सा० का० मि ० 326 ( अ) राजनयिक एवं कींगली अधिकारी ( शपथ एवं मुल्क) अधिनियम 1948 ( 1948 का 41 ) की धारा 8 की उप -धारा ( 2) के ब्रांड ( क ) के माथ पठित धारा 6 द्वारा प्रवल शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार, इसके द्वारा , राजनयिक एव कौंसली अधिकारी (शुल्क नियमावली , 1949 में संशोधन करने के लिए निम्नलिखित नियम बमाती है , यथाः
व्यापारिक नौवहन के संबंध में लिया जाने बाला शुल्क
(1) वे नियम राजनयिक एवं कौमली अधिकारी ( शुल्क) संशोधन नियम 1979 कहलायेंगे ।
( 2) ये नियम राजपत्र में प्रकाशन की तारीख से लागू हो जायंगे ।
1. जहाजों की रजिस्ट्री , हस्तांतरण और प्रेषण , जहाजों में हित , या जहाजों पर बंधकों के उद्देश्य से व्यापारिक मौपरि- वहन अधिनियम , 1958( 1958 का 44) के अंतर्गत ली गयी या रिकार्ड की गई प्रत्येक घोषणा के लिए

यह शुल्क दो संबद्ध जहाजों में बराबर -बरा- बर बांटा जाना चाहिए अतः दो जहाजों से लिया गया अधिकतम शुल्क श्रेणी "क " के देशों में 1500/-रु ० भौर श्रेणी " ख" के देशों में 1000/- रु ० से अधिक नही होना चाहिये ।
43. जहाज के वस्तावेजों के निरीक्षण के लिए जब उन्हें प्रस्तुत करना अपेक्षित हो ताकि कोंसली भधिकारी जहाज की ओर से कोई विशिष्ट कार्य कर सकें

मोट:-जहाज के दस्तावेजों भाषि की अभिरक्षा के लिए भव 18 के अंतर्गत लिए जाने वाले शुल्क के अतिरिक्त यह शुल्क तब तक नहीं लिया जाए जब तक कि बीच में कोंसली कायर्यालय से यह करार वापिस म ले लिया गया ही ।

मोट : थल सेना, नौ सेना वायु सैमा अथवा व्यापारिक नौवहन सेवा के कार्मिकों भथवा उनकी विधवानों अथवा उत्तराधिकारियों के कागज पत्नों पर हस्ताक्षर करने के लिए कोई शुल्क नहीं लिया जाएगा और कोंसली अधिकारी के हस्ता- क्षर के पास "निःशुल्क " शब्द लिखा जाएगा । जिन व्यक्तियों को सिविल पेंशन अथवा सेवा- निवृत्ति वेतन मिल रहा हो, उन्हें शुल्क में छूट नहीं की जाएगी ।

नौट: जीवन संबंधी प्रमाण -पत्रों तथा हर छठे महीने उंगलियों के निशानों के संबंध में हस्ताक्षर के लिए और उन पर मौहर लगाने के बारे में बसीकवारों से कोई शुल्क नहीं लिया जाएगा, ऐसे मामलों में कौंसली अधिकारी के हस्ताक्षर के पास " निःशुल्क " शब्द लिखा जाएगा ।

मोट ( 1 ) -यह मुल्क उस समय लिया जाएगा जब कि किसी मूत भारतीय नाग- रिक की सम्पत्ति अथवा उस सम्पत्ति की बिक्री से प्राप्त राशि किसी कोंसली अधि- कारी को उसकी आधिकारिक हैसियत में स्थानीय प्राधिकारियों द्वारा अथवा अभ्य व्यक्तियों द्वारा स्थानीय कानून के अनुसार उक्त सम्पत्ति का अथवा उस की बिक्री मे प्राप्त धन राशि का कोई कानूनी रूप से सक्षम दावेदार न हो और यह सम्पत्ति अथवा राशि अनुपस्थित पक्षों में सीधे ही अथवा भारत सरकार के माध्यम से वितरण के लिए कौंसली पधिकारी को सौपी गई हो।
62. किसी दस्तावेज अथवा दस्तावेज के किसी अंश की प्रति को प्रमाणित करने के लिए यदि वह 100 शब्दों से अधिक न हो

नोट: यदि दस्तावेज किसी विदेशी भाषा में हो तो उपर्युक्त शुल्क का बुगुमा शुल्क लिया जाएगा जय प्रति कोंसली अधिकारी द्वारा तैयार की जाती है तो अतिरिक्त शुल्क मद 3 के अनुसार लिया जाता है ।

नोट ( 3 )-इस शुल्क में पत्तव्यवहार रसीवों पर हस्ताक्षर ऋणों का भुगतान और प्रशासक के रूप में कार्य करने के लिए तथा उन पक्षों को सम्पत्ति का वितरण करने के लिए जो कानूनी तौर पर इसके हकदार हैं अथवा भारत सरकार को हस्तांतरित करने से संबद्ध भानुषंगिक कार्य ; जैसी भी स्थिति हो इसमें शामिल है । यदि मृत भारतीय की संपत्ति के प्रबंध अथवा वितरण के लिए किसी कोंससी अधिकारी के लिए कोई अन्य सेवा आवश्यक हो जिसके लिए विशेष शुल्क की इसमें व्यवस्था की गई हो तो ऐसी सेवा के लिए शुल्क लिया जाना चाहिए ।
नोट ( 4 )-जब किसी भारतीय की मृत्यु के मामले में रिश्तेदारों के न होने के कारण किसी कोंसली अधिकारी को भेजा जाता है और रिश्तेदारों के प्रथवा अन्य व्यक्तियों के पहुंचने तक जो इसका भार संभालने में समक्ष हो सकते हैं अथवा ऐसे व्यक्तियों से प्रभुवेश मिलने तक यवि वह मृतक की सम्पत्ति की अस्थायी तौर पर केवल परिरक्षा की व्यवस्था करता है तो 20 प्रतिशत का यह शुष्क नहीं लिया जाएगा लेकिन कोमली अधिकारी की मोहर लगाने तथा मृतक के घर पर उसकी उपस्थिति के लिए शल्क लिया जाएगा ।
नोट ( 5 ) किसी भी अधीनस्थ कोंसली केन्द्र पर संभाली गई सम्पदा से संबंधित कोई भी धन अथवा वस्तुनों को अधीक्षण कोंसलावास में भिजवा देना चाहिए ।
67. कोंसली अधिकारी के निवास के देश में किसी ऐसे व्यक्ति की सम्पत्ति जोन तो भारतीय नागरिक हो न ही माविक हो तथा बिना वसीयत किए मर गया हो अथवा उक्त मृतक ने अगर वसीयत की भी हो तो, के कानूनी रूप से सक्षम प्रति- निधियों के प्रभाव में जब कि भारत में उसके उत्तराधिकारी श्रांशिक या पूर्ण रूप से यह सम्पत्ति लेना चाहते हों के बारे में मद 66 में उल्लिखित कार्यों के समान कार्य करने के लिए

69. पब्लिक रिकार्ड ग्राफिस अथवा कही अन्यत्र से स्थानीय रजिस्ट्रोंसे उद्धरण लेने अथवा वसीयत विलेा अथवा अन्य चीजों की प्रतियां प्राप्त करने के लिए अथवा तलाश के लिए , जो इस खर्च से और साध्यांकन के नोट: सामान्यतया कोई कोंसली अधि- कारी केवल सम्बद्ध पक्षों से अथवा स्था- नीय प्राधिकारियों से अनुरोध प्राप्त होने पर ही कार्यालय से बाहर उपस्थिति होंगे । लेकिन ऐसी उपस्थिति कोंसली अधिकारी की इच्छा पर निर्भर होगी बातें उसकी अनुपस्थिति से मरकारी कार्यालय में बाधा न पड़ती हो । पोतभंग होने की स्थिति में अथवा मुसीबत के समय जहाज की महायता करने के उद्देश्य से कोंसल। अधि- कारी को किसी विशेष अनुरोध की प्रतिक्षा किये बिना उपस्थिति होना चाहिए । क्योंकि लोगों की जान बचाने के लिये किये गये प्रत्येक संभव उपायों में उमर्की उपस्थिति सहायक हो सकती है , और ऐसे अवमरों पर मद 73 और 74 में बनाया गया शुल्क नहीं लगाया जाएगा । लेकिन जब तक विशेष रूप से अनुरोध न किया जाये तब तक वे किसी अन्य उद्देश्य के लिए वहां नहीं ठहरेगा । कार्यालय के बाहर वो कौमली श्रधि- कारियों के उपस्थत होने की स्थिति, जो केवल बहुत ही विशेष मामलों में अथवा पार्टियों के अनुरोध पर ही होगा , कनिष्ठ अधिकारी की उपस्थिति के लिए शुल्क इस अनुसूची में निर्धारित राशि से आधा होगा क्योकि उन्हें लिपिक की हैमियन से अपने वरिष्ठ के साथ गहायक के रूप में समझा जाएगा ।

Note (2) The fee shoud also be
charged on a valuation of any portion of the property which a consular officer may, in the exercise ofhis discretion , remit home . Trinkets and other arti- cles, including securities , not exceeding the estima- ted value of Rs . 2000/ - may be remitted home without charging any fee ; if it ex- ceeds that estimated value , and remitted home without realisetion on the spot, the fee of 24% mustbe charged on the whole of the esti- mated value .

duties incidental to acting as administrator , and to distribution of the property to the parties legally enti- tled to it, or to its transmis- sion to the Government of India, as the case may be . If in the administration or distribution ofthe property of a deceased Indian sub- ject it is necessary for the consular officer to per- form any other service for which a special fee is pro- vided herein , the fee or fees for such service should also be charged.
Note (4) When, in the case of the death of an Indian subject, aconsular officer is sent for owing to the absence of relatives , and he only makes arrangements for the temporary custody of the property of the deceased, pending the arrival of rela- tives or other persons who may be competent to take charge of it, or of instruc- tions from such persons , no charge of the fee of 2 per cent shall be made, but the fee for affixing the consular officer's scal and the fees for his attendance atthe house of the deceased shall be chargeable .
Note (5 ) Any money or articles be- longing to the estate taken charge of at a subordinate consular post should be sent to the Superintending Consulate .

Part III-Fees for certain attendance by consular officers .
Note-As a general rule , a consular officer isto attend out of Office only on the application of the parties concerned, or of the local authority, and such attendance is to be at the discretion of the consular officer and provided his official duties admit of his absence. In the case of ship- wreck, or for the purpose of assisting a ship in distress the consular officer should attend without waiting for any special request, as his presence may conduce to every possible mea- sure being taken for saving life , and on such occasion , fees indi- cated in items 73 and 74 are not leviable, but his attendance should not be continued for any other purpose unless it is specially requested .
In the event of two consular officers attending out of office , which should only occur invery special cases , or at the request of the parties , the fee for the attendence of the junfor is to behalf of the amount fixed in this Schedule , as he is to be looked upon as accompanying his senior in the capacity of a clerk . A proconsular officer attending alone is a consular officer for the purpose of fees.
