नई दिल्ली, 2 क्षेप्रैल , 1979
सा० का० ति० 327 (अ): केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 (1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विनायक निस्सारित तेल, बितेलित भोजन और खाने योग्य आटा ( नियंत्रक ) आदेश , 1967 में और संशोधन करने के लिए निम्नलिखित आवेश करती है , अर्थात्:-
1. ( 1 ) इस श्रादेश का नाम विलायक-निस्मारित तेल, वितेभित भोजन और खाने योग्य ग्राटा ( नियंत्रण) संशोधन भावेश , 1979 है ।
( 2 ) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
2. विलायक निस्तारित तेल, वितेलित भोजन और खाने योग्य आटा (नियंत्रण ) आदेश, 1967 में, खण्ड 3 के उपखंड ( 2 ) में पैरा ( V) के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्:-
"( v) प्रवर्ग 'ङ':-ऐसा उत्पावक ( क) जिसके कारखाने में यद्यपि विलायक निम्सारण संयंत्र नहीं लगा है, फिर भी वह अपनी तेल- मील में अपने द्वारा उत्पावित खली या अपने द्वारा श्रायानित तिलहन से, किसी अन्य उत्पादक के कारखाने में विलायक , निस्सारित तेल या विते- लित भोजन के विनिर्माण संबंधी कारबार में नियोजित हैं ।
(ख ) जिसकी अपनी ही कोई तेल-मील महीं हैं, किन्तु जिसे केन्द्रीय सरकार की पूर्व सहमति से, नियंत्रक ने लिखित आवेश द्वारा और अपना यह समाधान हो जाने पर कि ऐसा करने के लिए पर्याप्त आधार है, किसी अन्य उत्पादक के कारखाने में अपने द्वारा उपाप्स तेल वाले पदार्थों का प्रसंस्करण करने की अनुज्ञा दे वी गई है :
परन्तु नियंत्रक केवल निम्नलिखित शर्तों पर ऐसी अनुज्ञा वेगा, भर्थात्:-
(क ) यह कि ऐसा प्रसंस्करण नियंत्रक की पूर्व सहमति से किया आएगा ;
(ब) यह कि नियंत्रक द्वारा विनिर्दिष्ट तेल वाले पदार्थों से भिन्न किसी तेल वाले पदार्थ का इस प्रकार प्रसंस्करण नहीं किया जाएगा;
(ग) यह कि खण्ड ( क ) के अधीन नियंत्रक द्वारा विनिविष्ट तेल वाले पवार्थ का प्रसंस्करण , ऐसे कारखाने/कारखानों के परिसरों में जो नियंत्रक द्वारा विनिविष्ट किए जाएं , तथा नियंत्रक द्वारा विनिविष्ट सीमा तक किया जाएगा ; और
( ष) प्रसंस्करण नियंत्रक द्वारा विनिर्दिष्ट अवधि के भीतर पूरा किया जाएगा । "
3. उक्त आदेश की प्रथम अनुसूची में
(i) पैरा 1 में "जिमने आवेदन की तारीख से ठीक पूर्ववर्ती बारह कलैण्डर मासों की अवधि के पूर्व या उसके दौरान बिलायक मिस्सारित तेल का उत्पादन प्रारम्भ किया था , और" शब्दों के पूर्व निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्
या
जिसकी अपनी ही कोई तेल मील नहीं है , किन्तु जिसे केन्द्रीय सरकार की पूर्व सहमति से नियंत्रक ने लिखित भावेश द्वारा भौर अपना यह समाधान हो जाने पर कि ऐसा करने के लिए पर्याप्त श्राधार हैं, नीचे वर्णित उत्पादक ( उत्पादकों) के, जिनका प्रवर्ग उनके नाम के

मामने विनिविष्ट किया गया है, कारखाने/ कारखानों में अपने द्वारा आप्त तेज वाले पदार्थों का प्रसंस्करण करने की अनुज्ञा वे श्री है:
कारखाने का नाम उत्पादक का नाम अनुज्ञप्ति सं ० प्रवर्ग
(ii) अंत में निम्नलिखित जोड़ा जाएगा , श्रर्थात्:--
केवल प्रवर्ग ' ' के अनुज्ञप्तिधारियों के लिए जिन्हें अनुज्ञप्ति खण्ड
2 (v ) ( ख) के अधीन जारी की गई है
( 1 ) ऐसी तेल वाली सामग्री से, जो उसके द्वारा उपाप्त की गई है, विलायक निस्मारित तेल और विनेलित भोजन का विनिर्माण , पैरा 1 में विनिर्दिष्ट उत्पादकों के कारखाने/कारखानों में ही किया जा सकता है, किसी अन्य कारखाने में नहीं
(2) उपरोक्त ( 1 ) में निर्दिष्ट किसी विनिर्माण स्थल के होते हुए भी, अनुज्ञप्तिधारी की यह जिम्मेवारी होगी कि वह यह सुनिश्चित करले कि,
(क ) यह कि ऐसा प्रसंस्करण नियंत्रक की पूर्व सहमति से किया जाएगा;
(ख ) यह कि नियंत्रक द्वारा विनिर्दिष्ट तेल वाले पदार्थों से भिन्न किसी तेल वाले पदार्थ का इस प्रकार प्रसंस्करण नहीं किया आएगा;
(ग) यह कि खण्ड (क ) के अधीन नियंत्रक द्वारा विनिर्दिष्ट तेल वाले पदार्थ, का प्रसंस्करण , ऐसे कारखाने/कारखानों के परिसरों में, जो नियंत्रक द्वारा विनिविष्ट किए जाएं , तथा नियंत्रक द्वारा विनिविष्ट सीमा तक किया जाएगा; और
(घ) प्रसंस्करण नियंत्रक द्वारा विनिर्दिष्ट अवधि के भीतर पूरा किया जाएगा ।
(3) अनुज्ञप्तिधारी यह भी सुनिश्चित करेगा कि,--
(i ) कोई भी विलायक निस्सारित तेल सीधे मानव उपभोग के प्रयोजमों के लिए उसके द्वारा तब तक प्रस्तुत नहीं किया जाएगा जब तक कि उसे ताप ( जो 180 ° में० ग्रे० से कम नहीं होगा ) और निम्न वाव ( जो निरपेक्ष पारद के 25 मि० मी० से अधिक नहीं होगा) के अधीन क्षार- निष्प्रभावित, विरंजित और वाष्प -निर्गन्धीकृत न कर दिया जाए और वह सूतीय अनुसूची के अनुरूप न हो जाए ।
( ii ) कोई भी विलायक निस्सारित तेल विक्रय के लिए या सीधे मानव उपभोग के लिए परिष्करण के प्रयोजनों के लिए या बनस्पति के विनिर्माण के लिए उसके द्वारा तब तक प्रस्तुत नहीं किया जाएगा जब तक कि वह तृतीय अनुसूची के भाग 2 में विनिविष्ट क्वालिटी-मानकों के अनुरूप नहीं है , और
( iii ) किसी भी विनेलित भौजन को पशुओं के चारे के रूप में प्रयोग के लिए विक्रय के लिए उसके द्वारा तब तक प्रस्तुत नहीं किया जाए जब तक कि वह चतुर्थ अनुसूची में विनिदिष्ट क्वालिटी- मानकों के अनुरूप न हों ।

ORDER
New Delhi , 2nd April , 1979
G.S.R. 327 (E) . In exercise of the powers conferred by section 3 of the Essential Comfodities Act, 1955 10 of 1955) , the Central Government hereby makes the following Order further to amend the Solvent-Extracted Oil , De -oiled Meal and Edible Flour (Control ) Order , 1967 , namely :- 1. ( 1 ) This Order may be called the Solvent-Extracted Oil, De-Oiled Meal and Edible Flour ( Control ) Amendment Order, 1979.
(2) It shall come into force on the date of its publication in the Official Gazette .
(v) Category 'E' in respect of a producer, 2. In the Solvent-Extracted Oil , De -oiled Meal and Edible Flour (Control ) Order , 1967 , in sub - clause (2 ) of clause 3, for paragraph (v ) , the following paragraph shall be substi- tuted, namely :- "
(a) whose factory though not equipped with a solvent- extraction plant , is still engaged in the busi- ness of manufacturing solvent -extracted oil or de- oiled meal in the factory of any other producer from out of the oilcake produced by him in his own oil mil or from oil-seeds imported by hẩm ;
(b) who is not equipped with his own oll mill, but is permitted by the Controller , with the prior concurrence of the Central Government, by order in writing and on being satisfied that there are sufficient grounds for so doing, to process oil- bearing material procured by him in the factory of any other producer :
Provided that the Controller shall not give any such per- mission except on the following conditions , namely : -
(a) that such processing is done with the prior concur-
rence of the Controller ;
(b) that no oil - bearing material other than that speci- fied by the Controller wouldbe so processed ;
(c) that the processing of the oil - bearing material speci- fied by the Contreffer under clause (a) , shall to the extent specified by the Controller , be in the premises of such factory /factories as may be speci- fled by the Controller ; and
(d) that the processing shall be completed within the period specifled by the Controller. "
3. In the First Schedule to, the said Order ,
(i) in paragraph 1, before the sub-paragraph beginning with the words " who commended production of solvent extracted oil" and ending with the words "the date of application , and" , the following shall be inserted, namely :-

who is not equipped with his own oil mill, but is permitted by the Controller , with the prior concur- rence of the Central Government, by order in writ- Ing and on being satisfled that there are sufficient grounds for so doing , to process oll -bearing material procured by him in the factory/factories of under-mentioned producer ( s ) of specified against each :- the the categories

(ii) the following shall be added at the end, namely :- For category 'E' licensees issued under clause 2 (v ) (b ) only.
(1) The manufactured of solvent-extracted oil andde-oiled meal from the oil bearing material procured by him may be 573

carried out only in the factory /factories of the producers specified in para 1, and not in any other factory.
(2) Notwithstanding the place of manufacture referred to (1) bove, it will be the responsibility of the licensee to en- sure that ,
(a) such processing is done with the prior concurrence of the Controller ;
(b) no oil bearing material other than that specifled by the Controller would be so processed:
(c) the processing of the oil - bearing material specified by the Controller shall , to the extent specified by by the Controller , be in the premises of such factory/ factories as may be specifled by the Controller; and
(d) the processing shall be completed within the period specified by the Controller .
(3 ) The licensee would further ensure that : -
(i) no solvent- extracted oil is offered by him for sale for purposes of direct human consumption unless it has been alkali- neutralized , bleached and steam- deodorized under temperature ( not less than 180 ° C) and low pressure (not more than 25 mm of mercury absolute ) and conforms to the standards of quality specified in Part I of the Third Schedule ;
(il) no solvent-extracted oil is offered by him for sale or for purposes of refining for direct human con- sumption or for manufacture of vanaspati unless it conforms to the standards of quality specified in Part II of the Third Schedule ; and
( iii) no deoiled meal is offered by him for sale for use as livestock feed unless it conforms to the standards of quality specified in the Fourth Schedule .
