये इनमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 32 में, खण्ड (क ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्ः--

व्यापार नाम, विवरण तथा उत्पादन में प्रयुक्त संघटकों की सूची । "(क) इम सूत्री में संघटकों का उल्लेख, यथास्थिति, तौल या भ्रायतन की मात्रा के हिसाब से अवरोही क्रम में किया जाएगा ।"
3. उक्त नियमों के नियम 37क के स्थान पर निम्नलिखित नियम अंतःस्थापित किया जाएगा अर्थात्ः-
"केन्द्रीय सरकार द्वारा माम्पत्तिक खाचों के लेबलों का अनुमोदनः--
37. क . सभी प्रकार के साम्पत्तिक ग्राधों में , जहां काल्पनिक नाम या व्यापार नाम का प्रयोग किया जाता है, खाद्य के नाम या उस प्रवर्ग का, जिसके अंतर्गत बह इन नियमों के अधीन भाता है, भी उल्लेख लेबल में किया जाएगा । ऐसे खाद्यों के लेबलों को , और विनिर्माण का , जिनका मानकीकरण परिशिष्ट ' ख ' में नहीं किया गया है , खाद्य के विक्रय से पूर्व केन्द्रीय सरकार को अनुमोदित करता होगा ।
स्पष्टीकरण : इस नियम के प्रयोजन के लिए, " काल्पनिक व्यापार नाम" या "साम्पत्तिक नाम " से , खाद्य की ऐसी परम्परागत किस्म अभि- प्रेत है जिसका इन नियमों के अधीन मानकीकरण नहीं किया गया है । "
4. उक्त नियमों के नियम 42 ( च) के पश्चात् निम्नलिखित अंतः- स्थापित किया जाएगा, अर्थात्ः-
"( न) परिष्कृत साल बीज वसा के प्रत्येक प्राधान पर निम्नलिखित लेबल लगा होगा , अर्थात्ः--
पष्कृित साल बीज वसा
केवल बेकरी और कनफेक्शनरी में उपयोग के लिए ।
-सीधे उपयोग के लिए नहीं ।
5. उक्त नियमों के नियम 44 में , वर्तमान परन्तुक के स्थान पर निम्नलिखित परन्तुक रखा जाएगा , अर्थात्ः-

"परन्तु यह और कि, साम्पत्तिक खाद्य वस्तुओं के ऐसे लेबलों की , जो केन्द्रीय सरकार द्वारा नियम 37 क के उपबन्धों के अधीन अनुमोवित कर विए गए हैं, इस नियम के प्रवर्तन से छूट दी जा सकेगी । "
6. उक्त नियमों के नियम 45 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
"कोई व्यक्ति किनी ऐसे खाद्य के, जो शहद से मिलता जुलता है किन्तु शुद्ध शहद नही है, लेबल , पैकेज या विज्ञप्ति पर ' शव ' शब्द का या उसके समामार्थक या समरूप किमी शब्द का प्रयोग किसी अन्य शब्द, टिप्पण, चित्त या युभित के पूर्व या पश्चात् या उसके साथ , उस प्रकार नहीं करेगा कि उससे ऐसे खाथ के शहव होने का आभास हो:
परन्तु शाहूव युक्त ऐसी साम्पत्तिक खाश्च वस्तु पर, जिसके लेबल को नियम 37 क के उपबन्धो के अधीन अनुमोदित कर दिया गया है, संघटक के रूप में ' महद' का उल्लेख किया जा सकता है ।"
7. नियमो के नियम 49 में, उपनियम ( १ ) के पश्चात्, निम्नलिखित उप-नियम अंतःस्थापित किया जाएगा, अर्थात्ः
" ( 10) कोई भी व्यक्ति साल बीज थसा का खाद्य प्रयोजन के लिए विक्रय सब तक नहीं करेगा जब तक कि वह परिष्कृत नहीं कर दिया गया है और उस पर लगे लेबल पर नियम 42( 7 ) में श्रधिकथित घोषणा नही है ।"
8. उक्न नियमो के परिणिष्ट "ख " में,
(1 ) मद क. 10.06 के पश्चात् निम्नलिखित मद और प्रविष्टियां
ओड़ी जाएगी , अर्थात्ः-
"क. 10.07 साल बीज बसाः-
साल बीज बसा से, साल वृक्ष, शोरिया रोवस्टा, गैरटन ( डिपटेरोकेपाका नहीं ) के स्वच्छ और ठोस बीजों की गिरी से विलायक निष्कर्षण प्रक्रिया द्वारा प्राप्त वसा अभिप्रेत है । पिछलाए जाने पर यह स्वच्छ और अपमिश्रण तलछट , निलम्बित या अन्य विजातीय पदार्थों , पृथक्कृत जल या मिलाए गए रंजक पदार्थों से मुक्त होगा । यह निम्नलिखित मामकों के अनुसार होगा:-
(क ) अटीरों रेफेक्टोमीटर 40° से ० पर -36.7 51.0 या 40 ° सें ० पर अपवर्तनांक -1.4500-1-4500
(ख) आयोडीन मान ( विज पद्धति) 35-45
186-195 (ग) साबुनीकरण मान
(घ) असाबुनीकरण पदार्थ तोल में 2.5 प्रतिशत से अधिक नहीं
(ङ) उने हुए नमूने को 24 घन्टे तक 50 ° सें ० पर रखने के पश्चात् कोई श्राविलता नही होगी ।
(च) मुक्त बसा अम्ल ( जिसे ओलीक अम्ल के नाम से अभिव्यक्त किया गया है) तोल में 6.0 प्रतिशत से अधिक नहीं
या
अम्ल तत्व-
-12.0 से अधिक नहीं ।
साल बीज वसा का उपयोग केवल बेकरी और कन्फेक्शनरी में किया जाएगा । यह परिष्कृत की जाएगी और ( क) से ( क) तक में उल्लिखित मानकों के अनुरूप होगी । वह निम्नलिखित मानकों के भी अनुरूप होगी, अर्थात्
(i ) आर्द्रता तथा अन्य अविलेय अशुद्धियां 0.1 प्रतिशत से अधिक नहीं
( ii ) मुक्त वसा अम्ल ( जिसे ओलीक अम्ल के नाम से अभिव्यक्त किया गया है ) 1.0 प्रतिशत से अधिक नहीं या अभ्ल -0.5 प्रतिशत से अधिक नहीं तत्व

(iii) 9.10 एपोक्सी और 9.10डिहाइड्रोक्सी स्टिऐटिक अम्ल -तोल में 3.0 प्रतिशत से अधिक नहीं
(iv) प्रज्वनताप ( पेंस्की मार्टेन बंद पद्धति से) 250° सें ० से अधिक नहीं ।

NOTIFICATION
New Delhi , the 19th March , 1979
G.S.R. 254 (E) . The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government proposes to make in exercise of the powers conferred by sub- section ( 1) of section 23 of the prevention of Food Adulteration Act , 1954 ( 37 of 1954) , and after consultation with the Contral Committee for food sten- dards , is hereby published as requiredby sub - section ( 1 ) of the said section 23 of the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after the expiry of 45 days from the date on which the copies of the Gazette of India, in which this notification is published , are made available to the public .
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified , willbo considered by the Central Government .
DRAFT RULES
1. These rules may be called the Prevention of Food Adul- toration (Amendment ) Rules , 1979 .
2. In the Prevention of Food Adulteration Rules , 1955 , (hereinafter referred to as the said rules ) , in rule 32, for clause (a) , the following clause shall be substituted , namely :-
"(a) the name, trade name , description of food, giving the list of ingredients used in the product in descending order of composition by weight or by volume as appropriate."
3. For rule 37A of the said rules, the following rule shall be inserted , namely :-
" 37A . Approval of labels of proprietory foods by Central Government -In all types of proprietory foods where fancy names or trade names are used , the name of the food or the category under which it falls in these rules , shall also be mentioned on the label . The labels as well as the manu- facture of such foods which are not standardised in Appendix B, shall be subjected to be approved by the Central Govern- ment , before sale .
Explanation for the purposes of this rule " fancy trade пате" от " pгoprietory name " means the non conventional type of food which has not been standardised under these rules . "
4. After rules 42 (S ) of the said rules , the following shallbe inserted , namely : - 463

"(T) Every container of refined salseed fat shall bear the following Jabel :-
REFINED SALSEED FAT
FOR USE IN BAKERY AND CONFECTIONERY ONLY
NOT FOR DIRECT CONSUMPTION .
5. In rule 44 of the said rules , after the existing proviso the following proviso shall be added , namely :-
"Provided further, the labels of proprietory food articles , which are approved by the Central Government , under the provisions of rule 37A may be exempted from the operation of this rule . "
6. For rule 45 of the said rules , the following shall be subs- tituted, namcly :-
"45. Food resembling but not pure honcy not to be marked honey. No person shall use the word ' honey ' as such or its synonym or homonym , or honey even in pre - fix or in suffix or in combination with any word , remark , illustrations or device that suggest honcy on the label or in package or in any advertisement form in food that resembles honey , but is not pure honey :
Provided that the proprietory food article containing honey , the label of which is approved under the provisions of rule 37A may contain 'Honey ' as one of the ingredients . "
7. In rule 49 of the said rules , after sub -rule (9) , the following sub - rule shall be inserted namely :-
"( 10) No person shall sell salseed fat for edible purpose unless it is refined and bears the label declaration as laid down in rule 42(T) " .
8. In Appendix B of the said rules :
(i ) after item A.10.06, the following item and entries shall be added, namely :-
"A.10.07-Salseed fat : Salseed fat means the fat obtained by the process of solvent extraction from clean and sound seed kernels of Sal tree , Shorea robusta , Gaertn . f. ( N- Dipterocarpaceae) . On melting , it shall be clear and free from adulterants , sediment , suspended or other foreign matter, separated water or added colouring substance . It shall conform to the following standards :-
(a) Buryro - refrectometer reading at 36.7-51.0 40° C
Refractive Index at 40 ° C
1.4500-1.4600
35-45
(b) Iodine value ( Wijs'method)
186-195
(c) Saponification value
(d) Unsaponifiable matter
Not more than 2.5 per cont by weight .
(e) 'There shall be no turbidity after keeping the filtcied sample at50 ° C for 24 hours .
Not more than 6.0 por cent by weight .
( f) Free Fatty acid ( expressed as Oleic acid) ог
Acid value
Not more than 12.0.
Salseed fat shall be used only in bakery and confectionery . It shall be refined and shall conform to the standards at (a)to (c). Additionally, it shall conform to the following standards:-
Not more than 0.1%
( i) Moisture and other insoluble impurities
Not more than 1.0%
Not more than 0.5. (ii ) Free Fatty Acid (expressed as oleic acid) ог Acid value
( iii) 9.10 ероxy and 9,10 Dihydroxy stearic acid
Not more than 3.0 % by weight .
Not more than 250°C. "
