ORDER

New Delhi, the 4th April, 1979SO. 196(E).—Whereas by its Order No. S.O. 706(E), dated the 8th December, 1978, published at page No. 1511 of the Gazette of India, Extraordinary, dated the 8th Decernber, 1978, issued under clause (b) of sub-section (1) of section 3 of the Sugar Undertakings (Taking Over of Management) Ordinance, 1978 (5 of 1978) (hereinafter referred to as the said Ordinance), the Central Government in the Ministry of Agriculture and Irrigation (Department of Food), vested the management of Shree Satpuda Tapi Parisar Sahakari Sakhar Karkhana Limited Purushottam Nagar, District Dhulia, in (371) 8 GI/79

372 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] management of which is vested in the Government of Maha- rashtra; the State of Maharashtra (hereinafter referred to as the said Sugar undertaking) in the Central Government with efl'ecl from the Uth December, 1978;

And whereas the said Ordinance has now been replaced by the Sugar Undertakings (Taking Over of Management) Aci, 1978 (49 of 1978) (hereinaf.cr referred to as the said Act);

Now, therefore, in exercise of the powers conferred by c'ausc (b) of sub-section (1) of section 3 of the Sugar Under- takings (Taking Over of Management) Act, 1978 (49 of 1978), the Central Government hereby rescinds the said Order No. S.O. 706(E), dated the 8lh December, 1978 retrospectively with effect from Ihe 13th December, 1978.

And whereas the Central Government, after considering Ihe report of the State Government of Maharashtra, is of Ihe opinion that the said Sugar Undertaking Is under the manage- ment of he Government of Maharashtra ;

And whereas by virtue of section 18 of the said Act, the SLiid Act is not applicable to the said Sugar Undertaking the
